For first time, congressional limit reached on some skilled­worker visas

For the first time ever, the congressional cap on visas for some foreign­skilled workers has been reached.
The H­2B visa, used for seasonal skilled workers in the areas of tourism, landscaping, food processing, ski resorts
and other such venues, has a cap of 66,000 visas a year.  
As of Tuesday, the cap was reached, federal officials said on Thursday. No new H­2B visa applications will be
processed until after the new federal fiscal year starts Oct. 1.
``We don't know what's driving the increased demand,'' said Chris Bentley, spokesman for the Bureau of
Citizenship and Immigration Services.
This program is much less popular among employers than the H­1B visa, which is used to bring highly skilled
foreign technical workers. The cap of 65,000 H­1B visas has also been reached for this fiscal year despite
increasing unemployment figures.
The H­2B category, says Angelo Paparelli, an Irvine immigration lawyer, is difficult to qualify for because an
employer has to prove no American worker could be found for the job and both the worker and employer must
attest that the job will last no longer than 10 months.
Given the difficulty of complying with these requirements, Paparelli said, having a cap ``is one of the most illogical
examples of congressional action.''
Business leaders have been lobbying on Capitol Hill for increased caps, particularly on the H­1B visas, but so far
no action has been taken either in the House or Senate.
