The properties are known as Parcel 1 and Parcel 2 (Properties) of the Compass Subdivision Exemption and are located near Woody Creek, Colorado as shown on Figure 1. 2.0 PROJECT DESCRIPTION The Applicants propose to construct a residential structure and ponds on Parcel 1 and Parcel 2. The Applicants own shares in the Salvation Ditch that were historically used to irrigate approximately 14.6 acres of land on Parcel 1 and 5.5 acres on Parcel 2 for a total of 20.1 acres. The ponds will be filled with Salvation Ditch water via a ditch lateral and the Properties will continue to be irrigated with diversions from the Salvation Ditch. Irrigation pump stations will be constructed near the ponds for continued irrigation of the Properties with Salvation Ditch water delivered into the ponds. A Water Court application to change a portion of the Applicant?s Salvation Ditch water rights from irrigation to irrigation, augmentation, and storage is proposed for the water resources plan for the Properties. Storage rights for the ponds will also be included in the Water Court application. The consumptive use credits derived from the change of use of the Applicant?s Salvation Ditch water rights associated with dry up on the Properties, delayed return flows from infiltration through a recharge pond, and contract water from the Basalt Water Conservancy District (BWCD) will be used to offset the evaporation from Leland Upper Pond, Leland Middle Pond, Leland Wetland Pond, Leland Parcel 2 Irrigation Pond, associated ditch laterals, and a swimming pool. The Applicant?s Salvation Ditch water rights that are not changed will continue to be used for irrigation of the Properties. A further description of the change of use, the new storage water rights, and a plan for augmentation are presented below. 3.0 EXISITING WATER RIGHT The Applicant?s Properties consists of 20.1 acres of historically irrigated hay and pasture grass. The Applicants own 298 shares of the Salvation Ditch which are used to flood irrigate the Properties. It is proposed to change a portion of the Applicant?s Salvation Ditch water rights associated with dry up of historically irrigated land from construction of the house, driveways, parking areas, ponds, and associated ditch laterals. The Salvation Ditch water rights would be changed to fill ponds on the Properties and the dry up credits used to replace out-of-priority evaporative depletions. Resource Engineering, Inc. (RESOURCE) analyzed the historical use of the Salvation Ditch water rights on the Applicant?s Properties based on a 38-year study period from 1975 through 2013 as presented in the following sections. Historically, the Cameo call has been placed for one week in April, one week in May, two weeks in June, all of July through October, and one week in November. The Colorado Water Conservation Board (CWCB) holds instream flow rights for 30 from October 1st through March 31St and 55 from April 1st through September 30th on the Roaring Fork River from the confluence with Maroon Creek to the confluence with the Fryingpan River. There has never been a CWCB call in this reach of the Roaring Fork River. For purposes of this report, RESOURCE assumes there is a potential for a future call during August and September of an extreme dry year for these instream flow water rights. Replacement of pond evaporation and return flow obligations from the change of use of the Applicant?s Salvation Ditch water right will be required during times of call. The Applicants do not need to augment Woody Creek because the Salvation Ditch water is imported and the Applicants do not propose to divert and store any water tributary to Woody Creek. Applicants will install appropriate measuring devices to allow measurement and release of any native precipitation during a Woody Creek call. 6.2 River Depletions Out-of-priority river depletions come from two sources: The depletions due to evaporation from 1.41 acres of ponds and ditch water features when the Salvation Ditch is diverting, and the loss of delayed groundwater return flow from the dry up of 1.81 acres under the Salvation Ditch. Evaporation depletions are shown on Table 4 and return flow obligations are shown on Table 5. Evaporation depletions when the Salvation Ditch is diverting total 4.17 AF and return flow replacement obligations total 0.66 AF for a total river depletion of 4.83 AF. However, based on the anticipated call period, the full 4.83 AF will require only partial replacement as described later in this report. Water diverted into the Leland Wetland Pond will infiltrate to the groundwater and return to Little Woody Creek at rates equal or greater than historic rates to replace stream depletions from loss of historic delayed return flows and the balance of evaporative depletions not offset by dry up consumptive use credits. Annual diversions into the Leland Wetland Pond will be required to fully replace evaporation from the proposed ponds and ditch laterals and replace return flow obligations from the 1.81 acres of dry up during a local call. The required Leland Wetland Pond inflow totals approximately 10.0 AF as shown on Table 7. 6.6 Future Administration Appropriate accounting sheets will be prepared as may be requested by the Division Engineer to administer this plan for augmentation. The actual evaporation depletions and return flow obligations and their sources of replacement will be reported at a minimum. Appropriate measuring devices will be installed as requested by the Division Engineer. If the junior water right and plan for augmentation are approved and implemented as described above, it is our opinion that there will be no injury to other vested water rights. 7.0 CERTIFICATION This report was prepared by and under the direction of Michael J.
