JESSE HELMS :jks ?= To Whom It May Concern; In February of 1975,1 joined the U.S. Marine Corp. After 2 ye^nvdf active duty, I achieved the rank of sergeant E5 with all promotions meritorious. On November 23,1977,1 re-enlisted to serve with the inspector/instructor staff reserve unit in Columbia,. S.C. While there, a position became available with the AFEE- testing division in Columbia S.C. (this is where one is given highly classified testing material for testing each of the four branches of military service). I was stationed at Fort Jackson Army Base in Columbia, S.C. during this time in which I was approached by an army truck driver. This driver told me he had access to some Ml 6 rifles to sale at a very cheap price. Being a hunter and firearm enthusiast that I have always been, the offer was more than tempting. I purchased the weapons and was enroute of transporting them back, to my home in North Carolina when I was apprehended by the C.I.O. (Criminal Investigation Department) and the A.T.F. (Alcohol, Tobacco & Firearms). Upon arrest I was questioned by the ATF officer in which I co-operated and answered truthfully to the charges. I also agreed to take a polygraph test in order to prove my innocent in regards to my intentions in buying the guns. My intentions were for my personal use only in hunting and shooting them not for the intention of resale. (Enclosure 1-Polygraph report). On October 16,1978,1 plead guilty to Count 1 of violation of Thle 26, U.S. Code, Sections 5861 (d) and 5871 (Possession of a fully automatic weapon without class II firearms license. Failure to register) The other 2 Counts for the same offense were dismissed. On December 12, 1978,1 was sentenced to 2 years suspended and placed on probation for a period of 5 years. Said probation was to be unsupervised while on active duty in the Marine Corp. and in the event I was discharged prior to these 5 years, I would be placed on active o supervision for the remainder of the probationary terms (Enclosure 2-sentencing) I was released from active duty from the Marine Corp on November 20,1981 with an honorable discharge. During my years of service as a Marine, I was awarded the Meritorious Mast Award; L4flBjf of Appreciation-1976 & 1981; Good Conduct Metal; Rifle Expert Badge; Pistol Expert Badge; and the Good Conduct Metal with Star. I also attended and completed a number of courses and workshops while in the Marine's as well These being MCI General Administrative Procedures; MCI Correspondence Procedures; Manpower Management System; MCI Reserve Personnel Administration; NCO School; Service Records; MSI The Marine NCO; Files, Directives and Publications; MCI Punctuation; MCI Spelling; MCI 105MM Gun Tank; Basic Tank Crewman (Enclosure 3 -DD Form214). Upon my releasefromactive duty, I reported to Mr. Tony Brown, federal probation officer in Statesville, N.C. for active duty probation. Mr. Brown allowed me to accept a job dbriving a truck long-distance based on my excellent record in the military. On August 2,1982, it was the order of the court for my probation to be terminated, due to the recommendation of my probation officer. Therefore, I was on inactive probation for nearly 3 years and only 8 months of active probation. (Enclosure 4- Probation Release). Within the next 6 months after my releasefromprobation, I applied to the Department of ATF for restoration offirearmprivileges in which i was granted immediately. (Enclosure 5- Re-instatement of rights) In 1999, my wife and I completed the Firearms Safety Training course for concealed handguns. This was due to my wife's occupation that we decided to do so. We completed the course and applied for our permits. My wife's was granted but I was denied due to the Brady Bitt. (Enclosure 6-certificate of training) Only until this time did I realize that my fireanns rights were not entirely restored I have not had any criminal charges against me nor even as much as a traffic violation since that time. (Enclosure 7-Copy of Criminal Record Check) At the time in which I purchased these rines, I was only thinking of "what a good deal I have stumbled upon", only recklessly unaware of what this foolish act could have and has caused. It has denied me of the enjoyment and sporting entertainment that I have so loved. My love for hunting and gun collecting began with rabbit hunting with my father at the age of 6. In August of 1978,1 made a foolish mistake and still nearly 25 years later, I am still being penalized. The U.S. Marine Corp. honorably discharged me (without any exemption due to my record). The Federal probation officer highly recommended early dismissal (due to my exemplary record). The ATF forgave me and awarded my rights back (due to my exceptional record). But now due to the passing of this bill, even after myrightshad been re-instated, I am once again being pushed back nearly 25 years ago when I was on probationary status and myrightswere denied I have tried to live and do all things legally. Last year in November 2001, after aO the problems and devastation of 9-11,1 had reservations for a hunting trip in Canada. I was denied entrance into this country because ofthe felony charge against me. After a number of calls and conversations with the border patrol regarding my situation and faxing them documentation as enclosed, they rehabilitated myrightsto enter Canada with a firearm Here we have Canada, another country who has the reputation for having some of the strictist of gun laws-allowing me my rights to enter. (Enclosure 9> permission from Canada). I am self-employed with my own business and have worked & sacrificed many long hours to accomplish and maintain a secure and comfortable lifestyle for myself along with living as a law abiding citizen. This beingforthe primary reason to expect in return some of the simple pleasures and enjoyments in life which happens to be the sport of hunting. Needless to say, I never know from year to year when this pleasure will beforfeitedfromme as weft. I apologize for the delay in replying but, due to security measures undertaken in response to the reports of anthrax, we have experienced lengthy delays in receiving mail, and your letter arrived last week. Mr. Ikerd's pardon petition remains under consideration, and, notwithstanding that it has been pending for some time, we can give no assurances that afinaldecision will be reached at any specific juncture. Although you noted in your letter that Presidential pardons have been granted around Christmas or New Years, President Bush did not grant any pardons at those times.
