The agent is debarred under 20 CFR 655, Subparts A and from participating in any action related to the H-2A and H-2B temporary labor certi?cation programs. On July 22, 2014, the agent, under indictment before the United State District Court for the Middle District of North Carolina (case number for obtaining visas by fraud, entered into a plea agreement submitting to permanent debarment by the United States Department of Labor and the United States Citizenship and Immigration Service from the H-2A and H-2B visa programs. The plea agreement reached by the United States District Court and the agent supersedes the Department?s regulatory requirements under 20 CFR 655.182 and 655.31 with respect to administrative appeal procedures, statute of limitations and period of debarment. Therefore, the Office of Foreign Labor Certification (OF LC) will not issue future labor certi?cations, permanently, to an employer represented by the agent under 20 CFR 655, Subparts A and B. This Notice represents a ?nal agency action and the permanent debarment for the agent takes effect immediately. Sincerely, William L.
