Offense Level: Misdemeanor Offense Date (on or about): 10/27/2015 Control #(ICR#): 15921919 Charge Description: On or about October 27, 2015 within the County of Olmsted, Courtnay Elizabeth Montgomery did wrongfully and unlawfully obstruct, resist, or interfere with a peace officer while the officer was engaged in the performance of official duties. 1 STATEMENT OF PROBABLE CAUSE   The Complainant states that the following facts establish probable cause:   Your complainant is a licensed peace officer employed by the Olmsted County Sheriff's Office. In that capacity your Complainant has reviewed the police reports relating to Courtnay Elizabeth Montgomery, the above-named defendant, and the allegations contained therein. Based upon that information, your complainant believes the following to be true and correct.  On October 27, 2015, the Honorable Joseph F. Chase issued a search warrant for the premises at 1915 65th Street NE, Haverhill Township, Olmsted County, Minnesota. The purpose of the search warrant was to search for an elderly adult female, hereinafter identified as “Victim.” Prior to the issuance of the search warrant, the Olmsted County Sheriff’s Office had received information that Victim is manipulated and controlled by COURTNAY ELIZABETH MONTGOMERY (DOB 5/31/64) and may not have been receiving adequate care. More specifically, the Olmsted County Sheriff’s Office learned that Victim, who normally resides in Florida, had been kept in Minnesota by MONTGOMERY and that Victim had missed neurocognitive appointments at Mayo Clinic on September 25, 2015 and October 7, 2015. The search warrant was requested to facilitate a face-to-face meeting with Victim to check on her welfare and ensure that she was receiving adequate care.  On October 27, 2015, officers from the Olmsted County Sheriff’s Office and an adult protection social worker went to 1915 65th Street NE to execute the search warrant. Contact with MONTGOMERY was attempted at 12:58 p.m. Although MONTGOMERY did not answer the door, telephone contact was eventually made at 1:02 p.m. MONTGOMERY refused to unlock the door and cooperate with the search warrant. At 1:08 p.m., MONTGOMERY called a second time and advised that Victim’s attorney was en route and that MONTGOMERY was calling KTTC news. At 1:14 p.m., deputies attempted to contact MONTGOMERY without success. Various additional attempts to gain MONTGOMERY’s cooperation followed. At 1:32 p.m., after being advised that deputies had obtained the garage code, MONTGOMERY stated:  “If you come in, that’s your business. But, I’m going to tell you right now, I am going to protect [Victim] and me. You better call a f***ing (unintelligible). You better call a (unintelligible) because I am going to protect [Victim] and me. Do you understand that? If you enter, if you enter without authorization, I will stand my ground. Do you hear what I am saying?”  From past contacts, deputies knew that MONTGOMERY possessed firearms in her home and interpreted MONTGOMERY’s words as a threat to use deadly force against the deputies. Eventually, after additional efforts to reason with MONTGOMERY, deputies gained access to the residence at approximately 2:05 p.m. (67 minutes after their arrival). MONTGOMERY made the comment that she was not armed, but that there were loaded firearms in every room of the residence.  Due to concerns that the MONTGOMERY was manipulative and controlling of Victim, officers decided that MONTGOMERY would not be allowed in the room when Victim was interviewed and evaluated. When so advised, MONTGOMERY refused to leave the room where Victim was located. Inv. David Rikhus advised MONTGOMERY that, if she did not leave, she would be placed under arrest. MONTGOMERY refused to leave and asked Victim if she wanted MONTGOMERY to be present. At that point, Inv. Rikhus advised MONTGOMERY that she was under arrest and asked her to stand up. MONTGOMERY refused. Inv. Rikhus asked MONTGOMERY a multiple times to stand up, but she refused, saying that any attempt to put hands on MONTGOMERY would result in a lawsuit.  2 At one point, MONTGOMERY wrapped her arms around the arm rest of the bench she was sitting on, in order to prevent anyone from escorting her out. While in this position, MONTGOMERY lunged her head toward Inv. Rikhus in an apparent attempt to bite Inv. Rikhus on the arm. MONTGOMERY’s hands and arms had to be pried from the arm rest. When MONTGOMERY s grasp of the arm rest came off, MONTGOMERY went to the floor. MONTGOMERY started screaming that her wrist hurt and that she couldn’t get up off the floor because of health problems. Nonetheless, all attempts to assist MONTGOMERY off the floor were met with resistance. Specifically, MONTGOMERY was lying on her back, kicking at deputies, thrashing and screaming. MONTGOMERY was eventually assisted to her feet and was escorted out of the bedroom. As she was being escorted out of the bedroom, MONTGOMERY yelled to
