AFFIDAVIT

Affiant, Arthur Paul Roche, being duly sworn states as follows:
employed as a Special Agent with the Federal Bureau of lnvestigation (FBt)
since April 25,7999.1 am currently assigned to the Mobile (Alabama) Division. I am authorized
to investigate violations of Federal Law, including Title 18 U.S.C.2252 (a)(2)(e) Receipt of Child
I have been

Pornography. Prior to my employment with the FBl, I was a U.S. Army Officer in the Military
Police Corps for five years.
This Affidavit is made in support of an Application for a Federal Complaint against

Jeremiah Hunter for violations of Title 18 U.S.C. 2252 (a)(2Xn) Receipt of Child Pornography,
which is defined as any person who knowingly receives any visual depiction using any means or
facility of interstate or foreign commerce if the production of such visual depiction involves the
use of a minor engaging in sexually explicit conduct. For reasons I will detail below, I believe

that Jeremiah Hunter is involved in violations of Federal Law.
Jeremiah Hunter is an 8th grade teacher at Hankins Middle School in Theodore, AL and is

ofthe cheer-leading team there.

2hBl2OI6, a state search warrant
was executed by the Mobile County Sheriff's Office (MCSO) at the residence of leremiah Hunter
located at 6152 Magnolia Trace North, Theodore, AL 36582. Hunter was arrested by MCSO
also the coach

On Thursday

Deputies at his residence prior to the start of the search. Hunter was arrested on state charges
of Stalking 2nd Degree, Alabama Code Section 134-6-90.1. The property to be searched listed
on the warrant included electronic devices such as cellular telephone and computers.
The MCSO case involved a 16 year old victim who was a former student of Hunter's.
Hunter was advised of his Miranda rights and made a statement to MCSO investigators
subsequent to his arrest. Hunter also agreed to give MCSO investigators consent to search the
electronic items taken from his home during the search warrant (an iPhone6S, an ipad Mini,
and a Sony Vaio Laptop computer). Hunter provided the pass code for the iPhone6S and the
iPad Mini. The pass code for the iPhone6S was "O9O499" which matched the date of birth for
the juvenile victim in the stalking case. The pass code for the iPad Mini was "0904" which
matched the month and day of the juvenile victim's birthday in the stalking case. Aframed
picture ofthe juvenile victim was found during the search warrant on the night stand next to

Hunte/s bed.
On Friday 2/19/2016, MCSO contacted the Affiant regarding what they had found while

reviewing the contents of Hunters iPhone6s. lt appeared that Hunter was having a sexual text
message conversation with another student and was receiving naked pictures from that
student via text message. Th e MCSo obta ined a secon d state search warrant to review the
contents of the electronic items seized during the first search warrant. The text conversation

took place on L/7312016 between Hunter and CHILD #1 (who has been identified as a 13 year
old 8th grade student at Hankins Middle School). During the text conversation CH ILD #1 sends
Hunter several pictures of naked and partially naked males. The images were received through
text messages on a cellular telephone which is an instrumentality of interstate commerce. The
pictures and descriptions are as follows:
-three pictures sent at 2147:24 PM on L/1312016. Each of these pictures show a
nude male with an erection. The face of the male is not shown in the pictures. During the text
conversation CHILD #1 tells Hunter that these pictures are of CHILD #2.
-one picture sent at 7:30:14 PM on t/73/2OL6. lt is a picture of an erect male
penis being held by a hand. ln the back grou nd of the pictu re you can see part of a toilet and

the edge of a bathtub. During the text conversation CHILD #1 tells Hunter that this picture

is

of

-one picture sent at 7:47:35 PM on U73/2O76. lt is a picture of a nude male
sitting in a bathtub holding his penis. You cannot see the male's face in the picture. During the

text conversation CHILD #1 tells Hunter that this

is CHILD #4.

-one picture sent at 7:54:02 PM on 1/13/2016. lt is a picture of a shirtless male
wearin8 under armor underwear and holding his genital area. You cannot see the male's face in
the picture. ln the background ofthe picture you can see a shower curtain with a circle pattern
on it. During the text conversation CHILD #1 tells Hunter that this is picture is of CHILD #3.
-one picture sent at 7:54:33 PM on Lh3/2O15. lt is a picture of a nude male with
an erection holding his penis with his right hand. ln the background of the picture you can see a
shower curtain with a circle pattern on it. You cannot see the male's face in the picture. During
the text conversation CHILD #1 tells Hunter that this is picture is of CHILD #3.
-one picture sent at 8:02:52 PM on U73/2O76. lt is a picture of a nude male in a
bathtub. You can see the male's face in this picture.

-one picture sent at 8:03:47 PM on 7/73/2076. lt is the same picture that was
sent at 8:02:53 PM. lt is a picture of a nude male in a bathtub. You can see the male's face in
this picture.
-one picture sent at 8:04:27 PM on

During the text conversation with CHILD #1, Hunter tells him to get more pictures and
specifically asks CHILD #1 to get pictures of CHILD #5. Hunter also tells CHIILD #1 that CHILD #6
had showed Hunter a video of him masturbating.
The MCSO also found other text messages between Jeremiah Hunter and another 8th

grade student at Hankins Middle School in Theodore, AL, identified her as CHILD #7. During one
text conversation that took place on 2h6/2O16 at 6:13:02 PM Hunter tells CHILD #7 that he is
not texting because CHILD #7's mother probably reads his texts.
On Monday 2/22/2016, the Affiant, along with Special Agent George Glaser FBl,

interviewed Jeremiah Hunter at his residence. Hunter was advised ofthe nature ofthe
interview and that he was not under arrest. Hunter voluntarily spoke with the agents. Also
present during the interview was Hunter's mother, Mary Ellen Hunter.
Hunter admitted that it was him that had conducted the text conversations with both
CHILD #1 and CHILD #7. Hunter was shown printouts ofthe 10 pictures sent to him by CHILD #1
on l/L3/2Ot6. Hunter recognized those pictures as the ones he had received from CHILD #1.
Hunter stated that in two ofthe pictures he recognized the male as CHILD #4 (these were the
pictures sent at 8:03:47 PM and 8:04:27 PM on 7/73/2016; where you can see the male's face
in the picture). Hunter stated that CHILD #4 is a freshman at Theodore High School. Subsequent

investigation by SA Roche has found that CHILD #4 is currently 14 years old.
Hunter about the names that appeared in the text conversation with
CHILD #1. Hunter stated that CHILD #2 is a 7th grade student at Hankins Middle School. The
three pictures sent by CHILD #1 to Hunter at 2:47124 PM on 7h3/2O76 were said to be of
SA Roche asked

Hunter stated that CHILD #5 (the person Hunter had asked CHILD #1 to obtain pictures
of) is a 9th grade student at Theodore High School. Subsequent investigation by SA Roche has

found that CHILD #5 is currently 14 years old.
Hunter admitted that CHILD #6 had shown Hunter a video of himself masturbating.
CHILD #6 is a 9th grade student at Theodore High School.
Subsequent investigation by SA Roche identified another juvenile male that was in three
ofthe pictures sent to Hunter by CHILD #1. These pictures are the ones sent on 1/13/2016 at
7:30:14 PM (lt is a picture ofan erect male penis being held by a hand. ln the back ground of

the picture you can see part of a toilet and the edge of a bathtub), at 7:54:02 PM (lt is a picture
of a shirtless male wearing under armor underwear and holding his genital area. You cannot see
the male's face in the picture. ln the background of the picture you can see a shower curtain
with a circle pattern on it), and at 7:54:33 PM (lt is a picture of a nude male with an erection

holding his penis with his right hand. ln the background of the picture you can see a shower
curtain with a circle pattern on it. You cannot see the male's face in the picture). These three
pictures are of CHILD #3. CHILD #3 is an 8th grade student at Hankins Middle School. CHILD #3 is
currently 14 years old. On FridaV 2126/2016, the Affiant, along with Sergeant (SGT) Keith Miller
MCSO, interviewed the father of CHILD #3 at

their residence in Moblle, AL. The father
identified his son, CHILD #3, as the person who was in the pictures. The father also allowed the
Affiant and SGT Miller to view the bathroom in the residence and take photos ofthe bathroom.
The shower curtain in the bathroom is the same one as in the pictures that were sent to
Hunter. The toilet and edge of the bathtub were also the same as in the picture that was sent to
Hu

nter.
Based upon all the information set

forth in this affidavit, the Affiant respectfully submits

that there is probable cause to believe that Jeremiah Hunter violated Title 18 U.S.C. 2252
(aXZXn) Receipt of Child Pornography, which is defined as any person who knowingly receives
any visual depiction using any means or facility of interstate or foreign commerce if the

production of such visual depiction involves the use of a minor engaging in sexually explicit
conduct. ln consideration of the foregoing the Affiant respectfully requests that this Court
issue a criminal complaint charging Jeremiah Hunter of violating Title 18 U.S.C. 2252 (al(zl(Al
