BARBIERI Sir: In compliance with Special Order #15-168 dated September 14. 2015 and being responsive to a report authored by Captain David Martin. Squad A Uniform Commander, this report is being submitted. SUIVIIVIARY On September 11. 2015 at approximately 7:30 PM. Of?cers Jonathan Truner and James Goldrick arrested Mr for a default warrant out of Dudley. Massachusetts. Mr. was booked at 130 Pearl Street and placed in cell 011 September 13, 2015 at approximately 12:15 AM. suffered a medical emergency while in custody. Mr. was formd run'esponsive in his cell by Of?cer Michael Rodri guez while he conducted his ?rormds? or cell checks. Of?cer Rodriguez noti?ed Sergeant Phillip McBride and Of?cer Joel Rosemond who came to assist him in giving ?rst aid to Mr. Several of?cers provided rescue breathing and compressions (CPR) an also utilized an Automated External De?brillator (AED). American Medical Response (AMR) responded took over the care of Mr. -and ultimately transported him to the Baystate Medical Center where he was pronormced deceased at approximately 1:10 AM. by Of?cer John Taylor, Squad Major Crimes Division, authored a report to Commissioner Jolm Barbieri. The following is an excerpt of that report, including any grammatical errors: Dr Dr. Cause of Death Dr. A review of the Commonwealth of Massachusetts Certi?cate of Death for Mr. dated November 23. 2015 showed that the ?manner of death? was anatheofdearh? Sergeant Phillip McBride, Squad A Uniform Division. stated that on September 13. 2015 he was assigned to the Booking area. Sergeant McBride stated that he arrived in SO #15-168 Pg. 2 of 36 the Booking area at approximately 11:30 PM. on September 12, 2015 and relieved Sergeant Louis Bortolussi. Sergeant McBride stated that Sergeant Bortolussi told him that the prisoner in cell #10 was given a dose of medicine from his asthma pump at approximately 6:35 PM. Sergeant McBride stated that Sergeant Bortolussi also informed him that Mr. in cell #9 complained of slight discomfort in his lower back. Sergeant McBride stated that Of?cer Michael Rodriguez came into the Booking area at approximately 11:32 PM. 011 September 12, 2015. Sergeant McBride stated that Of?cer M. Rodriguez conducted a ring and took a quick cormt of the prisoners to con?rm the count. Sergeant McBride stated that Of?cer M. Rodriguez told him that all the prisoners were accorurted for and all were responsive. Sergeant McBride stated that at approximately 12: 15 AM. on September 13, 2015 Of?cer M. Rodriguez told him that he formd Mr. turresponsive. Sergeant McBride stated that he went to the cell with Of?cer Ro ?rguez and Of?cer Joel Rosemond. Sergeant McBride stated that he saw Mr. was sitting on the ?oor with his eyes open but his gaze was ?xed 011 the opposite wall of the cell and he was not responding to verbal Sergeant McBride stated that Of?cer M. Rodriguez opened the cell and they immediately performed CPR on Mr. Sergeant McBride stated that he went and noti?ed Captain David Martin and requeste an ambulance. Sergeant McBride stated that AMR responded at approximately 12:26 AM. and was transported to the Baystate Medical Center. Sergeant McBride stated was pronorurced deceased at the Emergency Room by Dr. Mr. that Mr. Of?cer Michael Rodriguez, Squad A Uniform Division, stated that 011 September 13, 2015 he was assigned to male cell guard at 130 Pearl Street for his tour of duty. Of?cer Rodriguez stated that he arrived on September 12, 2015 at approximately 11:30 PM. and immediately conducted a cell count per Sergeant Phillip McBride?s request. Of?cer Rodriguez stated that there were 14 male inmates, including Mr. cell Of?cer Rodriguez stated that dru?ing his cell count, he conducted a ?ring? which is when an of?cer checks each imnate and ensru?es that they are alive and breathing. Of?cer Rodriguez stated that a ring is to be completed every 15 minutes. Of?cer Rodriguez stated that during his third ring, at approximately 12:12 A.M., he noticed Mr. sitting on the ?oor. Of?cer Rodri lez stated that the imnate in cell #24, Mr directly across from Mr. cell, told him that Mr. wasn?t breathing or moving. Of?cer Rodriguez stated that he opened the cell door, conducted a sternrun rub to check for responsiveness but Mr. did not respond or show any signs of responsiveness. Of?cer Rodriguez stated that he immediately noti?ed Sergeant Phillip McBride and began CPR. Of?cer Rodriguez stated that Of?cer Joel Rosemond grabbed a medical bag and AED. Of?cer Rodriguez stated that while he was conducting CPR, Of?cer Rosemond began to apply the AED on Mr. Of?cer Rodriguez stated that AMR arrived and they took over the care of Mr. and began to provide CPR and fluther care. Squad A Uniform Division, stated that 011 September 13. 2015, he was assigned to the booking area along with Sergeant Phillip McBride and Of?cer Michael Rodriguez. Of?cer Rosemond stated that at approximately Of?cer M. Rodiiguez came to the booking area and noti?ed Sergeant McBride that was not breathing. Of?cer Rosemond stated that Of?cer Rodriguez and Sergeant McBride retluned to Mr. cell and began conducting CPR. Of?cer Rosemond stated that he grabbed the medical bag and AED and went to Mr. cell (M9). Of?cer Rosemond stated that while Of?cer Rodriguez was conducting CPR he applied the AED on Mr. Of?cer Rosemond stated that when AMR arrived they informed of?cers that they would be taking over care for Mr. Of?cer Rosemond stated that AMR transported Mr. - to the Baystate Medical Center. Report submitted. Sergeant Louis Bortoloussi, Squad Uniform Division. stated that on September 12. 2015 he was assigned to the Booking area along with Of?cer Michael Dowd and Of?cer Joel Reyes. Sergeant Bortolussi stated that at the beginning of his shift he did the cell checks and prisoner. Mr. appeared to be ?ne and did not complain of any ailment. Sergeant Bortolussi stated that at approximately 8:45 PM. he was told by Of?cer Reyes that Mr. was complaining about some minor lower back pain. Sergeant Bortolussi state rat he told Of?cer Reyes and Of?cer Dowd to monitor Mr. for the rest of the night. Sergeant Bortolussi stated that Of?cers Reyes and so #15-168 Pg. 4 of36 Dowd told him that Mr. throughout the rest of the night. was checked every 15 minutes and he appeared fme Of?cer Joel Reyes, Squad Uniform Division, stated that on September 12, 2015 he was assigned to the booking area as the male cell guard along with Sergeant Louis Bortolussi and Of?cer Michael Dowd. Of?cer Reyes stated that at approximately 9:00 P.M., while performing hislS minute cell block checks, Mr. who was in cell complained that his lower back bothered him. Of?cer Reyes stated that he told Sergeant Bortolussi about the complaint made and he instructed him and Of?cer Dowd to monitor Mr. - for the rest of the evening. Of?cer Reyes stated that he fmished his shift about an hour later and there were no more complaints from Mr. - Of?cer Michael Dowd, Squad Uniform Division, stated that on September 11, 2015 he was assigned to the Booking area and at approximately 9:25 PM. was arrested and brought to the book to be processed. Of?cer Dowd stated that never requested any medical attention nor did he state that he had any blems. Of?cer Dowd stated that Mr. - was placed into cell #9 without Mr. medical pro incident. Of?cer Dowd stated that he also was assigned to the Booking area the following day on September 12, 2015. Of?cer Dowd stated that dru?ing his cell checks on September 11, 2015 and September 12, 2015 MI. was active, moving arormd his cell, he did not complain of any medical problems and the only conversation he had with Mr. was when he would ask for the time. 0 rcer Dowd stated that on his last cell check on September 12, 2015 at about approximately 11:35 PM. Mr. - was sitting on his bench and said nothing as he walked by. Sergeant Arthur D?Ambr'osia, Squad Uniform Division, stated that on September 11, 2015 he was assigned to the Booking area along with Of?cers Edward Seder and Michael Dowd and at approximately 9:25 PM. he booked Mr. I Sergeant D?Ambrosia stated that Mr. presented no problems at booking and conducted himself as a gentleman. Sergeant D?Ambrosia stated that Mr. did not complain of any ilhress or injury at the time of booking and he was placed into holding cell #9 without incident. Sergeant D?Ambrosia stated that at no time did Of?cers Seder or Dowd tell him that any prisoner complained to them that they were not feeling well. 011 September 13, 2015 Sergeant efferv Martucci, Squad Maior Crimes Division, authored an ?Interview Synopsis? for the interview of Mr. . Kennedv and I (Marti/cci) interviewed The interview was in relation to the death The interview was audio and video taped with Mr ?s permission. Mr- stated that he was arrested on Saturday (9/12/15) and placed in his holding cell (24) at approximatelv 8: 00 PM He described the person directly across 80 #15?168 Pg. 5 of36 from him as yelling, whining, banging his feet against the plexiglass, tossing, turning and trying to ?nd a comfortable position to sleep. Mr. stated that when he returned to his cell from being processed (records show he was processed at 8:40 PM) Afr. seemed ?ne. Approximately 2 hours after this, described as sleeping, tossing and turning. At some point, sweat, took off his shirt and began to ?drag himself on the ?oor. stated that the o?ficer that eventuallr found had just started his stated that this o?icer saw? alive 2 times and the third time stated that the icer did one round and then the guy yelled and the o?icei? went back to the cell. He stated that- mumbled something to the o?cer and the ozj?icer then left. stated that eventuallv sat on the ?oor with his back resting on the bench. observed gasping and eventually stopped breathing. state tat he waite a out 10 minutes and banged on the cell to get the o?icers attention. The o?icer responded to the bang and informed the o?icer that was not breathing. The o?icer checked on yelled for the Sergeant and began CPR, hooked him up to a green box and then an ambulance showed up. - stated that no officers entered cell prior to entering for his medica attention. -identified- in a sing photograph. On November 10, 2015 I interviewed Mr. . who stated that 011 September 12, 2015 at approximately 2:10 AM. he and his cousin, g" were arrested and booked at police headquarters. Mr. state at was aced in cell #25 and after being fm erprinted and photograp he noticed that his neighbor from Mr. was in a cell 9 which was almost directly across from his cell. Mr. stated that he casually knows Mr. when he sees him walk and ride his bicycle through the neighborhood. Mr. stated that this was about an hour after being arrested. Mr. stated that he - from to which Mr. began to spoke to Mr. by saying, ?Your name is replied, ?Yeah.? Mr. stated that as a police of?cer walked by doing his ?rounds? Mr. would shout to the of?cer. can ?t breathe, I need my treatment.? Mr stated that Mr. would also yell out that he was getting sick and that he was ?hot.? Mr. state rat 1e described the of?cer as being a short white male, 30-40 years of age, wearing a lon sleeve shirt with just a police patch on the arm. shaved head. and a medium build. stated that the of?cer told Mr. - ?You need to hold on, I need to do my rounds.? Mr. stated that the of?cer never came back to address Mr. complaints of not feeling well. Mr. stated that this of?cer also came to his cell and discussed his bail requirement and again Mr. screamed out that he needed his treatment but the of?cer did not address Mr. Mr. stated that eventually Mr. complain fluther about health issues. Mr. stated that in the morning the of?cers came by to give everyone coffee and donuts. including Mr. Mr. stated that Mr. ate the donuts and drank the coffee and did not complain fruther. laid down and fell asleep and didn?t SO #15?168 Pg. 6 of36 Mr. - stated that at approximately 10:00 AM. to 11:00 AM an of?cer (Of?cer Ramon Santana) took him out of his cell to be released on bail. (A review of the release of Mr. - showed that he was actually released on bail at approximately 1:00 PM. on September 12, 2015.) Mr. - stated that he told Mr. - ?Behave, keep strong, you ?re about to go to court soon? to which Mr. - replied, ?Alright.? Mr. - stated that the next day, September 13, 2015, he saw Mr. girl?'iend (ruiknown name) standing in the street and she was crying. Mr. that she told him that Mr. was found deceased in his cell. 1 showed Mr. otographs of all the of?cers that had worked the booking area ?'onr the time of Mr. arrest at 7:22 RM. 011 September 11, 2015 to the time he was discovered um?esponsive at approximately 12: 15 AM. 011 September 13, 201 5. stated Mr. - picked out a photograph of Sergeant Donald Denault (17647) and wrote 011 a copy of the photograph, am 50% percent sure this the o?icer came and talk to me about bail and disregarded medical assistance and this is the o?cer that came around and did the round even: 15 min.? Mr. - stated in his interview that the of?cer that Mr. - complained to was the same of?cer that spoke to him about bail and walked him to the Clerk of Courts to be bailed out at 1:00 PM. 011 September 12, 2015. A review of the video of release on bail (approximately 1:15 PM. on September 12, 2015) showed that it was Of?cer Ramon Santana, Squad Uniform Division, that walked him out of the cell block and positioned him in front of the booking desk. (Of?cer Santana worked ?'om 7:45 AM. to 3:45 PM. and could not have been the of?cer who spoke to Mr. - at approximately 3:15 AM.) The of?cers assigned to the booking area during the times (3:15 AM.) described by Mr. - would have been Sergeant Donald Denault, Of?cer Jacob Strange and Of?cer Brian Phillips. Sergeant Donald Denault, Squad A Uniform Division, stated that on September 12, 2015 he was assigned to the Booking area. Sergeant Denault stated that during his initial cell checks that evening, Mr. was present and he did not complain of any medical issues or ask for any medical assistance. Sergeant Denault stated that he did not have any more contact with Mr. for the rest of his tom: Sergeant Denault stated that on September 12, 2015 he also booked - and after the booking procedru?e he did not have any further contact wit 1 Mr. On November 10, 2015 I interviewed Mr. who stated that 011 September 12, 2015 at approximately 2: 10 AM. he and his cousin, Mr were arrested and booked at police headquarters. Mr stated that shortly after being booked he was taken to the hospital to be treated for injuries that he said he incrured during a ?big ?ght? that night. Mr. stated that he arrived at police headquarters at approximately 5:00 AM. and was placed in cell #24. stated that when he arrived everyone was sleeping, including stated that he didn?t notice that his neighbor, Mr. - was in a cell directly across ?'om him rmtil it was time for him to be bailed out (approximately SO #15-168 Pg. .7 of36 1:15 PM. on September 12, 2015) and when he was being let out of his cell, Mr. said to the of?cer (Of?cer Ramon Santana), ?Can you call my wife, I need my medication, I need to get out of here.? Mr. stated that he also told (Of?cer R. Santana), ?You need to call his wife, he is a sic 'y person.? I asked Mr. - how he knew that Mr. was a sickly person and he said. saw him take his medication outside one time.? I asked Mr. if he knew of any medical ailments that Mr. suffered ??om and he replied, ?No. Mr. described the of?cer that took him out of his cell to be bailed out as a white ma e. ate 30?s to early 40?s. black hair and heavy set. Mr. stated that the following day on September 13, 2015 his aunt (Ms told him that Mr. had passed away while in his cell. I showed Mr. photographs of all the of?cers that had worked the booking area ??orn the time of Mr. arrest at 7:22 PM. on September 11. 2015 to the time he was discovered urn?esponsrve at approximately 12:15 AM. on September 13, 2015. Mr. picked out a photograph of Of?cer Michael Dowd (19743) and wrote 011 a copy of the photograph am 75% percent sure this is the o?icer that released me from my cell and ignored the Ciys of other sickly inmate when inmate need proscribed medical medication and to please call his wife.? A review of the video of Mr. release on bail (approximately 1:15 P.M. on September 12. 2015) showed that it was Of?cer Ramon Santana, Squad Uniform Division. that walked him out of the cell block and positioned him in ??ont of the booking desk. (Of?cer Michael Dowd is assigned to the Squad Uniform Division, 4:00 PM. to 12:00 midnight shift and could not have been the of?cer that released Mr. I. This On November 17. 2015 I interviewed interview took place at the Harnpden ormty House 0 orrectrons 1n Lu ow rere Mr. has been held since his arrest (Arrest on September 11, 2015. Mr. was placed in cell #8 (which is directly next to Mr. cell from September 11, 2015 at approximately 2:05 PM. to 6:51 AM. on September 14. 2015. Mr. stated that on September 12, 2015 at approximately 6:00 PM. he heard Mr. tell the of?cer that was conducting the cell checks that his back hurt him. Mr. described the of?cer as being Hispanic. medium/heavy build. late 30?s with black hair. Mr. stated that the Hispanic of?cer told Mr. ?I?m going to tell the sergeant? to which Mr. replied. ?Alright.? Mr. stated that the next time that the Hispanic of?cer came to do his round he heard Mr. ask, ?Did you tell the sergeant?? and the Hispanic of?cer replied. ?Yes, I told him?? Mr. stated that the next time the Hispanic of?cer came arormd he heard Mr. say, ?This is crazv, just call the ambulance, you can call the .Mercv, they will tell you what?s up?? Mr?. -stated that the Hispanic of?cer to? ?We called an ambulance, it?s on the way.? Mr. stated that Mr. calmed down and fell asleep. Mr. stated that an am 11 ance never came urrtr much later in the night after they forurd Mr. not breathing. 80 #15?168 Pg. 8 of36 Mr. - stated that later in the night Mr. woke 11p and started to bang on the glass for 2 hom's, while screaming, ?This ain?t right, call the ambulance.? Mr. - stated that again, Mr. fell asleep. Mr. - stated that again, Mr. awoke and started to bang on the glass and eventually the banging stopped. Mr. stated that as a new of?cer came by to make the rormds the 1 in the cell across ?'om his told the of?cer, think he stopped breathing.? Mr. stated that he heard the cell door open and then heard the of?cer yelling for help. Mr. stated that several of?cers arrived and they performed CPR and then AMR arrived and took over doing CPR. Mr. - stated that no of?cer ever entered Mr. - cell and Mr. - never complained about an other aihnents other than back pain. I showed Mr. photographs of all the of?cers that had worked the booking area ??om the time of Mr. arrest at 7:22 RM. 011 September 11, 2015 to the time he was discovered um?esponsrve at approximately 12: 15 A.M. 011 September 13, 201 5. Sergeant Louis Bortolussi authored a report in which he described that Of?cer Joel Reyes noti?ed him that complained that he was having back pain. Sergeant Bortolussi told Of?cers Reyes and Dowd to monitor Mr. - for the remainder of the tour. On November 11, 2015 I interviewed Mr. - was arrested on September 12, 2015 at approximately 2:09 A.M. and was placed in cell #22 (across ??om Mr. - cell #9 and two cells away.) Mr. - stated that he was released on bail at approximately 1:00 PM. on September 12, 2015. Mr. - stated that he did not recall hearing anyone asking for help for medical issues. He informed me there were 14 male prisoners and 2 female 15 prisoners in custodv. He told that 3 of the males were Q5 Sgt. Bortolussi informed me that the prisoner in Cell 10 -) was given a dose of medicine from his asthma pump at approximatelv 1835. He also informed me that Prisoner in Cell 9 complained of slight discomfort in his lower back. Rodriguez came into the Booking Area at approximatelv 2332 hours. At approximately 0015 hours I was heading to the Male Cell Block to do the cell checks after Mr. -was secured in his cell. As I was heading to the cell block, Off Rodriguez informed me that when he was doing the 0015 ring he found Mr. was unres onsive. He said that as he approached the cell the prisoner in Cell #24, AR), told him there was something wrong with the guy across the hall. I went to the cell with Rodriguez and Rosemond. I observed that Mr. was sitting on the ?oor with his eyes open. His gaze was ?xed on the opposite wall of the cell and he was not responding to verbal commands. Off. Mr. - stated that this of?cer also came to his (Mr. cell and discussed his bail requirement and again Mr. screamed out that he needed his treatment but the of?cer did not address Mr. Mr. - stated that eventually Mr. complain fruther about health issues. Mr. was placed in cell #8 (which is directly next to Mr. cell ??om September 11, 2015 at approximately 2:05 PM. to 6:51 AM. 011 September 14, 2015. Mr. - stated that on September 12, 2015 at approximately 6:00 PM. he heard tell the of?cer that was conducting the cell checks that his back hint him. Mr. described the of?cer as being Hispanic, medium/heavy build, late 30?s with black hair. Mr. - stated that the Hispanic of?cer told Mr. ?I?m going to tell the sergeant? to which Mr. - replied, ?Alright.? Mr. stated that the next time that the Hispanic of?cer came to do his round he heard Mr. ask, ?Did you tell the sergeant?? and the Hispanic of?cer replied, ?Yes, I told him?? Mr. - stated that the next time the Hispanic of?cer came arormd he heard Mr. - say, ?This is crazv, 'ust call the ambulance, You can call the hierar, they will tell you what?s up?? Mr. stated that the Hispanic of?cer told Mr. ?We called an ambulance, it?s on the wart.? Mr. - stated that Mr. calmed down and fell asleep. Mr. stated that an ambulance never came imtr much later in the night after they found Mr. not breathing. Mr. - stated that later in the night Mr. woke up and started to bang on the glass for 2 horu?s, while screaming, ?This ain?t right, call the ambulance.? Mr. - stated that again, Mr. fell asleep. Mr. - stated that again, Mr. awoke and started to bang on the glass and eventually the banging stopped. I showed Mr. photographs of all the officers that had worked the booking area from the time of Mr. arrest at 7:22 P.M. on September 11, 2015 to the time he was discovered unresponsive at approximately 12:15 A.M. on September 13, 2015. Mr. did not respond or show any signs of responsiveness. It appeared as though Mr. was not breathing. I did not see the rise and fall of the chest. I immediately notified Sergeant McBride and began CPR. O?icer Rosemond grabbed a medical bag and AED. On that day I performed several cell block checks and did not encounter any unusual activities or events. It was also our duty to o?er food and drinks to these clients that day. That particular day we gave them breakfast and lunch. This is done by phvsicallv opening the cell door and handing them their food and drink. This also allows them to share any concerns or needs with us at that time. My recollection of Mr. that day is that he occupied male cell Number 9 during my shift.
