PLANO POLICE DEPARTMENT 909I4??StrectPlano.TX75074 "9 I3 ELONY PROBABLE CAUSE AFFIDAVIT Offense 16-99432 Warrant/f: 380A-20160529-02-PPD In the Name and by the authority of the State of Texas: BEFORE ME, the undersigned authority on this day personally appeared the undersigned affiant, who after being by me duly sworn on oath, deposes and says that he or she has good reason to believe and does believe, that heretofore, to wit: on or about May 29th, 20m and anterior to making and filing this complaint, in the County of Collin and state of Texas Kenneth Alan Amyx 01/05/71) TX did then and there commit Murder PC a criminal offense against the laws of the State of Texas. (If necessary, additional pages are attached and incorporated into this affidavit). Affiant, Jonathan Hay, is employed by the Piano Police Department, Plano, Texas, assigned as Crimes Against Persons Detective. Affiant's belief is based on the following facts: On May 29, 2016, Affiant (Detective Jonathan Hay) was called to assist with a Murder investigation and received the following information from Detective Martinez. On May 29, 2016 at about 1003, Plano Police Dispatch received a call from Judy Stein about a possible suicide or murder about to occur. Stein told dispatchers that her daughter Jennifer and her daughter?s boyfriend Kenneth ?are going to kill each other." Plano Police Officers were diSpatched to the scene located at 2300 Ln #624 City of Plano, Collin County, Texas to investigate. Officer Donahoo and Of?cer McArtor arrived on the scene and attempted to make contact with Jennifer and Kenneth but there was no response. Officers Donahoo and McArtor contacted the maintenance worker for the apartment complex to gain access to the garage of the apartment. Upon making entry into the garage, the officers found the door from the garage to the interior of the apartment to be secured by deadbolt from the inside. Officers Donahoo and Officer McArtor forced entry into the apartment and began to search for Jennifer and Kenneth. Officer Bass also arrived to assist. Upon entering the bedroom of the apartment, the officers found a nude male, later identified as Kenneth Allen Amyx 01/05/71) lying on top of a nude female, identified as Jennifer Lee Spears 05/12/73) on the floor of the bedroom. Amyx initially appeared to be deceased but started to make noises. Officers moved to Amyx and observed a knife in his right hand. Officers removed the knife and moved Amyx to an area of the apartment where he could be treated by Plano Fire Department personnel. When Amyx was moved, officers observed a second knife under him. Officers also observed Spears to be deceased. Spears had multiple knife wounds to her forearm, wrist, and neck. Amyx told Officer Bass the truth was that Spears had ?chickened out" and he had to ?finish her off." Amyx was transported to Centennial Hospital in Frisco, Texas. Officers secured the apartment to protect the evidence at the scene. Affiant proceeded to Centennial Hospital at the request of Detective Martinez. Affiant arrived and contacted Dr. Craig Brockman and the ER Staff. Dr. Brockman and the staff were attending to Amyx and assessing his injuries. Dr. Brockman stated that Amyx had one 80m wound to right side of his neck (that would require stitches) and superficial wounds to his left wrist. Affiant learned from Officer McArtor that Amyx was wanted out of Dallas and Rockwall Counties for Sexual Assault of a Child. Affiant confirmed from Amyx that he was indeed a fugitive from justice. Affiant confirmed on the warrants using Amyx?s Texas driver?s license number #14266085 as an identifier. Affiant spoke with Fireman Daniel Daly 11/20/79) who attended to Amyx in the ambulance during his trip the heapital. Daly said that during the drive to the hospital Amyx was very upset and stated ?Oh I killed her, oh I lost her, I'll never get her back, just kill me". Daly wrote a written report for the medical call for service. Affiant then spoke with Charles Amyx 01/21/46) and he stated that his son (Kenneth) had called him and said ?this is Ken, I love you, we've cut our throats?. Charles said that Kenneth gave him the apartment complex address and hung up. Charles Amyx wrote a written statement about the phone call. Amyx stated that he had been lifelong friends of the victim, Jennifer Streit?Spears, and they had been dating about 4 months. Amyx stated that they had planned to run away together knowing that he was wanted. Amyx then stated that they both decided to commit suicide and had discussed it for a few months. Today they both had been drinking and stated that they agreed to stab one another until they died. Amyx said that they were in the bedroom lying down and had two knives. Amyx stated that he cut the back of her neck first and then they took turns cutting one another. When asked, Amyx said that he did not cut Streit- Spears anywhere else (other than the neck). Amyx said that Strait?Spears said that she was cold and she said hit it hard (out her harder). He then said he came down hard (?like cutting tomatoes?) and when he pulled the knife out blood came all over the place. Amyx said Streit?Spears then said she said she was cold, don?t think she can do it, she was took weak. Amyx said that he grabbed her hand (that had the knife) and cut himself hard. Amyx said that he then posted photos of both of them (wounded) on Facebook and then text Streit- Spears mother the same picture. Affiant received the above information by Affiant?s personal observations/research, personally Speaking with Officer McArton, Officer Donahoo, Detective Martinez, Detective Pfhaning, Charles Amyx, and Fireman Daniel Daly, and reviewing the Plano Police Department's offense report database.
