Absent language that prohibits that very same thing in statute or rule, I think that 313 could provide for a scenario where only low paying employees were created, provided of course that the applicant has demonstrated that such scenario is in line with industry standards. Although that language is in there about creating ?high-paying jobs," I think that the rhetoric that we were hearing about 313 in the last session is that it should not be construed as a jobs creation statute but a means to draw capital investment to the state. And, I think that the fact that every change in the statute related to employment has been to the bene?t of industry lends itself to that argument: removing the 80% language, changing the de?nition of "county average manufacturing wage," the inclusion of non-qualifying jobs, and the cumulative economic benefit language regarding determining whether or not the number of qualifying jobs has been created. I know that we need to have this resolved quickly as to Gregory Portland and Taft. Dale is already working with his clients to see whether or not the information on the application has changed in any manner that would moot the question (as it did with and Priddy where the same question arose). But in terms of overall policy of whether or not a waiver could be granted if an applicant may also have non-qualifying jobs, I think that there is currently no rule or statute that would prohibit it.
