I represent the Edgar County Watchdogs, Leaks, and also report for Disclosure News Magazlne. In a letter dated October so, 2015, written by John l. Marrella, Bureau Chief, Bureau of Transit was discussion on the former East Central Mass Transit District and Rldes Mass Transit District. The letter waswritten to Mr. King Sutton, Chairman, ECIMTD. My main question is this: Does Mr. Marrella have any documentation that allows "grant activities" or "grant assurances" to violate state law? In the letter he states that "Any remainlng funds that were derived during grant activities in the projects must remain in the public transportation system. Therefore these remaining funds should be conveyed to the current grantee Rides Mass Transit District". How did he come up that concluslcn? he conslder the requirements or state law when dealing mass transit Please deflne "should" when he referenced "shDuId be conveyed to the current grantee". think we all know the difference between "should" and "shall". State law mandates all remaining funds, upon dissolution of a Mass Transit District, be refunded to the County or Counties, on a proportionate basis, that formed the District, There is no provision in state law that allows "merging" or "annexing" one mass transit district with another. The only option is to dissolve a district, settle its accounts, sell remaining inventory, and prorate the remaining funds to the county or counties. Those counties can then place those funds into their general fund and use at their leisure.
