Can't disclose until it's, you 20 know, ripe to disclose. 21 I'm going to do -- do I have anything pending on -- 22 I mean, I've ruled on this case before, I know 23 that. 24 25 MR. SUSSER: So... HAZELTINE: Well, he has two motions, though, that he filed. 3 MR. SUSSER: 4 MS. HAZELTINE: Correct. And he set this hearing today 5 on his motion to set an evidentiary hearing on his 6 two motions. 7 8 So that's all that's been -- THE COURT: Okay. So that I have two mandates that I received? 9 MR. SUSSER: Yes, sir. 10 THE COURT: Recently? 11 MR. SUSSER: January. 12 THE COURT: 13 Okay. Oh, but people just didn't set things -- 14 MR. SUSSER: Correct. 15 THE COURT: Oh, okay. 16 MR. SUSSER: 17 Nothing's been done. So that's why I moved to intervene to try to set hearings because -- 18 MS HAZELTINE: 19 MR. SUSSER: It's on his fees. It's on the issue from the Court 20 of Appeals on the award of appellate fees, 21 Mr. Goldsmith's fees, as well as my fees and my 22 lien. 23 THE COURT: What I'm going to do, though, is, 24 based upon Ms. Hazeltine's involvement in the case 25 and disclosure and your request, you don't have to Florida Court Reporting (561) 689-0999 Page: 7 1 file a motion, I'm just going to enter an order 2 that reassigns the case to, at random, and it will 3 either go to Judge French or Judge Gillen. 4 MR. SUSSER: 5 THE COURT: Thank you, sir. And then those matters that need 6 to get set you'll reset before them, et cetera, et 7 cetera. 8 MR. SUSSER: 9 MR. BISSONNETTE: Very good, sir. May I ask a question? 10 Because on the fee issue, you know, obviously you 11 were the presiding judge at trial, and you're going 12 to have more familiarity with the -- are you 13 assigning just Mr. Susser's motions out? 14 if they're denied, I would prefer that the post 15 appeal issues be decided by Your Honor. 16 THE COURT: Because You know, your -- here's the 17 thing. 18 simple way, and it has, it's worked up 'til now. That makes it 5 more messy than not. 6 Mr. Susser definitely has the right to have it 7 reassigned. 8 9 So, okay. It doesn't happen often, but I'll get an order out.
