CITY OFPORTST. LUCIE CITY A TTORNE City for All Ages? November 13, 2015 VIA ELECTRONIC MAIL TO: ONLY Nicole Rodriguez Treasure Coast Newspapers RE: Public Records/Access Request re: Outgoing Email Account of Jeff Bremer, City Manager, and Incoming and Outgoing Email Accounts of City Council Members Dear Ms. Rodriguez: This office is in receipt of your public records/access request for the above referenced file. Please be advised, after careful consideration, your request for access to Mr. Bremer?s outgoing email account, as well as the incoming and outgoing email accounts of the City Council members, has been denied. As I am sure you are aware, there are privileged documents and confidential and exempt information that is exchanged via email and, unfortunately, there is no way to filter such information to prevent its disclosure. As such, your request cannot be accommodated as the City?s burden to redact any confidential and/or exempt information remains in?tact and such access inhibits the City?s ability to perform such ministerial functions. While your request for unfettered access to the listed email accounts has been denied, you retain the ability to submit public records requests for documentation identified with sufficient specificity to permit the records custodian to identify the records and forward the requisite statutory fees, if any. Please note, however, the mandate requiring compliance by producing all non-exempt documentation in the custody of the agency which are responsive to the submitted request, upon payment of any charges authorized by Chapter 119, PS, applies only to those documents in the custody of the agency at the time of the request; nothing in the Public Records Act requires that an agency respond to a ?standing' request for production. Should you wish the City to reconsider its position on this issue, I ask that you please provide case law in support of your argument for further consideration. 121 SW Port St. Lucie Boulevard - Port St. Lucie, Florida 34984-5099 - 772/871-5294 - Fax2772/344-4298 TDD: 772/873-6339 Should you have any questions or should you require any additional information, please do not hesitate to contact me at (772) 873-6513 or pbooker@citvofpsl.com.
