STATE OF WISCONSIN CIRCUIT COURT WWNEBAGO COUNTY STATE OF WISCONSIN, Plaintiff vs. Case No. 09-CF-530 JUSTIN L. MIELKE, Defendant -. 20m 33/ This matter came to the court 5 attention on the defendant 5 ?ea?g'?burt 1e Remove Entries from CCAP System. A hearing on this matter was held on June 23, 2010, at which time the court entertained arguments of counsel. Having considered said arguments, the court grants in part, and denies in part, the motion. The court ?nds that the public interest in this particular case, in deleting the CCAP entries herein, outweighs the public?s interest in access to the same information. Speci?cally, the court ?nds that there is a real danger employers are using information found in the system in this case as a basis to deny the defendant employment, despite prohibitions found in the Wisconsin Statutes against employment discrimination based on mere arrests. WHEREFORE, IT IS HEREBY ORDERED that: 1. That portion of the motion requesting that the court ?le be sealed in this case is denied; 2. That portion of the motion requesting that the CCAP entries in this case be removed and deleted from the system is granted. Therefore, the clerk is ordered to delete from the CCAP system the defendant?s name and all entries associated with Case No. 09-CF-530. The court understands that the case number itself will remain in the system. Dated this Q1 day of 314 .2010. BY THE COURT: war";- The Hon. Barbara Key?
