Pursuant to the Freedom of Information Law, please provide me a copy of any
list(s) of 421-a buildings in New York City covered under the state's prevailing
wage law for service workers who work in such buildings.
The information you have requested is exempt, under NYS Public Officers Law §
87(2)(g)(iii), which states that an “agency may deny access to records or portions
thereof that . . . (g) are inter-agency or intra-agency materials which are not . . .
final agency policy or determinations.”
Accordingly, your FOIL request is denied.
Pursuant to NYS Public Officers Law § 89(4), you have the right to appeal this
determination. Appeals must be submitted in writing within 30 days of receipt of
