Risks Since e-mails are generally sent across borders via open facilities which are easily accessible to third parties, the use of email in- volves certain inherent risks including, in particular: (1) lack of confidentiality (e-mails and their attachments can be read and monitored without detection); (2) manipulation or falsification of the sender's address or content changing the sender's address or information); (3) system outages and other transmission errors, which can cause e-mails and their attachments to be delayed, mutilated, misrouted or deleted; (4) occurrence of viruses, worms, etc. that may be spread undetected by third parties via e-mail and may cause considerable damage; (5) misuse resulting in damages caused by third parties intercepting e-mails. 3. Duty of care UBS maintains computer and IT infrastructures that are operated in a manner customary within the industry. The Client under- takes to (1) consider the risks and take due care regarding e- mails received from UBS (if in any doubt, the Client should contact UBS by telephone); (2) reenter UBS's address when replying to emails (and not use reply buttons or links in emails); (3) take appropriate steps in the event that he detects or suspects any irregularities the tampering with or falsifying of e-maiis or e-mail addresses or if there is any doubt as to the origin of the e-mail), such as to immediately contact UBS and to delete the e-mails; (4) to update his own computer system and security software on a continuous basis by installing recommended security patches, by observing customary 05.10.2010 technical security measures, in particular the installation of firewalls and continually updated antivirus programs). 4. Exclusion of liability and warranty E-mails are processed in the ordinary course of business and are not dealt with on a priority basis. In the event that the transmitted information is time critical, the Client must choose an alternative means of communication that enables timely pro- cessing. Either party may refuse to accept or process e-mails without expressly rejecting them or make further inquiries before processing. The Client is aware of and accepts the inher- ent risks of using e-mails, in particular the risk that the bank- ing relationship and confidential information relating thereto are disclosed to third parties, and, as far as permit- ted by law, shall exempt UBS from any liability for losses or dam- ages resulting from the use of unsecured e-mail. UBS excludes all warranty as to the correctness, integrity as well as the process of receiving and sending unsecured e-mails. The uninterrupted use of e-mails cannot be guaranteed due to technical, mainte- nance and security reasons. UBS therefore excludes all liability for losses or damages resulting from such interruptions or the overloading of IT systems. 5. Use of e-mail address The Client authorizes UBS to use all agreed e-mail addresses within UBS for marketing purposes that relate to the existing ac- count or business relationship; the Client shall have the option to request that UBS ceases to send such emails. 6. Amendments and termination UBS reserves the right to amend these terms and conditions at any time.
