The above offense is a serious felony within the meaning of Penal Code Section 1192.7(c) and a violent felony within the meaning of Penal Code Section COUNT 3 FIRST DEGREE RESIDENTIAL BURGLARY, in violation of Section 459 of the Penal Code, a Felony. Defendant ANTHONY HARRISON BAXTER, On or about the 12th day of January, 2016, willfully and unlawfully entered an inhabited dwelling house and trailer coach and inhabited portion of a building occupied by MICHAEL HELSBY, with the intent to commit larceny and any felony. It is further alleged that the above offense is a serious felony within the meaning of Penal Code section It is further alleged that the above offense is a violent felony within the meaning of Penal Code section in that another person, other than an accomplice, was present in the dwelling house and trailer coach and inhabited portion of a building during the commission of a burglary. It is further alleged that the above offense is a violation of Penal Code Section 462(a). COUNT 4 UNLAWFUL DRIVING 0R TAKING OF A VEHICLE, in violation of Section of the Vehicle Code, a Felony. Defendant ANTHONY HARRISON BAXTER, On or about the 12th day of January, 2016, did willfully and unlawfully drive and take a certain vehicle, to wit: FORD FOCUS LICENSE then and there the personal property of MICHAEL ENGELHAUPT, without the consent of and with intent, either permanently or temporarily, to deprive the said owner of title to and possession of said vehicle. COUNT 5 DISSUADE WITNESS BY FORCE OR THREAT FROM ATTENDING, in violation of Section of the Penal Code, a Felony. Defendant ANTHONY HARRISON BAXTER, On or about the 13th day of January, 2016, did willfully, knowingly, maliciously, and unlawfully prevent and dissuade ENELLE MONTANO, and attempt to prevent and dissuade JENELLE MONTANO, a victim of and Witness to a crime, from attending and giving testimony at a trial, proceeding, and inquiry authorized by law said offense having been accompanied by force and an express and implied threat of force and violence upon a victim, witness and another person, and the property of a victim, witness and another person. COUNT 6 CRIMINAL THREATS, in violation of Section 422 of the Penal Code, a Felony. Defendant ANTHONY HARRISON BAXTER, On or about the 13th day of January, 2016, did willfully and unlawfully threaten to commit a crime which would result in death and great bodily injury to ENELLE MONTANO, with the specific intent that the statement be taken as a threat. It is further alleged that the threatened crime, on its face and under the circumstances in which it was made, was so unequivocal, unconditional, immediate and speci?c as to convey to JENELLE MONTANO, a gravity of purpose and an immediate prospect of execution. It is further alleged that the said JENELLE MONTANO was reasonably in sustained fear of his/her safety and the safety of his/her immediate family. DURING THE COURSE OF THE INVESTIGATION, I LEARNED THAT ANTHONY BAXTER CHOKED, BEAT, AND STABBED BOTH VICTIMS WITH A BUTTER KNIFE 2 TIMES EACH IN THE CHEST WHICH RESULTED IN THE DEATH OF BOTH VICTIMS. BAXTER THEN STOLE BOTH CELL PHONES AND ONE OF THE VEHICLES AND FLED THE SCENE. BAXTER LATER ABANDONDED THE STOLEN VEHICLE ON MILLVILLE PLAINS ROAD WHERE ANDERSON POLICE RECOVERED IT. ON 01-15~2016, DURING THE MORNING HOURS AND PURSUANT TO AN ARRESTIRAMEY WARRANT, BAXTER WAS TAKEN INTO APD CUSTODY WITHOUT INCIDENT. DURING A POST MIRANDA INTERVIEW, BAXTER ADMITTED TO BOTH IN GREAT DETAIL AND TO STEALING THE VEHICLE. A415 ANDERSON POLICE DEPARTMENT 1505 HRSI CASE--16-687 VICTIM I: VICTIM 2: MICHEAL ANDRE VZ- GEORGIA ANN DEFENDANT: D- BAXTER, ANTHONY HARRISON IN IAL CALL FOR SERVICE: On 01-14-2016, at approximately 1505 bolus, I was on duty in full law enforcement uniform working in my official capacity as a Police officer for the Anderson Police Department (AFB). 1 received a call for service from Shascom dispatch in which the reporting party, - reported she came home to find her 2 roommates were dead inside the rcsidenoe. was working with APD Officer M. Catanio. Officer Catanio and I both responded to 1693 Manter Drive apt Anderson, CA (County of Shasta) code-3 from APD at 1508 hours and arrived at 1513 hours Upon arrival, I contacted who was standing on the exterior of the building approximately 20 feet north of the building in the parking lot area. Montano was hysterical, crying, and advised me "They are both dead Eric". INVESTIGATIVE NARRATIVE: It should be noted, I have had numerous prior contacts with -and have specific knowledge of her long term dating relationship with D- Anthony Baxter. Additionally, I responded to it prior call for service at 1693 Manter Drive #1 (APD 15-18067)on12-16-2015 and was familiar with the interior layout of the residence. The weather conditions at the time of my arrival on scene were cloudy and raining, The apartment is described as a 4 apartment, 2 story complex. The building is gray in color with blue trim and a gey composition/shingle roof. The front door of #1 faces east and opens inwardt The bottom portion of apartment #1 consists ofan open floor plan living room on the east side, a kitchen on the north west side, and a bathroom on the south side. A stair case is approximately 5-7 feet west of the front door and lead up to short hallway which runs east/west 0n the west side of the hallway is a bedroom which was approximately 10X12 feet in size. Just east of the west bedroom was a second bedroom which was approximately 10x12 feet in size. At the em! end ofthe hallway was a bathroom. I an-iveti at the same time as Officer Catanio. Due to the information contained in the call for service and my observations at the scene, Officer Catanio and I made entry into the closed, unlocked front door of apartment Upon opening the front door, I observed a male subject, later identified as decedent/victim #1 Mishael Helsby, and a female subject, later identified as decedent/victim #2 Georgia Engelhaupt, who were both on the lying on the living room floor. I walked to both victims and check each one's carotid artery for a pulse and there was none, I felt I ANDERSON POLICE DEPARTMENT 01-14-1016 @1505 HRS. CASE-16-687 . 44 both victims were cold the touch. I gently pulled upward on the lefi upperarm of both victims and 45 observed their bodies to be rigid as rigor mortis had set in. Based on my observations, determined i 46 both victim were deceased at 1514 hours. officer Catania and I cleared the remaining portion of 47 the residence in an attempt to locate any suspects/additional victims and there were none. 43 Numerous APD Officers and Anderson Fire Department personnel, arrived on scene. An interior 49 and exterior perimeter was roped off with crime scene tape (refer to Sgt. Blunk's supplemental 50 report for further information regarding the scene information), 5l Due to the weather conditions and my limited resources at the time. I interviewed multiple 53 witnesses in my vehicle. Prior to interviewing each witness at the scene, I activated my department 54 issued audio recorder. The audio recording of each witness was later copied to a compact disc and 55 which was booked into evidence at APD under this case number. The following are 55 summarirations ofinterviews with all witnesses I interviewed in this case and are not exact quotes 57 unless specifically stated. Refer to the audio recording evidence disc for the entire conversations. 53 59 interview. -- 01-14-2016 at 1547 hours: identified verbally 60 61 verbally identified (and from numerous prior contacls) - -knows the residents 62 that live in 1693 Manter Drive apartment to be herself, her sister and Michael 63 Helsby. Michael was the original occupant of the apartment and later let -and -live 64 there because he felt bad for them as they needed a place to live. l-lelsby had advanced stages 65 leukemia and had told he had about 1 year to live. Helsby was in a dating relationship 66 with v- whom she knows as "Georgia". who stayed the night at the residence once in 67 a while. knew Helsby to drink alcohol regularly and smoke marijuana occasionally, 68 l-lelsby had no enemies and did not know of anyone that mated to hurt him.- 69 had seen Engelhaupt with a 2-3 year old autistic child numerous times before. 70 71 - was last at the residence on Monday 01-13-2016 and iefi to stay with her father on Park 72 Chop Lane in Anderson. On Tuesday, 01-14-2016, at about 1445 hours. -sbowed up at the 73 residence to get the rest ofher belongings out orthc residence because she was oing to move in 74 with her father._.ried to open the door and there was no answer. tried to contact 75 l-lelsby via text and there was no response- knocked on the front door of apartment #2 and 7s contacted a male name "Chant" who was gond friends with Helsby. Chant had a key to Helsby's 77 apartment which Helsby had given to him in case of emergencies. 7s 79 Chant unlocked the front door to apartment #1 and - entered the apartment with Chant. so --ibserved Helsby and Engelhaupt covered in blood and deceased on the living room floor. til _called 911 and was requested to check for a pulse on both decedents and there was none. 32 _then exited the residence and stood by outside until I arrived. 33 34 Interview-- Michael Joiner: It 1532 hours; identified by CM as so Joiner lives at 1693 Mamet Drive apartment #2 and has lived there for approximately 13 months. 2 100 101 102 103 104 105 106 107 108 109 110 111 112 113 114 115 116 117 118 119 120 121 122 123 124 125 126 127 128 129 ANDERSON POLICE DEPARTMENT 01--14-2016 1505 HRS. Joiner lives in :42 with his mother-in-law (Ning), father-inJaw (Chant), and his wife Syan Joiner. Joiner knows "Michael" next door and sees lurn almost every day. Joiner described a male named "Troy" that was going to stay the night at the residence on Sunday night or Monday night and gave a physical description of Troy. Joiner knows Engelhaupt to drive an orange Ford Focus four door, Engelhaupi always parks her vehicle in the south eastern most parking space of the parking 10! every time, which is closesl to apartment l. Joiner last saw Engelhaupt's vehicle on Tuesday (01-12-16) night when he came home from work around 5-6 pm. When Joiner got up to go to work Wednesday morning, he did not observe Engelhaupt's vehicle in the parking lot and had not seen it since. Joiner never knew of I'lelsby to have any enemies or did not know anyone that would want to kill him. luterview-- Ning 'I'hatilath at 1651 hnu rs: Identified verbally Thatialath lives at 1693 Manner Drivc apartment #2 and had lived there [or about 2 ears. Thatialath knows "Mike" (Helsby), Georgia (Englehaupt), --, and live in apartment 1. Helsby is nice guy and does not know who would want to hurt him. Thatialath knows -and to have numerous different males coming in and out of the residence and invite "weird" people to the apartment. Thatialath felt that - had something to do with death because her boyfriend (Jake) was in a physical confrontation with Helshy about 2 weeks prior. Also Thatialath thought that - boyfriend (Baxter) could have killed Helshy because he was at the apartment m1 Tuesday of Wednesay night screaming he was "going to kill everybody". Interview-Chang Suetern It 1712 hours: Identified by CDL stetem lives at 1693 Manter Drive apartment #3 and has lived there since June of2015, Saetem knows the occupants of apartment #1 to he Michael (Helsby) and Georgia (Engelhaupt). Engelhaupt has a son named Michael and a 2-3 year old grandson named Zephartih who is autistic. Engelhaupt's son works as a customer service supervisor at Walmart in Anderson. Saetem knew that Helsby allowed- and to stay at his residence because he did not want them to he homeless. On Tuesday night (01-12-2016), a male subject was standing out front of the apartment who was yelling, "You're in there, who knows who you're flicking, is he in there right now, you making threats, 1 am going to flicking kill you, I am going to fucking kick your ass". Saetern thought the male subject was ex>>boyfn'end. Saetem called the police and an APD Officer later drove by with his spot light on. The male subject had lefi prior to the Officer getting to the scene. Sactem did not see anything suspicious on Wednesday and did not see oi Engelhaupt either. Interview- Sagrina at 1734 hours: Identified verbally Phcuamkha lives at 1693 Manter Drive apartment #3 and has lived there since June of 2015. 3 130 131 132 133 134 135 ANDERSON POLICE DEPARTMENT 01-14-2016 1505 HRS. Phouamkha knows the occupant of apanrnen: #1 re go by the name of "Mike". Also rhcre is a female narncd that has been staying ar all who has a "crazy cx-boyfrien On Tuesday night (01-12-2016), at about 2100 hours, Phouamkha was inside her apamnent rnaking spagheni for dinner, wrule she was inside she heard a male's vcice yelling, know you have another guy you are fucking with, Iknowthai you have another boyfriend, and he said he wouldn't be afraid to kill to kill anybody that she's fucking wiih". Phouamkha looked ouLside her window and saw 136 and her boyfriend cuLsidc apaflmem'. #1 yelling. -th trying Io calm her 137 138 139 140 141 142 143 144 145 146 147 148 149 150 151 152 153 154 155 156 157 158 159 160 161 162 163 164 165 166 167 1613 169 170 171 172 boyfriend down. lnterview- Michael Engelhaugt at 1903 hours: Identified by CDL i was able in lccare an address for Michael Engelhaupt in the 2300 block of Highway 273 APD Officer Richardson and i wear to Engelhaupl's residence and knocked on the front door. A male subject opened the door, whichi recognized from prior calls as a manager at Walmari in Anderson, named Michael Engelhaupt. 1 identified Michael verbally and by his CA Driver's License, Michael Engelhaupl's racdrer, Georgia Engelhaupi was dating Michael Helsby for approximalely 2 years. Helsby lived with Michael Engelhaupl for a few month before Helsby moved cu! on his own. Helsby and Georgia have a good relationship and did not report any issues, Helsby lives 1693 Manter Drive #1 and was able to describe its location in detail, Michael did not know Georgia or Helsby to have any enemies. Michael owns a 2001 Ford Focus (CA GMFVOSZ) and described ii to me. Michael Engelhaupt described his vehicle Io have an approximalely 5 inch touch screen radio/dvd player in the dashboard of his vehicle. Michael Engelhaupt was able to provide me with a license plate number and VIN number from his records. It should be noted, a records check revealed Georgia Engelhaupt had been stopped in 1he vehicle several months prior and the vehicle was registered to Michael Engelhaupz. Michael Engelhaupt has not seen nor heard from his mother since and has tried to call Georgia on several occasions with negative resuls in contacting her. CASE-16-687 Lake and Oasis in shasta Lake City-stayed at the trailer park all day uf01-14-2016 where she smoked meth during the daytime hours. _was contacted by me who got a ride to the scene where she was interviewed, On 01-14-2016, at 2309 hours, I contacted!via telephone and advised her I needed to speak with her again. relayed to me was at "Indian Joe's" (Joseph Lawson) at 1797 Shasta Street, Anderson CA 96007. i asked if she would meet me near the corner of Shasta Street and Fair Oaks Street, which wasjust down the street from Lawson's residence drove from the homicide scene and met with I activated my audio recorder before _got into my patrol vehicle. _elayed to me she had lcfi her 6 year old daughter at 1797 Shasta Street with Joseph lawson whom she knows, inquired with - if Lawson would be able to provide adequate, safe child care for her daughter. I drove to Lawson's residence where I ohserved a male standing on the front porch. it should he noted, I have previously arrested Lawson and believed the male to be Lawson on the porch. exited my patrol vehicle and walked to Lawson. They appeared to have some dialog between each other and walked hack to my patrol vehicle. continued that Lawson was able [0 provide the necessary care for approximately 1 hour while we went to APD for a follow up interview, While driving to APD grated the following in summary: forgot to tell me some information during my i 1 interview On 01-122016, Baxter nun oul where .55 staying at Helsby's residence. was in an argument with Baxter out front of Helsby's residence. walked away fimm Baxter alter the argument and subsequently lefi. leh Helshy's residence and ended up at a male's residence named "Paul" who lives at the Mi way Trailer Park off of Highway 273. When .t-n'ved at Paul's residence, Baxter ms there. Baxter and gain got into an argument where Paul asked them both to leave. _lett Paul's and went to her father's residence off of Pork Chop Lane-as extremely vague as to where Baxter went, what was said during the argument, and how she got to her father's residence. I placed _nto an audio/video recorded interview room. Second interview- -- in 2324 hours: Identified verbally It should he noted, the entire interview with _lasted approximatcl 7 hours which contained numerous breaks. During the vast majonty of the interview, inppeared to be concealing information peninent to the homicides specifically surrounding the days of 01/11--12/2016. During most of the interview, 1 would allow-speak at length about different topics that surrounded the time frame of the homicides. During numerous occasions, would omit specific information during her explanation of what happened. Baxter replied that he did have a vehicle._ put her daughter in a gold Ford Poeus (which belonged to the female Georgia Bngelhaupt), Baxter drove -and her daughter towards Pork chop Lane. During the drive, Baxter advised- that he would do an 'ng for her. Baxter said he was going to take-- on an road trip. inquired as to why and Baxter replied, took care orwhat I had to do over at Mike's", Baxter continued and said, "If you tell anyone i will kill your entire family, including your daughter, you will watch and be the last one to die". _pleaded for her lite for Baxter to not hurt her in flout other daughter. When Baxter, arrived at - father's residence, -stated She was going to te Cr 3! er it out the situation as she exited the Vehicle, Baxter exited the vehicle and grabbed--on her right upper arm, Baxter squeezed her arm and said, "Make everything look normal and don't say a fucking word", It Should be noted, at the lime --told me this she rolled up her long sleeve sweatshirt and showed me a circular bruise on the inside afher right bicep about midway up the bleep. The bniise appeared to be larger than a quarter, dark purple in color, and appcared to be a consistent injury of finger compression, Photographs were later taken 0- bicep. Baxter had a conversation with believed the car Baxter drove to his house to be stolen and told Baxter to get the car on his property. Baxter drove off he property toward Dersch Road. Baxter returned to -- residence a short time later on foot. Baxter told - he had "dumped the car" olftoward Shingletown. -later observed the car on Millville Plains Road the next day and told -- At that time during the interview, I took a quick break and advised APD Officer Robert Richardson to drive out to Dersch Road at Millville Plains Road and search for the vehicle. During the course of interview with- it became apparent that Baxter was at the residence where'was previous to our interview at 1797 Shasta Street. 1 based this on information-provided rne during the interview and that (6 We) called numerous times during our interview via her cell phone. At oncmul -on speaker phone with rne. 1 inquired with - as to who was at the residence with her. --told me "Joe" was there and was hesitant to tell me about another person. Multiple APD units had already surrounded the residence in anticipation Baxter was inside, While advising-to exit the residence and run toward the street where she would meet with APD Officers, 1 chserved a mate subjects voice on the phone telling to put on her jackets I reco nized the voice to be Baxter's and _additienatty hchevcd the male's voice was Baxter'sg-- was eventually secured by APD Officers as she exited the residence and was transported to APD. I concluded my interview with _and completed a search] Ramcy arrest warrant for Baxter for the charge of 187PC, murder. The warrant was signed by a Shasta County Bench Officer about 0600 hours on 01-14--2016, On 01-14-2016, at about 0830 hours, the Shasta County SWAT Team assisted in the service of the warrants and apprehended Anthony Bsxter without incident. APD Officer's served the Search warrant and located several bloody clothing items which were the same size as the clothes which Baxter wears. The bloody clothing was later booked into evidence ar APD under this case numberi transported Baxter back to APD where I placed him in an interview room. Interview~ Anthony Baxter It 0926 hours: Identified verbally Baxter appeared to not be under the influence of a controlled substance and of a sound mind during my interview. I advised Baxter of the Miranda warning to which he stated he understood and had no questions regarding his rights. Baxter voluntarily submitted to buceal swab samples and finger nail samples which were later booked into evidence at APD under this case number. Baxter stated in summary: Baxter initially did not remember very much ofthe evening nfTucsday (ll-1272016 and denied any involvement in any murder. Baxter wa Vague in his statemean and admitted that he was at Helsby's residence on Tuesday 01-12--2016 durin the evening hours and _was there Later that evening on Tuesday, Baxter went and met hat a trailer park off of Hwy 273. On Wednesday during the morning hours, Baxter went out and met with father, Hat his residence on Pork Chop Lane. I exited the interview room and created ruse finger print cards with my own finger prints on them and wrote the name of "Anthony Baxter" with ease number "16-687" on them. I re-entered the interview room and showed the cards to Baxter while inquiring into VeEngelhaupts vehicle. Baxter admitted to stealing Engelhaupts vehicle on Tuesday night and drove up to the Midway Mobile Home park where he met up with _Baxter drove _and her 6 year old daughter to father's resi enee on Pork Chop Lane. While driving Baxter advised but he wanted to take her and -on a road trip to Baxter advised, although he had never been to he had family there. Since he was on probation and stole the car; he thought he might as well have fun driving before he went baek to jail. Baxter could not explain the bloody clothes that were loeated at the Shasta Street residenee where he was arrested and still maintained his position that he did not kill and Helsby. Baxter stated he would take a polygraph testto assist in proving his innocence. A polygraph expert was contacted and requested to assist. During a pro-polygraph interview, Baxter admitted, irl great detail, to killing Englehaupt and Helsby. mtched the confession via video in a different interview room. Once the polygraph expert eoneluded his interview, Sg1. Casey Day and I entered the interview room with Baxter and re-queslioned him regarding the homicides. anter confession: Baxter stated the followin in summary: Miehael Helsb disrespeeted sister and other members xi family. onee and - lefi the residence on Tuesday night and only Helsby and Bngelhaupt were home, Baxter came back to Helshy's residenee around 2200 hours. The front door was unlocked. Baxter opened the front door and observed Helsby and Engelhaupt were both asleep on couch and no one else was home. Baxter reached over the back of the couch and grabbed Helsby's neck. Baxter deseribed grabbing Helsby's "wind pipe" and squeezing it in an attempt to "choke him out". Baxter squeezed Helsby's windpipe for about 5 minutes until Engelhaupt started to "stir". Engeihaupt stood up, realized what was going on. Engelhaupt started "going far a phone" at which point Baxter let go ofHelsby and placed Engelhaupt in a standing rear choke hold. Baxter held Engelhaupt in a "choke hold" for about 5 minutes until her body "went limp", Baxter then observed Helsby was gasping for air and trying to get eoueh. Baxter let go of Bngelheupt and grabbed a nearby glass alcohol bottle. Baxter hit l-lelsby over the head twice with the glass bottle and "that's where the blood earne from". Baxter then grabbed a "butter knife" from the kitchen and "plunged it into his heart twice", resulting in killing Helshy. Baxter then walked over and pieked up Bngelhaupt, drug her over to Helsby's body and stabbed Bagelbaupt with the butter knife twiee in the heart. Baxter leh Engelhaupt's body next to Helsby in the living room. Baxter stole both Helsby's and Engelhaupt's aell phones, stole the keys to Bngelhaupt-s vehicle, walked outside and stole the ear. Baxter drove to meet -at the 9 ANDERSON POLICE DEPARTMENT 0144--2016 1505 HRS. CASE-16-687 388 Midway Mobile Home Park where hi: gave her a ride to her father's residence. Baxter later 339 abandoned the stolen car and proceeded on with his life until he was arrested. Addilionally, Baxter 39o relayed he had bumed the cell phones and threw the knife he used to stab the decedents into a 391 storm drain/sewer drain. Baxter was unwilling to disclose the locations oftlie physical evidence he 392 destroyed. 393 394 Baxter relayed his reasoning for killing both Helsb and En elhaupt was all over "disrespect". 39s Baxter believed Helsby had broken into and badmom's before, threw their 396 items out ofthe residence, and threatened to evict them from the residence. Baxter believed it was 397 an act of disrespect to evict -who had a 6 year old little girl with her. Baxter wanted 3911 everyone to know they could not disrespect - and her family. Baxter would give his last 399 breath to - loves her, and regularly calls -his "wife". 400 401 Baxter's clothing ms seized as evidence and later booked at APD under this case number. 1 402 subsequently transported Baxter to the Shasta County Jail where he was booked for 2 counts of 403 117 PC for murdering Helsby and Engeihuapt. Additionally, Baxter was booked on 2 counts of 404 211 PC for stealing Helsby's cell phone, and Engelhaupl's cell phone and vehicle. 405 406 On 01-19-2016, at approximately 1000 hours, I contacted Baxter at the Shasta County Jail. 1 407 advised Baxter he was free to leave at any time and to simply let me know ifbe did. I advised 4012 Baxter of the Miranda warning to which he stated he understood and had no questions regarding 409 his rights. Additionally, 1 advised Baxter it was my understanding that he did not have an attomey 410 at that time, however he would probably be appointed one soon and he could wait to speak with me 411 until afier he had spoken with his attomey. Baxter did not seem interested in speaking with an 412 attorney and wanted to Ialk with me at that time. I explained to Baxter my intent and why I wanted 413 to find the knife and cell phones Baxter relayed the following in summary: Baxter threw the cell 414 phones into an open field near the intersection of Highway 273 and Thomas Rnad, near the 415 Midway Mobile Home Park. Baxter threw the knife into a stoma/sewer drain on Shasta Street. 1 416 drew a map oreach area and Baxter pointed out to me on the map as the exact locations of each 417 item. Baxter relayed that no one assisted him in the homicides and he acted completely alone. 418 419 On 01-19-2016, at approximately 1330 hours, Officer Richardson, cso Kelly, and 1 went to each 4211 location and conduced a search. 1 was unable to locate the knife used to murder both decedents. 421 However, in an open field near the intersection of Highway 273 and Thomas Road, 1 conducted a 422 grid style search of an open field resulting in the seizure a cell phone, cell phone back case, cell 422 phone battery, and a dark leather glove, which were in the exact area Baxter described to me he 424 threw them. I OBSERVED A MALE SUBJECT RIDING A BICYCLE ON THE SIDE OF HWY 273 WITHOUT PROPER FRONT AND REAR LIGHTING EQUIPMENT, IN VIOLATION OF CVC. I INITIATED MY EMERGENCY LIGHTS AND CONDUCTED A TRAFFIC STOP OFTHE BICYCLE NEAR THE INTERSECTION OF HWY. 273 AND SPRING GULCH CONTACTED THE MALE SUBJECT, VERBALLY IDENTIFIED AS -S- ANTHONY HARRISON BAXTER, AND ADVISED HIM OF REASON FOR THE STOP. A RECORDS CHECK ON BAXTER REVEALED HIM TO BE ON SHASTA COUNTY PRCS. I OBSERVED A LARGE HANDLE FROM UNDER JACKET. 1 DEMANDED BAXTER KEEP HIS HANDS WERE I CAN SEE THEM AND WALK TOWARDS ME, HE COMPLIED. I THEN PLACED WRISTS IN HANDCUFFS AND ADVISED HIM HE WAS . BEING OBTAINED FOR A PRCS SEARCH AND FOR MY SAFETY. I UNZIPPED JACKET AND OBSERVED A METAL AX HANGING FROM A LEATHER HOLSTER ON HIS BELT. THE AX WAS CONCEALED BY HIS JACKET AND WAS EASILY ACCESSIBLE. BAXTER INFORMED ME HE USES THE AX FOR I VISUALLY ESTIMATED THE BLADE TO BE OVER 2 INCHES LONG. BY- POSSESING THE AX, BAXTER WAS IN DIRECT VIOLATION OF 3453(o)(1) PC. I TOOK PHOTOS OF THE AX ON PERSON WITH MY DEPARTMENT ISSUED DIGITAL WHILE HE WAS IN HANDCUFFS. THE PICTURES SHOW HOW WELL HIS JACKET CONCEALED THE AX BLADE. I CONVISCATED THE AX AND THE LEATHER INFORMED BAXTER I WOULD BE FILING CHARGES AGAINST HIM WITH THE HE WAS RELEASED FROM THE SCENE. BOOKED THE ITEMS OF EVIDENCE INTO THE APD EVIDENCE ROOM. AX, ITEM HAD AN APPROX. 3 INCH BLADEAND AN APPROX. 11.5 INCH HANDLE- THE HANDLE OF THE AX COULD ALSO BE USED AS A DEADLY WEAPON, SIMILAR TO A OR LEADED CANE.
