Lumpkin, Sr. Bias Based Pro?ling is the selection of an individual(s) based solely on a trait common to a group for law enforcement action. This includes, but is not limited to, race, ethnic background, gender, sexual orientation, religion, economic status, age, cultural group or any other identi?able group. A. PURPOSE: The purpose of this policy is to clearly state that Bias Based Pro?ling in law enforcement is totally unacceptable to the Athens-Clarke County Police Department. Additionally, to establish guidelines to insure ACCPD of?cers are conducting effective programs and enforcement initiatives and not practicing illegal policing. B. POLICY: A primary value of the ACCPD is to respect the dignity and worth of each individual. It is the policy of the Athens-Clarke County Police Department to treat all persons with fairness, compassion, and dignity, and to guarantee their constitutional rights. This agency will not tolerate the practice of Bias Based Pro?ling in traf?c contacts, ?eld contacts, and in asset seizure and forfeiture efforts or disparate treatment of any person on the basis of their race, ethnic background, gender, sexual orientation, religion, economic status, age, cultural group or any other identi?able group or attribute. Further, this agency will, in a proactive manner, investigate suspicious activity and circumstances, and actively enforce motor vehicle laws while ensuring that police actions are based solely on the violation observed. Any alleged violation of this policy, from citizen complaint or by agency review, will be investigated thoroughly by means of established agency policy. C. PROCEDURES: 1. The Commanding Of?cer of the Training Unit is responsible for providing training to all of?cers in of?cer safety, courtesy, cultural diversity, search and seizure, and interpersonal skills. Training will emphasize respecting the dignity and worth of all citizens and their constitutional right to be free from unreasonable intrusion and/or police action. 2. Enforcement of traf?c, state law, as well as local ordinances is to be accompanied by consistent ongoing supervisory review to ensure that of?cers do not violate a person?s constitutional rights. 3. Motorists and pedestrians shall only be subjected to stops, seizures or detention upon reasonable suspicion and evidence that they have committed, are committing, or are about to commit a violation of the law. Inherent within all of?cers? job responsibilities is the requirement to remain cognitive of constitutional, statutory and case law. 4. Each time a stop is made, the of?cer will advise Central Communications of the location of the stop, description of the person or vehicle detained, and reasons for the stop. 5. Enforcement action should always be completed, generally, in the form of a warning, citation, or arrest. 6. Information regarding the person detained or arrested shall be listed on the appropriate departmental form. Such information can reasonably be ascertained by physical appearance or from a driver?s license, ID card, etc. This will greatly assist the department in data collection and measurement endeavors. 7. No motorist or pedestrian, once cited or warned, shall be detained beyond the point where no reasonable suspicion of further criminal activity exists. I 30&SitelD= I 3/15/2016 Page 2 of 2 8. No person or vehicle shall be searched in the absence of probable cause or a warrant; a legally recognized exception is the voluntary consent to search and frisk of a person for a weapon when the of?cer has reasonable suspicion pertaining to a weapon. In each case where a search is conducted, the information will be recorded, including the legal basis for the search and the results. 9. Departmental issued tape recorders and/or in-car audio/video systems will be employed in each vehicle st0p and non-warrant search. They shall remain activated until the person is released and/or arrested. 10. In the absence of a speci?c credible report containing a physical description, a person?s race, ethnicity, gender, sexual orientation or any combination shall not be a factor in determining probable cause for an arrest or reasonable suspicion for the stop. D. COMPLAINTS OF BIAS BASED PROFILING: Complaints from the public will be handled under established departmental procedures. No person shall be discouraged, intimidated, or coerced from ?ling such a complaint, or discriminated against based on the ?ling of such a complaint. Supervisors shall forward all complaints of Bias Based Pro?ling to the Internal Affairs Unit. The Internal Affairs Unit will investigate all such complaints, and an acknowledgment of receipt of the complaint will be delivered to the complainant. Upon conclusion of the investigation, the appropriate Internal Affairs Investigator will report his/her conclusions to the Chief of Police. A Command Review (Two Precinct Captains and the Communication Center Captain) of this investigation will occur within 10 days of receipt of the Internal Affairs Report. The Command Review shall report its ?ndings in the form of recommendation for disciplinary action, unfounded, unsubstantiated, change to policy training, etc. After conclusion of the investigation and review, the complainant will be noti?ed within 72 hours of the results and actions related to his/her complaint by the Internal Affairs Investigator. E. MEASUREMENT: Each month each Uniform Division Lieutenant shall review a sampling of in-car video tapes and/or audio tapes as an inspection tool to ensure that ACCPD personnel are performing within the law and policy as expected. Additionally each Uniform Division Lieutenant and Sergeant shall respond at random to of?cers on vehicle pedestrian stops to ensure Of?cers are performing as expected. Supervisors must be alert to any pattern or practice of possible discriminatory treatment by individual Quarterly, supervisors will submit to the appropriate Precinct Captain their ?ndings from these reviews. The Accreditation Manager will conduct an annual review of agency practices, including a review of citizen concerns. After the Chief approves the Accreditation Manager?s annual review, the Accreditation Manager will make available to the public a summary of all pro?ling complaints for the preceding year, including the ?nding of such complaints.
