THE SUPERIOR COURT OF CALIFORNIA, COUNTY OF SAN DIEGO THE PEOPLE OF THE STATE OF CALIFORNIA DECLARATION IN SUPPORT Plaintiff, OF ARREST WARRANT vs. )a 1 Cage No.1 CD266583 Tieray JONES ?gagrwe?i?imge AEA117 Greg, Deputy I, Maura Mekenas-Parga, 3781, do on oath make complaint, say and depose the following on this 15th day of April, 2016: that I am a peace officer employed by the San Diego Police Department (SDPD) and have been so employed for 30 years and 10 months. QUALIFICATIONS I am a Police Detective assigned to SDPD Vice Operations for the past 7 months. Prior to this assignment, I was assigned to the following units: Homicide/Cold Case/ Missing Person?s Unit, for 6 years; Robbery Unit, for 6 years; Gang Unit, for 2 years; San Diego Police Area stations as a ?Generalist? detective, for 4 years; I worked Vice Operations for 3 years; Central Division specialized mounted patrol unit for 6 years; Specialized walking team against narcotics (W.E.C.A.N.) for 3 years and two years of basic training and patrol duties. During the course of my 30 years in law enforcement, I have investigated and solved well over four hundred crimes against people and property. I have assisted on more than 30 homicide investigations resulting in convictions, including a 2011 ?no body? investigation that started as a missing person case, resulting in a special circumstances murder conviction and a life without parole prison term. I have received hundreds of hours of California POST Institute of Criminal Investigations training in crimes against persons and property. During the course of my duties, I have learned the following information based upon my discussions with the named witnesses or by having read the reports of or talked with other SDPD of?cers and investigators, who have spoken directly with the named witness. All events referred to herein occurred in San Diego County unless otherwise stated. ENTRODUCTION Affiant is seeking an arrest warrant for Tieray JONES for the unlawful killing of 26 month old ahi TURNER occurring on or about 4/23/2002 - 4/25/2002 in Violation of Penal Code sections 187 and 273ab(a). The facts and circumstances supporting this request are set forth below. On Thursday, April 25, 2002, at 14:26 hours, Tieray JONES called 911 and reported his 2-year-old step~son ahi TURNER missing from a park located at 28th Street Cedar Street in the City of San Diego. He stated that he left Jahi TURNER at the playground while he attempted to get Jahi TURNER something to drink at a vending machine located a short distance away; he estimated 10- 15 yards. (It is actually over 150 yards away.) Upon returning to the playground he discovered that ahi TURNER had disappeared, He reported that he then wandered through the nearby neighborhood for approximately 15-20 minutes looking for his step-son before calling 911. Numerous police of?cers and detectives from San Diego Police Department, as well as numerous allied agencies, and canine tracking dogs, conducted a and exhaustive search for Jahi TURNER. During the investigation, Tieray JONES was interviewed approximately seven times. A comprehensive canvassing of the park, apartment complex and numerous surrounding neighborhoods and canyons did not produce any leads to Jahi location or corroboration for the history provided by Tieray JONES. Jahi Turner?s body has not been found. The evidence of what happened to Jahi TURNER between Monday, April 22 and Thursday, April 25, 2002 consists I Ix'of: the interview statements of Tieray JONES, personal journal entries written by Tieray JONES during this time period, the interview statements of Tameka TURNER, other witness statements and circumstantial evidence. (Tameka TURNER and Tieray JONES kept a notebook/journal in which they wrote to each other when they were apart because of her Navy duties. This notebook was found in the apartment on 4/25/02, the ?rst day of the missing child investigation.) As will be detailed below, evidence collected in the subsequent police investigation supports the conclusion that the kidnapping/ missing child story was fabricated by Tieray JONES in an attempt to cover up the death of ahi TURNER. CASE BACKGROUND ahi TURNER was born in Maryland on February 10, 2000. ahi biological parents are Tameka TURNER (DOB 7/20/1983) and Tramane SAMPSON. Tameka TURNER and Tramane SAMPSON did not maintain a relationship after Tameka TURNER became pregnant. On August 31, 2001, 18-year-old Tameka TURNER joined the US Navy. Tameka TURNER left her baby son, ahi TURNER, in the care of her mother, Penny THOMPSON, and her step-father, Rene THOMPSON, who live in Frederick, Maryland, while Tameka TURNER began her career in the Navy. On December 27, 2001, Tieray JONES (DOB 7/7/ 1978) and Tameka TURNER were married in Maryland. On February 8, 2002, Tameka TURNER was transferred by the Navy to San Diego, California. On March 7, 2002, Tieray JONES moved with Tameka TURNER to Navy housing located at 3455 Beech Street #39, San Diego, California. During the week of April 14-17, 2002, Tameka TURNER learned from Rene THOMPSON that Social Services were making inquiries into the living situation of her Sun ahi TURNER and her I U) I brother Luke, because of suspected drug abuse and neglect on the part of her mother Penny THOMPSON. To avoid further problems, Tameka TURNER made arrangements with the Navy for leave and to borrow funds to relocate her son Jahi TURNER to San Diego. On April 18, 2002, Tameka TURNER ?ew from San Diego to Maryland to pick up ahi TURNER. On Sunday, April 21, 2002, at 17:30 hours, Tameka TURNER and Jahi TURNER arrived in San Diego California from Frederick, Maryland. Jahi TURNER was a healthy 26 months old child on arrival in San Diego. He weighed approximately 35 pounds and was approximately 35 inches in height. April 22 April 25, 2002 Monday, April 22, 2002, at approximately 05:30 hours, Tameka TURNER went to work on the USS Rushmore in San Diego, California. Tameka TURNER and Tieray JONES knew that Tameka TURNER was scheduled to be at sea the week of April 22, 2002 April 25, 2002. ahi TURNER was left in the sole care and custody of Tieray JONES at their 3455 Beech Street apartment #39, San Diego, California residence. Tameka TURNER left behind her cell phone for Tieray JONES to use while she was on ship because his phone was close to being turned off for being over the allotted minutes. When Tameka TURNER left on Monday morning, Tieray JONES had very little money. Tameka TURNER was expecting funds from the Navy to be deposited into her Armed Forces Bank account during that week, so she also left her bank card with Tieray JONES. Their only vehicle, a 1989 Cadillac, was not working. It was parked in the apartment complex parking lot. On Monday, April 22, 2002, between 12:00 noon and 14:00 hours, Beech Street apartment neighbor, Casey Jo HARRIS reported seeing Jahi TURNER playing at the apartment playground with her two year old daughter. She never saw Tieray JONES. Beech Street apartment neighbor. Christine WILSON reported seeing ahi TURNER playing in the apartment playground and she saw Tieray JONES by a car on Monday or Tuesday. Veronica GARCIA lives in the Beech Street apartment complex and does "in home day care? with three children. GARCIA told detectives the apartment complex playground always has children playing in it. She never saw ahi TURNER. Colby DOMINGUEZ lives in the apartment below the JONES. DOMINGUEZ last saw Tieray JONES on Tuesday walking from the laundry/mailbox area towards his apartment. DOMINGUEZ never saw Jahi TURNER. HARRIS AND WILSON were the only two witnesses in the Beech Street apartments who reported seeing Jahi during the week of April 22, 2002 April 25, 2002, and neither report seeing ahi TURNER after April 22 23, 2002. On Tuesday, April 23, 2002, Tameka TURNER called Tieray JONES from the ship at approximately 11:00 hours. She talked to ahi TURNER. ahi TURNER only made some noises and said ?Bye. Tieray JONES told Tameka TURNER that ahi TURNER was watching a movie. Tieray JONES further told Tameka TURNER that ahi TURNER fell off the bed and hit his head on the dresser when the cats jumped up and scared him. Tieray JONES told Tameka TURNER that ahi TURNER had a small bump on his head but it was ?no big deal.? Tieray JONES complained to Tameka TURNER that ahi TURNER "peed" the bed Monday night. This was the last contact Tameka TURNER had with Tieray JONES and her son. On Wednesday, April 24, 2002, at approximately 08:30 hours, Beech Street apartment neighbor Katey HIGGINS saw Tieray JONES carry two large black trash bags towards the apartment complex laundry room/ trash area. At approximately 08:45 hours, HIGGINS saw Tieray JONES walk through the complex with a third black trash bag. The trash dumpsters were emptied between 09:30 and 10:30 hours that day. At approximately 13:00 hours, Beech Street apartment neighbor ennifer NEWTON saw Tieray JONES carry a white trash bag to the dumpster located at the front lof the Beech Street apartment complex. NEWTON stated to investigators that it did not look like trash. During interviews with detectives on April 26, 2002, and May 1, 2002, Tieray JONES denied taking the trash out on Wednesday. On Wednesday, April 24, 2002, $2,529.00 was deposited into Tameka Armed Forces bank account. Bank records show that there were three ATM transactions on Tameka account at 3035 Cedar Street [?The Food Bowl Market?] requesting $20.00 at 13:31:08, 13:31 :59 and 13:35:37. All transactions were denied. This market is located approximately a half a mile from the Beech Street apartment complex. Phone records show that on Wednesday, April 24, 2002, Tieray JONES spent close to two hours on the phone with the Armed Forces Bank, and ex-girlfriends, Lizette GONZALEZ and Jackie HOWARD, both of whom live on the east coast. Tieray JONES convinced Lizette GONZALES to call the Armed Forces Bank and pretend to be Tameka TURNER in a failed attempt to get access to the funds recently deposited in Tameka TURN bank account. A three-minute call to the Bank was made from Lizette Gonzalez?s phone at 19:13 hours. ahi TURNER was not seen by anyone all day Wednesday, April 24, 2002. On Thursday, April 25, 2002, at 14:26 hours, Tieray JONES used his cellular telephone (310) 524- 8275 to call 911. Tieray JONES reported his step-son, ahi TURNER, missing from the 28th Street Park, located at the intersection of 28th Street and Cedar Street in the city and county of San Diego, California, approximately one mile from the Beech Street apartment complex. Tieray JONES said that he last saw ahi TURNER at the 28th Street Park playground approximately 15-20 minutes before calling 91 1. Of?cer L. DAVIES #5580 and Of?cer R. RUDE #5022 contacted Tieray JONES at 14:41 hours. Of?cer DAVIES noticed JONES was initially panicked and Spoke rapidly while diSplaying a white pasty tongue and a white foamy substance in the comers of his mouth. A blood sample drawn from JONES at approximately 22:00 hours tested positive for marijuana, consistent with recent usage. Tieray JONES told the of?cers he and ahi TURNER left his apartment at 3455 Beech Street #39, San Diego, California at approximately 13:00 hours to walk to 28th Street Park, almost one mile away. (Your af?ant has taken that route and noted that this walk includes several hills and takes approximately 20 minutes from the Beech Street apartments. The walk, even half way to the park, would be very dif?cult, if not impossible, for a 26 month old. Additionally, JONES had a playground directly across the parking lot from his apartment. There was no reason for JONES to take ahi TURNER to a park one mile away.) JONES told of?cers that once they got to the park, he sat under a tree and watched ahi TURNER play with two white children while a white female was also present watching the children in the playground. ahi TURNER walked over to him and stated he wanted his cup. JONES told ahi TURNER he did not have his cup but JONES would go to the vending machine and get ahi TURNER some juice. JONES said he left Jahi TURNER at the playground while he walked to the vending machine. On return to the play area, JONES noticed that ahi TURNER was gone along with the other children. He walked around the block looking for ahi TURNER before calling 91 1. While speaking with of?cers, Tieray JONES realized he had lost a bankcard and a photograph of ahi TURNER while he was walking around the neighborhood looking for ahi TURNER. Of?cer DAVIES noted Tieray JONES seemed more concerned about the lost items that he dr0pped from his wallet than the whereabouts of ahi TURNER. Tieray JONES gave ahi clothing description; long sleeve navy blue shirt with Winnie the Pooh and Tigger on the front, navy blue nylon pants with extra pockets on the knees and gray Michael Jordan shoes child size 8 1/2 or 9. As the investigation progressed, Tieray JONES spoke with several different law enforcement of?cers, including Officer D. WICK #5134, Sgt. LARAMOUR #1550, Detective RIDDLE #4311, Detective D. MASON #1595, Detectives D. WALKER #3095, H. PETTY #4631, L. RYDALCH and T. TORGERSEN. These interviews were memorialized in written reports and! or recorded. Your af?ant has noticed that the timeline and details of various events related by Tieray JONES varied in signi?cant ways as he spoke with different law enforcement officers during interviews on April 25, April 26, and May 1, 2002. The timeline that JONES gave investigators regarding the activities with ahi TURNER on April 25, 2002 was the following: 7:30 - 8:00: JONES and Jahi TURNER wake up and eat breakfast 11:00: JONES and ahi TURNER eat lunch and take a 45 minute nap 12:45 12:50: JONES dresses ahi TURNER and they leave for the park 13:20: JONES and ahi TURNER arrive at Park 14:26: JONES calls 911 Law enforcement of?cers contacted all individuals who were present at the 28th Street Park between noon and 15:00 hours on April 25, 2002. Not one witness saw JONES or Jahi TURNER that day. Martin FLORES was at the 28th Street Park playground on April 25, 2002 with his two children between 1315 and 1445 hours. FLORES never saw Tieray JONES or Jahi TURNER at the lspark. FLORES did see a HiSpanic woman with two children at the playground while he was there. Hong HOM was walking in the 28th Street Park on April 25, 2002 between 1330 and 1400 hours with his wife and son. HOM never saw Tieray JONES or Jahi TURNER. Dave GASTELLUM is a San Diego city park worker and was cleaning the bathrooms at 28th Street Park by the vending machines. GASTELLUM stated he never saw Tieray JONES or Jahi TURNER. GASTELLUM stated he was at the bathroom cleaning them between 1240 and 1440 hours. QUIEROZ was cleaning the bathroom with GASTELLUM at 1430 hours and she never saw Tieray JONES or ahi TURNER. Guadalupe SAUCEDA was at the 28th Street Park between 1330 and 1430 hours and did not see Jahi TURNER or Tieray JONES. Witnesses did see Tieray JONES without Jahi TURNER during this time frame. At 12:00 noon, Beech Street apartment neighbor, Orta MILLER, saw Jones walking alone on Cedar Street away from the Food Bowl Market towards the apartment complex. At 12:15 pm, Orta MILLER had arrived at the complex and was with her friends Kim BACA and Teresa ORR. All three witnesses saw JONES walk into the apartment complex. ahi TURNER was not with him. Armed Forces Bank records show a rejected ATM request for funds on April 25, 2002. During an interview on May 1, 2002, JONES was asked if he tried to use the ATM on April 25, 2002. He replied that he tried to use the ATM at the Food Bowl Market while he was on the way to the park with ahi TURNER. This was the ?rst time JONES stated he went to that market. (Of?cers contacted workers at the Food Bowl Market and no one was able to state they had ever seen JONES or ahi TURNER that day.) Tieray JONES was confronted with the fact that witness Orta MILLER saw JONES walking away from the Food Bowl Market on Cedar Street at noon, without ahi TURNER, and again walking alone into the Beech Street apartment complex at 12:15 hours on April 25, 2002. JONES had no explanation. -9- IxPhone records show JONES was on the phone most of the day on Thursday April 25, 2002, particularly during times he was allegedly with ahi TURNER. JONES was on the phone with ex- girlfriend Jackie Howard between 0730 and 0800 hours for 26 minutes when he and ahi TURNER allegedly were waking up and having breakfast. At 11:14 and 11:32 hours, when JONES was allegedly feeding ahi TURNER lunch and taking a nap with him, he had two more phone calls with Jackie HOWARD. HOWARD told detectives she talked to Tieray JONES on April 25, 2002 between 10:00 and 10:30 hours, east coast time. JONES told HOWARD, ahi TURNER was in daycare and he was going to go get him to take him to the park. JONES asked HOWARD to wire him $30.00 for gas and food. HOWARD said she initially agreed, but changed her mind. She called JONES between 14:00 and 14:30 hours to tell him she did not have a ride to wire him money. Howard never heard ahi TURNER in the background when she spoke with JONES. JONES made numerous other calls during the time that he and ahi TURNER were allegedly napping at the apartment. Between 11:39 am. and 12:03 pm, JONES made ?ve calls to Terica GILLIAM and Juanita WILLIAMS. Terica GILLIAM and Juanita WILLIAMS were shipmates of Tameka TURNER. Tameka TURNER left Tieray JONES their numbers to reach her on ship, since she had left her cell phone with JONES. Each received messages from JONES on April 25, 2002 to have Tameka TURNER call immediately because there was an emergency. JONES admitted leaving these ?emergency? messages for Tameka TURNER to call. These ?emergency? calls took place over two hours prior to the 911 call made by JONES at 14:26 hours. JONES also made numerous calls while allegedly walking to the park with ahi TURNER and while playing at the park. JONES called ex-girlfriend?s Lizette GONZALEZ and Jackie HOWARD from 13:51 14:20 hours. The last call was made just six minutes prior to JONES calling 911 . lsYour af?ant also noted signi?cant inconsistencies between the various statements given by JONES to law enforcement about the events of April 25, 2002. Of particular note are the following: The Time JONES and Jahi TURNER arrived at 28?? Street Park: 10:00 hours 13 :20 hours Who was at the playground with Jahi TURNER: Two white kids, one woman watching Two kids, two women watching Two girls, one woman Two boys, one woman How Jones and Jahi TURNER separated: ahi TURNER wanted a drink and followed Jones for 30 feet to a vending machine; Jones did not look back Jones left ahi TURNER by the slide ahi TURNER went back to the playground while Jones walked away When Jones noticed ahi TURNER was gone: Came back, sat by tree, looked at playground, saw no kids Came back, sat on bench, realized everyone was gone Noticed they were gone while walking back How long Jones was away from ahi TURNER: Not more than 15 minutes 3 4 minutes at the most lsThere is also evidence to suggest that ahi TURNER suffered a fatal physical injury while in the sole care and custody of Tieray JONES between April 22 and April 25, 2002. In the journal collected by law enforcement were numerous entries written by Tieray JONES during the week of April 22, 2002 - April 25, 2002. These journal entries describe a serious physical injury. In ajournal entry, dated Tuesday April 23, 2002 at 16:00 hours, Tieray JONES wrote the following statement about ahi TURNER: ?Today for some reason he hasn ?t been moving or really talking. Jahi is starting to act really funny he won?t get up off the ?oor. He?s not walking or talking when I tell him to get his cup he just looks at me. I know it?s going to take some time. But I don ?t want him hating me for something I can ?t control. The bump on his head has gone down gotten a little red. When questioned by investigators, JONES at ?rst denied that ahi TURNER had any falls, accidents, or injuries while JONES was taking care of him. He then admitted to one fall, but stated that the fall took place on the other side of the bed from what he had told Tameka TURNER. JONES was speci?cally asked if ahi TURNER had any cuts or bumps, and JONES responded, 1} On March 17, 2015, your affiant monitored and recorded a phone call placed by Tameka TURNER to Tieray JONES. At one point, JONES alluded to what had happened to ahi TURNER as an accident. Tameka TURNER thereafter asked JONES to clarify what he meant by it being an accident. JONES immediately became unnerved and stumbled and stuttered in his response attempting to minimize, if not walk back, his accident statement. His response: No I didn 't say. I said. baby. said there was, ah. there was an accident or something, it would have been an was something that I You know what. there was an accident and I could not, you know, that I don't know, then I am just saying it was an accident. That is what I meant, you know. the thing that if something happened. if! did something, but what I am saying is that if it H-?tun and I did something. like. why? What I saying is just uh, you know, of everyone supposedly saying, you know, it?s me sweetheart. I am not an idiot to sit up here, I 'm not trying to sit up here and say that I am campaigning to get you to believe something. but I am just saying. I mean. just look at me. Look at the person you have been next to. Now that you haven 't been next to me you don ?t know who I am? That is what I am saying. if.qu it was an accident sweetheart, I would have just said it was an accident. I 'm not. I don I have never run mvay from anything. A board certi?ed child abuse doctor has looked at the described in the journal and believes them to be consistent with either blunt force abdominal trauma or a serious head injury. Both of which could be fatal if not treated by a medical professional. ahi TURNER was never brought to a hospital or medical doctor between April 22, 2002 and April 25, 2002, despite having access to health care via Tameka employment in the military. Also of note to the child abuse doctor was the fact that very little food was missing from the house. Jahi TURNER was sent out with a full bag of animal cookies. No cookies had been eaten. There was also ample food in the refrigerator, 11 eggs and sausage and juice, despite numerous journal entries that they were running out of food after eating large breakfasts on Wednesday and Thursday. On Wednesday, April 24, 2002 at 10:30 hours, JONES wrote: ?Making something to eat for me and our son. Jahi is a wounder kid and Tameka is a wounderfnl mother. He still doesn ?t want to go to the pot. I just sit him on the toilet and let him go when he wants. I?m going to take him to the big park tomorrow. He doesn ?t like the sand to much at the park we have here. I asked Greg (WILLIAMS) for ten dollars so I can buy Jahi some pampers but I was going to buy cigarettes with the money. Well I?m going to give him a bath something I don ?t think he likes when I do it. He cried last night when I gave him a bath. Thursday, April 25, 2002 at approximately 08:54 hours, Tieray JONES wrote the following in his journal: ?We need more food in the house I don ?t have the money to keep what we need in the house. How will we ?nd someone to watch him when we want to go out on the town. I want to mess with the car I guess Jahi will just sit in the car or I?ll let him play in the park. What do you want to become 0 our amil Well we?re on our wa out the house.? .V The child abuse expert also saw evidence of triggers for abuse, particularly Jahi?s problem with wetting the bed. On Tuesday April 23, 2.002, JONES complained to Tameka TURNER that ahi TURNER had ?peed the bed? Monday night. On Wednesday, April 24, 2002, at approximately 16:00 hours, JONES made the following written entries in the journal indicating ahi TURNER wet the bed Tuesday night: ?You still haven ?t called. The money has been deposited but I can?t use the card. I let him sleep bag under his blanket. And he peed to, glad the bed didn ?t wet. I washed the little bit of stuff I could that he pissed in. We walked to the store but I couldn?t use the card. Later that same day, Wednesday, at 18:40 hours, JONES wrote the following in his journal: ?This couldn ?t be a more fucked up day. First they give us money then we can ?t use it. Then as I?m using the phone calling the fucking bank and they cut the damn thing off. I ?m ?ening for a cigarette I guess we?re going to have to wait to see our mommy. Jahi is already sleep. I put his blanket next to the bed. Cause I really don want to role over on pee. Forensic testing has detected urine on the bed sheets recovered from the JONES apartment on April 25, 2002. When questioned about the issue of ahi TURNER wetting the bed, JONES minimized the problem and made inconsistent statements. JONES initially told investigators that he removed the wet bedding and clothing early Tuesday morning and took it down to the laundry room. He -14- Ixlater changed this story and said he waited to wash the wet materials until Wednesday. JONES also insisted during his interviews that this was the only time that ahi TURNER had a bed wetting problem. JONES told the of?cers that he had little problems with ahi potty training; saying that he would sit ahi TURNER on the toilet for over 30 minutes at a time, waiting for ahi TURNER to call him when he was done. Interviews with Penny and Rene THOMPSON revealed that ahi TURNER was not capable of holding himself up on a regular toilet; he would have fallen in. They had a child potty training seat while they were caring for ahi TURNER in Maryland. This af?ant noted additional items of evidence that cast doubt on statement that ahi TURNER went missing on April 25, 2002. The apartrnent laundry basket had a onesie of ahi Forensic testing indicated that ahi blood was on the onesie. Jahi TURNER also had an Elmo blanket, which was recovered from the bed. Forensic testing indicated ahi blood was on this blanket. A child?s red pajama out?t was collected from the trunk of car. The pajamas were positively identi?ed by Tameka TURNER in 2015 as belonging to ahi TURNER. Tameka TURNER stated there was no reason for ahi pajamas to be in the trunk of the car and none of ahi clothes should be in the car. Saliva was found on the pajama shirt indicating ahi TURNER had worn the pajama out?t. Additional items of Jahi clothing were found in the trash dumpster near the JONES apartment. In 2016, Tameka TURNER positively identi?ed a pair of Winnie the Pooh overalls and several other clothing items in and near the dumpster as belonging to ahi TURNER. These items of clothing were mixed in with items of her own. Tameka TURNER told this af?ant she had not discussed throwing away any of her or ahi clothes with JONES. your af?ant?s opinion that the totality of the circumstantial evidence, witness statements, JONES evasive interview statements and JONES contradictory journal entries, when considered with the obviously fabricated disappearance story, support the inference that JONES either inflicted an intentional injury on ahi TURNER in response to his urination problems ultimately causing ahi death, or ahi TURNER suffered an accidental injury of some sort and JONES thereafter neglected and refused to secure needed medical aid for the child, resulting in his death. Under either theory, JONES is criminally responsible for the death of ahi TURNER.
