Dear Mr. Musgrave:

This is in further response to your letter, dated December 3, 2013, and in response to your
follow-up letter dated January 12, 2014, appealing the detennination by the Records Access
Officer (RAO), dated November 22, 2013, of your above-referenced request, pursuant to the
Freedom of Information Law for five recent Unusual Occurrence Reports.

In a letter dated December 13, 20l3, you were informed by the undersigned that a further
search was being conducted for the requested reports. You subsequently submitted letters dated
December 28, 2013 and January 12, 2014 inquiring about the status of the processing of your
request. The search has been completed, and five recent Unusual Occurrence Reports are
enclosed. Redactions have been made pursuant to Public Officers Law (POL) Section 
to the extent that the requested records are related to ongoing law enforcement investigations or
judicial proceedings; pursuant to pursuant to POL Section 87(2)(b) and 89(2) because disclosure
of the requested records would constitute an unwarranted invasion of privacy; and pursuant to
POL Section 87(2)(f) because disclosure thereof could endanger the life or safety of any person.
Other exemptions under FOIL also may apply.

Please send a check or money order in the amount of one dollar and twenty-five cents
(copying expenses for 5 pages), payable to the New York City Police Department, to Records
Access Appeals Officer, NYPD, One Police Plaza, Room 1406, New York, New York 10038.
Please note the file number, l3PLl08089, on your payment.

You may seek judicial review of this determination by commencing an Article 78
proceeding within four months of the date of this decision.
