As you may recall, we worked hard last session to ensure that any increase in state land revenues from economic development taking place on state lands would go in equal measures to tax relief and school construction spending. When the Governor's budget was first released in November, we had misinterpreted a line item in that budget as proposing to frustrate this intent. The Governor's Office has recently clarified that the line Item in question only reflects the increased state general fund spending (of $11.5 million) needed to replace one time only funding that we incorporated in Senate Bill 175 last session. The bottom line is that Governor Bullock has not proposed to adjust or otherwise interfere with this key element of Senate Bill 175 in any way. We thank the Governor's Office for bringing this information to our attention and want to make sure our members know of this correction in our analysis. As we have previously stated on many occasions, MTSBA supports Governor Bullock's proposal to provide schools with inflationary increases needed to continue to increase student achievement and otherwise improve education for children educated in Montana's public schools. We also support Governor Bullock's vision and efforts to expand opportunities for younger children through Early Childhood Education. We remain hopeful that both proposals will eventually pass this session and we will continue to advocate for these and other priorities embraced by the K12 Vision Group and the partner groups in the Montana Public Education Center. Once complete, this new IBMP will guide the manner in which wild Yellowstone Bison are managed. Attached, please find a letter from 14 advocacy and community organizations - representing conservationists, scientists, and spo11sman, as well as millions of members and advocates -- who have come together to outline the core goals and principles that we strongly believe should guide the final IBMP that results from this new process. As I stated in caucus and the reason this bill passed the House 97-1 is because corrections facil ities are no place for patients with serious mental illness. I have personally conducted mental commitments as a prosecutor and I have closely followed the Montana A CLU in their litigation in these matters. I would have can-ied the bill myself. Placing these patients in punitive settings- particularly where a judge has remanded them to a clinical setting- does not benefit the patient or the community. Bottom line: Patients, their fam ilies, and their physicians should have the opportunity to pa11icipate in the process prior to transferring them from a clinical hospital to punitive correctional setting. PrinL Page 2of10 Let me cut to the chase: Montana judges sentence defendants GBMI with the expectation that DPHHS will onlv transfer a patient to a conectional facility if the transfer better serves the patient's custody care or treat·ment needs. What is happening in practice is DPHHS is transferring GBMI patients to the prison to clear bed space or for reasons not related to the patient's custody care or treatment needs. Providing just a modicum of due process would help ensure that DPHHS is only transfe11"ing prisoners where it will better serve the patient's custody care and treatment needs. GBMI patients, most of whom have serious mental illness, are often uprooted from the state hospital and transfen-ed to the prison with no notice and no ability to provide input or input from their family members or treating physicians. At the prison, the psychiatrist patient ratio goes from less than l: l 0 at MSH to approximately I :300 at MSP. Corrections facilities are no place for patients with serious mental illness. Placing these individuals in punitive settings does not benefit the patient or the community. Patients, their families and their physicians should have the opportunity to participate in the process prior to transferring them from a clinical hospital to punitive correctional setting. I am enonnously passionate about this issue and this vicious (and costly) cycle in our criminal justice system. I sincerely implore the Governor NOT to veto this bill and I could not in good conscience uphold a veto on it. For those interested in more details, I have responded to Margie's bullets in favor of a veto below in CAPS. With total respect to her position, I have a different perspective. From Margie's email: 1) Montana is more "enlightened" than most states in that we allow individuals adjudicated as GBMI to be sentenced to the custody of the DPHHS - In the vast majority of states, all of this population remains in custody of the DOC equivalent. Almost all of our GBMI cases remain in custody ofDPID-IS throughout their term of incarceration. This is our current law. MOST STATES DO NOT NEED THIS LAW BECAUSE TRANSFER FROM DPHHS TO CORRECTIONS IS NOT ALLOWED, AND MONTANA IS ONE OF A MINORITY OF STATES THAT HA VE THE GBMI SENTENCE, RATHER THAN THE INSANlTY DEFENSE. It involves two layers of review, as I understand it. HERE'S WHAT WE HEARD IN COlv1MITIEE: THE CURRENT PROCESS REQUIRES ONLY THAT A FORENSIC REVIEW BOARD RECOMMEND THAT THE DPIIBS DIRECTOR TRANSFER THE PATIENT. IT DOES NOT PROVIDE A SHRED OF DUE PROCESS FOR THE PATIENT. THE PATIENT IS NOT GIVEN NOTICE THAT HE MAY BE TRANSFERRED. THE PATIENT IS NOT GIVEN AN OPPORTUNITY TO SPEAK OR ATTEND THE FORENSIC REVIEW BOARD MEETING, AND NO TREATING PHYSICIANS ARE CONSULTED OTHER THAN MSH STAFF ADVOCATING FOR THE TRANSFER. In other words, there are no other states that mandate a contested case administrative law judge for this. AGAIN, I AM UNA WARE OF ANY OTHER STATES THAT HAVE THE SAME SYSTEM THAT WE DO IN WHICH A DPIIBS AGENCY CAN UNILATERALLY TRANSFER A PATIENT ADJUDICATED GBMI TO A CORRECTIONAL FACILITY RUN BY DOC. AS STATED ABOVE, MONTANA IS AMONG THE MINORITY OF STATES THAT EVEN HA VE A GBlVII SENTENCE. 4) The bill has no impact on persons adjudicated as "not guilty but mentally ill" for individuals who were determined to have committed the crime, but whose illness is held responsible. This group of people cannot be transferred to the custody of the DOC, under any circumstances. THE FACT THAT CIVIL C0lv1MITS CANNOT BE TRANSFERRED DOES NOT MAKE THE TRANSFER ANY LESS EGREGIOUS. In other words, there are no other states that mandate a contested case administrative law judge for this. 4) The bill has no impact on persons adjudicated as "not guilty but mentally ill" for individuals who were determined to have committed the crime, but whose illness is held responsible. This group of people cannot be transferred to the custody of the DOC, under any circumstances. 5) There is a very small population that would be impacted by SB 316 - approx. 3 such cases a year over the past 5 years would fall into this set. For these reasons, and because it needs to be a very high bar to oppose our Governor's veto, I will vote to sustain him on SB 316 if he vetoes the bill. It is an important feature of our system for passing legislation that there are multiple hoops - a veritable gauntlet. It is not all that unusual that a bill will sail through one or both houses but is found to be fundamentally flawed or wanting for a variety of reasons. I certainly saw bills that sailed through the Senate with barely a "nay" vote hit the skids in the House for good reasons (sorry Senators!). The Governor also plays a role in that process, particularly when it is the executive branch that is closest to the situations and the people, both citizens and staff, that our bills will affect. (Incidentally, DPHHS did testify against SB 316 in the House Human Svcs Committee.) I know there are issues that need to be addressed in this area. It sounds like Sen. With three different proposals on how to fund state infrastructure, the Legislature failed to put any money into the hands of local communities for needed projects. Democratic Gov. Steve Bullock's HB 5 was taken apart in the Legislature. House Speaker Austin Knudsen, R-Culbertson, HB 402 was tabled and a bipartisan, negotiation bill failed to pass the House by a single vote in the final days of the Legislature. Commissioner Duane Mitchell said he thinks it was a good thing the negotiated SB 416 did not get through. "People didn't know SB 416 had $76 million worth of spending," Mitchell said, "all of it to western Montana. He (Bullock) was only talking about $35 million maximum for impact infrastructure after he spent $76 million for his projects. ThaCs what's crap about it." Mitchell put the fault on Republicans in name only, or "RINOs," centrist Republicans who sided with Democrats on certain issues, saying they nullified the Republican majority's hold on the Legislature. He said he's glad the compromise bill was shut down to prevent spending on projects that he didn't consider to be necessary infrastructure, and added he'd like to see more of that in Washington, D.C. Commissioner Shane Gorder said he was yet to sit down with Rep. Scott Staffanson and Austin Knudsen to discuss the finer point of their feelings about 416. However, he did say he was disappointed that infrastructure wasn't more of a priority in the session. "What upsets me most is since 2010 we've been giving tours to representatives to show them our infrastructure needs, what's happening in eastern Montana and how important water and sewer is," Gorder said. "It was upsetting to see it as the very last topic. If they had started earlier, they might have gotten it worked out." Commissioner Loren Young said it came down to political maneuvering. "I think the bill got loaded up and the Republicans got outmaneuvered," he said. ''It's regretful that there wasn't some infrastructure (options) better than that. I'm unhappy with both sides." Young, too, said the centrist Republicans cost the Right Wing their hold and made it easier for Democrats to shut down their majority. He added that ifHB 416 had passed, it would've been safe from veto because it funded the governor's "pet projects," whereas Knudsen's bill faced a sure veto from Bullock, having vetoed an almost identical bill in the previous session. The commissioners also expressed worry about the future funding of the Medicare expansion through the Affordable Care Act, which is expected to provide health care for up to 70,000 people in the state. However, after the federal government foots the first year's bill, the funding begins to go down to 90 percent, and the state has to pitch in for the remainder. "When the federal government pulls out, there will be no such thing as a surplus when it comes to health and human services," Mitchell said. "This state is going to be in worse shape than they are now. The federal government is broke. We're still going to have those 50-70,000 people on the dole, and we are going to continue to pay for it." In order for these programs to continue, either the locals have to pay for them or you have to eliminate them. I think we 're going to see more of that." Gorder said he was excited to see it implemented, but hopes it is done safely with extra signage in slower areas. "I just crune home from South Dakota doing 80 mph," he said. In general, how does MT show other states how to react to dark money tactics: • Montana has shown that citizens must not accept the domination of government by moneyed interests -- it is possible to push back and maintain a citizen democracy. • Montanans overwhelmingly reject Citizens United, voting for 1-166 in 2012 by a 75% margin. o Montanans, while working through 1-166 to change Citizens United, have at the same time supported strong disclosure, passing the bi-partisan Disclose Act in 2015. • Classic dark money tactics like "attack mailers" have been challenged and criticized by Montanans. E.g., the AFP campaign against Republican legislators who refused to reject any Medicaid expansion went nowhere, and in fact convinced Rep. Gamer to carry the bill on the House side. • We just don't buy into the ugliness and anonymity of Dark Money tactics -we have an effective citizen democracy and we're going to keep it. In the wake of Chuck Johnson & Mike Dennison's departure, what does that mean for citizens who want to stay informed about dark money tactics. • Mike and Chuck will be missed. But Montana newspapers and journalists recognize the importance of this issue to the people of Montana and (we hope) will continue to track it closely. • Citizens can also inform themselves directly via the COPP website, which will be posting information on all candidates and groups in the state in a timely manner, and keeping the information updated. As an appointed associate medical examiner, he was often contacted directly by coroners and counties to perform autopsies. The AG had no direct Influence over that. MSU Extension was not involved in any "negotiations or conversations." There was a years'-old written agreement between Department of Ag and Extension that MDA would pay 50 percent of the cost of the program manager, that amounted to a total of$30K, year. MDA failed to do so for many, many years, instead only paying $15K/year. Three months ago, Extension brought the issue up again and added that yes, the program manager had a doctorate and there were additional costs - MDA share should now be $3 SK/year. MDA said it couldn't afford that and would only pay $33K-which is only 45 percent of the cost. MSU agreed to $33K/year. The "added" cost of the program director's doctorate was only $3,000/year. The real cost to the MDA was having to finally honor their agreement after many, many years. Next Lhing we know, they cancel the agreement. They ure claiming ifs because of increased cost related to the program director getting a doctorate. That's not true. The vast bulk of the increased cost is we asked them to finally - after years - honor their agreement. And now, to deflect that heat, the Department of Ag is trying to use MSU as the scapegoat saying it's our fault that it is so expensive.
