Dear Chief Perry: The State of Hawaii Organization of Police Of?cers (SHOPO) is in receipt of the PDF copy of the letter that you sent to SHOPO Business Agent Mr. Stanton Koizumi, dated December 10, 2015, RE: Body Worn Camera Policy/Implementation. In said letter, you stated, in pertinent part, that ?the Kauai Police Department shall be rolling out the implementation of the Body?Worn Camera Program on Monday, December 14, 2015.? (Emphasis in original.) SHOPO understands that the Kauai Police Department (KPD) intends to begin issuing Body- Worn Cameras (BWCs) and re?train officers on or about December 21St through and including December 24th 2015, and will unilaterally implement BWC Policy 14-04. As you know, after our meeting with you on November 25, 2015, SHOPO and KPD worked out an agreement on Version 13 of the proposed BWC Policy 14?04. Also, during said meeting with you on November 25, 2015, both parties agreed that future amendments to the BWC policy will be necessary as issues arise. Since SHOPO steadfastly asserts that this matter is a subject of mandatory bargaining, it is manifest that, among other things, any future amendments would necessarily require the mutual consent of the parties. Therefore, please be advised that if KPD insists on unilaterally implementing BWC Policy 14-04, SHOPO will be seeking recourse from the Hawaii Labor Relations Board. Should you wish to reconsider your current course of action, and would like to work with us towards amicably resolving this matter instead, please do not hesitate to contact me.
