Dear Mr. Olday,

Please see the attached letter dated May 25, 2016, from the United States Department of the Interior
Fish and Wildlife Service (USFWS). in this letter USFWS revoked its approval of the Sovereign Lands
Construction Permit No. 16?021 (permit) issued by the Department to Dakota Access, LLC on March 3,
2016. This permit was issued for the construction, maintenance and operation of an underground
pipeline across the Big Sioux River Wildlife Management Area (WMA). And this permit was conditioned
upon approval by the USFWS. Because that approval has been revoked, Dakota Access, LLC is no longer
authorized to engage in any activities pursuant to that permit.

In addition, earlier in the day on May 25, 2016, John Doershuk, State Archaeologist of lowa sent an
e?mail to Andrew Gottsfield, of Burnes 8: McDonnell, which stated that in accordance with iowa Code
chapter 2633 ?no one (including professional archaeologists or biological anthropologists) may conduct
any sort of ground-disturbing activity or investigation at or near the location of This location
encompasses the entire eastern one-half of the WMA overlapping DAPL PCN 1 in Lyon County, Iowa.

For the reasons discussed above, before Dakota Access may do any work pursuant to permit No. 16?021,
it must first obtain approval from the State Archaeologist and USFWS.
