The Emergency Temporary Guardian failed to attach an appraisal or any other document re?ecting a valuation for the Ward?s real property to the Veri?ed Inventory. 2. The Emergency Temporary Guardian failed to attach an appraisal or any other document re?ecting a valuation for the Ward?s vehicle to the Verified Inventory. 3. The Emergency Temporary Guardian failed to include the Ward?s cash assets in the total of the Ward?s personal property on the Veri?ed Inventory. In addition, the Emergency Temporary Guardian included Trust accounts which are not subject to the guardianship and which should not be included in the total value on the Veri?ed Inventory. 4. The Emergency Temporary Guardian failed to include the Ward?s cash assets in the total of the Ward?s personal property on the Veri?ed Inventory. 5. The Emergency Temporary Guardian failed to include account statements for the Ward?s Merrill account ending in NSA Account and State of Florida Department of Children and Families account. 6. The Emergency Temporary Guardian failed to include the Ward?s Merrill CMA Account ending in on the Inventory and only attached a copy of trade con?rmations to the Inventory. Obieclions to Final Report and Accounting of Emergency Temporary Guardian 7. The Emergency Temporary Guardian failed to attach any account statements to the Final Report and Accounting. 8. The Final Report and Accounting includes Trust accounts and transactions which are not subject to the guardianship. 9. The starting balance is the same as the closing balance and is based upon the cash value listed on the Veri?ed Inventory, which included Trust accounts that should not be included. 10. PETITION FOR ORDER AUTHORIZING GUARDIAN TO RENT REAL PROPERTY Petitioner, Elizabeth Savitt, alleges: 1. Th.) Petitioner is the duly appointed plenary guardian of the person and property of Carla Simmonds (the Ward), having been appointed by Order and Letters dated August 26, 20l4. The Ward is the owner of homestead real property located at 1070 W. Lancewood Place, Delray Beach, Florida 33445. However, the Ward is currently residing at 2362 W. Silver Palm Road, Boca Raton, Florida 33432, the home of Daniel Schmidt. It is likely that the Ward will return to her home in the future but she will be residing with Daniel Schmidt for the time being. The Ward?s home is currently empty and the Ward?s funds are being used to pay for the expenses ofthe home even though she is not using it. Petitioner would like to rent the Ward?s home for fair market value until such time as the Ward is able to return home and believes that she will be able to rent the home for between $2,000 and $2,200 per month. A recent Zillow report re?ecting the current rental estimate for the property is attached hereto as Exhibit Pursuant to RS. 744.44 1(12), the guardian is required to seek court approval in order to lease the real prOperty of the Ward. WHEREFORE, Petitioner respectfully requests the Court enter an order authoring the guardian to rent the Ward?s real property.
