At issue in this suit is CPD’s failure to produce videos and other reports showing fatal officer-involved shootings since 2011 and CPD’s ongoing pattern of willful delay—a pattern that this Court must bring to a conclusive and definitive end. INTRODUCTION 1. Pursuant to the fundamental philosophy of the American constitutional form of government, it is the public policy of the State of Illinois that all persons are entitled to full and complete information regarding the affairs of government and the official acts and policies of those who represent them as public officials and public employees consistent with the terms of the Illinois Freedom of Information Act (“FOIA”). 5 ILCS 140/1. 2. All public records of a public body—including videos and records showing the police shooting people—are presumed to be open to inspection or copying. Any public body that asserts that a record is exempt from disclosure has the burden of proving by clear and convincing evidence that it is exempt. 5 ILCS 140/1.2. 3. Each public body shall, promptly, either comply with or deny a request for public records within five business days after its receipt of the request, unless the time for response is properly extended. 5 ILCS 140/3(d). 4. The FOIA preamble clearly states: “The General Assembly recognizes that this Act imposes fiscal obligations on public bodies to provide adequate staff and equipment to comply with its requirements. The General Assembly declares that providing records in compliance with the requirements of this Act is a primary duty of public bodies to the people of ELECTRONICALLY FILED 3/18/2016 3:49 PM 2016-CH-03918 PAGE 2 of 15 this State, and this Act should be construed to this end, fiscal obligations notwithstanding.” 5. Defendant CHICAGO POLICE DEPARTMENT has violated FOIA by failing to produce videos and records related to fatal shootings by CPD officers on the basis that there is insufficient public interest to require CPD to undertake the work involved to respond, even with a 60-day extension. 6. CPD’s FOIA practices with regard to shooting videos have not materially changed following the release of the Laquan McDonald shooting video. 7. CPD’s failure to provide the requested videos and reports at issue here is part of an ongoing pattern of delay in the release of police shooting videos. PARTIES 8. Plaintiff BETTER GOVERNMENT ASSOCIATION (“BGA”) is a nonpartisan, Illinois non-profit corporation, whose mission is to educate the public about waste, inefficiencies, and corruption in government by acting as a watchdog agency uncovering and exposing this type of activity; to promote respect for the law; and to support public officials in -2- the rightful performance of their duties. BGA was founded in 1923 to protect the integrity of the political process in Chicago. 9. Defendant CHICAGO POLICE DEPARTMENT is a public body located in Cook County, Illinois. 10. Defendant CITY OF CHICAGO is a public body located in Cook County, Illinois. PUBLIC INTEREST IN PROMPT RELEASE OF POLICE SHOOTING VIDEOS 11. A code of silence exists among some or all CPD officers. 12. As a result of the code of silence, the public has been given false accounts about ELECTRONICALLY FILED 3/18/2016 3:49 PM 2016-CH-03918 PAGE 3 of 15 the events resulting in the use of deadly force by CPD officers in one or more instances. 13. In more than one instance, when CPD officers have killed someone, CPD and the Fraternal Order of Police have released their accounts of events within a day of the shooting occurring. 14. In one or more instances, following the arrests of non-police-officers, and before any trial, CPD has released details such as the alleged criminal history and alleged gang membership of the accused. CPD does not, however, release the complaint history against the officer involved at the same time it releases the alleged criminal history of the person arrested. 15. In more than one instance, videos showing police use of deadly force have provided objective evidence of what has actually occurred. 16. In one or more instances, release of videos showing police using deadly force has allowed the public to identify false accounts and misconduct by officers. 17. There is a tremendous public interest in the prompt release of videos showing police officers using deadly force. 18. The City of Chicago is at a critical and historic juncture with regard to policing. -3- 19. The release of the Laquan McDonald shooting video has been a positive event for the City of Chicago and has resulted in a purported commitment to reform. 20. According to the Chicago Police Board, policing must change in the twenty-first century. 21. Reform of CPD is necessary to restore trust between police and the communities they serve. 22. The Chicago Police Board is seeking a new superintendent to welcome and ELECTRONICALLY FILED 3/18/2016 3:49 PM 2016-CH-03918 PAGE 4 of 15 demand accountability and not shy away from scrutiny of CPD’s practices. 23. CPD must reach out to communities in a true spirit of partnership and respect. 24. Reform of CPD requires facing hard truths and creating a roadmap for real and lasting transparency. 25. The Mayor’s task force on police reform believes that prompt release of police- shooting videos is a crucial part of reform, holding CPD accountable, and building trust and respect in the community. 26. FOIA requires the release of police shooting videos within five business days, potentially extended to ten business days in certain circumstances, unless an exemption applies. 27. In more than one city other than Chicago, including Seattle, videos showing officer-involved-shootings have been produced within a day of the shooting. 28. According to the Mayor’s task force on police reform, under no circumstances should a video showing police using deadly force that would otherwise be exempt under FOIA be withheld from the public for more than 90 days after the use of deadly force occurred. -4- BGA’S FOIA REQUEST AND CHICAGO POLICE DEPARTMENT’S WILLFUL VIOLATION 29. On December 20, 2015, BGA requested from CPD: “All police reports and related records including but not limited to any and all video and audio records of fatal policeinvolved shootings from Jan. 1, 2011, to present.” A true and correct copy is attached as Exhibit A. 30. On January 5, 2016, CPD claimed, under the “undue burden” provision of FOIA Section 3(g), that the request was unduly burdensome. To make that claim, under the plain text of the statutory provision, is to contend that release of the requested records is of insufficient ELECTRONICALLY FILED 3/18/2016 3:49 PM 2016-CH-03918 PAGE 5 of 15 public interest to justify the work involved in producing it. A true and correct copy of the response letter is attached as Exhibit B. 31. At the time CPD responded to the request, it had already violated the required response deadline. As a result, under the plain text of the statutory provision, CPD waived the right to assert the undue burden provision of FOIA. 32. On January 11, 2016, as a courtesy and in an effort to reach a resolution, BGA offered CPD an additional 60 days to comply with the request so long as CPD began producing records on a rolling basis by January 22, 2016. In response, CPD continued to assert, with no legal justification, that production of the records would be unduly burdensome. A true and correct copy of the email exchange is attached as Exhibit C. 33. On January 22, 2016, CPD claimed that it was “re-approaching” the request. Exhibit C. 34. In the nearly two months since CPD said it would re-approach the request, CPD has provided no further communications and has produced no records or videos. -5- 35. Upon information and belief, CPD is deliberately avoiding or stalling the production of these videos and reports. 36. Under well-established practices, CPD does not allow its FOIA officers to release police shooting videos or many other records without “approval” from currently unidentified other people within CPD or other parts of City government. 37. Upon information and belief, the decision on how to respond to BGA’s FOIA request here was made by people other than CPD’s FOIA officers. 38. The law requires CPD to devote adequate resources to ensure timely compliance with all FOIA requests. ELECTRONICALLY FILED 3/18/2016 3:49 PM 2016-CH-03918 PAGE 6 of 15 39. In 2015, CPD failed to respond to over 49% of the FOIA requests it received by the required deadlines. 40. While CPD has claimed that some late responses are not truly late because requesters agreed to extensions not documented in CPD’s FOIA database, CPD has never produced any evidence of such extensions. 41. Even accounting for any extensions not reflected in CPD’s database, to the extent there are any, upon information and belief, CPD failed to respond to at least 25% of FOIA requests by the required deadlines in 2015. 42. Failures by CPD to respond to FOIA requests by the required deadlines one or more times have not been the result of rare clerical errors. 43. As of June 30, 2015, CPD had a backlog of over 700 unfulfilled FOIA requests. If CPD had been timely complying with requests, the backlog should have been less than 200. 44. As of June 30, 2015, many, if not all, of CPD’s FOIA office staff and the Corporation Counsel’s office attorneys who handle FOIA litigation for City departments, the -6- Mayor’s FOIA officer, the head of CPD legal affairs and another top CPD lawyer, and others were aware of that backlog because they were so informed in an email from a CPD FOIA officer referring to a “CompStat of sorts” of FOIA response data. 45. At least once approximately every two weeks throughout 2015 and through present, CPD FOIA officers, Corporation Counsel attorneys who handle FOIA litigation for various City departments, and other City of Chicago staff received, reviewed, and discussed FOIA requests received by media requesters. Those reports and discussions have included identification of late responses. Upon information and belief, the request at issue here has appeared on these media requests lists. CPD’s failure to respond to FOIA requests by the required deadlines, including the requests at issue in this case, has been the result of either inadequate resources devoted to compliance, delays caused by the need for “approvals” by people other than CPD’s FOIA officers, or both. COUNT I – VIOLATION OF FOIA 47. The above paragraphs are incorporated by reference. 48. CHICAGO POLICE DEPARTMENT is a public body under FOIA in possession of public records responsive to the request. 49. CPD has not produced records responsive to the request. 50. CPD has willfully and intentionally violated FOIA. unfortunately due to the wording and request content, even with the time allotted, would exceed far beyond the capabilities of our current resources to isolate each particular record to locate a particular incident that resulted in a fatality.   There is no one classification listed in a UCR (Uniform Crime Reporting) code that would isolate such incident. This also would include any viable involvement of a dash cam or POD video, the availability of such video, and the search for incidents that may be relative to the same. In addition, referring to other resources (within the Chicago Police Dept.) to locate each particular incident would Ex C again exceed time constraints to complete its fact finding and analysis,
