The Operative has participated in numerous special investigations as a covert operative, which has resulted in hundreds of prosecutions for serious class and Class fish and wildlife crimes as well as numerous felonies. SANBOKN, the subjects are husband and wife and are suspected in engaging in serious class hunting violationsw include illegally selling beat pans, 5) Your atfiant states that on August 30, 2013 the Operative made mntact with RICHARD SR. via the intemet. social networking site Facehook. The Operative discussed wanting to go bear hunting and SANBORN offered a guided week long day bear hunt for five hundred dollars, plans bear hunt for one-thousand dollars or a one were made for the Operative to make Contact with SANBORN SR. at a inter dale. NOTE: SANBORN SK does not have a license to glide hunmrs in the State of Maine. 6) 7) 3) 9) The Operative reported that he had. two digitally recorded phone conversations with SANBORN SR. on September 6, 2013 and again on September 18, 2013 in regards to going on a guided bear hunt with SANBORN SR. on September .21, 2013-. On September 20th and 21St "2013 the Operative spent time with SANBORN SR. and his associates and had multiple conversations with SANBORN SR. regarding his involvement in illegally guiding without a license, night. hunting, illegally selling/buying bear parts, and other serious class crimes. The Operative observed several violations of illegal hunting ?rst hand to include hunting bear in New Hampshire without a. license and during closed season, hunting bear with 9 dogs (maximum number of dogs allowed in Maine is 6), guiding without a license, and illegal possession of bear parts with intent to illegally sell without a hide dealer?s license. The Operative heard SANBORN associates openly discuss their involvement in illegal activity and observed them participate ?rst hand in some of the above mentioned crimes. The Operative determined that SANBORN SR. and many of his associates Were clearly predisposed to commit serious class hunting violations. On September 20, 2013 while riding in a vehicle with SANBORN SR. and his wife, KATHY SANBORN, SANBORN SR. discussed with the OperatiVe that if he killed a bear he (SANBORN SR.) had a friend who was a licensed Maine guide that would go, to the tagging station to register the. bear with the Operative. SANBORN SR. explained that a non-resident hunter, as the Operative was posing as, was not allowed to hunt bear with the use of hounds in. the state of Maine unless accompanied by a licensed Maine guide. Later in the evening of September 20, 2013 SANBORN SR. advised the Operative that. since he would only be hunting bear with him for one day he we aid only be reguired to pay him five-hundred dollars if the Operative killed a bear. 10) The Operative reported that while bear hunting with SANBORN SR. on September 2'1, 2013 SANBORN SR. again told him that he (SANBORN SRJ was only expectins'a . $500 payment from the Operative if he was. actually able to tree a bear for the Operative to shoot. He told the Operative if he booked a hunt nextwa 113- Charge the 1 Id Operative $1000 for. the week regardless if he got a bear or not. SANBORN SR. 513:: to the Operative that. he could reduce that price a little? to $750 if the: Operatlve broug someone with him fer the week ($750 each). 11)The Operative reported that at approximately 10:20 AM on September 21 2013 a KENNETH L, MARTINEAU - of Parsonsfield and CORY R. HALE also of Parsonsfield called SANBORN SR, to tell him they had a bear treed with their dogs in New Hampshire. The Operative arrived with SANBORN SR. at MARTINEAU and HALE's location along route 153 in New Hampshire and the men walked into the location where the dogs had the bear treed. It was decided that they would let the bear out of the tree and SANBORN SK would release his dogs to chase the hear back into Maine (a distance of approximately 1 mile). At approximately 11:10 AM SANBORN SR.'s GPS unit he was using to track the dogs indicated that dogs now had the bear tread in Maine. When the Operative walked into the tree with SANBORN SR. he noted that there were now 9 dogs at the base of the tree (Maine law limits the use of 6 dogs to pursue bear). MARTINEAU and HALE had released dogs as well by this point as well as an individual by the name of SCOTT Cr DAY DOB 10/2/1969. The dogs were pulled away from the tree and the Operative shot'and killed the bear out of the tree. This was video recorded (digitally) by an 11 year old boy by the name of NATHAN and 21 Jake GAGNE -- Everyone took turns dragging the bear out ofthe woods and it was loaded into the back of SANBORN SKIS Ford Ranger pickup truck. 12) The Operative reported that at approximately 1:00 PM while driving to the tagging station in SANBORN pickup truck, SANBORN SR. told the Operative that he owed him $500 for getting him a bear. SANBORN SR. advised the Operative that he would give MARTINEAU and HALE some of the money for initially treeing the bear but he also told the Operative that he should buy the men some beer for their efforts. l3) SANBORN SR. and the Operative met CHRIS ST. and ST. SAVIOUR was briefed on what had occurred so it would appear that ST. SAVIOUR had been with the Operative during the bear hunt and when the hear was killed. The men went to the tagging statiun in Limerick where the Operative regisrered the bear. ST. SAVIOUR went into the store and also signed the tagging slip. SANBORN SR. got a 30 pack of Bud light beer and a 12 paid: ofTwisted-Tea beer and told the Operative to pay for it. SANBORN SR. told the Operative that it was payment to the guys (HALE, MARTTNEAU, DAY. and C.ST.SAVIOUR) for helping him on his hunt. 've oned that while back at SANBORN SR.'s residence Later that day :Xefiigi 5r:~ :ut out the bear's gallbladder. MARTINEAU and HALE- mocked SANBORN SR. for being so greedy with the price he offers them for their beer gallbladders. SANBORN SR. openly discussed how his buyer in Hawaii had egg/13:30" hard to rind a buyer and get a high paying price. The men continued mocking SR. for being cheap and not paying a fair price for the bear gallbladders (The men were joking but again appeared as if their concerns were serious). The men commented that they did not believe SANBORN SR. was being truthful about how muoh profit he made on the bear gallbladders he sold to his buyer in Hawaii, KSANBORN helped her husband put the gallbladder in a Zip-lock bag. While at the residence the Operative paid SANBORN SR. $500 he owed him for the bear hunt. The Operative observed SANBORN SR. walk away and hand what appeared to be approximately $80 to MARTINEAU. SANBORN SR, stated that he should have the Operative hand ST. SAVIOUR the money first just to make sure he wouldn't get in trouble. SANBORN SR. told he would give him some money for assisting but ST. SAVIOUR stated that the beer that the Operative purchased was payment enough. 15) On the evening of September 22, 2013 the Operative spoke with SANBORN SR. via the telephone and SANBORN SR. began to explain how his bear gallbladder buyer in Hawaii will sometimes get him $500 for one. SANBORN SR. told the Operative that sometimes it takes a while to get a good price. SANBORN SR. and the Operative had a discussion about the gallbladders and the prices of them. 16) The Operative reported that on the evening of October 25, 2013 he had numerous conversations with SANBORN SR. at his residence. SANBORN SR. discussed selling bear and bear parts to a Chinese food restaurant in New Hampshire and about selling the gallbladdels to his buyer in Hawaii for $500. SANBORN SR. showed the Operative two gallbladders fiozen in his freezer. The Operative offered to purchase the for $100 dollars each and SANBORN agreed to sell them to him. The Operative advised SANBORN SR. that it was illegal for him to buy, sell or possess the gallbladders in and SANBORN SR told him that he would not say anything to anyone, SANBORN SR. discussed his knowledge with the Operative about needing 8 hide dealer's license in order to buy and sell gallbladders in Maine and how he is taking a big chance by shipping the gallbladders through the mail to Hawaii. 17) The Operative reported that die following morning, 10/27/13 he was again talking with SANBORN SR. at his residence as SANBORN SR. prepared to go bear hunting in New Hampshire and he explained that he gets way more money sending them (gallbladders) to Hawaii but told the Operative he is taking a big chance and a lot Offisk in getting caught, SANBORN SR. said, "if they ever open one of my packages, I'm -, I can say I'm giving them away for a Christmas present and that I'm not selling them, but I'm probably still SANBORN SR. said, can - give them (gallbladders) away but can't - sell them," 18') The Operative advised your affront that on 11/23/13 SANBORN Sn; took a phone call from one of the members of his ?hunting crew? (the DUNNELLS family) and SANBORN Sr. advised the Operative that they would be meeting the DUNNELLS- to hunt with them (conduct deer drives) The Operative advised that they arrived at one of the residence?s andhe was introduced to a number of?peOple who would be hunting and participating in the deer- drives as either ?standers? or ?pushers?. The Operative advised -that there were ten people. present for the ?rst deer drive that they did. The Operative further-advised that they continued to go 'tordifferent locations and"?pus different pieces of woods. After lunchtime more "hunters joined the group and at one point at least 13 people Were involved in the same deer drive. RICHARD SANBORN Jr. arrived as well using a 30-30 lever action ri?e and also participatedin the deer drive (Sanborn had already killed several deer up to that date during the deer season and. was hunting after havin killed one). Previously on 11/13/13 SANBORN Jr?. had registered an adult male deer allegedly shot and killed in Parsons?eld, Maine. Th tagging records alleged that SANBORN shot the deer with a .243 caliber ri?e. The Operative noted that SANBOR Sr. had 'a semi-automatic .308 caliber ri?e during these deer drives, additionally SANBORN Sr. also kept 'a .243 caliber ri?e at his residence that SANBORN Jr. would occasionally use. According to the Operative, the ?rearms which SANBORN Jr. would use while hunting are kept .at'the residence of SANBORN Sr. and includes .308 caliber ri?e, a .243 Caliber ri?e and the 30?30 lever action ri?e. 19) On 11/23/13 the Operative witnessed SANBORN Jr. participate in a deer- drive using his 30-30 caliber lever action ri?e. Your af?ant would note that according to Maine Department of Inland Fisheries and Wildlife?s Big Game Registration Records, RICHARD SANBORN Jr. registered an adult male deer 'on 11/ 13/ 13. The Operative advised your af?ant that SANBORN Jr. openly discussed killing deer with the Operative and had advised he had already killed three deer during the. ?then. current? 2013 hunting season. SANBORN Jr. described both of thed?eer .he had Shot as being killed over he and TREVOR baited tree stand and that both were doe de'er.. SANBORN Jr. stated that. one of the deer was simply cut up and the other was registered by a MYRON WATSON. Your affiant would note that according to Big Garne Registration records MYRON WATSON regiStered an adult. female deer on 11/11/13. 20) Your af?ant was advised by the Operative that on the afternoon of ,1 1/23/13 while ?road hunting? with SANBORN Jr. in the Operative?s vehicle along With SANBORN Sr. and SMBORN Jr?s daughter. The OperatiVe observed SANBORN Jr. with a .243 inside the- vehicle vvhioh SAN BORN Jr. loaded inside the vehicle - Sr. 21) The Operative advised that during-two separate phone-conversations Wltl'l Sagfdiilg; on 5/26/14 and on 6/2/14 SANBORN Sr. discussed? prices for. bear parts to in gall hlziddersr Sin also advised that he gets good money fer gall bladders from his buyer in Hawaii but that it takes a long time to get rid nfall of his gall bladders because he is only able to sell a few at a time and that he also has to wait a period of time before he gets the money for the gall bladders. The Operative advised that several months later on 8/21/14 he spoke with SANBORN Sn again and they discussed buying and selling bear pans. The Operative had told SAN BORN Sr. that he would be coming up with his friend's (fictitious buyer's) money to purchase hear parts. SANBORN Sr. told the Operative that he would need to come up with "all" of the buyer's money because he would have "a bunch of -paws and galls". 22) Your affiant was advised by the Operative that on yet another phone call on 10/5/14 with SANBORN Sr, SANBORN Sr. told the Operative that he was getting fiverhundred dollars for each gall bladder he said to his buyer in Hawaii. The Operative told SANBORN SI. that his friend and buyer would be sending up eight hundred dollars when the Operative came back up in October. SANBORN Sr. told the Operative to bring all of it with him. During this conversation that the Operative had Willi SANBORN Sn, SANB ORN told the Operative that he had treed six different bear for clients to shoot. SANBOM Sr. also advised that he had only taken paying customers out this year. SL stated that he was getting paid for taking clients through Southern Maine Guide Service on bear hunts with his hounds because Sciithem Maine Guide Service did not have hear dogs. 23)Ths Operative reported that on 11/19/2014 he had a telephone conversation with SANBORN Sr. In this conversation SANEORN Sr. updated the Operative an what had happened since he had led the area on November SANBORN Sr. toid the Operative that he registered a 5 point buck that he had "shot the nose error during a deer drive, SANBORN Sr. niso commented that SANBORN lr. had registered a "spike" hitch, On the same date, afier getting eff the phone With SANBORN Sr. the sperms called and spoke with SANBORN Jr. SANBORN Jr. went into further details regarding the deer that he had registered. The Operative later learned that SANBORN Sr. had actually only wounded the six point buck during a user drive and that DALE DUNNELLS Sr. actually killed the deer and his father registered it for DUNNELLS Sr (DALE DUNNELLS Sr. hod yet ro register a deer arid: own). SANBORN Jr. told the Operativeabout how his father (RICHARD SANBORN Sr.) had gotten into an altercation with a landowner on 11/29/14 after he and his hunting group had conducted a deer drive in the town of New?eld. SANBORN Jr. told the Operative thathis father had illegally killed a doe deer (already tagged out and eXceeding the bag limit) with his .308 ri?e and that KENNETH MARTWEAU registered the deer. This story was again repeated by SANBORN Jr. to DAVID HARMON at residence later that. evening and HARMON acknowledged knowing about the circumstances. The following day on 12/12/14 the Operative had a'personal conversation with SANBORN Sr.- in which he was told a detailed story of how he had shot the doe deer with his .308 on 11/29/14., got in a confrontation with a landowner and then had KENNETH MARTINEAU later register the deer for him. Your af?ant would note that Game Warden Carletdn Richardson received a call regarding this incident. and spoke to the landowner and received photos of the individuals involved driving away in a pickup truck, further corroborating the stories told by SANBORN Jr. and SANBORN Sr. 26) Your affront would note that according to Big Game Registration records KENNETH MARTINEAU registered a female deer on 11/29/14 at approximately 4:21 PM claiming toha?v?e- shot the deer in the toWn of Parsonsfield. with a .3 08- caliber title. 27) Your affront was advised by the Operative that on 12/ 12/ 14 he was hunting with SANBORN Sn, DERRICK DUNNELLS, DANIEL. Sr. and a BARRY HADLOCK and the group was conducting organized deer drives in the Town of Limerick. The Operative witnessed-SANBORN Sr. hunting deer. after having killed 01' registered. one using. his .50 caliber Thompson Black Diamond Muzzleloader. The Operative also witnessed DANIEL DUNNELLS hunting two Thompson-Black Diamond Muzzleloaders and DERRICK DUNNELLS hunting With an older style rhuzzleloader. which utilizes the older ?caps? for ignition. The. group conducted a deer drive seeing several deer. A?erWards they were joined by a SAM 1-1. JEWELL and DARRELL DUNNELLS. On the third deer drive the group conducted, the Operative witnessed DARRELL DUNN ELLS position himself in afield to Watch' for deer in Vin- frequently hunts from his. vehicle due to dif?culties getting gut an'sg?na amend in the Woods). had previ'OusIY "tagged out 12/6/1424? Zeog?rs. m: an adult female deer aft-the Limerick taggihg Station At apprommaiel)? - Operative heard 2 Shots coming from where Sr. was positioned and about a minute afier that heard one shot come fi'om where DERRICK DUNNELLS was positioned. The Operative Walked to DANIEL DUNNELLS Sri's location and DANIEL DUNNELLS Sr. advised that he had shot both of the muuleloaders he was carrying (both Thompson Black Diamonds) at No separate deer and had killed one female yearling deer, The Operative then went to DERRICK DUNNELLS location and discovered he had also killed a yearling doe with his older style muzzleloader. The Operative assisted in transporting deer and muzzleloaders back to the road and vehicles and spoke with DARRELL DUNNELLS who was still sitting in the truck with his loaded "Wolf' brand muzzleloader. 28) Your afflant was advised by the Operative that after registering his deer DANIEL DUNNELLS Sr. again participated in a deer drive in the tour! ofCorrtish. DUNNELLS sat in his vehicle watching over a spot he expected the deer to cross, DUNNELLS only loaded one of his muzzleloaders, which. according to the Operatixe had a stainless steel barrel. 7.9) The Operative noted that later in the day on 12912114 at approximately 1600 hours while he and RICHARD SANBOKV Sr, were "road llunti 0" (hunting deer from a motor Vehicle) they met DARRELL and DERRICK DLNNELLS "ho also stated they were out road hunting but had yet to see any deer. All the men laughed about how they were still hunting but were all legall) "tagged out". SAXBORN Sr. made the commenL, "That's how we- do it up here in Maine'h 30) On ll'lS/M the Operative reported assisting in numerous deer drives with the DUNNELLS family and SAXBORN Jr. and SANBORN Sr. along with several other hunters. The Operative once again witnessed SANBORN Sr. hunt his Thompson Black Diamond Muzzleloader and also witnessed DANIEL DUNNELLS Sr. hunt with his Thompson Black Diamond Muzzleloader. DERRICK DUNNELLS also was hunting but much of the day he used one ofhis father. DANIEL DUNNELLS Sris Thompson Black Diamond Muzzleloadersi 3 l)Tl'le OperatiVe reported that during the last hour or so of legal hunting on 1y13/14 he once again "road hunted" with SANBORN Sr. SANBORN Sr, told the Operative that he would likely not travel to New Hampshire to pick up the gall bladder that he knew he could purchase and in tunL sell to the Operative because it was too far away SANBORN Sr. stated that he would pick it up on one of his trips to New Hampshire and would have it for the Operative when he came back to Maine. Later that evening the Operative stated that SAXBORN st. explained that he would never buy the required "Hide Dealer's License" that legally allowed him to buy and sell gall bladders because then he would have to report who he purchased his gall bladders from and who he was selling them {0 and he didn?t want anyone knowing. IV. My education, training and experience may be summarized as follows: 1) Your af?ant has been a Maine Game Warden for over seVen years and has been working-as an investigator since February 2013. Your af?ant is a 2008 Graduate?of the 14th Basic Law Enforcement Training Program from the Maine- Criminal Justice Academy and has also Successfully completed the Maine Warden Service?S-Advanced Training Academy. Your af?artt has prepared numerous search warrants and has also. participated in the eXeCution of numerous search warrants to go along with hundreds of criminal investigations involving ?sh and wildlife crimes. 2) The Operative has been. employed by the Maine Warden Service for approximately 25 years and has participated in numerous _special investigations as a covert operative, Which'has resulted in hundreds of prosecutions for scrious class D. and class fish and wildlife crimes as welt as numerous felonies. The Operative'i?s an experienced covert operative who has been conducting undercover inVestigations since 1996.. V. Based on my education, training and experience, and the facts set forth in this af?davit, there is probable cause to believe, and I do believe, the following: 1.). RICHARD SANBORN Sr. has engaged in the offenses of Guiding without a valid license, False Registration of Deer, Hunting Deer after having killed one, Driving deer and Seliing bear parts without a hide dealer?s license. 2) Your af?ant would point out that. unlike a fennel interview conducted by a person that a suSpect knows to be a law enforcement of?cer, the subjects making statements to a covert operative are doing so to a person that they believe to be. a friend and associate. The persons making statements like those of RICHARD Sr SANBORN In, and other associates of the SANB are made in setting where the SUSpects have no knowled 3 a go that the statements the - to a law enforcement of?cer.
