The Program Director will select movies to be shown. The Warden will have final authority regarding movie selections. B. WCI will only show movies that are rated G, PG or PG-13. R rated movies that have been edited to eliminate and/or reduce offensive language, nudity, violence and sexual content can be shown with the approval of the Warden. C. Unedited R rated and X rated movies are prohibited. This includes movies used for educational purposes. C. WCI will maintain a log of all movies shown (both purchased and rented) for inmate leisure time activities. The log is to include the title of the movie and date(s) shown. D. Movies will be shown on the inmate announcement channel. General Guidelines A. Unauthorized pornographic material includes but is not limited to: 1. Written materials which the average person, applying state contemporary community standards, would find, when taken as a whole: a. Appeals to the prurient interest; b. Describes human sexual behavior in a patently offensive way; and, c. Lacks serious literary, artistic, political, educational, or scientific value. 2. Personal nude photographs which are not part of any published photograph or printed material. 3. Publications that feature photographs, pictures, and/or drawings of nudity. 4. Special mail – Correspondence to or from state and federal elected/appointed officials to include the Governor of Wisconsin, members of the Wisconsin legislature, members of the United States congress, Secretary of the Department of Corrections, DAI Division Administrator, investigative agency of the federal government, clerk or judge of any state or federal court, the President of the United States. USPS – United States Postal Service Vital Documents – Certified copy of the inmate’s birth certificate, signed social security card, driver’s license and/or State ID card. PROCEDURE I. General Guidelines A. All incoming mail, outgoing mail and packages received that violate Wisconsin Administrative Code s. DOC 309.04, 309.05(2) and DAI Policy 309.00.50 shall be disposed of in accordance with Wisconsin Administrative Code s. DOC 309.04. B. Packages which contain allowed and/or prohibited property or clothing shall be processed in accordance with DAI Policy 309.20.03. II. Mailroom Security Access to the mailroom shall be restricted to authorized staff. III. Mail Monitoring A. Incoming/outgoing inmate mail may be monitored and read with the written approval of the Security Director/designee using DOC-239. B. Monitored mail read shall be recorded on the DOC-240. IV. Distribution of Mail A. Processing of incoming and outgoing mail shall be completed as soon as possible. B. Magazines and subscribed periodicals are subject to a centralized review by DOC staff. This may result in a delivery delay of seven to ten days following receipt. Inmates shall not receive a specific notice of this delay. C. Mail shall be delivered to and from the mailroom and the living units. Inmates shall not be involved in the direct handling, sorting or distributing of mail directly to the inmates. When staff determines incoming or outgoing mail is suspicious, staff shall contact the Shift Supervisor. 1. Suspicious mail characteristics may include but not be limited to: a. Oily stains, discolorations or crystallization on the envelope or on the outside of the package. b. Excessive wrapping, tape or string. c. Rigid, uneven, irregular or lopsided packages. d. Packages with soft spots, bulges or excessive weight. e. Packages with protruding wires or aluminum foil. f. No return address. 2. Notify the inmate using DOC-243, unless it would inhibit an investigation of potential criminal behavior or other conduct in violation of facility rules. E. Incoming Inmate Mail 1. Consent: Inmates must give written consent on DOC-238 to receive mail. If consent is not given, all of an inmate’s mail shall be marked as refused and returned to the Post Office. 2. Inspecting incoming mail a. Staff shall open and visually check all incoming mail for contraband, with the exception of special and legal mail. b. Mail may be randomly scanned and inspected. c. Incoming mail shall be read if there is a justifiable belief that contents constitute a risk to the safety and security of the facility, specific individuals or the general public, or when there is reason to believe that the inmate or the sender is involved in criminal activity. d. Mail read shall be recorded on the DOC-240. e. Incoming packages shall be opened, inspected and processed based on the contents. f. Mail shall not be delivered if it meets any of the criteria set forth in Wisconsin Administrative Code s. DOC 309.04(4)(c). 3. Sorting incoming mail a. Incoming mail must be addressed with the following or it may be returned to sender: i. Inmate’s DOC recognized name. ii. DOC number. b. Incoming bulk rate mail shall be discarded, excluding: i. Catalogs. ii. Non-profits mailings. iii. Subscribed periodicals. iv. Newspapers. v. Magazines. c. If any of the following is on the envelope, the item shall be stamped “Refused” and returned to the post office: i. Address Service Requested. ii. Forwarding Service Requested. iii. Change Service Requested. iv. Address Correction Requested. Incoming mail may include the following: i. Paper with words and/or drawings on it. ii. Signed, non-musical, commercial greeting cards and post cards. iii. Photographs. No Polaroid or commercial photos and no advertisements containing thumbnail-sized examples of commercial photos for sale. iv. Periodicals and publications materials. v. Money orders or cashiers checks may be sent via mail for deposit in the inmate’s account. vi. Cash, personal checks, and foreign currency are not allowed and shall be returned to sender at the inmate’s expense. Staff shall complete and distribute a DOC-243. vii. Credit report from a credit reporting agency. viii. Incoming mail from a court or governmental agency that requests or requires a written response from the inmate may contain one metered (not stamped) pre-addressed return envelope addressed to the court or governmental agency. e. Printed Internet materials: i. Shall be on standard size paper (8 ½” x 11”). ii. Shall be reviewed on a case-by-case basis to determine if allowable. 4. Forwarding mail for transferred or released inmates a. Bulk mail shall not be forwarded. b. First class mail and subscribed periodicals shall be forwarded for up to 60 days. After 60 days from the date of the inmate’s transfer, or if a forwarding address is unavailable, it shall be returned to sender. c. The USPS will not process a change of address request for an incarcerated individual; therefore, it is the responsibility of the inmate to notify those persons or businesses from which he/she receives mail of a change of address. F. Non-Allowable Mail Incoming and outgoing mail, in whole or in part, is not allowed in accordance with Wisconsin Administrative Code s. DOC 309.04. In addition: 1. Pertains to unauthorized business activity including the practice of a profession, sale, solicitation, manufacture, or distribution of goods or services, excluding routine communication with a person who is operating a business established by the inmate prior to incarceration. 2. Contains photographs or personal information regarding DOC staff. 3. Contains stamps, instant cash cards, phone cards or debit/credit cards. 4. Contains items that pose a safety or sanitation hazard, including lipstick or other foreign substance and/or has an odor which includes perfume/aftershave. 5. Newspaper or magazine clippings are not allowed; however 8½” x 11” reproduced articles are allowed. 7. Inconsistent with or poses a threat to the safety, treatment or rehabilitative goals of an inmate. 8. Facilitates criminal activity. G. Non-Delivery of Inmate Mail 1. When incoming or outgoing mail is not delivered, the inmate shall be sent a completed DOC-243, except as noted in Section IV.E.3.c. 2. Mail constituting a risk to the safety and security of the facility, specific individuals, or the general public shall not be returned to the sender or intended recipient. a. These items shall be destroyed or referred to the Security Director for disposition. b. The intended recipient shall receive a completed DOC-243, unless it would inhibit an investigation of potential criminal behavior or other conduct in violation of facility rules. 3. With the exception of the items noted in #2, the inmate must choose one of the following dispositions: a. Incoming non-allowable mail shall be disposed of or returned to the sender along with a copy of the DOC-243. If it is returned, postage shall be applied at the inmate’s expense using an envelope provided by the inmate. b. Outgoing non-allowable mail shall be disposed of or returned to the inmate, if appropriate. c. Mail shall be held pending ICE review at the request of the inmate. H. Special/Legal/Health Care Provider Mail Incoming special/legal/health care provider mail shall be opened only in the presence of the inmate. Staff may inspect the contents to ensure the mail is legal, official in nature or clearly identified as being from a health care provider. I. State of Wisconsin ID Card 1. State of Wisconsin ID cards will be mailed to the facility address in a Do Not Forward envelope and shall be stored securely in the DOC-236D with an inmate receiving a DOC-237 for the ID card. 2. If an ID card is received for an inmate who is no longer at the facility, staff shall: a. Determine the current location of the inmate. b. Open the Do Not Forward envelope. c. Pull out the DOT insert (ID card will be attached). d. Put the insert with the new ID card into a new envelope and address the envelope to the inmate’s current location. Vital documents received shall be stored securely in the DOC-236D. The inmate shall be issued a DOC-237 for the documents received. 2. If vital documents are received for an inmate who is no longer at the facility, staff shall forward those documents to the receiving facility. K. Published Materials 1. Inmates are allowed to have subscriptions to newspapers or periodicals. 2. Publications ordered by an inmate from an authorized publisher or vendor shall be paid for in advance. 3. Gift publications are permitted only when shipped from the publisher or authorized vendor. Packages must arrive with the receipt which shows the value of each item. 4. Publications that have been altered or show signs of tampering are not allowed. L. Pen Pal Materials 1. Inmates shall be prohibited from using funds from their inmate trust account for unauthorized purchases, including but not limited to, personal web sites, pen pal web sites and pen pal print ads. 2. Facility staff shall review all DOC-184 forms and attachments. Any unauthorized purchases shall be denied. 3. Mailings from businesses which offer multiple services such as pen pals, Internet research, social media third-party maintained accounts, and commercial photo sales are subject to review and denial when appropriate. M. Outgoing Inmate Mail 1. Outgoing mail may include paper with words/drawings on it, signed greeting cards, and photos; no Polaroid or commercially published photos. 2. Inmates may not use the facility address as a business address. No business name or position title may be identified at the facility address. Any such representation on outgoing mail shall result in it being inspected and/or read and treated as non-allowable mail. 3. Only envelopes purchased in the canteen or from an approved vendor, or pre-paid metered (not stamped) envelopes provided by and addressed to a court or other governmental agency are authorized. 4. All outgoing mail is subject to inspection. 5. Outgoing inmate to inmate mail shall be submitted unsealed. If an inmate submits sealed mail, it shall be opened, searched and returned to the inmate. 6. All outgoing inmate mail shall be identified as being mailed from a correctional facility. 7. Outgoing inmate mail without the inmate name and number shall not be sent out of the facility. Inmates shall not correspond with another inmate committed to the DOC through intra-facility mail or the interview request system. C. Institution libraries will create and maintain a library materials collection development plan which addresses subject and genre coverage and depth. D. Inmates and staff may request materials through the Institution Librarian via the Wisconsin Interlibrary Loan System. Interlibrary loan materials must meet the same inclusion and exclusion criteria as those in the library’s own collection. J. Institution libraries will not select materials that: 1. Are pornographic. 2. Teach or advocate violence or hatred and present a danger to institutional safety and order. 3. Teach or advocate behavior that violates the rules of the Department of Corrections or state and federal laws. 4. Teach or describe the manufacture or use of weapons, explosives, drugs, or intoxicating substances. 5. Teach or describe the manufacture of devices that are likely to create a substantial danger of physical harm to self or others. 6. Are otherwise injurious. 7. Are listed on the DOC Denied Materials List. K. Institution staff may make recommendations for Library Materials to be added to the Library’s Collection. L. Materials that are lost, stolen, or destroyed are replaced as necessary, in order to maintain a well-rounded collection or to meet a particular institution need. M. Priorities for replacements are determined by the institution librarian. N. The institution library will accept public donations only if they meet the same standards required of library materials that are purchased. O. No title will be judged for exclusion by taking single passages\pictures out of context and basing condemnation of the material on such passages\pictures. If the librarian believes that the title in question is not suitable for the library, he/she will use the DOC-2405 to recommend the removal of the material to the DOC Library Materials Review Committee. T. The Library Materials Review Committee will make the final decision as to the retention or exclusion of the material in question. U. The librarian will notify the submitter of the DOC-2404 of the final disposition of the request. V. The Library Materials Review Committee will maintain a central list of all reviewed library materials, and the decisions of the committee will apply to all DAI institution libraries. W. Security shall be available to consult with librarian on specific library materials that may present a security risk. II. General Procedures for Institutions/Centers without a Librarian A. General A. Vendor canteen catalog system 1. The DOC has contracted with vendors to provide inmate personal property items which have been approved. 2. Facilities shall designate a staff member who is responsible for receiving and distributing the canteen catalogs upon their arrival. 3. Facilities shall develop a procedure for notifying inmates of any price changes in the canteen catalogs. 4. Items shall be ordered by inmates using order forms provided by the vendors. Inmates shall also submit a DOC-184 in accordance with their facility ordering procedure. 5. Inmates are required to pay applicable sales tax. 6. Items may be purchased by family or friends from contracted vendors via internet Web sites or toll free phone numbers. 7. Items received that are deemed faulty or the wrong item sent by the vendor shall be returned at the expense of the vendor. Wrong size or color ordered by the inmate or family member shall be returned at the inmate’s expense. 8. Allowable property items not available through the catalogs or canteen may be ordered from other approved vendors. Examples include, but are not limited to, prescription eye glasses, publications, certain religious items and release clothing. Orders shall be processed in accordance with facility procedure. Allowable personal property may vary between facilities depending on the security and treatment programs at the facility. 2. Facilities which house inmates in “temporary hold” status shall establish procedures to determine what personal property items belonging to inmates in transit status may be limited/restricted. 4. A record shall be kept of all authorized property in the inmate’s possession utilizing DOC-236/236A or DOC-1130. These forms shall be utilized to inventory all inmate personal property during intake, transfer, TLU and release. a. Staff shall list the serial and/or model numbers of electronic items when available on the DOC-236/236A. b. Staff inventorying property shall sign the form. c. Inmate shall sign the form upon receiving personal property. d. Staff shall issue a completed DOC-236/236A to the inmate at intake upon completion of inventory. e. Property staff shall record additions or deletions to the inmate’s recorded inventory. f. Facilities shall develop a procedure to secure property when it is outside of the direct control of the inmate (e.g., transfer, segregation or observation placements). 5. All personal property (excluding medically prescribed items, hobby materials, legal materials, electronic equipment, typewriters, fans or other large items) shall not exceed 8,192 cubic inches (equivalent to a container measuring 32” x 16” x 16”). Canteen items are considered personal property and count towards the cubic inch limit. 6. Property in excess of established limits shall be disposed of in accordance with facility procedure. 7. Written notice shall be provided on a DOC-237/237A to the inmate within 10 days of the disposal of any personal property. 8. Fees required for disposal of televisions or electronic items shall be at the expense of the inmate. 9. All incoming property must be new, shipped directly from the vendor with a receipt to include the price of the item. With prior approval, exceptions including cost may be made for medical appliances, correspondence course text books materials and specified religious items. a. Upon receiving electronics, musical instruments and/or major property items, staff shall plug them in to test them in the inmate’s presence. b. If items listed in Section a. above are working properly, staff shall engrave them with the inmate’s name and DOC number. 10. Inmates shall immediately report all missing property items to designated staff. A 90-day waiting period is established before missing property may be replaced after reporting the missing item in writing to the Property Department. 12. Staff shall complete a DOC-237/237A whenever an inmate receives or disposes of personal property. a. DOC-237/237A shall be completed as stated above except as noted in Section I.C.9. b. Staff shall list the serial and/or model numbers of electronic items when available on the DOC-237/237A. c. DOC-237/237A distribution for all property received, destroyed or sent out via commercial carrier is as follows: i. White – Property Department file. ii. Yellow – Inmate. iii. Blue – Unit. iv. Pink – Use determined by each facility. 13. Inmates shall maintain copies of DOC-237/237A and vendor receipts. C. Publications include newspapers, magazines, catalogs, pamphlets and books. 1. Publications must be received directly from publishers, approved retail outlets or other recognized commercial sources and shall not exceed 11” x 14.” 2. Inmates shall write their full name and DOC number on the inside cover of all allowable publications they are issued. 3. Books and publications received directly from State Representatives and other elected officials shall be reviewed on a case by case basis and may be allowed in accordance with Wisconsin Administrative Code s. DOC 309.05. 4. Publications shall be reviewed in accordance with Wisconsin Administrative Code s. DOC 309.04 and 309.05. a. A list of reviewed publications is available for staff to access on myDOC at: myDOC/Offender Management/Security and Emergency Operations/Publications. b. This reviewed publications list shall be posted in facility libraries and updated on a monthly basis. 5. Posters, CDs and other non-allowed property items may be removed from a publication if the integrity of the publication shall not be affected by removal of the item. Inmates shall dispose of the non-allowable item per facility procedure. Pages of disallowed content may not be removed. 6. Denial of magazines and books shall be documented by title utilizing DOC-243 with copies provided to the inmate, sender and Security Director/designee, if a publication is denied for reasons stated under Wisconsin Administrative Code s. DOC 309.05(2). When multiple inmates receive the same publication, a list of all inmates shall be included with a single DOC-243 to the sender of the publication. 7. When a sender’s address does not appear on the shipping label of a magazine, a search for the mailing address in the publication shall occur. When a sender return address cannot be located, staff shall document in the sender section of the DOC-243, No Return Address Located. 8. Non-allowable publications shall be disposed of in accordance with DAI Policy 309.04.01 and facility procedure. a. Non-allowable publications shall be recorded by title on a DOC243. If the inmate returns the publication to the sender, a copy of the DOC-243 shall be included. Postage applied shall be at the inmate’s expense. b. If the inmate requests to appeal the publication’s denial, it shall be held pending ICE review. 9. Disposable publications such as newspapers, magazines, catalogs and pamphlets, do not require a property receipt or record but count toward the total of publications in the inmate’s possession. 10. Allowable publications for which an inmate does not have a subscription for, shall require the completion of a DOC-237 as these items are not considered disposable property. 11. Publications that are part of an approved educational correspondence course in accordance with DAI Policy 300.00.26 may be approved, in advance, by the designated educational staff. “Used” condition publications shall be allowed only when used for an approved educational correspondence course. 12. Calendars may only be purchased from the property vendor catalogs unless the inmate is a member of an identified religious umbrella group who has calendars unique to their faith. These calendars shall be subject to review by the facility Chaplain/designee. 13. Fantasy role playing games and associated materials shall not be permitted., e.g., Dungeons and Dragons, Magic: The Gathering. 14. Maps that may compromise the security of the facility, safety of the public or safety of staff shall not be permitted. Atlases and/or individual maps shall be no larger than 11” x 14”. 15. Combined possession limit of twenty five (25) publications. 16. Segregation Unit a. A minimum limit of four (4) personal publications shall be allowed in a segregation unit. b. Religious text is considered a personal publication. c. Personal books allowed in a segregation unit shall be soft cover only. d. Inmates shall be permitted to exchange personal books from their stored personal property a minimum of every 30 days. e. Personal books shall be in addition to any books segregation inmates are allowed from the facility’s segregation library cart. f. Magazines and newspapers may be permitted in a segregation unit. When permitted, facilities shall develop procedures for distribution. g. Publications that contain contraband, or pose a security risk in a segregation unit shall not be delivered. All hobby materials must fit into a box no larger than 14” x 14” x 14” or 2,744 cubic inches with the exception of one oversized item. 2. Music is considered a hobby and each instrument is considered a separate hobby. 3. Electrical musical instruments played in cells/rooms must be played through a headset. 4. Amplifiers or speakers are not allowed. 5. Refer to DAI Policy 309.36.01 for allowable hobby items. E. Legal 1. Legal materials may be retained when necessary for legal actions. 2. Legal material shall be limited to a box no larger than, 20” x 20” x 20” or 8000 cubic inches. 3. Photographs are permitted when required for an active legal case. These photographs shall not count toward the personal photograph limit of 50 but must comply with guidelines as outlined in Section X.C. These photos may not be displayed in cell. 4. Digital formatted legal materials are allowed in accordance with DAI Policy 300.00.67. 5. The Warden/designee may permit temporary short-term storage to inmates who demonstrate a need for additional material in conjunction with ongoing litigation. The storage of additional materials shall be consistent with fire codes and regulations. F. Value of Property 1. The cost of electronic items or musical instruments shall not exceed $350.00 each, excluding taxes and shipping costs. 2. The cost of prescription eyeglass frames shall not exceed $125.00, excluding taxes and shipping costs. 3. The cost of all other individual property items shall not exceed $75.00 each excluding taxes and shipping costs. 4. Receipts from the merchandise supplier are required for all items received. a. Receipt must arrive with the item and must show the cost of each item on the receipt. b. Handwritten receipts and return address labels are acceptable. G. Damaged or Worn Property 1. Property items that are broken, altered or worn to the extent of being nearly or completely unserviceable shall be classified as contraband and disposed of in accordance with facility procedure. 2. Property items that have minor damage, are still in working order and are not a safety risk may be allowed to be retained by the inmate with approval from the Security Director/designee. 3. Property may be sent out via designated commercial carrier or USPS at the inmate’s expense. Inmates may be charged a disposal fee, when required, by the facility. H. Repair of Property 1. Repair of property shall be at the inmate’s expense. 2. Facilities shall determine which property items may be sent for repair under warranty to the manufacturer or to an approved retail outlet for items not covered by warranty. 3. Property items replaced by the manufacturer under warranty may be an equivalent product and must meet current specifications. I. Prescription Glasses/Reading Glasses 1. Prescription eyeglass frames may not exceed $125.00, excluding the cost of lenses. 2. Tinted lenses are not allowed unless documented medical approval from HSU is provided. 3. Photochromatic/transitional lenses are allowed. 4. HSU approval is limited to verifying the inmate requires prescription glasses and requirements for tints. HSU approval is not required for reading glasses. 5. Fashion glasses without prescription lenses are not permitted. 6. All frames are subject to security inspection. a. Frames with exposed logos or writing may not be allowed. b. Multi-colored frames may not be allowed. 7. Frames and lenses shall be ordered together from the same vendor. 8. Limit two (2) personal or a combination of (1) personal and one (1) State pair of glasses. Over-the-counter reading eyeglasses are counted towards this limit. 9. Per DAI Policy 500.30.35, inmates shall not be issued state eyeglasses if they already have a pair of personal eyeglasses in their possession or if they choose to purchase a pair of personal eyeglasses. 10. Eyeglass cases shall be permitted for each pair of glasses. 11. Eyeglass cases shall be soft sided. However, rigid, clear cases shall be allowed as long as they do not contain a metal hinge. 12. Additional personal prescription glasses may be approved when determined medically necessary. 13. Contact lenses are not permitted unless medically necessary and approved. 14. Cleaning cloths are allowed when they are received with the glasses. J. Tamper evident seals 1. Tamper evident seals shall be affixed to electronics and major property items. 2. The number of seals shall be determined by the size or shape of the item. 3. Destruction or alteration of seals by an inmate may result in disciplinary action. Non-Standard Property Items 1. Facilities may permit certain non-standard property items specific to that facility’s program as authorized in Section I. B. of this policy. 2. Non-standard property items permitted at one facility may not be permitted at another. 3. WCCS/WWCS facilities may allow non-standard, job specific property items which allow inmates to possess items necessary for work release and project crews. a. Inmates must have a job which requires non-standard property items. b. Non-standard property items shall be sent out at the inmate’s expense when no longer needed for the job/project. 4. Facilities shall identify non-standard property items. Inmates shall be responsible for the removal of these items prior to transfer to another facility. 5. Items not permitted at the receiving facility must be sent out of the facility or disposed of prior to transfer. 6. Non-standard property items shall be allowed for inmates who have documented disabilities. These items may include, but are not limited to: a. Vibrating alarm clocks. b. Walkers. c. Wheelchairs. d. Long shoe horns. e. Sock hooks. 7. Inmates who require non-standard medical property items shall have an active DOC-3332B on file. The facility ADA Coordinator shall assist the inmate with this process, reviewing the request and ensuring proper documentation is on file, if approved. II. Grandfathering Inmate Personal Property/Clothing Items A. Grandfathered items may be denied based on reasonable security justification. B. When property items are removed from the approved listing the DAI Administrator shall direct the disposition of items no longer authorized by one of the following options: 1. Establish an effective date when deleted property items shall no longer be permitted. 2. Establish a grandfather provision to allow property item(s) for those inmates who possessed the items prior to removal from the approved list, with the understanding inmates shall be permitted to retain possession of the items until mandatory release, parole, discharge or replacement of the item. 3. Establish a provision that when an inmate is transferred from one facility to another, regardless of security status, all property/clothing items considered grandfathered shall be removed from the inmate’s possession. Those items shall be disposed of in accordance with the sending facility’s procedure on non-allowable property. Inmates shall be responsible for contacting the facility’s Property Department to turn property items in for proper disposal prior to the effective date the property item(s) are no longer permitted. D. Grandfathering dates for specific property items: 1. As of June 1, 1999: Inmates are no longer allowed to purchase cassette players or cassette player combination units. Inmates shall be permitted to retain until mandatory release, parole, discharge or replacement of the item. 2. As of January 1, 2002: Inmates are no longer allowed to purchase watches that are not clear plastic. Inmates shall be permitted to retain possession of the watch until mandatory release, parole, discharge or replacement of the item. 3. As of January 1, 2002: Inmates are no longer allowed to purchase electronic items that are not clear plastic. Inmates shall be permitted to retain possession of non-clear electronic items until mandatory release, parole, discharge or replacement of the item. 4. As of April 17, 2006: Inmates are no longer allowed to purchase typewriters with memory capability. Inmates shall be permitted to retain possession of the item until mandatory release, parole, discharge or replacement of the item. 5. As of September 5, 2006: The DAI Administrator grandfathered property items that were in an inmate’s possession and no longer authorized as a result of past revisions to this policy. Specific information related to policy revisions is noted in the 2006 memo listed in the “References” section of this policy. Inmates shall be permitted to retain these items until mandatory release, parole, discharge or replacement of the item. 6. As of January 31, 2008: Inmates in possession of items issued to them from vendors other than the approved DOC canteen catalogs shall be permitted to possess these items provided they have retained receipts which note the date and cost of the item’s purchase. III. Suggestions for Revision and Review of Clothing and Personal Property A. Suggestions for revision of DAI 309.20.03 may be submitted by any staff member via email sent to the DAI Property Committee chairperson. B. The DAI Security Chief oversees the DAI Property Committee and appoints the committee’s chairperson and members. C. The Property Committee shall meet at a minimum of twice per year. D. The Property Committee Chairperson shall collect staff suggestions and submit them to the Property Committee for review. E. The Property Committee Chairperson shall summarize the committee’s review and submit it to the DAI Security Chief. The DAI Security Chief shall review the summary of suggestions with the DAI Administrator, and upon approval/disapproval of the Administrator, inform the committee of the decision. G. The DAI Administrator may authorize changes to this policy as needed. H. The DAI Administrator shall provide written notification to inmates and staff of the revisions and effective date of implementation. IV. A&E Intake Property A. Personal property of inmates in A&E shall be limited to basic needs. B. A&E inmates who have current magazine and newspaper subscriptions shall be allowed to possess these items up to the allowed limit of 25. 1. New subscriptions and book orders shall not be allowed. 2. A&E inmates may possess one (1) religious book of their faith. 3. A&E inmate property on Intake shall be logged on DOC-1130. 4. Inmate social security cards, birth certificates, driver’s license, State identification cards and passports shall be inventoried and retained in secure storage upon Intake in a DOC-236D. Refer to DAI Policy 309.20.02. 5. Inmates arriving from federal and other out-of-state facilities via ICC/IGA shall be processed according to the following guidelines: a. Inmates received who have a Wisconsin sentence and need to complete the A&E process shall be treated as a new admission. b. Allowable property shall be in accordance with DCI and TCI’s facility procedures for this policy. 6. Inmates received as an ICC/IGA trade may be allowed to retain property that meets this policy’s specifications. No food products, hobby or hygiene items shall be allowed. V. Processing Inmate Personal Property at the Sending Facility A. Inventory all property and record on DOC-236/236A. A copy of the completed DOC-236/236A shall be given to the inmate. 1. Consumables include, but are not limited to candy, cookies, crackers, chips, drink mixes, gum, soup mixes, deodorant, shampoo, toothpaste, etc. 2. Opened containers a. Edible products that have been opened are not allowed. b. Liquid and hygiene products that have been opened are allowed provided they are clear or translucent and in their original factory container that is clear or translucent allowing staff to view the product. 3. Unopened containers a. Edible and hygiene products that have not been opened (factory sealed) are allowed. In addition, liquid or hygiene products that are clear or translucent and in their original factory container that is clear or translucent allowing staff to view the product shall be permitted. 4. Medication (controlled and non-controlled) shall be packed separate from all other property per DAI Policy 500.80.15. 5. Photos shall be counted and the number documented on DOC-236/236A. 6. Electronic items a. Staff shall inspect the items to ensure they are properly engraved and belong to the inmate by verification of the correct serial number. b. Staff shall ensure the electronic item is in working condition. c. Property items that have minor damage but are still in working order and are not a safety risk shall be documented on a DOC-236/236A. d. TVs, radios and typewriters shall be packed in the original boxes with the original Styrofoam inserts, if available. If original packing material is not available, these items shall be packed using protective packing material, either bubble wrap, packing peanuts, or similar materials to ensure protection during transport. B. File original DOC-236/236A in the sending facility’s property file. C. DOC-236/236A shall be placed in a manila envelope marked “PROPERTY FORMS” for each receiving facility. D. The name of the receiving facility and total number of boxes shall be recorded on the sealed envelope. E. If a DOC-236D exists for a transferring inmate it shall be forwarded to the receiving facility in a manila envelope labeled with the receiving facility’s name. F. If a DOC-236D accompanies an inmate upon transfer it shall be stored in a secure location within the facility’s property department. G. WCCS and WWCS sites without a Property Department shall designate a secure location for storage of the DOC-236D. H. Transfer property shall be packed and sealed in boxes no larger than 16”x16”x16”. I. DOC-1303 shall be attached to each box/item (electronics, typewriters, musical instruments, etc.). J. DOC-1416 shall be completed in triplicate by the sending facility for each receiving facility/jail. 1. All boxed property, electronic items, vital documents (DOC-236D) and other property shall be listed. Staff preparing the DOC-1416 shall sign and print his/her name in designated area upon completion. 3. Transporting staff shall check the DOC-1416 to verify all property listed is accounted for and then print and sign his/her name in the designated area. K. Personal property received from any vendor after an inmate has transferred shall be forwarded by the receiving facility via designated commercial carrier to the inmate’s current facility. 1. Shipping costs shall be paid by the facility that receives the property from the vendor. 2. The DCI transportation unit shall not transport this type of property. L. Personal property for inmates placed at the DCI Infirmary 1. The sending facility is not allowed to transfer personal property for inmates temporarily housed in the DCI Infirmary. 2. The inmate’s assigned supervision shall be DCI before the personal property is to be shipped or approval must be granted by the DCI Warden/designee. VI. Responsibilities for Transport Staff Processing Property Transportation staff shall issue the receiving facility staff the following: A. Copy of the DOC-1416 upon verification and receipt of staff’s signature. B. A manila envelope containing copies of the DOC-236/236As. C. A second manila envelope containing the DOC-236Ds. VII. Processing Inmate Personal Property at the Receiving Facility A. Receiving facility staff shall: 1. Receive, verify and sign the DOC-1416 from the transportation staff. 2. Receive the manila envelope containing copies of the DOC-236/236As for filing in the inmate’s master property file. 3. Receive the manila envelope containing the DOC-236Ds and secure per Section V.F. 4. Inventory all allowable incoming property on the DOC-236/236A . Retain original in the Property Department and route a copy to the housing unit and the inmate. 5. Test electronics, musical instruments and/or major property items in the inmate’s presence. 6. Upon verifying ownership, engrave electronics, musical instruments and/or major property items that arrive without the inmate’s name and DOC number on them. 7. Document any minor damage to property items that are still in working order and pose no safety risk on a DOC-236/236A. Unauthorized property shall be recorded on a DOC-237/237A and marked as contraband. C. Inmates shall designate a method of disposal for contraband items per facility procedure. This shall be documented by staff on the DOC-237/237A. VIII. Disposal of Personal Property or Unauthorized Property Via Commercial Carrier, USPS or on Visits A. Property sent by commercial carrier or USPS 1. For tracking and insurance purposes, property items may be sent out via designated commercial carrier. 2. Facilities shall establish procedures for the use of USPS pack and ship services to make them available to inmates. a. The USPS does not automatically track or apply insurance. These services may be purchased separately. b. Inmates who choose not to purchase tracking or insurance on their package, accept the risk of loss. 3. Property shall be packaged in an appropriate shipping container. B. Personal property may be sent out on a visit when authorized by facility procedure. C. Inmates may choose to dispose of any non-allowable items by destroying such items in the facility’s Property Department in the presence of staff. A fee may be charged for disposal of some items per Section I.B.8 of this policy. D. The inmate may donate the item if allowed by facility procedure. E. The inmate is required to select one of the options listed above for disposal. Failure to select one of these options within 30 days of notification of the denial shall result in the facility utilizing one of the following: 1. Donating the item to a non-profit organization of the facility’s choice. 2. Destroying the item. 3. Sending out the item to a person on the inmate’s approved visiting list by designated commercial carrier at the inmate’s expense. F. If inmates fail to notify facility staff of the method for the disposal of personal property, the following shall be completed: 1. Property staff shall determine the appropriate method of disposal as noted in Section VIII. E.1-3 and shall record the method chosen on the DOC237/237A. 2. The inmate shall be routed a copy of this DOC-237/237A to inform him/her of the disposition of the personal property. G. Items that are contraband and pose a security concern may be disposed of immediately. Page 15 of 23 Processing Unauthorized Property Received Through the Mail/Commercial Carrier A. Unauthorized property shall be processed and recorded as contraband on DOC-237/237A. B. Publications shall be processed in accordance with Section I.C. of this policy. C. Items that pose a serious threat shall be disposed of immediately. D. Items purchased on credit by the inmate, including membership in book clubs, shall not be accepted and shall be immediately returned to the sender at the inmate’s expense. Inmate may be subject to discipline. E. Items normally allowed that are received from a private residence or a nonDOC approved vendor shall not be accepted and shall be considered contraband and disposed of per facility procedure. Release clothing is exempt from this restriction as inmates do not retain the items in their possession. F. Disposition shall be made in accordance with Section VIII of this policy. G. Disposition shall be made by the inmate within 30 days utilizing one of the facility’s disposal options at their own expense: 1. Return to sender via commercial carrier. 2. Send out to person on visiting list via commercial carrier. 3. If the inmate refuses to dispose of the property in 30 days, the facility may send the item to a person on the inmate’s approved visiting list by commercial carrier at inmate’s expense. 4. Send the item out on a visit if allowed. Refer to Section VIII. 5. Donate the item per facility procedure. 6. Destroy the item. 7. Items that are contraband and pose a security concern may be disposed of immediately. X. Approved Property Items The following outlines approved personal property and the authorized limits. A. Electronic Equipment 1. General a. Upon verifying the unit is allowed, electronics shall be plugged in and tested to ensure they turn on prior to engraving. b. Units must be equipped with an earphone jack and headphones or ear buds must be used. c. Duplication of an electronic item is not allowed. d. Units with remote speakers or remote control devices are not allowed. e. Only clear plastic or translucent models are allowed. 2. Size Limits a. Television – Screen may not exceed 13 inches diagonally. b. Radio – 1000 cubic inches. Radio/TV combination – 18” x 18” x 18”, screen may not exceed 13 inches diagonally. Televisions Televisions that require a remote control for programming are not allowed. Radios/Clock Radios a. Limit one only. b. May have AM/FM capability only and AC/DC capability. c. Clock radios are allowed in minimum and medium security facilities only. Must have earphone jack. Headphones/ear buds a. Limited to one pair of each, per inmate. b. Maximum length of the cord is 12’ fully extended. c. Detachable cords are not allowed. d. Volume controls, power boosters and control boxes are not allowed. e. Radio headsets are not permitted. f. Only clear plastic models are permitted. Digital Converter Boxes a. Inmates shall be allowed to purchase only if housed at a facility which requires their use. Limit one (1). Facilities that require the use of converter boxes shall note this in their procedure. b. Inmates shall be allowed to retain clear units upon transfer to another facility until their release. c. Remote controlled units are not allowed. B. Jewelry 1. General a. All jewelry items, which because of shape or configuration are apt to cause a laceration if applied to the skin with force, shall not be allowed. b. Earrings, rings or other small ornaments (i.e., nose rings, nipple rings, etc.) that are affixed to holes pierced in the skin are not allowed. c. Refer to DAI Policy 309.61.02 for specifications and allowances of religious property. 2. Rings a. Only married or widowed inmates are allowed to wear a wedding ring. i. Married or widowed female inmates who have a wedding set consisting of an engagement and wedding ring shall be considered one ring. ii. The ring may be sent directly from the inmate’s family. iii. The maximum value of the wedding ring is $75.00. iv. Inmates are responsible to ensure that rings received do not exceed the established value. b. The stone (1) or gem (1) must be imbedded or recessed into the surface of the ring. Multiple stones are not allowed. c. Ring band, including the setting, shall not at its thickest part exceed 1/8”. d. The setting or object held by it shall not extend more than 1/16” beyond the adjacent surface of the band. Medical Alert Medallion or Bracelet a. The HSU shall determine and approve the wearing of the medical alert medallion and bracelet. It shall be worn at all times. b. The external boundary of a medallion shall: i. Be no larger than 1-1/4”. ii. Not be hollow or a the locket-type. iii. Have a maximum thickness of 1/8”. iv. Have a maximum weight of two oz. c. The lanyard used to attach the medallion around the neck: i. Shall not exceed 30” in total single strand length when measured from end to end. ii. Shall not exceed 1/8” total diameter. iii. Lanyard shall be plastic material similar to inmate ID lanyards. C. Personal Photographs 1. Personal photographs are restricted to a combined limit of fifty (50). 2. Personal photographs include images on single thickness film, digital photos and images reproduced utilizing a computer scanner and printer. 3. Photographs which have been digitally altered by changing the background or any other part of the photo are not allowed. 4. Photographs are required to be square or rectangular in shape. 5. Personal photos shall not require a DOC-237 to be completed. The number of photos shall be recorded on DOC-236 whenever an inventory is completed. 6. Multiple digital photos are permitted on an 8 ½ “x 11” standard sheet of paper (limit of eight sheets and each sheet shall count as one photo). 7. Self-developing double thickness Polaroid pictures are only allowed from DOC facility photo projects. 8. Possession upon transfer of Polaroid pictures taken by facilities providing a photo service shall be regulated by the receiving facility. 9. Security Threat Group-related photographs that include, but are not limited to; the display of gang related colors, signs, insignias etc., are not allowed. 10. Photos that pose a threat to facility security and/or the rehabilitative interests of the inmate are not permitted. 11. Personal photographs that include nudity, human excretion and sexual behavior as described in Wisconsin Administrative Code s. DOC 309.02 are not allowed. 13. Reproduced photos of family, relatives, friends or other personal photos are not considered commercially published photographs. 14. Commercially published photos are not allowed. 15. Laminated photographs and other laminated materials are not allowed. D. Typewriters 1. Limit one (1). 2. May not have a memory bank or be capable of storing text. 3. A spelling feature is permitted if changes cannot be programmed. 4. Separate printers or attachments are not permitted. E. Calculators 1. Limit one (1) solar powered or button type battery operated calculator is allowed. 2. Shall not have print out capability. 3. Shall not have extended memory storage capability. 4. Shall not exceed 5” x 7”. XI. Personal Clothing Requirements A. The color gray is defined as a light to medium shade of gray. No dark gray or charcoal gray is allowed. B. The following items are not permitted: 1. Clothing articles with pictures, writing, or appliqués on them. 2. Fur (real or fake). 3. Camouflage designed clothing. 4. Leather clothing – real or imitation (footwear and belts may be leather). 5. Clothing that is mesh or of see-through material. 6. Lycra/spandex-like material. 7. Any obscene material or objectionable printing or lettering. 8. Decorative cutouts or slits. 9. Clothing and footwear with inside/concealed pockets. 10. All clothing is expected to fit properly. Oversized or baggy clothing shall not be allowed. Undersized clothing which may be determined to be overly tight shall not be allowed. C. Trade names or trademarks are allowed on inmate clothing, but only products of legitimate manufacturers that incorporate their trade name or trademark on the garment in an unobtrusive manner are allowed. The trademark or logo shall not exceed 2" x 4." XI. Specifications The inmate clothing specifications listed below are for both male and female inmates unless otherwise noted. A. Shoes 1. Logo size limitations are not applicable to footwear. 2. Two (2) pair of shoes may be purchased or received in a calendar year. 3. Inmates shall be allowed to possess two pairs of personal shoes. These shoes may be athletic type shoes or boots. 4. Metal or non-metal spikes or cleats shall not be allowed. 5. Shoes must be of matching colors with the right and left foot the same (matching pairs). 6. No inside or concealed pockets or compartments. 7. Boots shall not exceed 14" in height, measuring from the bottom of the heel to the top at the side seam. 8. Clear plastic windows or compartments that can be visually inspected shall be allowed. 9. Heels a. Heels shall not exceed 2" in height. b. No spiked heels are allowed. 10. Metal Plates or Attachments a. Metal attachments including speed laces, D-rings, cleats, logos, or other decorative features are not allowed. b. Metal lace eyelets are allowed. c. Safety toe shoes allowed only in minimum security when required for work release or project crews. d. Metal arch supports manufactured in the sole of the shoe are allowed . 11. Pump athletic shoes are not allowed. 12. Shoestrings a. No multi-colored shoestrings are allowed. Shoestrings for a pair of shoes must match. b. One set of shoestrings for each pair of shoes is allowed. 13. Soles a. Soles may not exceed 1" in thickness. b. No removable soles. 14. Removable straps on footwear are not allowed. B. Belts and Belt Buckles – Males Only 1. Only allowed at facilities that allow blue jeans. 2. Studs, conches, beads or any other attachments shall not be affixed to belts. Tank tops are not allowed for females. c. Sleeveless T-shirts and tank tops shall only be worn as undergarments or for recreational purposes. d. Jersey style/half-shirts with 3/4 length sleeves are not allowed. 2. T-Shirts and tank tops shall be solid gray in color and shall not have pictures, pockets or writing. 3.
