During the week of 090506 to 090706 I supplied Deputy District Attorney Charlene Woods with copies of reports and photographs pertaining to PPB Investigation #06- 76259. Deputy Charlene Woods stated she would be staf?ng this investigation with her superior and get back to me regarding the direction in which she would like to have me On 091106 Deputy District Attorney Charlene Woods stated that I needed to proceed in this investigation by interviewing the alleged suspect MIKE MARSHMAN. On 091 106 I contacted Supervisory Sergeant Pat Kelly informing him of what Deputy District Attorney Charlene Woods directed me to do. Sergeant Kelly stated he would send an email to our Captain, John Eckhart, explaining this and for me to contact Captain Tellis in Internal Affairs Division prior to contacting MARSHMAN to make sure directives were being followed. On 091106 I contacted Captain Tellis by phone. Both myself and Captain Tellis discussed the directives and Captain Tellis stated he would contact AC Beard and get right back to me regarding the interpretation of the directives. Captain Tellis contacted me back by phone stating after he had a conversation with AC Beard it was determined that no advance notice or bill of rights needed to be forwarded to MARSHMAN and that this was a criminal investigation and go about it the same way I do other criminal investigations. On 091206 myself and Detective Eric Carter went to the residence of 13946 NW Charlton Road. We spoke with MIGUEL GONZALEZ-MOSELER and identi?ed ourselves as police detectives showing him our photo identification and badges. I also supplied GONZALEZ-MOSELER with a business card. I explained to GONZALEZ- MOSELER that I was interested in seeing if there was any damage to a wall inside his residence and asked MOSELER if he was aware of any damage. MOSELER stated that he had not noticed any damage to a wall when he moved in. MOSELER was asked if it would be all right if we came into his home and he invited both of us in. We entered through a side door near a garage entering into the kitchen portion of the home. Directly next to the kitchen is the living room. GONZALEZ-MOSELER was asked how long he had been living in this home and he stated since February of 2006. According to MOSELER, that was the closing date. GONZALEZ-MOSELER was asked if he knew the names of the tenants that had lived there prior and he stated that their last name is MARSHMAN. GONZALEZ-MOSELER stated that he lives at that residence with his partner EWALD MOSELER and that they are busy with a wine distribution business when asked. GONZALEZ-MOSELER was asked if he knew what year the house was built and he stated 2002. According to GONZALEZ- MOSELER the house is not completely ?nished and he understood the previous family had run out of financing to do that. I contacted?and explained that I was in his previous residence and asked him to walk me through via the tele hone to the wall that the encounter occurred on involving him and his step-father. directed me to stand in front of the French doors looking out into the backyard from the living room. ?then stated there is a hallway to the left near the kitchen with two rooms.? asked if one of the rooms still had green carpet and I stated that it did. stated there should be a closet on one of the walls and that is the hallway that it occurred on. I thanked and ended my conversation with him at that time. I asked GONZALEZ-MOSELER if he could remove the pictures that had been hanging on the wall in the hallway. A?er GONZALEZ-MOSELER removed two photos that had been hanging side by side I observed two areas where the wall had indentations. I asked GONZALEZ-MOSELER if it would be all right if we had someone from our Identi?cation Division come out and take photos. GONZALEZ-MOSELER stated he had a court appearance to attend to regarding traffic and that he needed to leave his home to do that. Arrangements were made with GONZALEZ-MOSELER to return the following day on 091306 at 11:00 am. to take said photos. GONZALEZ-MOSELER stated he had not observed the indentation marks on the wall when he moved in. On 091306 myself and Detective Eric Carter contacted MIKE MARSHMAN in the Chief?s Office. We utilized office to speak with him. Both myself and Detective Carter introduced ourselves and I asked MARSHMAN if he could close the doors to his office for privacy. MARSHMAN did this. I explained to MARSHMAN that 1 had been assigned an investigation that involves some family members of his and that I wished to speak with him regarding this. It was approximately 9:10 am. when we contacted MARSHMAN. I asked MARSHMAN if he was willing to speak with us and he stated that he really didn?t know what to do. According to MARSHMAN, he had contacted Captain John Tellis after being contacted by the new homeowner of his old home yesterday. MARSHMAN stated he also spoke to Robert King who directed him to speak with Mike Staropoli, an attorney. MARSHMAN stated he has an appointment with Mike Staropoli at 10:00 am. today. We thanked MARSHMAN for his time and concluded our interview with him. MARSHMAN was asked to provide Staropoli with our names and numbers. On 091306 myself and Detective Eric Carter went to the residence of GONZALEZ- MOSELER. Also present with us was Criminalist Adam Cushman. GONZALEZ- MOSELER was asked if he had spoken with MIKE MARSHMAN yesterday after our visit. GONZALEZ-MOSELER stated that he did not but that his partner EWALD did. According to GONZALEZ-MOSELER, they were concerned about possible lawsuits and GONZALEZ-MOSELER asked about that. I explained to GONZALEZ-MOSELER that this had nothing to do with lawsuits involving him or his partner that it was con?dential and he did not have to worry. I again asked GONZALEZ-MOSELER if it would be all right if our criminalist went in and took some pictures. Pictures were taken of the wall in question and we thanked GONZALEZ-MOSELER for his time and left said residence. On 091406 myself and Detective Eric Carter spoke with Lieutenant Bob Heimbach from Family Services Division. I explained to Lieutenant Heimbach that it was my understanding that he had retrieved a phone number for STACY COLE from his phone. Lieutenant Heimbach stated he did not retrieve it from his phone that he had been given STACY cell phone number from another dispatcher after he returned from attending training at the FBI Academy in Quantico, Virginia. According to Lieutenant Heimbach, he had attended training in Quantico, Virginia from approximately January 7?h or 8th returning back to the Portland area on March 17th of 2006. Lieutenant Heimbach stated that he did not return back to work until April 4, 2006. According to Lieutenant Heimbach, he had met STACY COLE while working at East Precinct as a sergeant. Lieutenant Heimbach stated that he was involved in smoothing disputes between uniform of?cers and dispatch and that he knew STACY as MARSHMAN not COLE. Lieutenant Heimbach stated he had called up to dispatch shortly after returning from his training in Quantico, Virginia and was told that STACY was out on a disability. Lieutenant Heimbach stated when he returned with the paperwork Captain Eckhart shared the information that was inside the envelope with him. Lieutenant Heimbach stated the information was inaccurate and he shared that with Captain Eckhart. According to Lieutenant Heimbach, he told Captain Eckhart that MIKE wife?s name is not PATRICIA as was originally listed, that his wife?s name is STACY. Lieutenant Heimbach stated that he also stated that their son?s name was Lieutenant Heimbach stated he retrieved a phone number belonging to cell phone that he had written on paper providing that information to Captain Eckhart. Lieutenant Heimbach was asked if he ever contacted STACY COLE after returning from his trip from Virginia on her cell phone and he stated he did not. We concluded our interview with Lieutenant Heimbach at that time. On 091406 a meeting had been prearranged between Detective Carter and Attorney Mike Staropoli to take place at the Child Abuse Team of?ce located at 10225 Burnside at approximately 9:30 am. Mike Staropoli arrived for said meeting as scheduled. Introductions were made and I provided Mike Staropoli with a business card. I thanked Mike Staropoli for coming to the meeting and for Detective Carter assisting in arranging it. I explained to Mike Staropoli that myself and Detective Carter were assigned an investigation involving MIKE MARSHMAN. It was explained to Mike Staropoli that two anonymous letters had been received at the bureau regarding allegations of possible abuse to MIKE stepson. I provided Mike Staropoli with the postmarked date of the ?rst letter being June 23, 2006 and stated that the ?rst letter was very vague. I explained to Mike Staropoli that the second letter dated August 14, 2006 that had been sent to the bureau was a little more speci?c. I went on to explain to Mike Staropoli that the second letter mentioned photographic evidence. I explained to Mike Staropoli that myself and Detective Eric Carter contacted STACY COLE, the ex-wife of MIKE MARSHMAN as well as_ his stepson. It was explained that there are physical abuse allegations being mentioned by both and that there are photos depicting this. It was also explained to Mike Staropoli that myself and Detective Carter have also been out to the Old residence where the MARSHMAN ?s lived and that photos had been taken there as well. I went on to explain to Mike Staropoli that I had attempted to contact Charlene Woods who was the Deputy DA assigned to this case to see if she wanted me to show him the letter or the photos but was unable to get a hold of her at this time. I explained to Mike Staropoli that Charlene Woods would be out of the of?ce until Monday because of being away at training. Mike Staropoli stated he had talked with MIKE MARSHMAN and that MIKE MARSHMAN recalled an altercation that he had with his stepson and that there may be indications that it happened in the living room of the old house. Mike Staropoli stated that the date of Spring of 2004 came up when they were discussing this. I explained to Staropoli that both the mother and the son are saying that when ?was approximately seventeen years old when it happened. Mike Staropoli stated it would be interesting if the roll of ?lm documented the time frame of the injuries. Mike Staropoli stated that it was also mentioned from MIKE MARSHMAN to him that the pictures were used as a form of leverage and that MARSHMAN mentioned that he had also told his ex- wife that she had slapped her son. We spoke with Mike Staropoli regarding unrelated matters and concluded our interview with him. On 091406 I contacted Captain Tellis by phone. I explained to Captain Tellis that it was my understanding that MIKE MARSHMAN had contacted him regarding this investigation. Captain Tellis stated that he did speak with him a couple of times and that MIKE reason for contacting him was because of policies and procedures primarily. According to Captain Tellis, MIKE MARSHMAN told him that a person that had bought his house said that Karen Mack was at his old house making inquiries and wanted to know what was going on. MIKE MARSHMAN, according to Captain Tellis, contacted him wanting to know who he should make aware that this is taking place and if an investigation is occurring. According to Captain Tellis, MIKE position at work was originally associated with being an assignment in Internal Affairs Division and IVLARSHMAN is now working in the Chiefs Of?ce. Captain Tellis stated he advised MARSHMAN to let Chief Sizer know. According to Captain Tellis, the only other conversations that they had were words of encouragement. ITEM 5: ITEM SUMMARY: Two anonymous letters were sent to Internal Affairs Division regarding possible alleged abuse to MIKE step-son. MIKE ex-wife STACY COLE and ex-step-son ?were contacted regarding this alleged abuse. Also contacted was MIKE brother, EDWARD MARSHMAN. Phone conversations took place with writer and STACY COLE and writer and Captain John Tellis regarding information pertaining to this investigation. The information gained from those phone conversations is re?ected in the narrative portion of this report. NARRATIVE: On 082806 I received an interof?ce envelope from Lieutenant Jay Drum in the Internal Affairs Division. Said envelope contained a photocopy of a handwritten envelope titled ?Internal Affairs,? dated 23, June 2006. Said envelope also contained an interof?ce memorandum dated July 21, 2006 to Captain John Tellis from Captain Ronald Schwartz. Said envelope also contained a photocopy of an envelope addressed to Internal Affairs Division dated August 15, 2006. Said envelope contained an anonymously written letter dated August 14, 2006 to Internal Affairs Division. Also enclosed in said interof?ce envelope was a chronological record with IPR and a Portland Police Bureau person?s reports as well as a Portland Police Bureau Investigative Report. After reviewing said items in the interof?ce envelope I contacted Lieutenant Drum by phone. I informed him I did not receive the copy of the ?rst letter only the envelope. I also mentioned to Lieutenant Drum that I did not receive any documentation stating as to who performed the ?ngerprint test in the Identi?cation Unit on said letter. Lieutenant Drum stated that he would email Captain Tellis regarding these questions. On 082806 I received an email from Captain John Tellis that had been sent to Lieutenant Drum with ?cc? copy coming to me. In said email from Captain Tellis it states that the original ?rst letter sent had been examined for ?ngerprints by ID and the process destroyed the paper on which the message was printed. On 082906 I contacted Captain Tellis by phone. Captain Tellis stated that the original ?rst letter was destroyed in Identi?cation when they used a substance called Ruthiniun Pepraoxide to attempt to lift any latent ?ngerprints of value. Ken Jones. Captain Tellis stated the reason nothing was done of?cially is because it didn?t rise to the level of a complaint. According to Captain Tellis, when the Identi?cation Division was done examining said letter they gave it back to him with instructions not to open it because it was contaminated. Captain Tellis stated he didn?t want the letter being that it was contaminated and Criminalist Ken Jones offered to destroy the letter for Captain Tellis which he agreed to have take place. Captain Tellis stated that in Criminalist Ken Jones? letter that he will be sending to me makes reference that Captain Tellis was given the letter but Captain Tellis stated that he did give it back to Ken Jones to destroy. According to Captain Tellis, the Independent Police Review Board has a copy of this letter as well. Captain Tellis stated that in situations like this when somebody sends in an anonymous letter to Internal Affairs a copy of that is referred to the Independent Police Review Board as well. Captain Tellis stated that after receiving the anonymous letter there were two things that he wanted to accomplish. Captain Tellis stated that he wanted someone from Family Services to do some kind of background check initially. According to Captain Tellis, that check came up negative. Captain Tellis stated that if someone was alleging child abuse and it was a bureau member they had the job of reporting and could not remain anonymous when it had to do with child abuse. Captain Tellis stated that he had wanted to bring that person to test if he found out that it was a bureau member writing the letter anonymously. Captain Tellis stated that was the initial reasoning behind printing the letter to see if it was a bureau member sending it in anonymously. Captain Tellis stated that if a letter came in that was anonymous like this he would routinely print it and he stated that he would if it alleged child abuse and had to do with a bureau member when asked. Captain Tellis stated he was curious why someone would make a charge like that if they were a~ bureau member and not take action. Captain Tellis stated there were no ?ngerprints of value other than his of?ce staff found on said letter. I explained to Captain Tellis that I had received a second letter in a Ziploc bag. Captain Tellis con?rmed that they had received the second letter anonymously written. I asked Captain Tellis if anybody attempted to get the second letter printed and he stated that they did not. According to Captain Tellis, the ?rst letter yielded zero ?ngerprints and the likelihood of the second letter yielding any ?ngerprints would also probably be zero. Captain Tellis stated that it was obvious when it was only his of?ce staff members who had prints left on the ?rst anonymous letter that who ever sent it more than likely wore gloves while folding it and placing it in the enveIOpe. I inquired from _if he had the opportunity to assist his mother in retrieving the photos that she had mentioned earlier having in the garage in boxes. I asked _if his mother did find any photos. tated that he doesn?t believe his mother found any photos. I con?rmed with ?the correct phone number for his mother of? I left a voicemail message on STACY home phone number to have her call me. STACY COLE called back on 082906 and we spoke regarding the photos of her son STACY COLE stated she had found the photos but was reluctant to provide them to me for fear of what might happen to MIKE. STACY COLE asked if we had gone out to the house that they used to live at on Sauvie Island and I explained that we had not. I explained to STACY COLE that we would like to observe the photos to see what it is that we are dealing with if anything and that we are at kind of a standstill at this point. I explained to STACY COLE that a lot Of parents discipline their children and that the photos she has talked about might not rise to the level that we would even need to be involved. STACY COLE stated what if they show ?ngerprints on one side and thumbprints on another and yellowing in the center. I explained to STACY COLE that I couldn?t speculate that a lot of it just depends on what the photos show. STACY COLE went on to state that is what the photos would show. I explained to STACY COLE that I would like to have her reconsider turning over the photos she has. STACY COLE stated she didn?t know what to do and she had talked a lot with her son_ STACY COLE stated she did not know about turning over the photos and what it would do to MICHAEL and the fact that she had a hand in it and what it would all amount to. I asked STACY COLE if she was able to figure out which box the photos were in and she stated she did. I asked STACY COLE to go ahead and take some time and think about it and give me a call the following day to let me know whether or not she was going to turn over the photos. STACY COLE stated she doesn?t understand how clear handprints that are on a child?s neck can be viewed as discipline. According to STACY COLE, everyone has an idea of discipline and choking a child is not one of them. All items entered onto Property Receipt #975143. Two anonymous letters were sent to Internal Affairs regarding possible alleged abuse to MIKE step-son. MIKE ex-wife STACY COLE and ex- were contacted regarding this alleged abuse. Also contacted was MIKE brother EDWARD MARSHMAN. See narrative below regarding interviews that took place with above listed persons. On 082206 I was contacted by Multnomah County Child Abuse Team Sergeant Pat Kelly. Kelly instructed me that the following day he would be contacting me in regards to a con?dential investigation involving a Portland Police Of?cer. On 082306 myself and Detective Eric Carter met with Sergeant Pat Kelly and Sergeant Larry Linne in their of?ce located at the Child Abuse Team of?ce, 10225 Burnside. We were briefed by Sergeant Kelly regarding the investigation that needed to be conducted involving MIKE MARSHMAN. According to Sergeant Kelly, two letters had been sent to Portland Police Bureau by an anonymous writer. Sergeant Kelly stated the whereabouts of the ?rst original letter were unknown but that he had photocopies. Per Sergeant Kelly he wasn?t sure if Internal Affairs Division had the originals or not. Sergeant Kelly stated that a?er receiving the ?rst anonymous letter he called Personnel to see if MIKE MARSHMAN had any dependants listed and spoke with Sergeant Ron Alexander. Sergeant Kelly stated that Sergeant Ron Alexander told him that there were no references in MIKE personnel ?le to a step-son or any children. Sergeant Kelly stated that Captain Tellis was also contacted regarding this anonymous letter. Sergeant Kelly stated he talked to Captain Ron Schwartz on 072006 and an email was sent to Captain John Eckhart. Sergeant Kelly stated that he also checked Department of Human Services under the name of MARSHMAN and couldn?t ?nd any links to dependants of MIKE MARSHMAN. Sergeant Kelly stated that he had also told Captain Tellis about his ?nding through an email. Sergeant Kelly stated that Commander Cliff Madison and Captain John Tellis sent the second letter to Captain Eckhart. Sergeant Larry Linne had nothing to add to this and stated he didn?t recall seeing the ?rst anonymous letter. Sergeant Kelly provided me with a copy of his email dated 072006, a Special Report that he had prepared dated 082306, a two page handwritten account of persons involved dated 082306, a photocopy of a two sentence letter and envelope postmarked 23 June, 2006, an anonymous letter dated August 14, 2006 inside a plastic Ziploc bag with envelope attached to outside of said Ziploc bag addressed to Internal Affairs Division, and a type- written page pertaining to incident overview. Sergeant Kelly also stated he had a conversation with STACY supervisor JACKIE CARSON from BOEC on 082206 inquiring about work schedule. Sergeant Kelly stated the supervisor told COLE that the sergeant from CAT was trying to get a hold of her. Sergeant Kelly stated it was not his intention for supervisor to notify COLE. According to Sergeant Kelly COLE called him back and inquired as to what he needed. Sergeant Kelly stated he told COLE about receiving correspondence that had to do with someone she knew and someone would get a hold of her later. On 082306 I contacted Kara Dodson who is a supervisor at the Department of Human Services Hotline. I asked Dodson if she could run a check to attempt to locate any dependants under the names MIKE MARSHMAN, STACY COLE, or STACY MARSHMAN. I also asked Dodson to check on the name PATRICIA MARSHMAN. Dodson stated she had run these names for Sergeant Kelly previously and also ran a last name of DELLINGER. Dodson ran said names that I provided her and stated she was RF. I asked Lieutenant Jay Drum if he still had the original ?rst letter that had been forwarded over to Sergeant Kelly. Lieutenant Drum stated he would need to call me back after he located said letter and that the original letter was sent for ?ngerprinting at our Identi?cation Division. According to Lieutenant Drum, there were no known prints found on said letter. I explained to Captain Eckhart I was provided some written documentation pertaining to this investigation. I showed Captain Eckhart the items I had been provided by Sergeant Pat Kelly. According to Captain Eckhart, Commander Cliff Madison called him and said that he was with Captain John Tellis who is the Captain of the Internal Affairs Division and they had been discussing a situation regarding a second anonymous letter regarding Sgt. MARSHMAN. Captain Eckhart stated he had been made aware of this and Captain Schwartz had received a copy of the ?rst letter. Captain Eckhart stated he asked Lieutenant Heimbach to pick up the items Commander Madison had for him. According to Captain Eckhart, he received the items in an interof?ce envelope and that envelope contained a photocopy of the ?rst letter and envelope sent from an anonymous person, as well as a Ziploc bag containing the second anonymous letter with the envelope on the outside of said bag and the letter inside the bag. Captain Eckhart stated Lieutenant Heimbach told him he knew MIKE ex-wife?s name as STACY and that he thinks her son?s name is? According to Captain Eckhart, Lieutenant Heimbach also had cell phone number in his phone and retrieved said phone number writing it down as Captain Eckhart stated Lieutenant Heimbach stated STACY is an employee of BOEC. According to Captain Eckhart, Sergeant Kelly approached him stating this was getting bigger and it needed to be assigned to a detective for investigation referring to the follow-up Sergeant Kelly had been doing. On 082306 I next spoke with Ben Jumbo from Bureau of Human Resources by phone. Ben Jumbo referred me to Hanh Tran from Bene?ts to attempt to gain access for dependants listed either under STACY COLE or MIKE MARSHMAN. On 082306 I contacted Hanh Tran by phone. Tran stated that she would need me to fax a letter with bureau letterhead stating what I needed and that information would be forwarded to a panel so that they could see if they could release it under HIPPA rules. I contacted Captain Eckhart and Sergeant Kelly again and asked that they get involved so that I could attempt to get this information quicker without going through a HIPPA panel. This meeting had been prearranged the previous day between ED MARSHMAN and Detective Eric Carter. Detective Carter told me he had received a phone call from ED MARSHMAN whom he knew when working with the FBI. Detective Carter told me MARSHMAN had received a call from his sister-in-law, STACY COLE who had told MARSHMAN about our visit to her home. SUMMARY: Two anonymous letters were sent to Internal Affairs regarding possible alleged abuse to MIKE step-son. MIKE ex-wife STACY COLE and ex- step-son ere contacted regarding this alleged abuse. Further interviews were conducted regarding this investigation and the information gained from those interviews is shared in the narrative portion of this report. NARRATIVE: On 091406 Detective Eric Carter informed me that he was approached by Portland Police Detective Mike Perry regarding our investigation. According to Detective Carter, Detective Perry was heading out the door to coffee and mentioned to Detective Carter that if we needed to contact his wife about the MARSHMAN investigation to let him know and he would make her available. I explained to STACY COLE that I needed to obtain the negatives to the pictures that she had given to me earlier as well as any additional pictures that were on that roll. STACY COLE stated there were only three hotos on that roll of ?lm and the other photo I did not have was a photo of her sonind his grandmother PATRICIA MARSHMAN. According to STACY COLE, the picture of-and his grandmother was taken at their house. STACY COLE stated that a?er she took the photo she pulled the ?lm from the camera and there were no additional pictures on that roll. I asked STACY COLE if she knew the whereabouts of the remaining third picture and the negatives and she stated she would look for them. I asked STACY COLE about the bachelorette party that she had mentioned to us earlier that she had attended the night the incident is alleged to have occurred. I explained to STACY COLE that we were trying to establish whether or not her son as under eighteen years of age when the incident took place. Latent ?ngerprints of value were obtained. From the ?les of the Portland Police Bureau I pulled the inked ?ngerprint cards of yourself and Sgt. Judy Brum?eld. I had Cathy Rossetto come to ID where I took a full set of elimination prints. From the envelope I identi?ed the single identi?able latent print obtained as having been made by Cathy Rossetto who opened the letter. From the paper note, I identi?ed the single identi?able latent print obtained as having been made by Sgt. Judy Brum?eld who touched the note. No other latents were obtained even after additional latent ?ngerprint processing with The envelope and note have been returned with this memo in a plastic envelope. After discussion with Captain Tellis I assigned Sergeant Pat Kelly of the Child Abuse Team to make inquiries of the Personnel Division to determine if Sergeant Marshman had any children and/or step children.
