Smith was arrested for OVI and possession of marihuana. I was headed south on State Street. I observed a dark colored Lincoln northbound stopped at the traffic light at E. Schrock Road. I noticed the Lincoln didn't have a displayed front license plate, and the vehicle was also stopped past the stop bar. I turned around to the follow the vehicle. The light changed green, and the Lincoln headed northbound in the left through lane followed by a Ford SUV. We continued northbound, and It appeared that the Lincoln was weaving within its lane of travel. The Ford was very close to the Lincoln as if they were with each other. I advised Officer Jackson that we had two vehicles northbound on State Street and I aired the descriptions. When we came to Hoff Road both vehicles turned eastbound and the Lincoln made a wide turn. I conducted a traffic stop on the Lincoln, and Officer Jackson stopped the Ford. The Lincoln pulled into the parking lot of Giant Eagle, and it stopped. I went up on the passenger side and Officer Teegarden went up on the driver’s side. I made contact with the driver who was later identified as Smith. Smith said something that sounded like he said he was an officer. I asked him if he was a police officer, and he said “I’m great.” While talking to Smith I could smell an odor of an alcoholic beverage and burnt marihuana coming from inside his vehicle. Smith’s eyes were glassy, and his speech was slurred. I asked Smith about drinking, and he denied drinking. I asked Smith what his highest level of education was, and he said he had a college degree from Ohio State. I asked him if he knew the alphabet, and he said he did. I asked him to recite it for me starting from the letter “C” and stop at the letter “W.” Smith paused for about 20 seconds then he said “C, D, E, F, G, H, I” and he stopped. I went back to my cruiser and I requested a warrant check on Smith, and another unit for tests. Officer Shipman arrived on scene to assist. I performed “Standardized Field Sobriety Test’s” on Smith. I had him stand with his feet together, and I told him to watch the tip of my finger (stimulus) with his eyes, and not to move his head during this test. I held my finger approximately 12 to 15 inches from his nose, slightly above his eye level. I checked for equal pupil size, Resting Nystagmus, and I then checked for equal tracking. His pupils were approximately the same size, there was no Resting Nystagmus, and his eyes were able to equally track the stimulus. I checked for Lack of Smooth Pursuit by starting the stimulus at the center of his nose. I moved it to my right in two seconds and back towards his nose in two seconds. I moved it across his face checking his right eye out two seconds, and then I moved it back across his face in two seconds. I then repeated the test. I observed two clues during Lack of Smooth Pursuit. I checked for Distinct and Sustained Nystagmus at Maximum Deviation. I again started at the center, and I moved the stimulus to my right, and I held it at maximum deviation for a minimum of four seconds before returning to center. I checked the other eye the same way by moving to my left and returning after a minimum of four seconds. I then repeated this part of the test. Clues were observed in both eyes. I checked for Onset of Nystagmus prior to 45 degrees. This test was performed by moving the stimulus slowly from the center to a 45 degree angle that takes approximately four seconds. I first checked his left eye, and then his right eye, and I repeated the test for both eyes. Nystagmus wasn't observed prior to 45 degrees in both eyes. I then checked for Vertical Gaze Nystagmus. Vertical Gaze Nystagmus wasn't observed. I observed 4 of 6 clues on the Horizontal Gaze Nystagmus (HGN) test. Page' 9 oi 9 During the HGN test I again noticed that his eyes were glassy. A strong odor oi an alcoholic beverage was detected emitting irom his bmlh. During the test I had to renrind Smi numerous times to watch my linger as he kept looking straight ahead. I was unable to see ()nset oi Nystagmus prior to 45 degrees as he wouldn't watch my i'urger. The second test performed was the Walk and Turn test in which I observed 5 out or 8 possible clues. I had him a ume the requested instructional position I explained the test and I also demonstrated the test ior Smith. While in the starting pos on Snrith lost his balance three times, and he stepped out oi the position. Afler he acknowledged he understood I told him to begin the test. During the iirst series oi nine steps he missed heel to toe three times. made an improper turn as he spun around, and he stopped walking. 0n the return nine steps he raised his arms ior balance once. This test was administered on a ilat roadway iree oi debris. The next test was the ()ne Leg stand test in which 3 on possible clues were observed I had Snrith put his ieet together his hands by his side while I went over the instructions I then instructed him to raise one ioot, either one. approximately 5 inches oil the ground with his ioot parallel to the ground. I instructed him to count out loud in the iollowing manner, "Due thousand and one. one thousand and two, and one thousand and Ihree" and so on until told to stop. I asked him i he understh the instructions. and he said he did. I also demonstrated the test ior him. I then had him periorm the test . nrith raised his leit ioot and he began the test. During the test Smith swayed. raised his arms, and he put his ioot down twice. Smith also didn't count as instructed. This test was administered on a ilat roadway iree oi debris. I placed Smith under arml ior ov1, and I read Miranda Warnings to him. Smith was placed into the rear oi my cruiser. While in the hack oi my cruiser I could smell and odor oi burnt marihnana conring irom his person as well as an odor oi an alcoholic beverage coming irom his breath. I searched his vehicle based on the odor oi burnt marilruana. In the center console was a glass jar that contained two rolled cigars containing man'huana. seized the items as evidence. Smith was transported back to headquarters ior processing. At headquarters I mil the BMV iorm 2255 Consequences oi Test and Reiusal (0.x.c.4511.1921 to him I initiated a breath test on the Intoxilyzer 5m, and his test was .143 Fingerprints and photographs were taken I read the ALS portion oi the BMV iorm 2255 (Notice oi Suspension 4511.192) to Smith. snow Snrith was issued a cite through westerville Mayor's Court ior Bmlh, and Display oi Plates.
