Defendant,
Brenda Swintosky, Court Officer for Kewaunee County Sheriff?s Department. being first
duly sworn, states that:

Count 1: SEXUAL ASSAULT OF A CHILD UNDER 16 YEARS OF AGE

The above-named defendant on or about Saturday, August 05, 2006, in the Town of
Lincoln, Kewaunee County, Wisconsin, did have sexual intercourse with a child under the
age of sixteen, ASE), DOB 01f10l1991, contrary to sec. Wis. State,
a Class Felony, and upon conviction may be fined not more than One Hundred
Thousand Dollars or imprisoned not more than forty (40) years, or both.

PROBABLE CAUSE:

This complaint is based on the reports of Paula Ebert known to the complainant to be a
deputy with the Kewaunee County Sheriff's Department, who has provided true and
reliable information in the past.

Deputy Ebert reports that on October 26, 2006 she was contacted by Debra L. D. who had
discovered, through monitoring her daughter ASD's conversations on myspace.com, that
ASD may have had sexual intercourse with Michael J. Krueger. Deputy Ebert interviewed
ASD who confirmed that she had first met Michael J. Krueger a couple of years before,
when he was fifteen and she was thirteen. Michael later moved away and they lost touch.
Then in the summer of 2006 she was reintroduced to him through a friend. in July 2006
they began to date. Then on August 5, 2006 they met at the home of a friend and walked
into a wooded area. While there, they had sexual intercourse. A60 stated that it was not
forced upon her.

Deputy Ebert then interviewed Michael J. Krueger on November 21, 2006 at the Algoma
High School. Michael admitted having sexual intercourse with ASD. Hie description of the
event was consistent with that provided by ASD. He also admitted that he was aware that
she was 15 years old and that sexual contact with her was illegal.

Based on the foregoing, the complainant believes this complaint to be true and correct.
