WHEREAS, Section 75·2 of the Cherokee Code states, "It shall be the policy of Cherokee One Feather
to publish news articles and other materials and information judged by the editorial staff to have
general value to the Cherokee community. Such news articles shall include a resume of Tribal
Council business, Executive Committee and Business Committee actions and actions taken by other
Tribal committees, boards and enterprises. All news articles, editorials and other matters dealing
with controversial subjects shall be submitted to the editorial board for consideration and approval
prior to publication," and
WHEREAS, legislation known as the Free Press Act was passed and went into effect on May 12,
2006; and
WHEREAS, Sections 75·55 and 75-56 of the Free Press Act establish the Editorial Board and its
powers and duties; and

WHEREAS, the intent of the Free Press Act is in direct conflict with that of Section 75-2.
NOW, THEREFORE BE IT ORDAINED, by the Eastern Band of Cherokee Indians in Tribal Council
Assembled, at which a quorum is present, that parts of Section 75-2 of the Cherokee Code be
stricken.
