INVESTIGATIVE REPORT ASSIGNMENT On Friday, March 27, 2009, at 4:41 A.M., I was noti?ed of this crash by the Lake Worth Regional Communication Center. I arrived on scene Friday, March 27, 2009, at 5:14 AM. This crash was located on the southbound lanes of State Road 9 (1-95), south of State Road 870 (Commercial Boulevard), in Broward County. The crash was involving two motor vehicles that had collided head-on. One occupant was ejected and had been pronounced deceased on scene, four others had been transported to Broward General Medical Center. ROADWAY State Road 9 (1-95), consists of four asphalt paved southbound through lanes (12' inside, 12'2" inside center, 12? outside center, 12'7" outside). The travel lanes have an inside paved median and an outside paved shoulder At the time of the crash, it was nighttime. The street was lighted by overhead street lamps. The weather was mostly cloudy at the time of the crash with a temperature of 72 degrees Fahrenheit. Traf?c was light at the time of the crash. The roadway was not a factor in the causation of this crash. VEHICLE: V-l (SECTION 11 Vehicle-l: Section-l is a silver 2003, BMW Four Door Sedan, V.I.N. WBAGN63493DR19460, Florida Tag 474WBT. V-l contains an automatic transmission, hydraulic powered ABS brake system, and power assisted steering. Occupant: V-l: Driver Davydson DeOllveira Scares is a 31 year old male, who resides at 2011 West Atlantic Boulevard, Apartment 302, Pompano Beach, Florida 33069. At the time of the crash, was not utilizing the lapfshoulder restraint. D?l was familiar with the V-l and the route being taken. D-l sustained minor injuries as a result of this crash, and was transported to Broward General Medical Center. VEHICLE: V-2 (SECTION 2) Vehicle-2: Section-2 (V-Z), is a silver 2005, Ford F-350 Van, V.I.N. Florida Tag V-2 contains an automatic transmission, hydraulic powered ABS brake system, and power-assisted steering. Occupant: Driver Elba Marlene is a 39 year old female, who resides at 1901 Northwest South River Drive, Apartment 57, Miami, Florida 33125. D-2 possessed a valid Florida Class Operator's License at the time of the crash. At the time of the crash, D-2 was utilizing the lapfshoulder restraint. D-2 was en?route to her residence from West Palm Beach, Florida. D-2 was familiar with V-2 and the route being taken. D-2 sustained minor injuries as a result of this crash, and was transported to Broward General Medical Center. Occupant: V-Z: Front right seat passenger (0-1) Aracer Mendoza was a 23 year old female, who resided at 1960 Northwest Flagler Terrace, Aparhnent 2, Miami, Florida 33125. At the time of the crash, 0?1 was not utilizing the lapfshoulder restraint 0-1 sustained fatal injuries as a result of this crash. Occupant: v.2: Second row right seat passenger (0-2) Tonya Carrera is a 24 year old female, who resides at 1020 Northwest ti"1 Street, Miami, Florida 33136. At the time of the crash, 0-2 was not utilizing the lap/shoulder restraint. 0?2 sustained minor injuries as a result of this crash, and was transported to Browand General Medical Center. Case Number FHP 709-10-013 Page :3 INVESTIGATIVE REPORT Occupant: v.2: Third row right seat passenger (0-3) Ruby Castenerra is a 29 year old female, who resides at 3750 Southwest 94?h Avenue, Miami, Florida 33165. At the time of the crash, 0-3 was utilizing the lap/shoulder restraint. 0-3 sustained minor injuries as a result of this crash, and was transported to Broward General Medical Center. INVESTIGATION As I arrived, the scene had been secured and all southbon lanes of State Road 9 (1-95) were closed to vehicular traf?c. Florida Highway Patrol personnel and Broward County Sheriffs Department personnel were maintaining scene security. I conferred with Sergeant Ivan Sarrion Jr. and Trooper Paulo Pereira, concerning crash information they obtained prior to my anival. V-l was at ?nal rest facing in an easterly direction, straddling the inside center and outside center lanes. V-2 was at ?nal rest on its driver side, facing in a southeasterly direction, within the inside median. 0-1 was deceased and at ?nal rest in ?ont of V-2. D-2, 0?2, and 0-3 had been transported to Broward General Medical Center for medical treatment. While on scene, Trooper Paulo R. Pereira and Trooper Clifford F. Fisher made contact with D-l. Trooper Fisher stated he observed D-l being attended to by the paramedics on scene. D-l was identi?ed by his Brazilian Passport. Trooper Fisher stated was crying and had blood all over his body. D-l was complaining of pain to his right shoulder. Trooper Fisher stated he immediately smelled a strong odor of an alcoholic beverage emitting from his breath. He stated D-l had bloodshot wawry eyes and was unsteady on his feet. Trooper Pereira stated that D-I had a strong odor of alcoholic beverage emitting ?'orn his breath. Trooper Pereira stated D-l had watery eyes and a flushed face. He observed D-l with blood all over his torso and what appeared to be bum marks. Case Number FHP 709-1 9-013 Page 12 INVESTIGATIVE REPORT D-l was transported by ambulance to Broward General Medical Center. I photographed the scene and post crash evidence. Corporal Martin Hernandez, Jr. and I measured and recorded the scene utilizing a ?eld sketch and measurement record sheet. In order to document the scene, I established a Zero Point and Reference Line, from which all measurements were taken hunt. The Zero Point is the Median Support Pillar, for the ?yover ramp from eastbound State Road 870 (Commercial Boulevard), to southbound State Road 9 (I- 95). The Reference Line is the southbound State Road 9 (1-95) inside solid painted yellow line. V-l '5 left front headlight assembly was located within the inside lane, indicating V-l's direction of travel. This was measured at 47 feet, 11 inches south of the Zero Point and 9 feet, ?7 inches west of the Reference Line. Trooper Pereira stated, was leaning on the concrete barrier wall and bleeding while being treated by paramedics. The blood stain ?'om D-l was located on the median barrier concrete wall. This was measured at 64 feet, 5 inches south of the Zero Point and 8 feet, 4 inches east of the Reference Line. The rear left tire of V-l, indicating its point of ?nal rest was located and measured at 85 feet, 9 inches south of the Zero Point and 29 feet, 10 inches west of the Reference Line. The front left tire of Vsl, indicating its point of ?nal rest was located and measured at 88 feet, 4 inches south of the Zero Point and 19 feet, 2 inches west of the Reference Line. The rear right tire of V-l, indicating its point of ?nal rest was located and measured at 90 feet, 5 inches south of the Zero Point and 31 feet, 8 inches west. of the Reference Line. The hunt right tire of V-l, indicating its point of ?nal rest was located and measured at 93 feet, 3 inches south of the Zero Point and 24 feet, 2 inches west of the Reference Line. The beginning of a tire mark, le? by the braking of V-2's rear right tire was located and measured at 115 feet, 1 inch south of the Zero Point and 10 feet west of the Reference Line. The end of the rear right tire mark was located and measured at 119 feet, 5 inches south of the Zero Point and 9 feet, 8 inches west of the Reference Line. A tire mark, indicating V-2's rear left tire re-direction was located and measured at 119 feet, 5 inches south of the Zero Point and 2 feet, 9 inches west of the Reference Line. The beginning of a gouge, left by V?2's rear left rim, was located and measured at 124 feet, 6 inches south of the Zero Point and 1 foot, 5 inches west of the Reference Line. The end of the gouge mark left by V-2?s rear left rim was located and measured at 132 feet, 5 inches south of the Zero Point and at the Reference Line. The area of collision between, V-l and V-Z, was located and measured at 141 feet, 4 inches south of the Zero Point and 8 feet 4 inches west of the Reference Line. Scrape marks left by V-2's driver side roof edge, indicating the path of travel taken by V-2 as it slid on its drivers side, were located on the roadway and measured at 150 feet, 11 inches south of the Zero Point and 2 feet, 9 inches west of the Reference Line. A scrape mark was located on the concrete barrier wall indicating were V-Z's rear upper passenger side collided with the concrete barrier wall was located and measured at 158 feet, 8 inches south of the Zero Point and 9 feet, 3 inches west of the Reference Line. Scrape marks left by V-2?s left side were located and measured at 165 feet, 11 inches south of the Zero Point and 2 feet west of the Reference Line. Body ?uids indicating were 0-1 collided with the roadway, after being ejected, were located and measured at 182 feet, 6 inches south of the Zero Point and 1 foot, 5 inches east of the Reference Line. The beginning of a gouge left by V-2's left front rim was located and measured at 200 feet, 6 inches south of the Zero Point and 1 foot east of the Reference Line. The ending of the gouge left by V- 2's front le? rim was located and measured at 203 feet, 4 inches and 5 inches east of the Reference Line. The beginning of a gouge left by V-2's ?'ont left rim was located and measured at 205 feet, 6 inches south of the Zero Point and 6 inches west of the Reference Line. The ending of the gouge mark left by V-2's front left rim was located and measured at 212 feet, 6 inches south of the Zero Point and 11 inches east of the Reference Line. V-2?s front grill was located and measured at 213 feet, 4 inches south of the Zero Point and 3.5 feet, 1 inch west of the Reference Line. The ending of the gouge mark left by 2's undercarriage, on the concrete barrier wall, was located and measured at 213 feet, 4 inches south of the Zero Point and 12 feet, 2 inches west of the Reference Line. V-2's front right rim became detached from V-2 and was located and measured at 221 feet, 9 inches south of the Zero Point and 1 foot, 1 inch west of the Reference Line. V-2's rear left tire's ?nal rest was located and measured at 228 feet, 2 inches south of the Zero Point and 2 feet, 2 inches east of the Reference Line. V-2's ?-ont left tire's ?nal rest was located and measured at 238 feet, 6 inches south of the Zero Point and ?7 feet, 3 inches east of the Reference Line. O-l's ?nal rest was located and measured at 238 feet, 6 inches south of the Zero Point and 11 feet, ?7 inches east of the Reference Line. V-2's battery was detached and located within the left paved median. It was located and measured at 284 feet, 3 inches south of the Zero Point and 7 feet, 3 inches east of the Reference Line. Case Number FHP 709-10-013 Page 2 INVESTIGATIVE REPORT Corporal John E. Baker responded to the hospital and made contact with D-l. Upon his arrival Corporal Baker contacted D-1 and detected a strong odor of an alcoholic beverage emitting ?'om his breath. Corporal Baker requested a blood draw of D-l to determine his blood alcohol level. The ?rst blood draw was obtained at 5:54 AM. in the Trauma Room, at Broward General Medical Center (1600 South Andrews Avenue, Ft. Lauderdale, Florida 33316), by Trauma Room Paramedic Danielle Rousseau. On March 27, 2009, at 6:13 A.M., Corporal Baker took a digitally recorded statement of D-l. After being read his Constitutional Rights, D-l stated he understood. In the taped statement, D-1 stated he le? his house in a silver 2003, BMW Four Door sedan. at approximately 11:30 P.M. on 03i26/2009 to go to meet friends at a club who had called him. D-l stated he had stopped at an unidenti?ed club, (exact location and name is unknown), were he knew the manager and had one alcoholic drink. D-l stated that, he purchased a drink (at the unknown club) and left the club. After leaving there, D-l went to meet his friends at Automatic Slims (a night club located at 15 West Las Olas Riverfront, Ft. Lauderdale, Florida 33301). He arrived at Automatic Slims at approximately 12:30 AM. He went on to state he then consumed ?ve more drinks which were paid by his friend at Automatic Slims. He stated his friends name was "Ricardo". He stated Ricardo stayed at the club when he left. D-l also stated he and another friend (unknown name) walked to the car and then left. A?er Corporal Baker asked him again if he drove away, he stated, "1 don't remember". D-l stated he did not know what had happened at the crash. He stated he didn't remember getting out of the car. Case Number FHP 709-1 9-013 Page 19, INVESTIGATIVE REPORT A second blood draw was obtained at 6:45 AM. from D-l. Corporal Baker le? Broward General Medical Center and transported both blood kits the Broward Medical Examiner's Of?ce, Toxicology Section, (5301 Southwest 31" Avenue, Ft. Lauderdale, Florida 33312) to be analyzed. 0-1 was pronounced on the scene at 4:27 A.M., by Paramedic George Ginzo, of the Oakland Park Fire Department. Noti?cation to the family was delivered by Ervin Rios Estrada (victims roommate), on March 27, 2009, at 12:23 RM, to Aunner Mendoza (brother) in Nicaragua. On March 27, 2009, at 11:00 A.M., Louri Boiko, M.D., a pathologist at the Broward County Medical Examiners Of?ce, conducted a postmortem examination on (M. Dr. Boiko determined the cause of death to be from multiple blunt force injuries sustained in this crash. On March 27, 2009, at 12:00 P.M., Corporal Richard A. Nardiello completed a post crash inspection on V-l, at EMS Towing, 1800 West Sunrise Boulevard, Ft. lauderdale, Florida 33304. V-l sustained extensive crash to its right that end, with a maximum crush of 64 inches inward. The front right quarter panel was crushed. The ?oat right suspension system was torn and crushed. The engine compartment was compromised and crushed. The engine sustained crush damage. The hood was crushed rearward. The windshield was shattered. The right pillar was crushed inward, with a maximum crush of 32 inches. The pillar was crushed. The roof sustained crush damage. The front and rear door panels and the door frames, sustained crush damage. The right side ?ame sustained crush dmnage. The headlight assemblies, front grill and front bumper were crushed. The from right tire rim was crushed. The passenger side compartment sustained heavy damage. The driver side airbag was deployed. There. was Case Number FHP 709-10-013 Page 1; INVESTIGATIVE REPORT blood located on the rear left trunk lid, rear right trunk lid, rear center bumper, left pillar, rear le? quarter panel, rear le? door panel, rear le? door window, front left door ?ame, left pillar, drivers side passenger compartrnent, driver side airbag and driver side vents. The right side pillar, rear roof area and left front quarter panel sustained induced darnage. The driver's side door was offset due to induced damage. On March 27, 2009, at 1:15 P.M., Corporal Nardiello completed a post crash inspection on V-2, at EMS Towing, 1800 West Sunrise Boulevard, Ft. Lauderdale, Florida 33304. sustained heavy right front end crush damage. The front right quarter panel was crushed rearward The ?oat right bumper sustained crush damage. The front right suspension system was torn and crushed. The front right door was crushed. The rear light cargo doors were crushed. The right side and pillars were crushed. The roof was crushed. The engine compartment was compromised and crushed. The right side frame was crushed. The right side headlight assembly was crushed. The right side door ?'ames for the ?our passenger and cargo doors sustained crush damage. The right and le? pillar sustained crush from the concrete barrier wall. The lell side of the vehicle contained scratches from sliding on the asphalL There was blood located on the ?oat left hood area, front left bumper, right door panel, airbags and right side headliner. There was brain matter and tissue located on the right front undercarriage. The right cargo door, right side rear and rear cargo doors contained induced damage. On March 27, 2009, at 6:29 P.M., Corporal Baker conducted a sworn digitally recorded statement ?om witness, Carlton R. Bakley. The following is a synopsis of the recorded statement. Mr. Bakley stated that he was traveling eastbound on State Road 870 (Commercial 0 Case Number FHP 7?09-10-013 Page 1_ INVESTIGATIVE REPORT Boulevard). As he approached State Road 9 (1-95), Mr. Bakley observed lights and debris overhead on State Road 9 and thought it might have been a traf?c crash. Mr. Bakley proceeded to enter onto southbound State Road 9, via the southbound entrance ramp, from State Road 870. Mr. Bakley pulled into the safety apex at the end of the ramp and observed a vehicle crash. Mr. Bakley stated he observed a vehicle on its side and other various vehicles stopped on the roadway. Mr. Bakley observed people exiting the vehicle on its side. Mr. Bakley proceeded to the van on its side (V-2). Mr. Bakley stated he spoke with another "passer by" who had stated he had checked 0-1's pulse and could not ?nd one. Mr. Bakley assisted the other passengers from the van along the median because they appeared to be in shock from the crash Mr. Bakley stated he obser'Ved a Broward Sheriff's Of?ce Transport Van blocking the road from vehicular tra?c. at that time he observed V-l with extensive damage. Mr. Bakley stated he spoke with the Deputy Sheriff brie?y. As Mr. Bakley approached V?l, approximately ?ve minutes after arriving at the scene, he observed a man leaning against the concrete barrier wall. As patrol units ?'om the Florida Highway Patrol and other emergency vehicles arrived, Mr. Bakley approached the man leaning on the wall, who had no shirt Mr. Bakley asked D-l if he was the driver of V-l, as he pointed to V-l. D-l stated to Mr. Bakley, he was the driver. Mr. Bakley then asked D-l to move to the right because he was leaning against the wall and feared D-l might fall over onto State Road 870. Corporal Baker asked Mr. Bakley if he smelled an odor of alcohol coming ?'om D?l. Mr. Bakley stated he smelled what he believed to be alcohol coming from his breath. Mr. Bakley observed D?l had injuries to his right side of his body. Corporal Baker asked Mr. Bakley if D-l had mentioned of anyone else being in V-l, Mr. Bakley, stated Case Number FHP 709-1 0-013 Page INVESTIGATIVE REPORT Corporal Baker asked him if the photograph of D-l, that he had shown him, was the man he was talking to, Mr. Bakley stated "Yes". 011 April 01, 2009 at 11:27 I received the ?nal toxicology report, of D-l's blood draw, from the Broward Medical Examiners Of?ce. Toxicologist Nadra Nash performed the procedure. The ?nal toxicology report was completed by Toxicologist Michael Wagner, of the Broward County Medical Examiners Office. The toxicology report from the Medical Examiners Ol?cc indicated that had a blood alcohol level of 0.16g% on the ?rst blood kit and 0.15g% on the second blood kit. on April 3, 2009, I completed a search warrant af?davit and application for V-l. The warrant for evidence included but was not limited to blood, hair, ?ngerprints, clothing, biological samples, or any other trace elements of the driver and occupants was signed by Circuit Judge John J. Murphy, of the Seventeenth Judicial Circuit. On April 3, 2009, I obtained samples of D-l's blood (blood swatches), ?'om the Broward County Medical Examiners O?ice Toxicology Section, for DNA comparison. I turned over the blood swatches to Corporal Hernandez, for delivery to the Broward Sheri?'s Of?ce Crime Scene Lab. On April 08, 2009, Corporal Martin IIernandez, Jr., executed the vehicle search warrant on V-l, driven by V-l. Blood evidence was collected by Detective 'l?erry Gadis, ol? the Broward County Sheriffs Of?ce Crime Scene Unit. The evidence was recorded and submitted by Detective Gadis, to the Broward County Sheriffs Of?ce Crime Lab, for further testing. Corporal Hernandez, turned over the samples of D-l's blood (blood swatches), to Detective Gadis, to be Case Number FHP 709-10-013 Page 1_4_ REPORT submitted to the Broward County Sheriff's Of?ce Crime Lab for comparison with the blood evidence obtained from the execution of the vehicle search warrant. On April 13, 2009, Detective Gadis advised me, the results of D.N.A. test performed by the Broward County Sheriff's Of?ce Crime Lab, indicated a positive match between D-l's blood samples and the blood evidence collected from V-I's driver side air bag. On April 14, 2009, I completed a search warrant af?davit and application for oral swabs from D- 1 for a second DNA comparison to the blood evidence collected from V-l's airbag. The warrant was reviewed and signed by Circuit Judge William W. Haury, Jr., of the Seventeenth Judicial Circuit. The warrant was not executed due to 0-1 ?eeing and eluding from the authorities. On April 16, 2009, I completed an af?davit for the arrest of D-l. The arrest warrant was reviewed and signed by Circuit Judge Haury. I delivered the signed warrant to the Broward County Clerk of Courts for recording. After the warrant was recorded into the Broward County Clerks of Courts system, I delivered the warrant to the Broward County Sheriffs Of?ce, Warrants Division. The arrest warrant was entered into the data base on April 16, 2009. SUMMARY Vehicle 1 (V was traveling northbound in the southbound designated lanes of State Road 9 (I- 95). V-1 was traveling withinthe inside lane. Vehicle 2 (V-Z) was traveling southbound on State Road 9 (1-95) within the inside lane. Driver 2 (DZ) stated, as she crested the top of the overpass she observed a vehicle coming at her in the wrong direction. D-2 took evasive action to attempt to avoid a collision. D-2 applied V-2's brakes and steered to the le?. Driver did Case Number FHP 709-10-013 Page INVESTIGATIVE REPORT not take any evasive action prior to the collision. right ?'ont end collided with V-2's right front end within the inside lane. V-l rotated in a clockwise direction as it traveled across the inside center and into the outside center lane. V-l came to ?nal rest facing in an easterly direction, straddling the outside center and inside center lanes. V-2 rotated in a clockwise direction as it traveled in an easterly direction into the paved median. As V-Z traveled into the paved median it overturned onto its left side. 0-1 was ejected from V-2's right door, as it overturned. V-Z's left rear collided with the concrete barrier wall. V-2 continued to rotate as it traveled in a southerly direction within the inside paved median. O-l's body made contact with the paved asphalt surface ahead of V-2. V-2's undercarriage slid along side the concrete barrier wall. V-2 then rotated in a counter clockwise direction. V-2's front end collided with O-l's body, within the inside paved median. V-2 continued to travel southbound pushing O-l's body. V-2 came to ?nal rest facing in a southeasterly direction, on its left side, within the inside paved median. 0- 1's body ?nal rest was found in the supine position, in front of V-Z. Mr. Davydson DeOliveira Scares violated the following Florida State Statutes, 316.193 D.U.I. Manslaughter, which in part states: Any person who operates a motor vehicle with an unlawful blood alcohol level and by such operation causes or contributes to causing the death of any human being or unborn quick child commits DUI Manslaughter". 316.193 D.U.I. Serious Bodily Injury, which in part states: Any person who operates a motor vehicle with an unlaw?ll blood alcohol level and by such operation causes or contributes to causing the serious bodily injury to any human being commits DUI Serious Bodily Injury".
