Davon Lymon, a convicted felon, is accused of fatally shooting APD Of?cer Daniel Webster after a traf?c stop on October 21, 2015. Lymon previously served a 10-year prison sentence after being convicted for fatally shooting an Albuquerque man. Since his 2011 release, Lymon has been accused of several violent and illegal activities involving drugs, ?rearms and ?eeing law enforcement. According to news reports and court documents, Davon Lymon allegedly sold heroin to an undercover ATF agent on September 11, 2015 and allegedly sold additional heroin and a ?rearm to an undercover ATF agent on October 2, 2015. It appears that ATF agents did not arrest Lymon a?er his alleged narcotics and ?rearm sales. I understand that it takes time to build a case on suspected criminals, however I am sure that you can understand the community?s concern that Lymon was not arrested sooner, especially considering his violent history and the threat he posed to the public. Can you please answer the following questions about undercover operations? I Does ATF share information regarding its undercover operations with state and local police departments? 0 Does ATF have written guidelines on when to arrest a suspected criminal during undercover Operations? If so, can you please provide those documents? 0 Does ATF consider how potentially dangerous or violent a suspected criminal is when determining when to arrest a suspected criminal during undercover operations?
