I have also reviewed an email sent by Ms; Markham to Assistant, City Attorney Jay Unora dated Monday, October 19, 2015 regarding the status of this matter; indicating that an additional $15,000.00 payment was made last month to reduce the total balance owed to $73,564.65. The Of?ce of the City Attorney has discussed this proposal with the City of Milwaukee?s Department of Neighborhood Services (DNS). Based on a review of DNS records, it is our understanding that as of September 29, 2015, Diving Momentum Real Estate, LLC had an overdue balance of $92,937.00 from Municipal Court judgments based upon DNS code enforcement prosecutions. DNS indicates that there were approximately. 57 different cases ?led by DNS against Divine Momentum ReallEstate, LLC in the last three years, notably making Divine Momentum Real Estate, LLC thenumber one offender in the City of Milwaukee as it relates to ?code' enforcement. DNS, reviewed the list of properties attached to your July 31, 2015 letter as Exhibit A and has determined that 13 of those propelties are still on reinspection due to noncompliance with DNS orders; three'properties haVe- open code violations and one property is pending a raze order. It is our further understanding that DNS in late-2014, early?2015 gave Divine Real Estate, LLC a?road map to compliance as to all the properties. MILWAUKEE Ms. Monica Kim, JD, MBA Beth Markham November 3, 2015 Page 2 Based at least upon the 16 properties that are found in Exhibit A that are either on reinspection or have open code violations, it does not seem appropriate to begin a discussion as to forgiving any judgments while these properties are still not code- compliant. Frankly, given the extent, time and resources spent in prosecuting Divine Momentum Real Estate, LLC in the Milwaukee Municipal Court, your proposal to reduce the entire amount owing to zero, while not accounting for any sort of code compliance with any of the properties listed in Exhibit A of your July 31, 2015 letter, would seem to be inappropriately premature. . Sum, based upon cc-nsultaticn with our client DNS, the City Of?ce would respectfully reject your proposal to forgive or waive the remaining amounts owing. In spite of this rejection to waive the judgments due and owing to the City of Milwaukee, I would encourage you to again reach out to DNS and perhaps seek an updated road map for code compliance as to all of the properties owned and operated by Divine Momentum Real Estate, LLC. Of course, it would seem that it is the intention of all parties in this matter that the properties become code?compliant as soon as possible.
