Dear Deputy Commissioner Ballard and'Director Burton: .

I am writing in follow up tomy previous open records request regarding Kenneth Marconi. I
have now obtained information that is not in your ?le but which you have relied on. I believe 
that an investigation should be conducted of Mr. Marcum?s death. I believe that Southern Health
Partners "violated many standards in the. care-and treatment of Kenneth Marcum. I also believe
that Campbell County has improperly delegated duties required of them by the Kentucky
Administrative Regulations, Department of Corrections as well as the Kentucky Statutes.

In that regard, I enclose Mr. Marcum? 5 death certi?cate and autopsy report.

No one should go to jail to die. No one should die from a perforated gastric ulcer. Mr. Marcum
should have been evaluated by a physician and sent to the hospital. He should have had blood
test and urine test run to see exactly what was going on. None of this occurred. .

I can also advise you, based on review of the video,'that no one looked in on Mr. Marcum,
according to the medical. chart, from 5:30 pan. until he was found dead in his cell at
approximately 8:00 am. the next day. 

Though, the Corner records contains a statement from license practical Nurse Mullin that he last
checked on Marcum around 9:00 pm.

He was not making any trips to and from his bed as alleged in the unrecorded phone
conversation. The video tapes Show this and Mr. Daley knew this was not true.

Prior to the statutes amendment a grand jury would investigate this case. Now the statutes
delegate this duty to the Department of Corrections. 

Let me know your plans. There have been ?ve deaths in the jail since Southern Health Partners
to 0k over.
