The release and any communications dealing with the 1999 movie ?Enemy of the State.? Your request was received on 20 February 2014 and as previously informed has been assigned Case Number 76757. For purposes of this request and based on the information you provided in your letter, you are considered a representative of the media. Since processing fees were minimal, no fees were assessed so we did not address your request for a fee waiver. Your request has been processed under the FOIA and the documents you requested are enclosed. Certain information, however, has been deleted from the enclosures. This Agency is authorized by various statutes to protect certain information concerning its activities. We have determined that such information exists in these documents. Accordingly, those portions are exempt from disclosure pursuant to the third exemption of the FOIA, which provides for the withholding of information speci?cally protected from disclosure by statute. The speci?c statute applicable in this case is Section 6, Public Law 86-36 (50 US. Code 3605). In addition, personal information regarding an individual has been deleted from the enclosures in accordance with 5 U.S.C. 552 (6). This exemption protects from disclosure information that would constitute a clearly unwarranted invasion of personal privacy. In balancing the public interest for the information you request against the privacy interests involved, we have determined that the privacy interests suf?ciently satisfy the requirements for the application of the exemption. Under the Instruction, production companies seeking assistance must present enough information about the program'(ideally, the script). so that the proposal can be evaluated for?accuracy and the benefit which could accrue to the DOD if asSistance was provided. The producers opted not to provide that information, so NSA could not permit filming at our facilities. (U) In April, after the second visit, the production company took some aerial footage from a helicopter over the Headquarters complex which the Agency was unable to prohibit because of FAA policies on air space. We have also learned that the producers hired a former as a consultant. Public Affairs was queried in late 1997 about employees appearing as "extras" in location shots made in the Baltimore-Washington area.
