Communication Center of a fatal traf?c crash that occurred on northbound Interstate 95 (State Road 9A) 'at the overpass of Northwest 103"(1 Street in Miami-Dade County, Florida. The traf?c crash occurred at approximately 4:57 am. and I arrived on scene at 6:07 and. The crash involved a motor vehicle in tranSport colliding with ?ve pedestrians and a parked vehicle. The crash resulted in ?Ve fatalities and two incapacitating injuries. ROADWAY I State Road 9A is a twelve lane roadway with six northbound travel lanes and six southbound travel lanes. The north and southbound lanes are divided by a concrete barrier wall. The northbound lanes are bordered by a nine feet six inches wide concrete paved shoulder on the outside and an eight feet one inch wide concrete paved shoulder on the inside. The northbound lanes are ?irther divided by a row of plastic poles (delineators) separating the two inside express lanes from the four (4) outside general purpose lanes. The plastic poles are bordered on the east and west side by a solid white line. The northbound travel lanes inside edge line is a solid yellow painted striped line and the outside edge line is a solid white painted striped line. Broken white painted striped lines are used for lane division. The roadway has a negative two percent grade and a zero percent super elevation. The roadway has a posted speed limit of ?fty-?ve miles per hour. The street lights were on and operational at the time of the crash. The roadway and traf?c control device were not a factor in the causation of this traf?c crash. State Road 9A mainly travels in a north/south direction in Miami-Dade County, Florida. DRIVERNEHICLE Vehicle: V?l: V-l is a gray 2010 4-door Honda Accord. V-l has a Florida tag of XSSINJ assigned and attached to the vehicle and has a vehicle identi?cation number of 1AA176073. V-l has an automatic transmission. V-l is equipped with power assisted brakes and steering. V-l is equipped with a three point occupant restraint system in the form of a seatbelt and shoulder harness. V?l is equipped with driver and passenger side airbags that deployed as a result of the crash. Occupant: V-l: Driver D?l, Carlos Augusto Lacayo is a twenty?three year old white Hispanic male born on March 26, 1987 and he resides at 600 NW. 32"d Place #312 Miami, Florida 33125. D-l has a valid Florida Class (Operator) Driver License (1 - with no restrictions or endorsements. D-1 was wearing his seatbelt at the time of the crash. It is not known whether D-1 had any medical or mental conditions that would have contributed to the causation of this crash. D?l was familiar with the vehicle. It is not known if D-l was familiar with the area or the route. There was a single vehicle obstructing the left lane and left shoulder of the northbound express lanes facing in a southwesterly direction that was involved in a crash earlier (See case D-l was leaving a club located in the City of Miami (exact - address is unknown) and was driving to 1650 NE 135 Street in North Miami to dr0p off his passenger, Percival Russell at his residence. 'D-l sustained incapacitating injuries as a result of the crash. Case Number FHP 711-01-019 PAGE {3 kw INVESTIGATIVE REPORT w) Occupant V-l: Front Right 0-11: 0-1, Percival Anthony Russell 12:. is a twenty?six year old black male born on May 10, 1984 and he resides at 1650 NE. 135Lh Street #704 North Miami, Florida 33181. 0-1 was seated in the ?oat right seat of 0-1 was wearing his seatbelt and the passenger side airbag deployed at the time of the collision. 0-1 sustained incapacitating injuries as a result of the crash. PEDESTRIAN Pedestrian: P-1: P-1, Antuan Fernandez Perez is a twenty-two year old white Hispanic male born on May 1988 and he resides at 185 NW. 133? Avenue #229 Florida 33125. P-l has no known permanent illnesses or deformities. P?l was standing on the left shoulder of the express lanes on northbound State Road 9A after being involved in a three car accident on the left lane of the general purpose lanes (see case FHPBI 10FF012318). P-l was then struck by 13.1 after leaving his Vehicle and sustained fatal injuries as a result of the crash. P-l was pronounced on scene by Miami-Dede Fire Rescue. Pedestrian: Emerson Michael Kastenholz is a ?verity-three year old white male born on September 1987 and he resides at 4935 Waverly Woods Terrace, Lake Worth, Florida 33463. P-2 has no known permanent illnesses or deformities. was standing on the left shoulder of the express lanes on northbound State Road 9A after being involved in a three car accident on the left lane of the general purpose lanes (see case FHPEI 10FF012318). P-2 was then struck by 13-1 after leaving his vehicle and sustained fatal injuries as a result of the crash. P-2 was pronounced on scene by Miami Dade Fire Rescue. P-3 was then struck by Di after leaving his vehicle and sustained fatal injuries as a result of the crash. P-3 was pronounced on scene by Miami-Dads Fire Rescue. Pedestrian: P-4: Evidia Rodriguez is a ?fty-seven year old white HiSpanic female born on September 15?, 1953 and she resides at 6779-SW 25th Terrace, Miami, Florida 33155. P-4 was standing on the left shoulder of the express lanes on northbound State Road 9A after being involved in a three car accident on the left lane of the general purpose lanes (see case FHPEI 10FF012318). P-4 was then struck by D-l after leaving her'vehicle and sustained fatal injuries as a result of the crash. .P-4 was pronounced on scene by Miami-Dado Fire Rescue. - Pedestrian: Ana Belkis Gomez is a thirty-eight year old white Hispanic female born on May 1972 and she resides at 3357 sw 137?h Avenue Miami, Florida 33133. P-S was standing on the left shoulder of the express lanes on northbound State Road 9A after being involved in a three car accident on the left lane of the general purpose lanes (see case FHPEI 10FF012318). P-5 was then struck by D-l after leaving her vehicle. INVESTIGATION On Saturday, March 2011 at 5:28 I was noti?ed by the Marni Regional Center of a fatal traf?c crash that occurred on northbound State Road 9A at approximately Northwest 103rd Street. On my arrival, I observed dismembered bodies and lower extremities scattered on the scene. I observed V-l and on the left shoulder of northbound State Road 9A in the express lanes. was facing in a southeastern direction on the left shoulder in the express lanes with extensive rear end damage, bodily ?uids and body tissue attached. V?l was facing in a northern direction on the left shoulder with its right front and tire against the right ?oat tire of V-Z. To conduct measurements of the scene, a zero point and a reference line were established. The zero point was identi?ed as a laterally extended point on the reference line extending twenty-nine feet seven inches east of the concrete barrier wall at the southern separation (gap) point 95N8.3. The reference line is de?ned as the ?rst White outside edge line of the northbound express lane. V?l was traveling north on State Road 9A in the outside express lane. V-l had just passed a red Kia Optima that was disabled from a previous single vehicle crash and facing a southwesterly direction blocking the left shoulder and partially the left lane of the express lanes. The red Kja?s left rear tire was located thirty-four feet one inch north of the zero point and sixteen feet one inch west of the reference line. V?l veered sharply to the left after passing the red Kia and traveled across the inside express lane. This is Case Number FHP 711=01~019 PAGE INVESTIGATIVE REPORT supported by the start of the left front tire yaw mark located one hundred fifteen feet nine inches north of the zero point and twelve feet six inches west of the reference line. This mark ends two hundred ??y~four feet three inches north of the zero point and thirty feet one inch west of the reference line. This is also supported by the start of the right front tire yaw mark located one hundred thirty~two feet eight inches north of the zero point and eight feet eleven inches west of the reference line. This mark ends two hundred sixty feet eleven inches north of the zero point and twenty-?ve feet eight inches west of the reference line. This is also supported by the start of the right rear tire yaw mark located one hundred forty-six feet ten inches north of the zero point and seven feet eleven inches west of the reference line. This mark ends two hundred ?fty?eight feet ten inches north of the zero point and twenty~one feet ten inches west of the reference line. V?l then crashes into P-1, P-3, P-4, and and pins them between the concrete barrier wall and the left front end of V-l. This is supported by the start of the blood and fabric marks on the concrete barrier wall starting two hundred tidy-eight feet ten inches north of the zero point and thirty feet two inches west of the reference line. This is also supported by the blood and bodily ?uid that was observed on the left front end and left side of V?l on scene photographs. Blood splatter marks can be seen on the entire left side of V-l. The front end of V-l then collided with the left rear end of crushing the ?ve pedestrians between the vehicles. This is supported by the maximum engagement marks on the left shoulder located two hundred sixty-nine feet north of the zero point and twenty-six feet four inches west of the reference line. This is also supported by the crush damage sustained on the rear end of and the dismembered remain of a severed extremity of Case Number FHP 711-01-019 PAGE INVESTIGATIVE REPORT one of the pedestrians that was embedded in the left rear quarter panel of V-Z. V-Z was pushed forward while rotating in a counter clockwise direction, entering the left lane of the express lanes. This is supported by the start of the left rear post-crash skid marks of V-2 located two hundred seventy-two feet one inch north of the zero point and twenty- three feet ten inches west of the reference line.? This mark ends where came to ?nal rest facing a southeasterly direction. came to ?nal rest four hundred thirty-nine feet six inches north of the zero point and twenty~seven feet four inches west of the reference line. V?l skidded to a stop to final rest. This is supported by the crushed front end of 1 that prevented the Wheels from rolling and the post~crash skid mark of V-l starting two hundred sixty-nine feet north of the zero point and tWenty-six feet four inches west of the reference line. This skid mark ends four hundred twenty?nine feet one inch north of the zero point and twenty?seven feet seven inches west of the reference line. The ?rst pedestrian came to ?nal rest two hundred eighty-four feet seven inches north of the zero point and twentyeeven feet ten inches west of the reference line on the left shoulder of the northbound express lanes. The second pedestrian was launched airborne over the concrete barrier wall and came to ?nal rest three hundred forty feet two inches north of the zero point and thirty-seven feet four inches west of the reference line on the left shoulder of the southbound express lanes. The third pedestrian was also launched over the concrete barrier wall and came to ?nal rest four hundred forty-one feet nine inches north of the zero point and forty?three feet six inches west of the reference line in the left lane of the southbound express lanes. The fourth pedestrian was launched over the Case Number FHP 71 1-01-1319 PAGE 1_0 INVESTIGATIVE REPORT concrete barrier wall and came to ?nal rest ?ve hundred seventy?six feet one inch north of the zero point twenty?four feet four inches west of the reference line. was transported to Jackson Memorial Trauma Center. P-S was pronounced at Jackson Memorial Hospital on March 116?, 2011 at 9:26 pm. by Dr. Edward Lineen. An antepsy was perfonned on P-3. and P-4 by Jay Radtke M.D., of the Miami~ Dade County Medical Examiner Department. It was determined that P-2, and P-4 expired due to multiple blunt force injuries. autopsy was performed on P-5 by Dr. Kenneth Hutchins, MD. of the Miami-Dade County Medical Examiner Department. It was determined that expired due to complications of blunt injuries. DI and 0-1 were extracted ?om V-l by Mann-Dada County Fire Rescue and h'anSported to Jackson Memorial Hospital. Trooper Amaranto' Cabrera arrived at the hospital shortly afterwards and determined that there was probable cause believe that D-l may have been impaired. Trooper Cabrera had a nurse draw two separate blood samples one hear apart. The first sample was collected at 9:50 am. and the second sample was collected at 10:50 am. The toxicology report of the blood sample of 13-1 states that at 9:50 am, the blood alcohol level was 0.127g/100ml. The toxicology report of the blood sample ofD?l states that at 10:50 the blood alcohol level was 0.1079100 ml. On Saturday March 2011, I conducted a sworn digital recorded interview with witness Clayton Fountain. Mr. Fountain stated that he saw V-l losing control and swerve towards the wall where P-l, P-3, P-4, and P-S were standing. Mr. Fountain stated that they were standing and leaning behind against the wall because they were involved in an accident earlier. Mr. Fountain then stated that V-l slammed into the Case Number FHP 711-01-019 PAGE 11 INVESTIGATIVE REPORT pedestrians and the rear of Mr. Fountain stated that he stopped against the wall on the left shoulder after crashing into the red Kla. Mr. Fountain stated that he believes V-l lost control because he was speeding. Mr. Fountain stated that he believes that V?l originated from the general purpose lanes and not the express lanes. Mr. Fountain stated that he saw two occupants extracted from V-l by Miami-Dede Fire Rescue and although he doesn?t recall what the driver looks like, he recalls that the second person removed from V?l was a. white male. He did not see the ?rst person being removed from V?l whom he identi?ed as the driver. On Saturday, March 2011, I conducted a sworn digital recorded interview with Lieutenant Gregory Roberts of the Miami-Dede Fire Rescue. Lt. Roberts stated that he was in charge of the extrication of the two occupants from V?l. He described D-l as a short white Latin male with a blue shirt and he described P-l as a heavy set larger black male with bluejeans and a dark gray shirt. No one else was present in V-l. On Saturday, March 2011, I conducted a sworn digital recorded interview with Ivo Garcia?Gonzalez. Mr. Garcia stated that he did not see any lights visible on the red Kia. Mr. Garcia stated that he struck the red Kia and stopped his car. Then three cars crashed into his rear. Mr. Garcia does not recall where V-l originated from or where V-Z was prior to the crash. Mr. Garcia does not recall how many occupants were in Mr. Garcia recalls a collision, but does not recall the positions of the cars prior to the crash. On Saunday, March 2011, I conducted a sworn digital recorded interview with Lloyd Gordon. Mr. Gordon who is employed as a Road Ranger on State Road 9A stated that he was stopped in the le? travel lane of the ?general purpose? lanes with the Arrow board Case Number FHP 711?01-019 PAGE 13 INVESTIGATIVE REPORT and ?ashing warning lights diSplayed to alert approaching traffic item the rear of an existing hazard ahead. Mr. Gordon stated that the warning lights were displayed on the roof of truck. Mr. Gordon stated that when he arrived on scene, he saw a red Kia blocking the left lane and the left shoulder of the express lanes and that vehicles were blocking the left lane of the general purpose lanes (which he was parked behind, right next to the red Kia). Mr. Gordon stated that other vehicles that were approaching ??om the rear in the express lanes slowed down as they were approaching the Road Ranger due to the warning lights being displayed. Mr. Gordon then stated that V?l was approaching from the rear at an ?excessively high rate of speed? in the left lane of the express lanes. Mr. Gordon stated that V?l switched from the left lane to the right lane and then ?powerslid? back to the le? towards the concrete barrier wall and struck the ?ve pedestrians. Mr. Gordon stated that he saw one individual being removed from V-l by Miami-Dede Fire Rescue. On Thursday, March 24m, 2011, I conducted a sworn digital recorded interview with Percival Russell. Mr. Russell stated that he was a passenger in V?l and only he and Di were returning from a club called ?Le Boulevard?. Mr. Russell stated that they were traveling north on State Road 9A in the express lanes at an ?elevated speed? in which he estimates were above eighty or ninety miles per hour. Mr. Russell stated that D-l was switching lanes, not for traf?c but due to the curves in the roadway. Mr. Russell stated that he ?rst saw the red Kia in the roadway and hnmediately warned D?l. Mr. Russell stated that D?l tried to avoid the accident and subsequently lost control of V?l and crashed into V-Z. Mr. Russell stated that he was conscious when Miami-Dede Fire Case Number FHP 711-01-019 PAGE :3 INVESTIGATIVE REPORT WI Rescue extracted both he and DI ?om V?l. Mr. Russell stated that he does not know D- 1 by name. Post crash inspection of V?l revealed contact damage on the le? side from collision with the concrete barrier wall measuring zero to twenty??ve inches from the ?oat to the rear and between two to twenty-nine inches up horn the ground. Induced damage was observed on the left sidevmeasuring twenty-?ve to ninety-four inches from front to rear and nine to ?fty?one inches up from the ground. Induced damage was observed on the roof measuring zero to thirty~three inches from front to rear. Contact damage was observed along the entire front end measuring ?fty?seven inches across and measuring ?om three to twenty~six inches up ?'om the ground. The hood was separated from V?l due to the crash. The. windshield was completely shattered. Contact damage was observed on the right side measuring zero to twenty-eight inches from host to rear and zero to tamenity?seven inches up from the ground. Induced damage was observed on the right side measuring twenty-eight to ?fty-?ve inches from the front to the rear and zero to ?fty-four inches up from the ground. Damage observed on the right side doors were due to Miami?Dado Fire Rescue cutting and extracting D-1 and 0?1. Damage on the rear end bumper was due to tow truck dropping off vehicle at station (per Cpl. Andrew Chong?Yen). The total length of the left side during the post collision inspection is one hundred sixty?three inches. The overall length of V?l, according to Rec-Tee Pro, is one hundred ninety-?ve inches. V?l suffered approximately thirty?two inches of crush damage. Case Number FHP 711-01-019 PAGE 1g INVESTIGATIVE REPORT W) Post crash inspection of revealed red paint transfer and contact damage from collision with red Kia on the left side measuring three to ninety inches ?'orn front to rear. Contact damage on the left side ?om collision with V-l is located between one hundred eleven inches and two hundred Metre inches. Induced damage is located hem ninetyto one hundred eleven inches. The roof buckled inward into the passenger compartment. The outside mirror was sheared off. Both left side windows are shattered. There is one hundred six inches of crush damage at its deepest area when measured horn the left to the right rear at six inches. Contact damage is observed in the rear from one to thirty-?ve inches when measured from left to right. The trunk buckled inward into the passenger compartment. The trunk buckled inward. The left tailpipe was pushed inward and upward into the passenger compartment. Left rear wheel was sheared off and pushed back to the pillar. Induced damage was observed on the right side as the ?out door and the rear door were pushed forward approximately one and one half inches. The right rear quarter panel buckled inward. The right rear wheel was twisted clockwise from induced damage. V?l estimated speed is 86.54 miles per hour. This speed was determined using reconstruction data horn the crash to include the drag factor and the grade of the roadway, crush damage, the post crash skid marks, the estimated weight and the estimated braking percentage of V-l and V-2. The traffic crash occurred during the early morning hour of 4:53 am. on Saturday, March 5th, 2011. The sunrise time for this date is 6:40 am. The temperature was seventy~cne degrees Fahrenheit and the humidity was sixty?six percent. The winds were cast at Case Number FHP 711431?019 PAGE 1_5_ kw INVESTIGATIVE REPORT ??een miles per hour and the visibility was ten miles. All the available. physical evidence, and witness statements support the actions and positions of the vehicles as described in this investigative report. SUMMARY According to the digital photographs of the scene, the recorded statements made by the witnesses, and the post collision inSpection of V-l and on Saturday, March 2011, V?l was traveling north on State Road 9A in the left express lane at an unsafe speed greater than the posted Speed limit approaching the overpass of Northwest 103? Street. was stopped on the left shoulder of the express lanes facing a northern direction just north of the overpass "of Northwest 103rd Street. A third vehicle, a Kia Optima was disabled facing a southwestern direction on top of the overpass of Northwest 103rd Street blocking the left shoulder and partially the left express lane. The Kia had extensive front and rear and damage, disabling all lights to include the head lights and tail lights. (See FHP Case FHPEIIOFF012315). The re?ectors located on the left rear side of the Kia were also damaged due to the crash. (See FHP Case and P~l, P-2, P-3, P-4, and P-S were standing on the left shoulder to the rear of V-2 after being involved in an earlier crash. (See FHP Case V-l veered to the right to avoid colliding with the Kia. V?l entered the right express lane and then overconected back to the left. V-l crossed over the left express lane and entered the led shoulder. The front end of V?l struck P-1, P-2, and P-5 and pinned them against the concrete barrier wall, launching three pedestrians over the concrete wall and onto the southbound lanes. The Case Number FHP 711-01-019 PAGE 1a INVESTIGATIVE REPORT front end of V?l then struck the left rear end of V-Z rotated clockwise as it was pushed north and came to ?nal rest facing a southeastern direction on the left shoulder of the express lanes, partially blocking the left travel express lane. V-l continued north before coming to ?nal rest facing a northern direction on the left shoulder partially blocking the left express lane with its right rear end. ?The right front wheel of V?l was against the right front Wheel of P-1, P-2, P-3, and P-4 were pronounced on scene shortly after the arrival of Miami?Dede Fire Rescue. D-1 and were extricated from V?l and transported to Jackson Ryder Trauma by Miami~Dade Fire Rescue. P-S was also transported to Jackson Ryder Trauma by Miami-Dede Fire Rescue. P-S was pronounced on March 12", 2011 at Jackson Memorial Hospital due to the extent of the injuries she suffered. After the conclusion of this homicide investigation, it has been determined that the following Florida State Statutes were violated by Di. 782.071.13 Vehicular homicide which states: ?Vehicular homicide is the killing of a human being caused by the operation of a motor vehicle by another in a reckless manner likely to cause the death of, or great bodily harm to, another.? 316.193.3c3a Driving under the in?uence (3) ?Any person who causes or contributes to causing the death of any human being commits DUI manslaughter and commits a felony of the second degree.? Time: 315/2011 Scene Dr.: TERMINAL EVENT: According to initial police investigation, on March 5, 2011, the deceased was invoived in an motor vehioie accident on the northboond side 'of Interstate 95 and NW ioard Street. The decedent was standing on the left shoulder along with four other pedestrians who had also been involved in the accident. They all were standing outside their vehioies when the driver of a 2010 Honda Accord lost control and veered to the left where the decedent and others were standing. The vehicle hit the deceased along with the other four pedestrians. The impact crushed the decedent?s lower extremities against the concrete barrier wall causing her legs to be severed from her body. Fire Rescue transported her to Jackson Memorial Hospital Ryder Trauma Center where she subsequently expired from her injuries on March ii, 2011.
