INVESTIGATIVE REPORT ASSIGNMENT On Sunday, July 10, 2011, at 11:45 pm, I was noti?ed by the Miami Regional Communication Center of a fatal traf?c crash that occurred on State Road 90 (US. 41ISW 8 Street) at the intersection of the entrance ramp to southbound State Road 821 (Florida Turnpike) in Miami-Dade County. Florida. The traf?c crash occurred at approximater 11:30 pm. and I arrived on scene on Monday, July 11. 2011 at 12:17 am. The crash involved two motor vehicles in transport with one of the motor vehicles being a The crash resulted in two fatalities and one non-incapacitating injury. State Road 90 is an eight lane roadway with four eastbound travel lanes and four westbound travel lanes. The east and westbound travel lanes are divided by an elevated concrete curb east of the intersection, and an elevated grassy median/curb west of the intersection of the ramp to southbound State Road 821. The westbound travel lanes have two designated left turn lanes from westbound State Road 90 to the southbound State Road 821 entrance ramp. The westbound travel lanes also form a new right lane from the exit ramp of southbound State Road 821 to westbound State Road 90. The east and westbound travel lanes' outside edge line is a solid white striped line. The east and westbound travel lanes? inside edge line is a solid yellow striped line bordering the median. Broken white painted striped lines are used for lane division. The eastbound travel lanes have a designated right turn only lane from Case Number FHP 711431-042 PAGE A a INVESTIGATIVE REPORT eastbound State Road 90 to southbound State Road 821 entrance ramp. The entrance ramp to southbound State Road 821 has two southbound travel lanes. The entrance ramp of southbound State Road 821 is divided by a grassy median that separates the entrance ramp from the exit ramp of southbound State Road 821 to eastbound State Road 90. The exit ramp to eastbound State Road 90 has two right turn only lanes. State Road 90 has a zero percent grade and a positive two percent super elevation. The roadway has a posted speed limit of forty-?ve miles per hour. The intersection is controlled by a traf?c control signal device. The street lights were on and operational at the time of the crash. The roadway and traf?c control device were not a factor in the causation of this crash. State Road 90 mainly travels in an eastlwest direction in Miami-Dade County. Florida. WE Vehicle: V-1: V-1 is a GreenlSilver. 1998 Mercury Villager van. V-1 has a Florida tag of U239MG assigned and has a vehicle identi?cation number of 4M22V111WDJ15966. V-1 has an automatic transmission. V-1 is equipped with power assisted brakes and steering. V-1 is equipped with a three point occupant restraint system in the form of a seatbelt and shoulder harness. V-1 is equipped with driver and passenger side airbags that deployed as a result of the crash. Occugant: V-1: Driver (0-1): 0-1, Eusebio L. Duarte Guido is a ?fty-eight year old white Hispanic male born on March 25, 1952. He resides at 17501 SW 142 Court Miami. Florida 33177. D-1 has a valid Florida Class (Operator) Driver License (0632-212-52-105-0) with no restrictions or endorsements. 0-1 was Case Number FHP 711-01-042 PAGE 5 INVESTIGATIVE REPORT wearing his seatbelt at the time of the crash. It is not known whether D-1 has any medical or mental conditions that would have contributed to the causation of this crash. It is not known if 0-1 was familiar with the area or the route. 0-1 was familiar with the vehicle. D-?l sustained incapacitating injuries as a result of the crash and was transported to Kendall Regional Hospital. D-?l exhibited signs of impairment and a blood sample was obtained from the hospital by Trooper Francisco Lozano. Vehicle: V-2: V-2 is a 2008 Honda CBR1000RR V-1 has a Florida tag of 6291 LH assigned to the vehicle, however no tag was attached. V-2 has a vehicle identi?cation number of V-2 has a manual transmission. V-2 is equipped with a dual disc braking system in which the front brakes are controlled by the right hand and the rear brakes are controlled by the right foot. Occupant: V-2: Driver (D-2): D-2, Yaisey Cardentey is a twenty-?ve year old white Hispanic male born on October 25, 1985 and he resides at 5296 NW 4 Street. Miami, Florida 33126 D-2 has a suspended Florida Class (Operator) Driver License (0635-960-85-385-0) with a endorsement and no restrictions. 0-2 was wearing a helmet at the time of the crash. D-2 has no known medical or mental conditions that would have contributed to the causation of this crash. D-2 was familiar with the area and the route. 0-2 was familiar with the vehicle. 0-2 was pronounced on scene due to injuries he sustained from the crash. Case Number Fl-lP 711-01-042 PAGE 6 co INVESTIGATIVE REPORT Occupant: V-2: Rear (01 1: 0-1, Ylneliz Bermudez is a twenty year old white Hispanic female born on February 25, 1991 and she resides at 260 NW 57 Court Miami. Florida 33126. 01 was seated to the rear of D-2 on the 0-1 was wearing a helmet at the time of the crash. 0-1 sustained incapacitating injuries as a result of the crash and was airlifted to Jackson Memorial Trauma Center. 0-1 expired on Monday, July 11. 2011 at Jackson due to injuries she sustained from the crash. INVESTIGATION On Sunday. July 10. 2011, at 11:45 pm, I was noti?ed by the Miami Regional Communication Center of a fatal traf?c crash that occurred on State Road 90 at the intersection of the entrance ramp to southbound State Road 821. On my arrival. I observed V-1 facing a southern direction in the entrance ramp of southbound State Road 821. V-2 was facing a northern direction on its left side in the intersection. blocking the eastbound lanes. To conduct measurements of the scene, a zero point and a reference line were established. The zero point was identi?ed as a laterally extended point on the reference line extending ?fty-?ve feet ten inches north of the center of the base of the traf?c light pole for eastbound State Road 90 located on the southeast corner of the intersection on the sidewalk. V-1 was turning left from the left turn lane of westbound State Road 90 and was crossing the eastbound lanes of State Road 90 in a southern direction. V-1 was then struck by the front end of V-2. This is supported by the contact damage on Case Number FHP 711-01-042 PAGE 1 (A INVESTIGATIVE REPORT the right side of V-1 on both passenger side doors and the bent front fork visible on V-2. This is also supported by the broken front wheel spoke on V-1 continued in a southern direction after the collision. This is supported by the start of the post?crash gouge mark of the left rear tire of V-1 starting at one hundred twelve feet two inches west of the zero point and twenty-four feet six inches south of the reference line. This mark ends one hundred twelve feet three inches west of the zero point and twenty-eight feet eleven inches south of the reference line. This is also supported by the start of the post-crash skid mark of the left rear tire of V-1 that starts one hundred twelve feet four inches west of the zero point and twenty-three feet two inches south of the reference line. This mark ends one hundred sixteen feet four inches west of the zero point and forty feet eight inches south of the reference line. V-1 came to ?nal rest with its left rear tire located one hundred twenty-seven feet nine inches west of the zero point and seventy-one inches south of the reference line and its left front tire located one hundred twenty-eight feet four inches west of the zero point and eighty-one feet south of the reference line. V-2 came to ?nal rest on its left side with its front tire located one hundred twenty-one feet west of the zero point and seventeen feet six inches south of the reference line and its rear tire located one hundred twenty-one feet eight inches west of the zero point and twenty-one feet seven inches south of the reference line. 0-2 was pronounced at the scene by Miami- Dade Fire Rescue on Sunday, July 10, 2011. at 11:43 pm. An autOpsy was performed on 0-2 by Dr. Peter A. Gillespie, MD. of the Miami-Dade County Case Number FHP 711 -01-042 PAGE REPORT Medical Examiner Department. It was determined that D-2 expired due to multiple blunt traumatic injuries. 0-1 was transported by Miami-Dade County Air Rescue to Jackson Memorial Trauma Center, where she was later pronounced on Monday. July 11. 2011, at 1:43 am. An autopsy was performed on 0-1 by Dr. Peter A. Gillespie, MD. of the Miami-Dade County Medical Examiner Department. It was determined that 01 expired due to multiple blunt traumatic injuries. D-1 was ground transported to Kendall Regional Hospital. Trooper Francisco Lozano arrived at Kendall Regional Hospital on Monday, July 11. 2011 at 12:38 am. and determined that there was probable cause to believe that D-1 may have been impaired. Trooper Lozano directed Astrid Divino. R.N.. to draw one blood sample from D-1 and had the blood sample submitted into evidence for analysis. The toxicology report of the blood sample taken of D-1 on Monday. July 11, 2011, states that the blood alcohol level of D-1 was 0.178911 00ml. On Monday, July 11. 2011. I conducted a sworn digital recorded interview with witness Of?cer Agustin Rodriguez of the South Miami Police Department. Of?cer Rodriguez stated that he saw two including V-2, stopped at a red light on eastbound State Road 90 at Southwest 122 Avenue. As the traf?c light turned green, both V-2 and the other began traveling east on State Road 90, approaching a green traf?c light at the intersection of the entrance ramp to southbound State Road 821. Of?cer Rodriguez then stated that he saw V-1 make a left turn from the left turn lane of westbound State Road 90 to enter the entrance ramp of southbound State Road 821. V-2 then hit the right side of Case Number 711-01-042 PAGE INVESTIGATIVE REPORT V-1. Of?cer Rodriguez stated that the street lights were on. The roadway was dry and it was not raining at the time of the accident. Of?cer Rodriguez stated that V-1 only had one occupant. which was D-1, and V-2 had two occupants. which were D-2 and 01. Of?cer Rodriguez stated that V-2 was traveling approximately ?fty to ?fty-?ve miles per hour at the time of the accident. Of?cer Rodriguez stated that V-2 had his headlights on at the time of the accident. Of?cer Rodriguez stated that he noticed slurred speech and blood shot eyes during his interaction with D-1. On Monday. July 11. 2011, I conducted a sworn digital recorded interview with witness Doris Miranda-Becker. Ms. Miranda-Becker stated that she saw two traveling east on State Road 90 and passing her and approaching the entrance ramp to southbound State Road 821. She does not recall the color of the traf?c light. Ms. Miranda-Becker then recalls seeing a ?ying object which was later determined to be 0-1. When she stopped. she observed D-2 hanging out of the window of V-1. Ms. Miranda-Becker then stated that D-1 wanted to leave the scene. She then stated that she saw an off duty police of?cer break the driver side window to enter the van and detain D-1. Ms. Miranda-Becker recalls seeing V-1 turning left into the path of WI. but did not see V-1 prior to the accident. Ms. Miranda-Becker stated that V-1 was occupied only by D-1 and that V-2 was occupied by D-2 and 0-1. Ms. Miranda-Becker also stated that D-1 was incoherent after the accident and she believes that D-1 was under the in?uence of alcohol because she was able to smell the alcoholic beverage coming from D- Case Number FHP 711-01-042 PAGE r? INVESTIGATIVE REPORT 1. Ms. Miranda-Becker stated that the street lights were operational at the time of the crash. On Monday, July 11. 2011. I conducted a sworn digital recorded interview with witness Ali Salomon Turcios. Mr. Turcios stated that he saw V-2 and the other traveling at a high rate of speed and passing him. Mr. Turcios then stated that he saw V-1 turning left onto State Road 821 and then V-2 strike the right side of V-1. Mr. Turcios does not recall the color of the traf?c light (but he thinks that the traf?c light was green for eastbound traf?c). Mr. Turcios stated that he did not see any other occupant in the van except for D-1. Mr. Turcios stated that D-2 was a male and 0-1 was a female. Mr. Turcios estimates that V- 2 was traveling at approximately eighty miles per hour. On Monday. July 11, 2011. I conducted a sworn digital recorded interview with witness Anthony Figueredo. Mr. Figueredo stated that he was traveling eastbound on State Road 90 when he saw V-2 traveling east, cutting off other traf?c and traveling east at approximately eighty miles per hour. Mr. Figueredo stated that then came to a stop at the intersection of Southwest 122 Avenue. Mr. Figueredo then stated that when the traf?c light turned green at SW 122 Avenue, V-2 picked up speed and as it was approaching the intersection of the entrance ramp. he saw V-1 making a left and was in the middle of the road (of eastbound State Road 90) and V-2 struck V-1. 0-1 was ejected over V-1 and D- 2 was ejected and went into V-1. Mr. Figueredo does not recall the color of the traffic light at the intersection of the crash. Mr. Figueredo believes that V-2 was Case Number FHP 711-01 -042 PAGE 11 INVESTIGATIVE REPORT traveling in the right center lane of State Road 90. Mr. Figueredo stated that both occupants of V-2 were wearing helmets. Mr. Figueredo stated that V-1 did not spin after the collision, but just moved forward. Mr. Figueredo concluded the interview by stating that V-2 and the other were ?going fast?. On Monday, July 11. 2011, I conducted a sworn digital recorded interview with witness Kener Santiago Angel Lopez. Mr. Angel Lopez stated that he was traveling east on State Road 90 in the right center lane and V-2 was in the left center lane ahead. Mr. Angel Lopez stated that he saw V-1 get in front of V-2 and V-2 was unable to stop. Mr. Angel Lopez stated that the traf?c light was green for eastbound traf?c at the intersection of the crash at the time of the accident. Mr. Angel Lopez stated that he does not believe that V-1 had his headlights on at the time of the crash. Mr. Angel Lopez stated that V-1 was in the inside left turn lane of westbound State Road 90 prior to making his left turn. After the accident, Mr. Angel Lopez stated that he immediately stopped and saw that D-1 was the only occupant inside V-1. Mr. Angel Lopez stated that traf?c was normal and not congested at the time of the accident and that the street lights were on. Mr. Angel Lopez stated that he does not know how fast V-2 was traveling prior to the accident. Mr. Angel Lopez stated that D-2 and 0-1 had helmets on at the time of the crash. A post-crash inspection of V-1 revealed contact damage on the right side. It measured from front to rear eighty-one inches to one hundred twelve inches and eight inches to ?fty-eight inches up from the ground. Induced damage on the Case Number FHP 711-01 4142 PAGE 1_2, INVESTIGATIVE REPORT right side measured from front to rear was observed from ?fty-one inches to one hundred seventy-three inches and eight inches to seventy-?ve inches up from the ground. The rear trunk lift gate was pushed outward one inch when measured from the top. The roof is pushed upward seven inches when measured on the right side. The right side of V-1, in the area of impact, sustained between thirteen inches of crush damage when measured at the base frame (contact from the wheel of V-2) and twenty inches of crush damage when measured at its deepest point on the door. A post-crash inspection of V-2 revealed front end contact as the front wheel was pushed back into the radiator. The front fork was pushed back approximately eight and one half inches towards the rear. The front fork was broken at the point of the bend approximately eleven inches down from the handlebars. The front wheel had a broken spoke that was bent inward from contact with the base frame of V-1. The odometer display board was broken into pieces and missing. The wheel base from the center of each spoke measured forty-eight inches. V-2 estimated speed at impact is between 28.42 miles per hour and 43.04 miles per hour. This speed estimate was determined using the general damage description of V-2 in which the front wheel spoke was totally deformed and the crush damage sustained by V-1. The traf?c crash occurred during the night time hour of 11:30 pm. on Sunday. July 10, 2011. The sunset time for this date is 8:16 pm. The temperature was eighty-four degrees Fahrenheit and the humidity was seventy-four percent. The Case Number FHP 711-01 -042 PAGE 3 A A. INVESTIGATIVE REPORT winds were east southeast at eight miles per hour and the visibility was ten miles. The skies and conditions were scattered clouds. All the available physical evidence and witness statements support the actions and positions of the vehicles as described in this investigative report. SUMMARY According to the digital photographs of the scene, the recorded statements made by the witnesses, the physical evidence obtained from measurements. and the post collision inspection of V-1 and on Sunday, July 10, 2011, at 11:30 pm. V-2 was traveling east on State Road 90 in the left center lane approaching a green traf?c signal at the intersection of the entrance ramp to southbound State Road 821. V-1 was turning left on a red left turn arrow from the inside left turn lane of westbound State Road 90 to enter the southbound entrance ramp of State Road 821, crossing the eastbound lanes of State Road 90. then collided with the right side of V-1. The impact caused both D-2 and 0-1 to be ejected from V-2. D-2 was ejected and sent through the right side window of V-1 and came to rest on the left side window. was removed from V-1 prior to my arrival and placed on the ground to be rendered ?rst aid. D-2 was pronounced on scene by Miami-Bade Fire Rescue at 11:43 pm. 0-1 was thrown airborne over V-1 and landed on the ground. 0-1 was rendered ?rst aid and airlifted to Jackson Memorial Trauma where she expired due to her injuries. 0-1 was pronounced on Monday. July 11. 2011, at 1:43 am. D-1 was removed from V-1 and transported by Miami-Dads Fire Rescue to Kendall Regional Hospital. Case Number FHP 711411-042 PAGE (A INVESTIGATIVE REPORT \Mtnesses and Trooper Francisco Lozano determined that D-1 exhibited visual signs of impairment at the scene and at the hospital to include an odor of an alcoholic beverage, blood shot eyes, and slurred speech. After the conclusion of this homicide investigation, it has been determined that the following Florida State Statutes were violated by 0-1: 316.193.3c3a Driving under the in?uence (3) ?Any person who causes or contributes to causing the death of any human being commits DUI manslaughter and commits a felony of the second degree.? 316.075.101 Traf?c control signal devices. Vehicular traf?c facing a steady red signal shall stop before entering the crosswalk on the near side of the intersection or, if none, then before entering the intersection and shall remain standing until a green indication is shown After the conclusion of this homicide investigation, it has been determined that the following Florida State Statutes were violated by 0-2: 322.34.2c Driving while license suspended, revoked, canceled, or disqualified.
