PRESIDIO COUNTY OFFICE OFFENSE REPORT DATE 02-13-2016 16-066 Offense: Natural Death DAY: 02-13-2016 PLACE OF OFFENSE: Cibolo Creek Ranch COMPLAINANT: John Poindexter VICTIM: Antonin Scalia (DOB 03-11-1936) AGENCY REPORTED: Presidio County Sheriff?s Of?ce REPORTED TO: Sheriff Dominguez 011 02-13-2016 at approximately 12:14 P.M. the Presidio County Sheriff?s Of?ce in Marfa TX. advised me that a John Poindexter from the Cibolo Creek Ranch, 33 miles South of Marfa Tx. on U.S 6'7, wanted the US. Marshall Service phone number. I then advised the diSpatcher on duty to give him the San Antonio number. Then at 12:35 P.M. the Presidio County Sheri??s Of?ce called me again advising me that John Poindexter from the Cibolo Creek Ranch was on the line and was requesting to talk to me. I then accepted the call and was transferred to the caller Poindexter. He then advised me that he needed the number to the U.S.Marshall Service so he could report a death on his ranch. I then advised Poindexter that a death reported in Presidio County was under my jurisdiction and that it should be reported to my Of?ce. He then stated to me that this death was way beyond my authority and that it should go to the Feds (USMS). I then replied it doesn?t matter who it is, it was still under my jurisdiction. Poindexter still re?ised to give me the name of the deceased, so not to delay the call I advised Poindexter that would get him a ohone number of a USMS agent. and lhatI would have the agent call him. At approximately 12:41 pm. I attempted to call RAC (Resident Agent in Charge) out of Pecos, Tx Ken Roberts. Roberts didn?t answer but I left a message for him to call me back. At 12:44 RM. on 02?13?2016 Agent Roberts returned my call. I then advised him of 1 the situation and for him to call Poindexter back, and then to advise me of the call back. At approximately 12:50 RM. I called Roberts back. He then advised me that he and his agents were responding to the Cibolo Creek Ranch. I then advised Roberts that I would meet them there. I then got in my patrol vehicle and headed to the Cibolo Creek Ranch, and while in route I noti?ed my Chief Deputy Joel Nunez to contact the PCT 2 JP BishOp, and advise her of the death. Moments later Deputy Nunez noti?ed me that JP Bishop was out of town. I then contacted County Judge Guevara and advised her of the situation and if she could do an Inquest. Guevara responded yes she could. I advised her that when I arrived at the Cibolo Creek Ranch I would advise her of the situation and she responded ok. At approximately 1:35 RM on 02?13-2016 I arrived at the Cibolo Creek Ranch and was met by Ranch manager George Vanetten. He then escorted me inside and we were met by ranch owner John Poindexter and Allen Foster, a close friend of Scalia. Foster and Scalia had ?own in together the previous day, which was 02-12-2016. He then advised me of who the deceased was, which was Justice Supreme Court Judge Antonio Scalia. I then asked Poindexter what had happened. He stated that Scalia had arrived at the Cibolo Creek Ranch on 02-12-2016 for a weekend out to go hunting and visit the ranch. That evening they had supper and talked for a while. Then he said that Scalia had said that he was tired and was going to his room for the night. His friend Foster stated the same, as to what Poindexter had said. We then proceeded to the room where Scalia was found. Upon entering the room with Poindexter, Foster, and Vanetten, all seemed to be in order. Scalia was on the bed facing up, covered with bed sheets up to his chin. Scalia was laying on three pillows stacked up to elevate his head, and appeared to have fallen asleep in that position, indicating he died in that position as well. Both of Scalia?s hands were resting at his side. The top pillow case appeared to have shifted at some point in the night due to the v. eight of his head on the pillow, causing the pillow case to slide down and cover his eyes. The position of the pillow did not seem to have inhibited Scalia?s breathing. The sheets and pillows that were being used by Scalia were still in the creased position from that day?s room service, indicating that there was no struggle involved. A breathing apparatus was present on the table next to the lamp, on the left side of the bed. The hose for the machine was resting on the edge of the left side of the bed on the bed sheets. The breathing machine was switched off and the hose was not attached to Scalia. Personal items in the room included Sealia?a suitcase, which was Open. One shirt was outside of the suitcase, neatly folded and sitting next to the suitcase on the sofa. The remainder of his luggage was inside the suitcase, also neatly folded. Scalia had clothes hanging in the closet as well. A ?ashlight and pitcher of water with a glass were present on the table on the right side of the bed. The pitcher of water still had a napkin folded over the top. 0n the ork station table in the room, on the left side there was an orange cappen, a watch, and a bottle of water. On the recliner in the room, Scalia?s briefcase was laying on the seat of the chair, and the briefcase was closed. In the kitchen area of the room, there was a blue stretch band exercise device that had been placed on the counter. 2 His shaving kit was on the counter in the bathroom. Scalia?s shoes had been placed to the right of the bath tub. Nothing was out of place in the main room suite, the kitchenette area, or the bathroom area. I then advised County Judge Guevara of my situation, advising her of what I had observed and concluded, and after talking to her she said to get back with her ASAP. At approximately 1:51 P.M. on 02-13-2016, Judge Guevara returned my phone call and then at 1:52 P.M., she pronounced Scalia dead. A a short time later the U.S Marshall Service Agents arrived at my said location and were briefed on the situation. The Marshals then entered the room. After evaluating the situation, they contacted their supervisor, Ken Roberts. Roberts in turn then advised them to not allow anyone else inside the room until he arrived. After approximately an hour and a half, Roberts arrived at the scene. After evaluating the situation, Roberts contacted his supervisor in El Paso, who decided to depart El Paso via heliCOpter. The helicopter landed on the air strip at Cibolo Creek Ranch approximately one hour later. Roberts? supervisor evaluated the situation as well, and then noti?ed his superiors. By approximately 10:00 pm that night, the investigation had been on going for several hours. Marfa Sector Border Patrol Agents arrived on the scene that night to offer any assistance necessary. The FBI was contacted by the US Marshal Service in reference to Scalia?s death. However the FBI declined to get involved in the investigation, after hearing the report of the circumstances of the death from the US Marshals. US Marshals on scene decided to do an inventory of Scalia?s personal items. At approximately 11:30 pm the El Paso Funeral Home arrived at the ranch to retrieve Scalia?s body, and return to the funeral home. At approximately 12:00 am (midnight) the ?meral home departed the premises with Scalia?s body, along with the US Marshals and myself.
