(3769) Suspect Hate Bias Motivated: None Page 3 NARRATIVE REPORTING OFFICER NARRATIVE OCA Port St. Lucie Police Department 2015-13432 Victim Offense Date Time Reported KI REALTY GROUP ILLEGAL Thu 06/25/2015 15:32 On June 25, 2015 I was advised to go to the Publix in Tradition, located at 10400 SW Village Center Drive, in reference to illegal dumping. Upon my arrival I made contact with James Key, Publix Manager, who stated that while he was out to lunch, he observed a white male and a white female, dressed in business attire, dumping unknown materials in the rear Publix dumpster. Key stated that both individuals were in possession of several Publix shopping carts which were ?lled with what looked to be papers. After emptying all the contents of the cart into the dumpster, both individuals left. When Key went to the dumpster to see exactly what was thrown out, he stated that he observed a number of documents in the dumpster with name on them. Key went on to say that he observed bank documents along with blue prints and other papers that belonged to VGTI. Key added that since he knew that VGTI was having some legal trouble with the City of Port St Lucie, he called for assistance after he went into the dumpster himself and pulled out as much as he could. Shortly after I arrived, Wood, L271 and UCI Ofc Squitieri, L558 arrived on scene to assist. Iwas advised by Wood to take everything into evidence. Before leaving, I observed more paperwork in the dumpster. After Ofc Squtieri took pictures of the items, I went inside the dumpster to retrieve them. Key was able to provide black milk crates to place all the items retrieved from the scene. Once in the crates, 2 crime scene vans arrived to take the crates to the evidence building. Key was able to provide a sworn written statement with what he observed which will be turned in with this report. When I asked Key if he could possibly identify both individuals he said that he could possibly point out the female. He added that he never made contact with them but could possibly point her out. Wood provided Key with a business card and case number for future reference. Note: Prior to Wood?s arrival, there was a representative from Torrey Pines who also arrived on scene asking whether his company?s items were in the dumpster. He showed concern and questioned Key once again about whether he observed any Torrey Pines paperwork in there. Once Key said no again, the representative immediately left. Also, Key provided a name and phone number for the property manager. Kite Realty and the contact person is Amy Ferguson. A message was left with Ms. Ferguson by Lt. Scott via cellphone to contact either him or Sgt. Wood. At the time of this report, Ms. Ferguson had not returned the phone call. I took forty four photos total of the dumpster area in the rear of Publix along with miscellaneous paper work that was retrieved from the dumpster located in shopping carts. All paper work was packaged by us and crime scene and transported back to the evidence building in the crime scene vans. He said he was called by a former co-worker about something she saw on the "news" that had to do with VGTI and "dumping of documents" in a dumpster behind Publix in Port St Lucie. Favata also explained he was told the police were "investigating" the incident which was his reason for the Visit. I explained that I was not well versed on the current investigation but I would be happy to speak with him until Detective Willnow could conduct a follow-up interview if needed. Favata explained that he used to work for Mann Research Center but is currently a consultant for the Center and that his job was of a real estate advisor and consulting for construction of the VGTI building. He said his company had a contract to plan the building in 2009-2010 but has not had anything to do with that project since. Favata explained he (and his co-worker Mary Cassone) were the employees who threw away the documents in the dumpsters behind their of?ce (Publix shopping plaza). Favata said the company was doing "spring cleaning" as they often do and the documents thrown away were not sensitive and were mostly old proposals, blue prints, and miscellaneous documents produced during normal work. Additionally, his company had an of?ce in the building and as part of the lease had full use of the dumpsters as any business in the building had. Favata said he wanted to speak with someone either at the police department or city hall to explain his actions just in case someone was going to try to "spin something" and bring he or his company into something that it was not part of. Favata welcomed any follow?up questions that law enforcement might have for him and provided his cell phone contact information.
