[Rev 1010?} Investigative Report ASSIGNMENT On Saturday, June 30, 2007, at 6:16 pm. I was noti?ed by the Tampa Bay Regional Communications Center in Tampa, FL. of a motor vehicle crash with 2 con?rmed fatalities on State Road?25 (United States Highway-27), .4 mile north of the Highlands County line in Polk County, Florida. I arrived on the scene at 7:04 pm. Driver: V-l (Section 1) The driver of V-l was identi?ed as Brian Dale Andrews, D-l. D-l ?5 Florida class drivers? license was revoked on 11-02-2004, 5 years for driving under the in?uence. D-l license has an restriction for corrective lenses and no endorsements. It is unknown if D-l was wearing corrective lenses at the time of this crash. D-l was not utilizing the installed seat belt I shoulder harness safety devices at the time of this crash. This is evident by the fact that the seat belt shoulder harness was found in the retracted position with no scrapes, or scratches found on the seat belt fabric or latch plate. The supplemental restraint air bags were deployed as a result of this crash. There were no known permanent or temporary medical conditions that contributed to this crash. There were no environmental conditions, roadway conditions or obstructions that contributed to this crash. There were no known attitudes, or distractions at the time of this crash. D-I was familiar with the roadway, route, and vehicle operation. D-l was under the in?uence of alcoholic beverages at the time of this crash. D-l was airli?ed to Lakeland Regional Medical Center for treatment of injuries sustained in the crash. D-l was Operating a White 1992 Cadillac Eldorado 2 door. Driver: V-2 (Section 2) The driver of V-Z was Danny R. McCown, D-2. D-2 holds a valid Florida Class drivers? license with no restrictions or endorsements. D~l was utilizing the installed seat belt I shoulder harness restraint system at the time of this crash. This is evident by the fact that D-2 was cut free from the seat belt I shoulder harness system by emergency service personnel and the latch plate was still attached to the receiver at the time of this investigation. The driver side supplemental air bag restraint system deployed at the time of this crash. There were no known temporary or permanent physical defects that would have contributed to this crash. There were no known distractions, or attitudes on the part of 0-2 that would have contributed to this crash. No environmental conditions, roadway conditions, or visual conditions existed that would have contributed to this crash. There was no physical evidence to indicate that D-2 was under the in?uence of alcoholic beverages, or any other substances of abuse. D-2 was familiar with the roadway, route, and vehicle he was operating. D-2, Danny R. McCown sustained fatal injuries and expired on the scene of this crash. The right front seat passenger of V-2 was Patricia L. McCown, a white female. The right front seat passenger was wearing the installed seat belt shoulder harness system at the time of this crash. This is evident by the fact that it was still connected to the receiver and attached preperly at the time of this investigation. The right front supplemental restraint air bag deployed as a result of this crash. The right front seat passenger sustained fatal injuries due to the collision and expired on the scene. The driver of V-3 was Linda F. Gilliard, D-3. stated that she was utilizing the installed seat belt shoulder harness restraint at the time of this crash. There is no physical evidence to support or refute this statement. The supplemental restraint system (air bags) did not deploy as a result of this crash D-3 holds a valid Florida class drivers? license with no restrictions or endorsements. There were no known attitudes, distractions, temporary or permanent physical defects that contributed to this crash. There were no environmental conditions, roadway defects, or visual obstructions that contributed to this crash. There was no physical evidence to indicate that D-3 was under the in?uence of alcoholic beverages or any other substances of abuse at the time of this crash. denied any complaint of injury at the time of this investigation and received no medical attention on scene. D-3 was operating a blue 2007 Nissan Verga, 4 door. The right Front seat passenger of ?3 was Louise A. Grice, a white female. The right front seat passenger advised that at the time of this crash, she was utilizing the installed seat belt shoulder harness restraint system. There is no physical evidence to support or FHP 707-05-03] Page 5 Investigative Report refute this statement. The supplemental air bag restraint system did not deploy as a result of this crash. The right front seat passenger Louise A Grice denied any complaint of injury and did not require medical assistance at the time of this crash. INVESTIGATION I arrived on the scene and observed the southbound lanes of State Road-25 (United States Highway-27) had been closed by the Polk County Sheriffs Of?ce. V-l was observed on the west shoulder of the roadway facing in a southeasterly direction, and unoccupied. V-Z was located in the grass median between the north and southbound lanes of State Road- 25 facing in a northerly direction. I observed a white male, later identi?ed as 0-2 positioned on a medical back board beside V-Z, The right ?'ont passenger of V-2, a white female was still seat belted and entrapped in V-2. D-2 and the right front passenger of V- 2 had both been pronounced deceased by Polk County Emergency Medical Service. D-l had been airlifted by Life Net Medical Helicopter to Lakeland Regional Medical Center for treatment prior to my arrival. was observed south of the area of collision and stepped in the grass median facing in a southerly direction. D-3 and the right front seat passenger remained with V-3 during this investigation. I located, photographed, marked, and documented all available evidence on the scene at the time of this investigation. I met with Corporal J.W. Brook and gathered information on the identities of the drivers and information on injuries. Corporal Brock advised that V-I had been traveling north on State Road-25 prior to this crash and traveled across the grass median. V-2 had been traveling south on the inside lane of State Road-25. V-3 had also been traveling southbound on State Road-25 at the time of this crash. V-l crossed the median and struck the front of V-2 with the front of V-l. V-2 had then been pushed rearward in a northeasterly direction and rotated clockwise coming to ?nal rest in the grass median. The impact between V?l and V-Z caused V-l to rotate in a clockwise manner and continue off onto the west shoulder of State Road-25. Investigation revealed that V-3 was traveling behind V-Z at the time of this crash and skidded through the debris field from V-l and V-2. There was no physical evidence to indicate that V-l or V-2 made contact with V-3. FHP 707-05-031 Page 5 Investigative Report A zero point, which was used as a reference point for all measurements, was established at a place on the west edge line of the northbound lanes of State Road-25, 142 feet east, and 107 feet 2 inches north of utility pole The west edge line of the northbound lanes of State Road-25 was used as the reference line. V?l left rear wheel exited the roadway, and began matting down the grassy area of the median as it continued in a northwesterly direction for 417 feet 6 inches. The left front wheel exited into the grassy median 10 north of the left rear wheel and began a furrow that continued in a northwesterly direction for 447 feet. V-l right front wheel then exited the roadway and became a furrow as V-l began to rotate in a counter clockwise direction for 265 feet 6 inches as it traveled in a northwesterly direction. The right rear wheel of 1 exited the roadway into the grass median and became a furrow that traveled 265 feet 6 inches in a northwesterly direction. V-l then counter rotated in a clockwise manner as it entered into the southbound lanes of State Road-25. V-l left rear wheel became a scuff as it traveled in a northwesterly direction on the southbound inside lane of State Road-25 for 88 feet and terminated. The left front wheel entered the southbound lane and became a scuff that traveled in a northwesterly arcing direction for 42 feet 6 inches and terminated at the area of collision. The right front wheel made a scuff as it entered the southbound lanes and continued for 48 feet 10 inches and terminated at the area of collision where it became a gouge on the inside southbound lane of State Road-25 when the front of V-l struck the front of V-2. The area of collision was determined to be 554 feet north, and 46 feet west of the zero point where the right front wheel of Vail became a gouge on the inside southbound lane of State Road-25. V-l then began a clockwise rotation as it separated from the collision with V-Z. V-l left rear wheel made a scuff that arced in a northwesterly direction for 13 feet 4 inches and terminated as V-l continued to rotate. V- exited the roadway and came to ?nal rest 75 feet north, and 34 feet west of the area of collision, facing in a southerly direction. V-2 right front wheel made a skid prior to the area of collision that extended in a southerly direction on the inside southbound lane of State Road-25 for 32 feet 4 inches, and terminated at the area of collision where it became a gouge. The right front wheel of V-Z made a scuff mark that traveled in a northeasterly direction for 12 feet and exited the FHP Page 1 Investigative Report roadway into the median where it became a furrow. The furrow extended for 14 feet and terminated at ?nal rest. V-2 came to ?nal rest facing in a northerly direction 34 feet 8 inches north and 20 feet east of the area of collision. V-3 began to skid as it approached the area of collision. V-3 left side wheels skidded for 188 feet 6 inches, and the left side wheels skidded for 119 feet 9 inches and terminated. V-3 came to a controlled stop south of the area of collision in the grass median, facing in a southerly direction. A sworn taped witness interview of Jonathan L. Lang was conducted at the scene of the crash by Trooper L. Ali. Mr. Lang stated that prior to the crash he had entered State Road-25 ?'om County Line Road and was proceeding south. He stated that a white Cadillac. identi?ed as the defendants vehicle was also proceeding south and passed his vehicle nearly sideswiping him. Mr. Lang stated that he called 911 on his cellular phone and advised the 911 operator a drunk driver was traveling south. Mr. Lang stated that as he was giving the location the Cadillac made a U-turn in front of the Ridge Lounge and proceeded back northbound at a high rate of speed. Mr. Lang stated that approximately a quarter mile north of County Line Road he observed the Cadillac cross the grass median and strike a gray Chevrolet S.U.V. head-on. Mr. Lang then stated that he stopped his vehicle, exited and observed a lady and gentleman in the gray S.U.V. deceased. Mr. Lang further stated that he then observed the driver of the Cadillac exit the vehicle and appeared to run away from the scene. He further stated that the driver collapsed in the middle of the roadway where he remained until he was treated and airlifted by Medical Helicopter. Mr. Lang stated that no one else was in the vehicle. Mr. Lang further stated that the male subject he observed exit the vehicle was the same subject transported to Lakeland Regional Medical Center by heliCOpter. A sworn taped witness interview was conducted at the scene of the crash by Trooper L. Ali on witness Leslie Joiner. Ms. Joiner stated that she was traveling south on State Road-25 in the right lane. Ms. Joiner stated that she observed what was later identified as the Cadillac crossing the median. She further stated that she then observed a car in the air, and she began to stop and exit the roadway. Ms. Joiner stated that she then observed a man lying in the middle of the roadway. Ms. Joiner stated that she did not see anyone else FHP 707-05-031 Page 8 Investigative Report in the Cadillac. Ms. Joiner stated that she immediately called 911 to report the crash and approached the Chevrolet S.U.V. She stated that she observed the female passenger deceased and a male driver. She further stated that the man lying in the roadway was talking and trying to move. Again she stated that no one else was observed in the Cadillac. A sworn taped statement was obtained from the driver of V-3, Linda Gilliard at the crash scene by Trooper L. Ali. Linda Gilliard stated that she was traveling southbound on the inside lane of State Road-25. She stated that she observed a white vehicle traveling northbound cross the grass median in front of her vehicle. Linda Gilliard stated that she slammed on brakes and steered to the median to avoid it. Linda Gilliard later stated that the white car she observed was a Cadillac. No further information was available from Linda Gilliard. A sworn witness interview was obtained from the passenger of V-3, Louise Grice at the scene of the crash by Trooper L. Ali. Ms. Grice stated that they were traveling southbound and she observed a white car cross the grass median in front of their vehicle. No further information was gathered from this witness. On July 1, 2007 a post crash inspection was conducted on V-l at Tony and Sons Towing Service impound yard in Lake Wales. FL. The following damages were observed, documented, and photographed. The grill, headlights, and windshield were destroyed due to the collision with V4. The hood was buckled upward. The right fender was crushed rearward 14 inches due to the collision. The right post was buckled and twisted to the left 7 inches. The right side of the roof was buckled upward 8 inches. The right front door skin was peeled away, and the door frame pushed rearward 6 inches due to induced damage. The right quarter panel was buckled ?'om induced damage. The trunk lid was sprung rearward 6 inches due to induced damage. The left fender was shifted to the right 14 inches due to induced damage. The left front door was sprung forward 2 inches and buckled to the left. The left quarter panel was buckled from induced damage. The front bumper was torn off and the front valance on the right side was pushed rearward 15 inches due to colliding with The steering wheel of V-l was bowed forward. The left FHP 707-05-031 Page 9 Investigative Report front seat was twisted to the left and Sprung forward. No mechanical defects were found that would have caused or contributed to this crash. On July I, 2007, a post crash inspection was conducted on V-2 at Tony and Sons Towing Impound facility in Lake Wales, FL. The following damages were observed and documented, and photographed. The headlights, grill, and windshield was destroyed due to the collision. The front bumper cover was torn away. The bumper was crushed rearward 20 inches as a result of the collision with V4. The hood was crushed rearward 22 inches. The right fender was crushed rearward in an accordion manner 20 inches. The right front door was crushed rearward accordion style and had been pried Open by the Fire Department for extrication purposes. The right post was pushed rearward 12 inches: The right rear door was buckled outward 8 inches on the back edge. The roof was buckled upward 7 inches on the right side from induced damage. The right post was buckled and torn loose. The right quarter panel was buckled and the rear Opera glass was broken out. The frame was buckled to the left 6 inches. The right side dashboard was pushed rearward due to induced damage. The le? fender was crushed rearward 11 inches and twisted to the right 7 inches. The left front door was buckled. The steering wheel was pushed forward. The left front seat was sprung forward and twisted to the right. The dashboard was destroyed due to induced damage. The right front wheel and rim was pushed rearward due to the collision. No mechanical defects were found that would have contributed to or caused this crash. On June 30, 2007, a post crash inspection was conducted at the scene of the crash on V-3. The following damages were documented and photographed. A dent and scrapes were observed on the hood 12 inches left of the right corner and 12 inches rearward of the front due to colliding with debris ?'om V~l and V-2. No other damages were observed. The driver of V-l, Brian Dale Andrews was airlifted to Lakeland Regional Medical Center due to injuries sustained. Trooper Snell responded to the hospital to gather information on D-l .Upon arrival at the hospital Trooper J. Snell was directed by hospital personnel to treatment room A-1 and con?rmed that the patient had been transported to the facility by medical helicopter from the crash scene. Trooper Snell then conducted a driver?s license D.A.V.I.D. check and identi?ed the patient as Brian D. Andrews from the FHP 707-05-031 Page 1 Investigative Report driver?s license photograph. Trooper . Snell learned that a medical blood sample, obtained as medical procedure, by Lakeland Regional Medical Center indicated that D-l, Brian Dale Andrews blood alcohol level was .36 at the time of treatment. Trooper Snell attempted to speak to D-l, however D-l was unresponsive at the time. Trooper Snell then requested hospital personnel withdraw a legal blood sample from 0-1. Lakeland Regional Medical Center Nurse Danielle Delgiudice then obtained 2 vials of blood from the right arm of D-l, Brian Dale Andrews at 7:53 Trooper J. Snell packaged and sealed the samples, and transported the blood kit to the temporary storage facility at the Florida Highway Patrol station in Lakeland, FL. and deposited it a 9:40 pm. The legal blood sample from D-l was transferred to the Florida Department of Law Enforcement Crime Laboratory on July 3, 2007 by Lt. A. Carter. The blood sample analysis conducted by .D.L.E. crime lab. analyst Monica I. Fileger revealed that D-l ?3 blood alcohol content was .315 I .314 grams of ethyl alcohol per 100 milliliters of blood. On July 1, 2007, the Assistant District Ten Medical Examiner Doctor Vera V. Volnikh performed an autopsy on the driver of Danny R. McCown and stated the cause of death to be from blunt force trauma to the head as a result of a motor vehicle crash. No alcohol or any other substances of abuse were identi?ed in the blood. On July 1, 2007, the Assistant District Ten Medical Examiner Doctor Vera V. Volnikh performed an autopsy on the right ?'ont seat passenger of V-Z, Patricia L. McCown and stated the cause of death to be from blunt force trauma to the torso as a result of a motor vehicle crash. V-l crossed the grass median and struck V-Z, which was traveling south on the inside southbound lane of State Road-25 head-on. was redirected in a northeasterly direction as a result of the collision and came to ?nal rest in the grass median. V-l rotated in a clockwise manner after the collision and exited onto the west shoulder of southbound State Road-25, coming to ?nal rest facing in a southerly direction on the west shoulder. FHP 707-05-031 Page 3 1 Investigative Report D-l, Brian Dale Andrews, violated Florida State statute Manslaughter), (2 Counts), by driving or being in actual physical control of a vehicle within this state with a blood alcohol level of 0.08 or more grams of alcohol per 100 milliliters of blood, that resulted in the death of any human being. This violation resulted in the motor vehicle crash and death of 13-2, Danny R. McCown, and V-2 right front seat passenger, Patricia L. McCown. D-l, violated Florida State statute (Driving while license suspended I revoked) (2 Counts), by operating a motor vehicle upon the highways of this state while such license or privilege is suspended or revoked, and by which careless or negligent operation of the motor vehicle causes the death of another human being. This violation resulted in the motor vehicle crash and death of D-2, Danny R. McCown, and V-2 right front seat passenger, Patricia McCown. D?l, violated Florida State statute by driving or being in actual physical control of a vehicle within this state with a blood alcohol level of 0.08 or more grams of alcohol per 100 milliliters of blood, that resulted in damage to property of another. D?l, violated Florida State statute 316.1925 (Careless Driving), by operating a motor vehicle upon the streets or highways within the state without regard for the width, grade, curves, and all other attendant circumstances, so as not to endanger the life, limb, or property of any person.
