I DISCOVERY CONTROL PLAN 1. Plaintiff intends to conduct discovery, if necessary, under Level 2 of Texas Rule of Civil Procedure 190. II. PARTIES 2. Plaintiff is the Texas Department of Aging and Disability Services, a state agency (DADS). 3. Defendant is Ken Paxton, the Attorney General of Texas. The Open Records Division of the Office of the Attorney General (0RD) issued Letter Ruling the letter ruling at issue (Letter Ruling). A copy of Letter Ruling is attached as Exhibit A. 4. This suit is brought pursuant to Texas Government Code 552.324 and has been filed within the statutory 30?day time period. Plaintiff?s Amended Original Petition - OR 2015-08678 Page 1 Ill. SERVICE 5. The Attorney General may be served in the Price Daniel, Sr. Building, 8th Floor, 209 West 14th Street, Austin, TX 78701. Service is not necessary at this time. IV. 6. Venue and jurisdiction are proper in this Court under the authority of the Government Code as this is a suit pursuant to Section 552.324 of the Government Code. 7. In accordance with Section 552.325(b) of the Government Code, the attorney for DADS will make a timely good faith effort to notify the requestors, in writing, of the following: I the existence of the suit, including the subject matter and cause number of the suit and the court in which the suit is filed; a each requestor?s right to intervene in the suit or to choose to not participate in the suit; 0 the fact that the suit is against the Attorney General; and the address and phone number of the Office of the Attorney General. V. CAUSE OF ACTION UNDER GOVERNMENT CODE SECTION 552.324 8. DADS received a request for plat maps for specified cemeteries and burial lists related to former DADS clients, DADS determined that this information is confidential by law under Health Safety Code ?595.001 and Tex. Gov?t Code 552.101. DADS requested an Attorney General ruling as to whether the information could be withheld. 9. DADS timely sought a ruling from the attorney general regarding the . information DADS believes is protected from disclosure. Plaintiff?s Amended Original Petition - OR 2015-08678 Page 2 10. In the Letter Ruling challenged here, ORD ruled that some of the information DADS sought to withhold must be released. See Exhibit A at 2. 11. Under Government Code 552.101, information is excepted from disclosure if it is confidential by law. Here, the information at issue is confidential by law and not subject to disclosure. VI. CONCLUSION PRAYER 12. For these reasons, Plaintiff, Texas Department of Aging and Disability Services, asks this Court to enter a final judgment in its favor and rule that the information at issue in Letter Ruling OR2015-O8678 is confidential by law and therefore excepted from disclosure under the Public Information Act.
