On Wednesday, October 14, 2015, at approximately the defendant, 24y0 I Derrick Coleman, left the Seahawk?s training facility in Renton. He was captured on video unassisted and alone, walking to' his Dodge Ram truck. He pulled around the parking lot and stopped to pick up a passenger, identi?ed as Jeremy Lane. Mr. Lane appeared to be waiting for him in front of the facility. Mr.'Lane got into the front passenger seat and left the gated facility in the defendant?s truck. According to Mr. Lane, the defendant took him to his Renton area home and left. The defendant is believed to have driven toward the South Center area, but it is unknown where he went. He then drove back into Bellevue. Several traf?c cameras in Bellevue captured him as he drove toward the area of the collision. At approximately a camera recorded him driving extremely slowly, for no apparent reason, through an intersectiOn, down the block, and staying in the right lane which exits to the right onto another street. At approximately witnesses were alerted to his truck when he suddenly, and without apparent reason, accelerated to freeway speeds on a posted 35mph road. The witnesses noted that he attempted to pass a vehicle by using the center turn lane; however, he returned to his travel lane, and rear~ended the vehicle in front of him. This caused Mr. Fine?s car to ?ip over and land on its roof. The defendant?s vehicle also hit the embankment and landed on its driver?s side. Later collision reconstruction and the data from the Crash Data Recorder indicated that the defendant was fuily accelerating during this period and did not apply his brakes. His speed was over 60mph. Witnesses immediately contacted 911 and ran to both vehicles. The sole occupant and driver of the flipped car was Mr. Fine. Mr. Fine was able to crawl out of his upside down car and then coliapsed. He suffered a fractured collar bone that may now require surgical intervention as it is a difficult type of fracture. He also suffered a moderate concussion and showed confusion and memory issues in the Emergency Room. He continues to have related to his injuries. The defendant immediately attempted to climb out his rear window, but was helped out the rear door by a witness. He turned back into the truck and grabbed his cellphone. Several witnesses describedhim as ?aggravated and delirious? and ?incoherent.? He was advised to remain at the scene, but ?ed barefoot down the block and turned the corner. He had been driving in bedroom slippers which were found later in the driver?s foot well. He did not call 911. Within ten minutes of the crash, a responding police officer saw the defendant and identi?ed that he was the driver and contacted him. The defendant said that he was attempting to contact his agent and relinquished his cellphone. The police ensured that his hearing aids were working and that he was able to understand their questions. The defendant is substantially deaf and uses hearing aids. He declined to say exactly where or with whom he smoked the drug; however, he claimed that it was at a friend?s house in the Lakemont neighborhood at approximately The neighborhood mentioned is inconsistent with the evidence of his travels. A Drug Recognition Expert (DRE) of?cer arrived and was present. The defendant agreed to do Field Sobriety Tests (F STs) stating that he ?felt fine? and had ?no injuries.? During the STs, the defendant used his arms for balance, swayed, lost his balance, and showed signs that he was impaired from a drug. He showed no signs of a brain injury and did not complain of - any injury. - Spice is the umbrella street name given to cannabinoid drugs. These made designer drugs are intended to target the same area in the brain that the active drug in marijuana targets. Like the active drug in marijuana, these designer drugs are lipophilic and seem to move quickly from the blood stream into the fat cells, like the brain. The effect of the drug depends on the particular designer drug that is sprayed on the plant material that is smoked. Manufacturers tinker with the chemical compound and produce many different designer drugs, each with varying effects. The active drug appears to bind quickly in the brain. Some users report agitation, confusion, or or ?LSD~like effects? within the initial hour or so after use. Unlike marijuana, there is no known metabolite to track the use of these designer drugs. Little research has been done on the designer drugs in part because the compounds are frequently being altered. After the FSTs, the defendant was arrested. The defendant was evaluated by medical personal and found to not have any injuries. He was taken to the police precinct. The defendant called his agent as soon as he arrived at the police station. An attorney soon contacted the police and requested an in-person interview with the defendant. The police waited for the attorney?s arrival. The defendant Was permitted to spend nearly an hour with his attorney in a private room. A blood draw was done pursuant to a search warrant hours after the crash. His blood did not retain any of the cannabinoid he had consumed. An open cannabinoid packet was found in his vehicle. Also found in his vehicle?s center console were several packets of marijuana edible candies, other packets of a different cannabinoid drug, an drop solution to quickly relieve redness in eyes, and a glass pipe commonly used to smoke cannabinoids and marijuana. The State will not oppose the defendant?s release on his personal recognizance on the conditions that he not drive without a valid license and insurance, have no moving violations, not use any impairing substances within 12 hours of driving, shall not use or possess cannabinoids, appear for all hearings and waive extradition if the Court permits him to leave the State of Washington. The defendant has no known criminal history. His moving violations include speeding/HOV violation (5/20/2015), and a deferred for speeding (1 1/16/2013). Of?cer Keblish located a 30 year old inale in a black t~shirt and black pants with no shoes on at the corner ot?SE 37th St and 136111 Pl SE approximately two blocks from the scene of the collision. Officer Keblish detained the male in handcuffs at this location. Shaggs, Paul (08?27-94) who was eastbound at the 13500 of SE 36th St two vehicles behind a Dodge Crew Cab pickup noted the pickup suddenly accelerated from 35 to about 50?55 in a 35 zone and strike a vehicle in front of it pushing the other vehicle up the hill side and causing both vehicles to flip over as they collided with the hillside. Sltaggs indicated that as he approached the Vehicle a black male exited the vehicle and he appeared aggravated and out of it as he ran away from the scone. Toscano, Nicholas (08?17-94) who was in the vehicle with Skaggs stated that he observed the driver of the pickup attempting to climb out the rear sliding window upon arrival. Toscano opened the. rear driver?s side door ofthe pickup and assisted the driver out of the vehicle. Toscano stated the male than left the scene running eastbound. A third witness Kieselyov, Alexi a 6} year old male walking east on SE 36th St stated that he though the pickup was traveling at'ahout 60-70 mph. Both Toscano and Skaggs were taken to the location of the male and identi?ed the male detained by fficer Keblish as the same male that had exited the pickup and ran from the scene. A check of the 2015 Dodge Crew Cab Pickup Washington license plate DLCJ returned to a registered owner of Coleman, Derrick. A check of the other involved vehicle a 2007 Honda Civic WA license plate APV2948 returned with a registered owner of Fine, Kristopher. The Dodge pickup was at rest on its driver side and the Honda Civic had extensive rear end damage and was pushed up a hillside lying on its roof. Both vehicles had airbag deployments. I arrived on scene and spoke with the male driver who was identi?ed as Coleman, Demo-k 1.. Jr. Coleman advised me that he is deaf and had me activate his hearing aids so he could understand what I was saying. Coleman advised me that he could understand what I was saying after activating his hearing aids. Coleman advised me that he understood his rights and was willing to talk with me. I asked Coleman asked what happened and Coleman stated that he did not remember being in a collision. Coleman stated that he felt like he had passed out and then suddenly came to. Coleman mj I Cams? I eon?nned with Coleman that he had only walked away and Celenian claiitied that he had run away from the scene and then started walking after reaching the corner of SE 37th St and?136th Pl SE. Coleman stated he had then walked up to the corner ofa house and was attempting to call his agent. Coleman asked how the other driver was doing and 1' informed him that the other driver was currently at the hospital. I informed Coleman that I was aware that he had admitted to smoking some ?Spice? earlier. Coleman informed me that he had smoked Spice around 1700 hours and had then driven somewhere around 1730 hours. Coleman stated that he had felt ?ne and that the Spice normally wears oft?qoickly. i asked Coleman if he Was willing to perform some voluntary field sobriety tests and Coleman stated ?yes?. Coleman denied having any injury and stated that he felt fine after the collision. I had the handcuffs removed from Coleman?s wrists to perform the tests. Coleman did not have Horizontal Gaze Nystagnnis in either eye. Coleman was barefoot for the walk and turn test. Coleman was placed in the starting position for the walk and tum test and stepped out of the starting position for balance. Coleman began the test and began to raise his arms, but quickly returned them to his sides and did pen?brin the remainder of test according to the instructions. Coleman was provided the instructions for theone leg stand test and Coleman stated he understood the instructions. Coleman began the test raising his left foot and put his foot down immediately as he swayedand appeared unsteady on his foot. Coleman switched to raising his right foot and held his right foot up without swaying or putting his foot down for 30 seconds. I was advised that driver of the Honda Civic, Fine, Kristopher (1047?58), struck by Coleman sullei?ed a broken collar bone in the collision by Officer Folder who was at Overlalce Hospital.
