Kowalski, in Court of Common Pleas, Cumberland County, Case No. 2012-1820, Kuwait Gulf Link Transport Co., at al. v. John Doe, e! Dear Mr. Hammond: Defense Logistics Agency employees Normand V. Lussier and Medard R. Kowalski provided declarations to you regarding the case of Kuwait Gulf Link Transport et al. v. John Doe, Court of Common Pleas, Cumberland County, Case No. 2012-1820. Mr. Kowalski's declaration was dated January 28, 2013, and Mr. Lussier?s declaration was dated June 26, 2013. I understand that both declarations have been ?led with the Court of Common Pleas in by the plaintiffs (hereinafter KGL) in that case. A review of the content of those declarations by the Defense Logistics Agency (DLA) has - determined that both of those declarations contain material errors. Mr. Lussier?s declaration contains at least one material statement of fact that is incorrect. Mr. Kowalski?s declaration similarly contains at least one material statement of fact that is incorrect. Even if the facts set forth in these declarations were true and correct to the best of the declarants? knowledge, information and belief at the time they were signed, the declarations? contents are no longer true and correct to the best of the declarants? current knowledge, information and belief. Therefore, based on these determinations, DLA does not authorize continued use of the two declarations. DLA requests that KGL notify the Court of Common Pleas that the Lussier and Kowalski declarations have been determined to be erroneous and that the declarations should not be used or considered for any purpose. DLA further requests pursuant to Pa. Rules of Prof? 1 Conduct R. 204 Pa. Code 81.4, that KGL seek to have the declarations withdrawn from that case.
