The Corrective Action Plan included with the lWritten Warning is enclosed and is a part of this Notice. An unannounced visit will be made by a Child Abuse/Neglect Consultant to verify compliance with the Corrective Action Plan. Documentation to support compliance with the Corrective Action Plan is required. Unless otherwise noted, compliance with the Corrective Action Plan shall occur within two weeks after this Notice is received. Failure to comply with the Corrective Action Plan could result in further administrative action up to and including revocation and the assessment of a Civil Penalty up to five hundred dollars ($500.00) as authorized by Child Care Rules 10A NCAC 0'9 .l904(d) and Training required in tile Corrective Action Plan not be caicuittied as part of an empioyee?s turn uni its-service training hours. BASIS FOR ACTION- On August 12, 2005, a Child Abusez?Neglect Consultant of the Division of Child Development visited Tabernacle Christian Day Care to investigate a report alleging child neglect. On September 8, 2005, the Division of Child Development received written noti?cation from Union County Detiartment of Social Services that child neglect was substantiated at the conclusion of that agency's investigation of the report. The substantiation is based on inappropriate discipline of an eleven-year?old child by the center director. A substantiation of child neglect in a child care facility is a violation of North Carolina General Statute 1 The investigation determined that on August 10, 2005, Scott Couick, the center director, spanked an eleven-year-old child with a wooden paddle because the child spit in another child?s face. Mr. Couick gave the child ??ve licks? with the paddle, which is a piece of wood about twelve inches long, two inches wide and one half inch thick. The paddle does not have a handle. Mr. Couick said that he gripped the end of the piece of wood when he spanked the child. An adult witness was in the room when Mr. Couick Spanked the child. Mr. Couick called the child to the office and explained why the child was getting a spanking. Mr. Couick got down on his knees and asked the child to lay down ?at on the ?oor on his stomach in front of him. After each strike of the paddle, Mr. Couick talked to the child about his behavior. After the second strike the child began crying and said he would not do it again. After the punishment, he and the child prayed together. The investigation determined that bruises, resembling the size and shape of the paddle, were left on the child?s buttocks as a result of the spanking, a violation of North Carolina General Statute 10-91(10) regarding discipline of children.
