Montenegro #6991 and I am a peace of?cer of the City of Dallas, Dallas County, Texas. I, the af?ant, have good reason and do believe that on or about the 23_rd day of Ara?ril, 20 one (name of suspect) Christopher Brian Colbert did then and there in the City of Dallas, Dallas County, Texas commit the offense of Murder, a violation of Section of the Texgs Penal Code, a Felonv lst. Af?ant?s belief is based upon the following facts and information which A?iant received from: Af?ant?s personal investigation of this alleged offense. a fellow peace of?cer of the City of Dallas, Dallas County, Texas, who personally participated in the investigation of this alleged offense, providing this information to Af?ant, and whose information Af?ant believes to be credible. On September 24, 2015, Dallas Police of?cers reSponded to 725 N. Winnetka Avenue, Dallas, Texas regarding a dead body under a slab of concrete in the backyard of the residence. Detective Montenegro, #6991, began an investigation regarding a body found on the property by Witness Fredrick Robertson who is the current owner of the property. During the course of the investigation Detective Montenegro believed that the body was that of the previous home owner Ronald David Shumway. On February 12, 2016, the body was positively identi?ed through DNA as Ronald David Shumway. According to neighbors Complainant Shumway had not been seen or heard from for approximately 6 months. During the investigation, Detective Montenegro discovered that SuSpect Christopher Brian Colbert was posing and identifying himself as Ronald David Shumway during the sale of the house located at 725 N. Winnetka Avenue. Detectives also learned that Suspect Colbert superimposed his photograph on Complainant Shumway's Texas driver?s license and faxed it to the Chicago Title Company during the sale of the property. Approximately $109,000.00 dollars was deposited into Complainant Shumway?s active Bank of America account. Detective Montenegro learned that SuSpect Colbert withdrew all the money from Complainant Shumway?s account using a debit card issued to Complainant Shumway. Detective Montenegro created a six picture photo line-up that included a picture of Christopher Brian Colbert. Line-up Administrator Young, #9416, presented the six picture photo line-up to Witness Steinbrook and Witness Bramhall and both positively identi?ed Suspect Colbert as the person that identi?ed himself as Ronald D. Shumway during the sale of the pr0perty. Consequently on February 22, 2016 and February 25, 2016, Detective Montenegro and Financial Crimes Detective Lafleur, #7124, obtained arrest warrants for Suspect Colbert forTampering with Governmental Record [warrant number Securing Execution of Document by Deception [warrant number F1 6-75321 and Money Laundering [warrant number Fl 6-7533 The arrest warrants were disseminated via NCIC. On March 3, 2016, Los Angeles Police Department Of?cer Hernandez, #36039, assigned to the U.S. Marshal Service Task Force located and arrested SuSpect Colbert for the listed outstanding felony warrants. Detectives Montenegro and La?eur ?ew to the City of Los Angeles to interview Suspect Colbert. Suspect Colbert was Mirandized by Detective Montenegro. SuSpect Colbert waived his rights and agreed to talk to detectives. During an audio recorded interview, Suspect Colbert admitted to the fraud charges and to the murder of Complainant Ronald David Shumway. During the interview, SuSpect Colbert began denying any involvement in the offenses. Detective Montenegro confronted Sus ect Colbert with evidence found during the investigation for exam le: evidence that he was identi?ed as the person posing as the compl inant and also had evidence regarding where he bought the bags cement. At that point, SuSpect Colbert stated that they went back to being friends after moving out of the complainant's house. According to Suspect Colbert, one day Complainant Shumway began drinking which led to an argument. He claimed that Complainant Shumway came at him and tried to strangle him. He stated that he thought that the complainant might tie him up and kill him. According to Suspect Colbert, they both began choking each other. STATE OF TEXAS 1 AFFADAVIT FOR ARREST WARRANT I COUNTY OF Dallas 7 Suspect Colbert stated to detectives that Complainant Shumway struck his [Colbert's] head against the wall and he [Colbert] could not breathe. Suspect Colbert stated that he ended up choking the complainant with his hands. He stated it was self-defense. Detective Montenegro asked Suspect Colbert why didn?t he call the police and report it. He stated that he was in shock. Suspect Colbert was also asked how the complainant ended in the backyard encased in concrete. Su5pect Colbert stated that it was his idea and that no one helped him. He acknowledged that he bought the bags of cement at the Home Depot store on Fort Worth Avenue. Detective Montenegro asked Suspect Colbert if he tied the complainant. At ?rst he stated that he did not remember but then he said he might have tied him [Complainant Shumway] up but claimed that he blacked out from fear and shock. Detective Montenegro asked Su5pect Colbert what he use to wrapped the complainant. He claimed it was a blanket. He was corrected and was told it was a plastic bag. SuSpect Colbert acknowledged that it was a plastic bag and he gave the color ?black?. Detective Montenegro asked him if he dug a hole and he said no. He stated he "just made a thing around the house" referring to the cement enclosure. Suspect Colbert's statement corroborated the evidence found at the crime scene and evidence learned through the investigation. However, evidence found during the autopsy did not match with Suspect Colbert?s accounts of how the complainant was killed. During the autopsy, the complainant's hands and feet were bound with neck ties. Complainant Shumway also had several ligatures around his neck.
