Whitney is the Executive Director of the Medical Board of California, Department of Consumer Affairs, and brings this First Amended Accusation (Accusation) solely in her of?cial capacity. 2. On June 5, 2002, Physician?s and Surgeon?s Certi?cate No. A79324 was issued by the Medical Board of California to Frederick George Field, MD. (?Respondent?) Said certi?cate expired on January 31, 2012, and is in SUSPENDED status based on an order issued on September 1, 2011 pursuant to Business and Professions Code section 2310(a). First Amended Accusation (16-2011-217378) JURISDICTION 3. This First Amended Accusation is brought before the Medical Board of California], (the ?Board?) under the authority of the following sections of the California Business and Professions Code (?Code?) and/or other relevant statutory enactment: A. Section 2227 of the Code provides in part that the Board may revoke, suspend for a period not to exceed one year, or place on probation, the license of any licensee who has been found guilty under the Medical Practice Act, and may recover the costs of probation monitoring. B. Section 2234 of the Code provides that the Board shall take action against a licensee who is charged with unprofessional conduct. C. Section 2305 of the Code provides, in part, that the revocation, suspension, or other discipline, restriction or limitation imposed by another state upon a license to practice medicine issued by that state, that would have been grounds for discipline in California under the Medical Practice Act, constitutes grounds for discipline for unprofessional conduct. D. Section 141 of the Code provides: For any licensee holding a license issued by a board under the jurisdiction of a department, a disciplinary action taken by another state, by any agency of the federal government, or by another country for any act substantially related to the practice regulated by the California license, may be ground for disciplinary action by the respective state licensing board. A certi?ed copy of the record of the disciplinary action taken against the licensee by another state, an agency of the federal government, or by another country shall be conclusive evidence of the events related therein. Nothing in this section shall preclude a board from applying a speci?c statutory provision in the licensing act administered by the board that provides for discipline 1. The terms ?Board? and ?Division? or ?Division of Medical Quality? mean the Medical Board of California; First Amended Accusation (16-201 1-217378) based upon a disciplinary action taken against the licensee by another state, an agency of the federal government, or another country.? E. Section 2236 of the Code provides that the conviction of any offense substantially related to the quali?cations, functions or duties of a physician and surgeon constitutes unprofessional conduct. F. Section 2232 of the Code requires the revocation of the license of any physician and surgeon required to register as a sex offender pursuant to Penal Code section 290. FIRST CAUSE FOR DISCIPLINE (Discipline, Restriction, or Limitation Imposed by Another State) 4. On August 4, 2011 the Oregon Medical Board issued an Interim Stipulated Order based on an investigation by the Oregon Board which ?raised concerns to the extent that the Board believes it necessary that Licensee immediately cease the practice of medicine until the investigation is completed.? Respondent agreed to voluntarily and immediately withdraw from the practice of medicine and to place his license on inactive status pending the completion of the Oregon Board?s investigation into his ability to safely and competently practice medicine. On January 10, 2013, the Oregon Medical Board issued a Stipulated Order under which Respondent permanently surrendered his license to practice medicine, and was permanently prohibited from applying for a license to practice medicine. The Stipulated Order was based on the fact that on September 18, 2012, Respondent was convicted pursuant to a plea of guilty in Wasco County, Oregon Circuit Court of one felony count of rape in the first degree and ll felony counts of sexual abuse in the ?rst degree. Respondent was sentenced to 23 years of con?nement by the Oregon Department of Corrections. A copy of the Stipulated Order issued by the Oregon Medical Board is attached as Exhibit A. 5. Respondent?s conduct and the action of the Oregon Medical Board as set forth in paragraph 4, above, constitute unprofessional conduct within the meaning of section 2305 and conduct subject to discipline within the meaning of section l4l(a). Respondent?s criminal convictions constitute unprofessional conduct and the conviction of crimes substantially related to the quali?cations, functions or duties of a physician and surgeon, and are cause for discipline pursuant to Business and Professions Code sections 2234 and/or 2236. 8.
