Schultz, City Administrator of the City of Edgerton li - located in Rock County, wisconsin, that during February, 1993, defendant Ryan Patrick Scott was employed the finance director for the City of Edgerton. Schultz showed Detective Irmen a general fund voucher for the City of Edgerton dated February 17, 1993, written out by the defendant which stated that the defen~ dant was entitled to $30.97 for mileage and a purchase made by the defendant. This voucher was approved for payment.by the Edgerton City Council. The voucher for $30.97 had listed a check #16054-which indicates the number of the check which was issued for payment on the voucher. Schultz then showed Det. Irmen a check carbon for check #16054 drawn on the general fund account for the City of Edgerton dated February 17, 1993, made payable to defendant Ryan P. Scott which was issued in the amount of $300.97 . Schultz further had the cancelled check #16054 which showed that the defendant had endorsed the check and cashed it on February 19, 1993, at the First National Bank and Trust in Monroe, Wisconsin. Schultz explained that checks issued by the City of Edgerton out of the general fund are signed with a signa- ture imprint machine and that the signatures of the Mayor, Timothy Roenneburg, and the City Administrator, Richard Schultz, are required to be stamped on the checks. Schultz stated that the defendant had access to the_imprints for the two signatures during February, 1993. Schultz stated that he did not give the defendant permission or authority to use Schultz's signature which was stamped as City Administrator on check'#16054. Det. Irmen further contacted Constance wileman, Cindy R. Johnson, and Marilyn Moe, employees of the City of Edgerton, who have authority to issue checks on the general account, and all of those employees stated that they had not issued check #l6054. Det. Irmen states that he determined that the defendant is the only other person who would have authority or the opportunity to issue said check #16054. I received this telephone call at my residence. Chief Burdick directed me to report to the City Administrators' office as soon as possible. Chief Burdick told me that the City Administrator, identified as RICHARD ALLEN, 4-4, 21 Albion st. Edgerton, WI, 53534, 608-884-7939, had information about what appeared to be an employee theft. At I met with Mr. Schultz, at the Edgerton City Hall, located at 12 Albion St. in the City of Edgerton, Rock County, Wisconsin. Mr. Schultz told me that he had documents that led him to believe that the City Finance Director had misappropriated city money for his own gain. The Finance Director is identified as SCOTT, RYAN PATRICK, dob 04-21-53, 11250 Dallman Rd., Edgerton, WI, 53534, 608-884-3953, Mr. Scott is on administrative leave at this time. He was put on administrative leave by the Administrator on 07-02-93. Mr. Schultz showed me a GENERAL FUND VOUCHER for vendor number 19240, Ryan Scott. The voucher is dated 02-17-93, and indicates that Ryan Scott, Finance Director for the City of Edgerton, was reimbursed for 32 miles, at .275 cents per mile, and for (2) printer ribbons, at $10.46 each. According to Ryan Scott's voucher, he was asking to be reimbursed for $8.80 in mileage, and for $22.17 for the ribbons. I believe that the $22.17 was inclusive of tax. There is a receipt from Wal--mart in Monroe for the purchases dated 02-13-93. This receipt is attached to the voucher., On the face of the basic information above, there are two problems. First, $10.46, times 2 is $20.92, and if 5% sales tax is added, the total should be $21.96. I did call the Monroe Wal-Mart store (608-325-7701) to verify that there is no county or city sales tax, in addition to the 5% state sales tax. This means that Ryan Scott charged the city $00.21 extra for the Ribbons. Second, the mileage was charged to the city for his trip to Monroe. It should be noted, that according to the receipts that the items were purchased on 02-13-93 at 10:56am, this is a Saturday morning. Ryan I Scott also has a residence in Monroe which at this time he was living at. Ryan Scott had not yet moved to a residence in or near the City of Edgerton. The major complaint of the City Administrator is as follows. At the bottom of the voucher, it shows a total of $30.97 being owed to Ryan Scott. Mr. Schultz then showed me the check carbon for the Check that Ryan allegedly made out to himself. The check number is 016054 drawn on the City of Edgerton General Fund at Valley Bank Janesville. The check is made out to Ryan Scott, in the amount of $300.97. It is important to know that the check is referred to as a 'hand check', meaning it is made out by hand, using a typewriter, and it is not generated by a computer. Mr. Schultz told me that these types of checks are made out in the office, and that he did not make out the hand check for Ryan. These are City Hall employees. According to Mr. Schultz they both indicated that they had not made out the check either. A Mr. Schultz then showed me the canceled check. The canceled check matches the carbon copy. There are several items printed on I the back, indicating that it was cashed on 02-19-93 at the First National Bank and Trust in Monroe WI, 608-328-5100. There are also policies for the use of the vouchers, and places were people are supposed to sign these vouchers after certain work is done. On the front of the voucher in question, there are three critical lines that aren't completed. There is no signature in the area for the Department Director. This would be Mr. Schultz. There is no signature for the Comptroller. This would be Ryan Scott. There is also no signature for the Compliance Officer. This signature would be who ever made out the check itself. There is one set of initials on the check in the area titled "Posted By". Ryan Scott's initials appear here. The checks issued by City Hall on the General Fund, are signed using a signature imprint machine, and the two signatures required are Mayor Timothy Roenneburg and City Administrator Richard Schultz. The imprint dies are kept in the safe in the front office of City Hall. Ryan Scott did know the combination of the safe prior to his Administrative Leave. Further, it would be common for Scott to use the machine in his current position as Finance Director, and his initial position as Bookkeeper. It appears as though Ryan Scott used his position to take the money from the City. Further, it appears that he had no intent to return the money as the incident occurred more than four months ago. The difference between what Scott put on the voucher, and what he put on the check, was $270.00. There are copies of the canceled check, the check carbon, the voucher, and the receipt submitted for reimbursement enclosed. I will be contacting the office staff about this check in the near future. 93-000580 A 07-11-93 Detective Irmen On the above date and time, I spoke to a female identified as . JOHNSON, CINDY ROSE, 20 Broadway St. Edgerton, WI, 53534, 608-884-3233, Cindy is employed part time by the city and works at City Hall. I spoke to Cindy about the check. Cindy remembered being questioned by the Administrator about the check as well. Cindy told me that she did not make out the check for Ryan Scott. Further, she didn't know who had. At I made contact with another City Hall employee, identified as WILEMAN, CONSTANCE CLARA, dob 10-17-52, 603 W. Fulton St. Edgerton, WI 53534, 608-884-3695, Ms Wileman uses the name Connie. I asked Connie about the check in question. She told me that there was no way that she could have written the check as she was not yet employed by the City of Edgerton. Connie told A me that she didn't start working for Edgerton until March or April of 1993. I At on 07-11-93 I made contact with an employee of the city who currently works in the office at the street department, but at the time of this incident, did work at City Hall. The employee is identified as MOE, MARILYN ELAINE, dob 07-09-32, 308 w. Fulton st. Edgerton, wi, 53534, 608--a84--474B, ab I asked Marilyn if she remembered making this check out for Ryan Scott. She looked at the copy of the check, and the voucher. She told me that there was no way that she would have issued the check, without signing the voucher under 'Compliance Officer'. Marilyn told me that she did not make this check out. This concludes my involvement in reference to this incident at this time. 93-000580 09-16-93 Detective Irmen On the above date and time, I met with Assistant District Attorney Raymond Jablonski. The purpose of my meeting was to obtain a subpoena for Mr. Scott's bank account at Monroe Bank and Trust, in Monroe. Also, to get a warrant for Mr. Scott in reference to this incident. ADA Jablonski assisted our department in obtaining these two items. At Mr. Jablonski had completed these items. We then requested that Judge Rudd sign these documents. Judge Rudd reviewed/signed both the subpoena, and the warrant. At Chief Burdick and myself met with Mr. John T. Bridger, the Executive Vice President of the First National Bank and Trust of Monroe, Wisconsin, (1625 Tenth St. Monroe, WI 53566, I served Mr. Bridger the subpoena for Mr. Scott's bank account. Mr. Bridger was cooperative, and agreed to provide the information within the 72 hours, indicated on the subpoena. At Chief Burdick and myself met with Iowa County Deputy Steven Michek at the Iowa Count Sheriff's Department (Rt. 2, Box 3, Dodgeville, WI 53533, in We requested assistance from their department in going to Ryan's last known address, and trying to contact Mr. Scott for the warrant. In the morning hours of 09-15-93, Chief Burdick and myself met with Mr. Richard Schultz, City Administrator for the City of Edgerton. Mr Schultz was able to provide me with a possible address for Mr. Scott. Mr Schultz had received an address on an Unemployment Compensation request. The address on the form was 403 Lakeshore Dr., Avoca WI 53506. Upon arrival at Scott's last know address, we were able to make contact with Ryan Scott. The deputy from Iowa county informed him that he was under arrest. Ryan asked Chief Burdick "for what". Chief Burdick told Ryan we had a Warrant for his arrest. Ryan's response was for what? I explained to Ryan that we weren't going to discuss it for now The Deputy then indicated that he would have to come with us for now Ryan was allowed to change cloths, and secure his residence and vehicle The Iowa County Deputy, turned over to us Mr Ryan Scott Ryan was subsequently place into the back of our squad At 6 IOPM I witnessed Chief Burdick read Ryan his Miranda Warnings Ryan indicated that he understood his warnings, and indicated that Chief Burdick and myself then transported Ryan to the Rock County Jail During our transport of Mr Scott he was asked several questions about the check incident Ryan adamantly denied any involvement in stealing money from the City Ryan kept trying to blame Marilyn Moe for not observing the check as it was written He also tried to blame Donna Mayne for signing the voucher We allowed Ryan to look at the voucher Ryan made a comment about no other signatures being on the document Ryan was also allowed to look at the copy of the check Ryan told us that the signature on the check was indeed his Ryan however made a point to tell us that this whole situation was just an oversight explained to Ryan that I found it difficult to understand, how a person who was employed as a book keeper, who was then promoted to City Finance Director, could make a deposit in his account of S300 97, when he had full knowledge that he was supposed to be depositing $30 97 Ryan told me that this would have been during a turbulent time in his life, and this would have been a simple mistake I again asked Ryan how a person wouldn't be able to tell he had $270 00 more than he was supposed to, especially given his position, and education Ryan had no response. We spoke to Ryan about several other issues Ryan was basically cooperative. We asked Ryan,if he would be willing to stop at the Edgerton PD and make a statement. Ryan indicated that he didn't want to do this. Subsequently Ryan was transported directly to the jail and at about he was turned over to the Rock County Jailers. It should be noted that during this investigation Chief Burdick and myself also spoke to other people. The first was the manager of a trailer park were Ryan used to reside. Ryan's former address was 560 W. 21st St., lot 107, Monroe Wisconsin 53566. Ryan lived in this trailer with a subject identified as Samual Gomer. Ryan lived in this trailer park, at lot 107, prior to moving to Edgerton. Chief Burdick and myself, spoke to the manager of the Trailer park on 09-15-93, at The manager is identified as Ms. Gobel. We asked Ms Gobel about Ryan, and how long he had been gone from the trailer Park. he told us that he moved when he got his job in Edgerton. She also said that he was "strange". I asked Ms Gobel what that meant. She said that he was behind on the payment to the financial institution that had given him the money for his trailer. Ms Gobel indicated that she never had any real problems with him, but that he was strange, and behind in his A payments. Ms Gobel went on to tell us that Ryan had subsequently sold his trailer to Samuel Gomer and his wife. According to Ms I Gobel, the agreement was that Gomer pay the back payments on the trailer, and the back park rent. This was all that Ms. Gobel had to offer. We thanked her for her cooperation. It should be noted that Ryan Scott was less than truthful about were he lived prior to moving to Edgerton. He told me on more than one occasion that he owned and lived in an old school house. This conversation had come up several times. Ryan told me that he didn't want to move to Edgerton, because he would have to sell his old school house. Ryan told me he put several thousand dollars in the house after he bought it, in order to restore it. This was obviously untrue. At Chief Burdick and myself then went to Dick's supermarket, (725 Eight st. Momma, wx, 53566, The purpose of our visit was to meet with Mr. Gomer, Ryan's former roommate. Upon arrival, we located Samuel Gomer. Mr. Gomer agreed to speak to us in the car. Mr. Gomer told us that he hadn't seen Ryan since he left Edgerton. He also told us that he hadn't talked to him in the last few months. Gomer told us that he didn't know were Ryan was living either. It was obvious that Gomer was nervous, and that he didn't really want to speak to us. We Gomer if Ryan owned any other property in the area. Gomer told us no. We Asked if Ryan had any relatives in the area. Gomer told us that Ryan's mother and father, live in Apple River IL. Further, their names are Albert and Roberta Stocks. According to Gomer Gomer was also able to tell us that Ryan has an Aunt in Madison somewhere, and that her name is Arlene Scott. It should also be noted that Ryan, according to Gomer had changed his name from Stocks to Scott. Ryan was also adopted, and Gomer thought that Ryan's real father, may be his uncle. Prior to us leaving, Gomer asked us if we knew that Ryan had been in a mental institution. Gomer elaborated that Scott, had be admitted for depression. This was all that Gomer had to offer. Irmen SR08 3.6 Date Printed: 10/19/93 Page 7 il,? cantiuuation Pa EDGERTON POLICE DEPARTMENT 93-000580 Incident No Date Time Reported Complainant/Victim Name 93 000580 07/09/93 FRI 17 00 SCHULTZ RICHARD ALLEN On the above date and time, I went to the First National Bank and Trust in Monroe Wisconsin The purpose of my visit was to retrieve the bank documents which were subpoenaed Upon arrival, I met with the Vice President of the bank, Mr John Bridger Mr Bridger had called on Friday 09 17 93, and left a message that the bank documents were ready On today date, Mr Bridger provided me with the copies of Ryan Scott Bank records After reviewing the documents, I was able to locate a copy of the check in question, number 016054 This check was deposited with another city of Edgerton Check The second check is check number 028958, drawn on the City of Edgerton Payroll account Both checks have Ryan Scott gnature Further, I was able to obtain a copy of the deposit slip, which was completed by Scott The deposit slip, for account number 472 956 has only these two checks on it The amount of the check in question, $300 97, and the payroll check for, $492 28 In the subtotal of the deposit slip, the amount totaled is $793 25 Below the subtotal, is the amount received in cash, prior to the deposit The amount that Ryan received in cash from this deposit was $193 25 Given this information, it would appear that Ryan Scott would have had to of known that the check for reimbursement was not for the correct amount, as the totaled was $270 00 more than the correct amount, and there were only two items deposited I have made copies of the documents listed above, and placed them into this report The original copies from the bank, are in the possession of the Edgerton Police Department I have also placed a copy of the transactions in this report This was also received from the bank Finally, it should also be noted that according to Mr Scott's bank record, he received bank overdraft notices on four occasions in two months. I requested that Mr. Schultz provide me the original document which are in question in this case. The following documents were received from Mr. Schultz and packaged under the following evidence tag numbers. 93-000580-1 l. One City of Edgerton check #2a95e, drawn on - Edgerton payroll account. 2. One City of Edgerton Voucher for check #28958. - 1. One City of Edgerton expense voucher. 2. One cash register receipt from wa1~Mart. 3. One City of Edgerton check drawn on the General Account. These items were packaged in accordance with Departmental policy and turned over to the Rock County District Attorney's Office, more particularly Assistant District Attorney Ray Jablonski. I - This concludes my involvement in reference to this incident at this time. 93-000580 10-15~93 Detective Irmen On the above date and time, I was contacted by Cindy Johnson, a City Hall employee. She told me that after her testimony on Thursday that she had been trying to think of a way that it could be documented that Ryan had performed all the tasks necessary to issue the check in question. Cindy told me that she'woke up in the middle of the night and remembered that there is a check list which is completed by the party or parties who run the checks for City expenses. Cindy provided me with a packet of information. The title on the face sheet is "check list on the cycle". Below it is a batch number, in this case it is 021793A. Below that there is several tasks listed and a space for people to initial there tasks. In this case task enter invoices, was initialed by Ryan Scott indicated that he had completed that task. create recurring invoices, has an in the signature blank, indicating it's not applicable. "print, edit, list of invoices". Ryan Scott's initials appear in the blank to the left of this task, indicating that he performed the task. "make accounts payable journal entries".
