Incident #2015199? lNarrative: On Friday. January 08, 2016 around 0643 hours I, Lt. JeffArrington (UNT HSC PD Badge #037), was noti?ed by UNT HSC Communications of a shattered glass exterior door at 1412 May Street, Fort Worth. TX 76104, which is a property owned and/or controlled by the University of North Texas Health Science Center. I know UNT HSC Communications to monitor exterior and interior video cameras of the mentioned property. At the time of the call I was at the UNT HSC Police Department, which is located at 3600 Mattison Street, Fort Worth, TX 76107. UNT HSC Communications gave me a physical description over the radio of a white male wearing a black shirt and black colored pants (later identi?ed by a Texas Driver License as STALEY, Daniel Wayne w/m DOB 10/01/1991 TX DL . . Prior to leaving the police department for the call, I was able to evaluate video footage of ST ALEY exiting 1412 May Street through a shattered exterior glass door; therefore, I was able to get a good visual of STALEY. Also, I noticed that STALEY was carrying a brown bag in his hand when he was exiting the building. Shortly after receiving the call from HSC Communications I departed for 1412 May Street in UNT I-ISC PD marked patrol unit #132. Upon arrival, I was advised by a UNT HSC staff member,- - that her husband,?had followed STALEY to the Quick Trip convenience store located on Rosedale Street (physical address - 1101 Hemphill Street, Fort Worth. TX 76104) in his vehicle while STALEY traveled on foot. - also advised me that her husband had a visual of STALEY. -and? were communicating with each other using their respective cell phones. I briefly Spoke to- using _cell phone to con?rm that he had a visual of the same individual who broke into the building - which he replied in the af?rmative. Not being familiar with the geography of that area, I asked?if she knew her husband?s exact location - which she stated in the af?rmative. I asked ?if she would ride in the front passenger seat of UNT HSC PD marked patrol unit #132 to assist me with locating her husband, and STALEY - which she agreed in the af?rmative. NOTE: While en?route to Quick Trip,? mentioned to me she saw what she believed were bullet holes in one of the glass doors located inside the building. This led me to believe STALEY may be armed and to proceed with caution if/when I made contact with him. and I arrived at location, who was sitting in his parked vehicle on Grainger Street across from Quick Trip facing north (intersection of Grainger Street and W. Rosedalc were able to identify a white male wearing a black shirt and black pants standing at the north side of the Quick Trip store as the same individual who broke into 1412 May Street. I recognized STALEY to be the same individual from the video footage who exited 1412 May Street from the shattered glass door located on the east side of the building. I instructed to stay in the vehicle while I got out. As I approached STALEY, I noticed the same brown bag previously mentioned lying down by his right hand side. I also noticed two Fort Worth PD of?cers (later identified as Kelm #2847 and Stephens #2882) in the same vicinity of the area. I drew my department issued duty weapon from the holster and instructed STALEY to keep his hands within my view while he turned around slowly. After giving instructions to STALEY and having him face the brick wall of the Quick Trip store, I safely holstered my duty weapon and proceeded to place him under arrest (double-locked handcuffs). While I was placing the handcuffs on STALEY he advised me that he had just broken into a building and that he was "messed up." I performed a Terry frisk on STALEY to check for any weapons on his person, which I did not ?nd. Of?cers Kelm and Stephens asked if they could assist. I asked them if they would respond to 1412 May Street to clear the building and check on the employees - which they agreed in the af?rmative. I searched the rear seating area of unit #132 before placing STALEY in the back seat of the vehicle, and it was clear of any contraband. While placing STALEY in the back seat of unit #132 he voluntarily stated to me that he tore a piece of property "sensor" off the wall located inside the building. I later identi?ed the property as a grey HID card reader (used for the access control of room #102), which was located inside the brown bag that STALEY had in his pessession at the time of his arrest. I drove marked unit #132 to 1412 May Street to drop off_ retrieve evidence, take digital photographs, and perform a detailed search of STALEY's person. -Was dropped off at 1412 May Street without incident. EVIDENCE COLLECTED: I retrieved a light colored rock from inside the foyer of the building, which is the same rock STALEY used to damage three glass doors. I also retrieved the brown bag used by STALEY, and the grey HID card reader that was taken from the building. (See Evidence and Property Sheet) INVENTORY OF THE BROWN BAG: The items I found in the brown bag that was in STALEY's possession are as follow: 1) I retrieved the brown bag for identi?cation purposes (See Evidence and Property Control Sheet) 2) I retrieved one grey HID card reader that STALEY stated he stole from the building of 1412 May Street and placed it in to evidence (See Evidence and Property Control Sheet) 3) Four prescription pill bottles - placed with STALEY's property 4) Medical papers - placed with STALEY's property 5) Restaurant receipt - placed with STALEY's property 6) Twix candy bar wrapper - placed with STALEY's property 7) One pair of light grey Cabela's sock - placed with STALEY's property I performed a search of STALEY's person, incident to arrest, and placed all of his personal items in a plastic trash bag. NOTE: During a search of STALEY's person, I noticed he had a Smith and Wesson hand-cuff key attached to his key chain. DIGITAL PHOTOGRAPHS: I performed a walk-through of the building's foyer to assess property damage. I took digital photographs of the three damaged doors, the contents of the brown bag, and the damaged HID card reader outlet. While assessing property damage, I noticed that once STALEY was inside the building, he made an attempt to gain access into other areas of the building by throwing the mentioned rock at two other glass doors. One interior glass door was destroyed, but did not allow STALEY access due to its tempered glass safety feature. This is the same door that-thought she saw bullet holes. STALEY's access into the building was limited to the foyer and a restroom. One interior glass door (room #102) sustained only minor damage from the thrown rock. I returned to the UNT HSC police department with STALEY in marked unit #132 to pick up paperwork. complete a UNT HSC Criminal Trespass Warning on STALEY, and to take digital photographs of STALEY. CRIMINAL TRESPASS WARNING: I advised STALEY he was criminally trespassed from all property owned and/or controlled by UNT HSC and that he would be arrested if he was found to be in violation. STALEY signed the UNT HSC Criminal Trespass Warning. A copy of the original Criminal Trespass Warning was placed with the report and the pink copy was placed with STALEY's property. I transported STALEY to the Tarrant County Jail in marked unit #132 and released him to Tarrant County personnel without incident. I searched the back seat area of marked unit #132 after the transport and no contraband was found. WITNESS STATEMENTS Around 1430 hours on the same day I collected a total of ?ve witness statements from at 1412 May Street. Included in the report are witness statements from and REFUND ATTEMPT: Around 1430 hours on the same day I met with UNT HSC staff members ?and at 1412 May Street. ?and-advised me that STALEY tried to refund a total of $2,000.00 back to his credit card using a credit card machine that was located in the front lobby of 1412 May Street. Documentation (copy of two credit card refund receipts. transaction details, and batch close fail) provided thows STALEY made one $1,000.00 refund transaction at 0224 hours and another $1,000.00 refund transaction at 0225 hours on this same day. An e-mail I received from? at 1446 hours on this same day explains that STALEY made an attempt to balance the credit card machine, and did so unsuccessfully. advised me that the two $1,000.00 refund transactions were voided by the UNT HSC Business Of?ce staff. The documentation provided by. and an e-mail explaining the transactions are included with the report. VIDEO: Video of the offense was recorded using a camera monitoring system. A copy of the video will be created and added to the report. USE OF FORCE REPORT: I completed a Use of Force form as required by the UNT HSC Police Department for displaying my ?rearm when I made contact with STALEY. ARREST: As a commissioned peace of?cer of the State of Texas, I have reason to believe that STALEY entered the premise of 1412 May Street, Fort Worth, TX 76104 using a rock to shatter the front glass door to gain access. STALEY did not have the effective consent to enter the locked and secured property. which at the time was not open to the public. STALEY entered the building without effective consent and committed the offense of theft; therefore. I have reason to believe that STALEY committed the offense of Burglary ofa Building (Texas Penal Code Offense 30.02).
