During my approximate 20 years in law enforcement, I have interviewed no less than 500 subjects in criminal activity, conducted surveillance ol?crintinai subjects. used confidential and worked in an undercover capacity. I have personally investigated or participated in the investigation ol?ot'er 500 pert-ions involved in, but not limited to, participation in a criminal street gang. physical assault, sexual assault. conspiracy. emheaaletnent, attempted homicide, homicide. kidnapping, fraud, the theti ol? public funds, distribution and use of illegal narcotics, sale of illegal narcotics, and the investigation of major Drug Trafficking Organisations defined by the United States Department of Justice as ?complex organisations with higth detincd command- and-conlrol that produce, transport, and/or distribute quantities ot'one or more illicit drugs.? 6. During this investigation, I have consulted with Fresno Police Department Detective David Fries regarding sex tra?icking matters. Detective Fries has been a sworn police officer with liresno Police Department since Jttne 1993. He has successfully completed the POST Basic l?olice Acadehis which encompassed over 1000 hours ofspecialized training. 7. he Following is a sample of Detective Iiries? his training attd assignments. Detective Fries has conducted numerous investigations resulting in arrests (suspects in connection with various Vehicle Code, Penal Code, Health and Sal?er Code. war-am and Institution Code and Juvenile Law violations, Business and Professions Codes and U33. Detective Fries has processed numerous crime scenes and collected various items of evidence and preserved evidence for use in identifying suspects, victims, involved parties and property. Detective Fries has also prepared and used photo line?ups numerous times to identify suspects. 'l?hrough his more than 17 years experience in Law Enforcement on the street, Special suits and as a Detective, Detective Fries has become very Familiar training, experience, conversations, interviews, investigations, other officers and con?dential informants, with the crimes of prostitution, pimping, pandering, Human 'l'ralliclting and conspiracy to commit these crimes. Detective Fries has also learned the terminology, devices, clothing, Weapons, technology and tools used by those committing, these crimes. Detective Fries has arrested. cited, interviewed, talker] to or contacted over a 1000 suhjects, male and liemale, working as prostitutes from ages 13 years old to almost 70 years. Detective Fries has arrested, contacted or interviewed numerous subjects involved in prostitution, pimping, pandering or human traf?cking ol? persons. According to Detective Fries. in the Central Valley ol'Calilhrnia. persons working as prostitutes tend to almost always be female while the person acting. as pimp tends to almost alvvays be male. A solo pimp can has as Few as one person Working as a prostitute under him and as many as ten or twenty in his 'stablc' {the term used to describe the group ofgirls working under a pimp) although a larger amount of tetnales usually is run by two or more people. These larger groups are usually a criminal organisation and commonly a street gang. 11. In his experience Detective Fries has found there are generally three types of pimps referred to in Fresno; Street Pimp (a pimp who keeps his girls on the street and generally recruits females who are already involved in prostitution. He generally does not has a car and uses public transportation), pimp (a pimp who ?rst dates and romances a girl until she has deep feelings "For the pimp where he then can guilt her into prostituting so they can. has a "better life together")? and a Gorilla pimp (a pimp who will Force a girl to prostitute .th him by physical force, beatings or threat toward loved ones or kids). Pimps often go 'li?om acting as one type to another with different girls or with the same girl as circumstances change. Pimps recruit there girls everywhere they come in contact with them. Historically it has been at school functions, malls, theatres or any gathering place for teens and young adults. Over the last ten years more and more recruiting is taking place online. Females are being recruited through twitter, instagram and other social media outlets. This ability to recruit girls out of their own houses has exploded the numbers ofvictims and increased the target pool for the pimps. 12. it is often the case that Females are ?rst lied to and tricked into prostituting by a sweet tallting pimp or by a tomato working for a pimp that recruits the girl under the direction ot? the pimp. They are later made to work as prostitutes on the streets, in residences, .l1otels or motels under duress, t?ear, debta for the exchange oi'drugs while/ifthe fen'ialc is addicted to drugs or for the love ot?the pimp who has made the female believe she is the pilup's one and only girlfriend. The girls Forced to work as prostitutes will often refuse to leave or give intinrmat'ion about their rpimp' to law enforcement because Fear of retaliation the pimp has indicated would happen or of losing him because she ti:er he is the one she loves. Pimps are usually given all the money gained from the illegal prostitution activity by the Females they are prostituting in exchange For promises ot"'proteetitm? or other benefits like hottsiug, companionship, a. promise (its better life or love or by using leverage of '11 41 DJ 56x10"- children or family. This protection is ellen to keep the pimp from assaulting them or from fear of some other threat. These tetnales are often made to work the streets Ltntil they gain a quota amount of money for that day/night or complete a speci?c number of *dates', It is his experience that persons werlting as prostitutes often communicate with 'Johrts' (customers) via cell phone or email and often ttse testing or messaging aps to set prices for sexual acts, the amount oftime that will be spent doing the act and/or a location to meet. The female presututing will also stay in contact with their pimp by cell phone in order to keep him updated as to the activity on the street, the amount of n'tone}r they has made, the police activity and for transportation, to and from prostitution areas. This same cell phone will often be taken from the female to keep her from noti tying; anyone when he is not around or after she is disciplined. Pimps Will often have rules for the females working under them, to include but not limited in; not looking at any other black males for fear the female will be recruited by another pimp or the female will ?nd a new pimp ('choosing up' or asking her pimp for permission to buy anything with the mrmey made while on the street and ifa 'ft-ttnale wants to get out ofthe prostitution lifestyle ('the patne') she must pay an exit fee to the pimp. 13. Females working as prostitutes will often. be advertised online through a hisriad of sites. Advertising can be in forms of writing, pictures and/or Videos which often indicate a means ofcontacting the pimp and/or tiemalc for prostitution activity to include but not limited to a phone number. a website or email address- The postings often list the prostitution acts the female is 'willing' to do, the price for each act and/or the cost for a speeifte amount of time spent with the female for prostitution activity. in his experience it is o?en the pimp who will pay for, Update and/or monitor the postings for these online advertisements but at times will has a prepaid credit card in another name or will has one of the females workng under him use her own Credit card or 1D to pay for the posts and monitor them. 14. At times these pimps will also rent motel/hotel rooms or apartments to secure a place for the females to conduct the illicit activities and/or to has a place to stay hot at times will has one of the girls use their own ID to rent the rooms, either because he lacks one or to mam ere-och llhide his illicit actiVily. Other times the females will be instructed to have the ?rst ?date' pay for the room as payment list the act ot'prostitotion. This allows the pitnp and his girls names not to be on the registration to prevent detection. in high prostitution areas it is not Uncommon lor the girls andl?or the pimp to become Familiar with the sta It and management. Establishments in these areas ol'ten count on the income derived l'rom allowing prostitution activity to take place. Male managers are olten additional payments via above and beyond the price ot?the room or with sexual activity with the females working under the pimp. 15. Most pimps will has a female working For them who they trust more than the others who is referred to as the "Bottom Bitch" (The girl he trusts the most or has been working. for him the longest). he Bottom Bitch (or ?Bottom?) is in charge of the other girls when the pilot) is not around and will often t?ul'till all the roles of the pimp in his absence. these roles could include; collecting the money. monitoring the other females and amount ol? money they should have, monitoring the website postings and even discipline. The bottom bitch is often under the impression that the pimp loves her and she is his girlfriend/wife ot? the pimp, while the other girls are there only to support the pimp and the bottom bitch. The bottom bitch is usually operating under the same tear or threat of retaliation and has been subject to the oppression From the pimp the longest, in. Girls convinced by a pimp to prostitute for him typically come l'mm an upbringing of abuse or molestation and has fallen for the pimps promises and lies but are later ruled by his abuse and threats. The pimp is able to distance the female from all persons she would normally turn to For help causing the female to be dependent on the pimp for all her needs since she can't see any way out and feels trapped. He does this by gaining knowledge of the Family during the lirst part olitheir relationship. As time goes on the pimp uses his knowledge other litmin to lteep her in fear that he will do something to hurt them. At the same time he lets the "Family ltnow she is prostituting so they will shun or reject her so she only has the pimp to turn to. 17. Over time she resigns herself to accepting her "new life" of prostitution under the pimp and with this separation from loved ones; it creates a stronger draw to the pimp fer Ell-huh} encodesustenance. The pirnp will be the sole decision maker oi" when and where the girls will work as prostitutes. This is often decided by the amount of money being made or the increase of complaints and law enforcement presents. Pimps will move their girls to other areas within a city. begin to has them advortise online instead ot' walk the strip (area of prostitution), take them to another city all together or even take them to other states, which he has previous knowledge of or has been inliormed is producing a lot of money. The pimp will transport his females by vehicle, train, bus or even airplane depending on his resources or his destination. in the game" the mentality ol? the pimps and females that they control, is that the girls who choose to be with a pimp also choose the punishment that pimp gives them regardless of how severe. The pimp will believe he did not make her do anything she did not want to do. even though he beat. threatened or punished her for breaking his rules, because she chose to be in the game and chose to he with him. She chose to be in the game and with that she chose everything that took place alter that one decision regardless o'l?how many times she said she wanted out or tried to leave or run. This mentality exiSts even though the original choice was based off of lies the pimp told to her. Additionally the females are often under the impression that they will never be able to get away from the pimp and that he always will know where she is at and What she is doing. This belie!" is enhanced by the pimps through spying on the girls. A solo pimp will often use up and coming youngsters to help spy while the groups. like gangs. will often spy on each other?s girls and work as a group. In working together all the girls working under a group or a gang believe that the pimp will always know what they are doing and where they are at. With this belief the girls feel there is no where they can hide or turn to get away because every attempt has been met with threats, beatings or punishment. As law enibreernent agencies continue to learn and attempt to stop these girls from being vieti mi zed. the pimps learn new ways of hiding or evading detection. 18. As a result of my collaboration with Det. [tries and others who have expertise in prostitution and sex trafficking. as well as my participation in the instant investigation, 1 have become familiary with the practices and procedures used by pimps, and the culture surrounding sex traf?cking. u. me?laddition to the experience have gained in my tenure as a law enibrcemcnt officer and from listening to thousands ot'calls in the instant matter as well as conducting surveillance, 1 consulted with Detective Ken Dodd, who is a sworn police of?cer employed by the City of Fresno Police Department, where he has been so employed for approximately 22 years. Before joining fiPD, Det. Dodd worked for the County ot'Santa Cruz Sheriff's Department and had been so employed for approximately two and a halfyears. 20. During Det. Dodds career in law enter-cement, he has investigated thousands of Criminal violations involving ti'aud and/or forgery, identity theft, burglary, robbery, sex crimes, vice/narcotics, traffic, homicide, etc. Del. Dodd has written, served, or executed over 200 search warrants which has resulted in the arrest of over 100 suspects. Del. Dodd has served the Fresno Police Department in the capacity of patrol assignment, a tactical team member, a problem oriented policing ot'ticer, burglary detective, ?nancial crimes detective, a Task Force Of?cer assigned to the Federal Btu?eau oi" Investigation FBI) White Collar Crime Unit and is currently assigned to the Fresno Police Department?s Street Violence Section as a Homicide Detective. 21. As a result of my collaboration with Der. Dodd and who have expertise in investigating fraud crimes, as well as my participation in the instant investigation, I have become ftuniliar with the practices and procedures used by individuals engaged in fraud, particularly the type underlying the instant offense, that is the production and use of fraudulent credit cards. ?22. have authored search warrants auditor court orders in Alameda, liresno, Kern. Madcra, Mcrced, Monterey, and Tulane counties. Additionally, I have served numerous felony arrest warrants and/or search warrants anti have conducted hundreds of probation anti parole searches involving persons suspected ct" criminal activity. I have testified as a Peace Officer: in the Fresno. Kings, Madera. Merced. and 'l'ulare County Superior Courts. have also testi?ed as an Expert Witness in the field of narcotics in the Merced County Superior Court. 23. I am certi?ed by the California State Attorney General?s ('Ll'fl'ice in the l) practical, technical, and legal aspects at court ordered wiretaps (Penal Code Section 629.50 et seq) and am thus Familiar With the use 1.11Fclectr?onic tracking equipment, the ttse otieourt ordered pen register trap and trace intercepts, and the interception of telephone communications. 24. have personally been involved in the interception ofno less than 200 telephones conducted in relation to DTOs, homicide, attempted homicide, human traf?cking, narcotics and/or participation in a criminal street gang. Many of the members and associates of the Enterprise act as ?pimps,? defined as a person who befriends, recruits, trains and/or ponders a person for prostitution, and ?bottoms,? defined as a plant?s most trusted/senior prostitute who the pimp uses to promote and manage his/her prostitution activities. Most women are usually introduced into prostitution by someone who they hold in high regard or With whom they feel safe. Commonly this person poses as a boyfriend or someone who gives them the belief they will be taken care of and all their needs will be addressed. The young females are often from broken homes and commonly have been in the foster or group home system. They are promised love, money, a family atmosphere, anti a carefree lifestyle. The victims are often put through a "honeymoon" phase when lirst introduced. A honeymoon phase is commonly defined as a timeframe whereby they are made numerous promises and made to feel comfortable. At this titne the pimp may act :1 ?Romeo? pimp, or one who treats his prostitutes with care and af?setion, much as if he is engaging into a romantic relationship with them. As times go on the females begin to realise the prostitution life is dangerous, scary, and they begin to see that all the money they make prostituting goes directly into the pockets oftheir boyfriend/pimp. As the female begins to pull away, wants more of the profits, or decides she no longer wants to prostitute, the pimp begins to change. From ?Prince Charming? the prince pimp then changes tactics and begins to terrorize the female through fraud, coercion, emotional manipulation. threats to her or her loved ones, various forms of violent punishment, and shame in order to get their prostitutes to follow their rules. This style of pimping is commonly de?ned as being a ?Gorilla? pimp. Further, the pimp will sometimes take the female to other areas to prostitute so that the remote is removed from her family and friends; at that point her pimp and other prostitutes are the only people she knows. Pimps also use drug addiction as another method of preventing their prostitutes from leaving. More often than not, the females remain in the prostitution lifestyle until they hit roelt bottom and get to a point where they no longer care sheet their own lives and try to escape. 63. Based on the information obtained during this investigation believe the DPG has spawned a ?pimping,? subculture within the gang. This subculture has thereby created a separate set ofrulcs her which members must adhere. ProStitutcs are expected to maintain absolute loyalty to their pimp. and in fact, are often considered a commodity or property of the pimp and may be traded or sold among the pimps. Further prostitutes are not permitted to speak with or even look at other pimps; nor are they allowed to prci?brtn acts of prostitution with any African American male.
