The Commission staff cannot certify that you have met the requirements to receive MCEA funding for two reasons. First, you falsi?ed at least ten signatures of contributors on Receipt and Acknowledgement Forms that you submitted to our of?ce as part of your application for public campaign funds. These forms contained false statements by you as the forms? circulator that the contributors? signatures on the forms were genuine. Because of these falsi?ed forms and false statements, your request for certi?cation as an MCEA candidate is denied on the grounds set forth in 21-A M.R.S.A. (D-S). Second, the Commission staff is denying your request because we have determined that 42 of your qualifying contributions are not valid, leaving you with less than the required 175 qualifying contributions. (2l~A M.R.S.A. You have an opportunity to appeal this staff determination to the members of the Commission, as discussed in Section of this determination. Legal Requirements for Maine Clean Election Act Funding Duty to collect 175 qualifying contributions Candidates for the Maine Senate must obtain qualifying contributions during the qualifying period from at least 175 veri?ed registered voters from the candidate?s electoral division. M.R.S.A. A ?qualifying contribution? is defined as a donation: A. Of $5 or more in the form of a check or a money order payable to the fund and signed by the contributor in support of a candidate or made over the Internet in support of a candidate according to the procedure established by the commission; B. Made by a registered voter within the electoral division for the of?ce a candidate is seeking and whose voter registration has been veri?ed according to procedures established by the commission; C. Made during the designated qualifying period; and D. That the contributor acknowledges was made with the contributor?s personal funds and in support of the candidate and was not given in exchange for anything of value and that the candidate acknowledges was obtained with the candidate?s knowledge and approval and that nothing of value was given in exchange for the contribution, on forms provided by the commission. (2l?A M.R.S.A. 1 122(7)) For purposes of this staff determination, the key elements of this de?nition are: 0 a check or money order of $5 or more, payable to the fund, 0 made from the personal funds of the contributor, 0 whose voter registration within the candidate?s district has been veri?ed according to procedures established by the Commission, and the contributors acknowledgment that the donation was made from the contributor?s personal funds in support of the candidate without receiving anything in exchange. Mr. William Welch Page 3 June 20, 2016 Deadline to submit contributions and contributors? acknowledgements by 5:00 pm. on April 20, 2016 The candidate ?must submit qualifying contributions, receipt and acknowledgement forms, [and] proof of veri?cation of voter registration during the qualifying period according to procedures developed by the commission (21-A M.R.S.A. 1125(4)) For candidates for State Senate, the qualifying period ends at 5:00 put. on April 20*h of the election year. M.R.S.A. Under Chapter 3, Section of the Commission Rules, the Commission and its staff may not grant extensions for a candidate to submit the qualifying contributions, Receipt and Acknowledgement Forms and verifications of voter registration. Contributor Must Sign Money Order In order to be a valid qualifying contribution, a money order must be signed by the contributor. M.R.S.A. 1125(3)) Certification Statute In order to certify that a candidate has met the quali?cations to receive public funding under the Maine Clean Election Act, the Commission?s executive director must determine whether a candidate has complied with M.R.S.A. 1 125(5) (the most relevant portions are underlined below): 5. Certification of Maine Clean Election Act candidates. Upon receipt of a final submittai of qualifying contributions by a participating candidate, the executive director of the commission shall determine whether the candidate has: A. Signed and filed a declaration of intent to participate in this Act; B. Submitted the appropriate number of valid qualifying contributions; C. Qualified as a candidate by petition or other means no later than 5 business days after the end of the qualifying period; 01 . [repealed]; D. Not accepted contributions, except for seed money contributions, and otherwise complied with seed money restrictions; Mr. William Welch Page 4 June 20, 2016 Di. Not run for the same office as a nonparticipating candidate in a primary election in the same election year; Not been found to have made a material false statement in a report or other document submitted to the commission; 0-3. Not otherwise substantially violated the provisions of this chapter or chapter 13; 9-4. Not failed to pay any civil penalty assessed by the commission under this Title, except that a candidate has 3 business days from the date of the request for certi?cation to pay the outstanding penalty and remain eligible for certification; D-S. Not submitted any fraudulent qualifying contributions or any falsified acknowledgement forms for qualifying contributions or seed money contributions; and E. Otherwise met the requirements for participation in this Act. The executive director shall certify a candidate complying with the requirements of this section as a Maine Ciean Election Act candidate as soon as possible after final submittal of qualifying contributions and other supporting documents required under subsection 4 but no later than 3 business days for legislative candidates and 5 business days for gubernatorial candidates. The executive director may take additional time if further investigation is necessary to verify compliance with this Act as long as the commission notifies the candidate regarding the anticipated schedule for conciusion of the investigation. A candidate or other interested person may appeal the decision of the executive director to the members of the commission in accordance with subsection 14. A certi?ed candidate must comply with all requirements of this Act after certi?cation and throughout the primary and general election periods. Failure to do so is a violation of this chapter. A candidate must meet every requirement in paragraphs through in order for the Commission staff to certify that the candidate has met the eligibility requirements and is qualified to receive public funding. II. Determination by Commission Staff A. Falsi?ed Acknowledgement Forms and Material False Statements In order for a qualifying contribution to meet the statutory de?nition, the donor must acknowledge in writing that the contribution was made from the contributor?s personal funds in support of the candidate and nothing of value was received in exchange. (2l-A M.R.S.A. This acknowledgement is required to make sure that the contributor knowingly made a contribution to support the candidate. Mr. William Welch Page 5 June 20, 2016 The Commission staffs routine review includes a comparison of the contributor?s signature as it appears on the Receipt and Acknowledgement Form to the contributor?s signature as it appears on the contribution check or money order. Where the signatures on the qualifying contribution and the Receipt and Acknowledgement Form do not appear to be written by the same person, the Commission staff compares both signatures to the contributor?s signature on the voter card submitted by the contributor to the local Registrar of Voters to apply for voter registration (referred to as the ?voter registration card?). 1. Faisification of Signatures During her review of your application, Candidate Registrar Erin Gordon detected discrepancies between the signatures of several contributors on your Receipt and Acknowledgement Forms and the signatures of those same contributors on the checks and money orders that they used to make qualifying contributions. For further reference, Ms. Gordon obtained images of voter cards completed by the contributors when they applied to register to vote with their municipalities. Based on a comparison of all of these documents, the Commission staff identi?ed 19 instances in which it appeared that someone other than the contributor had signed the contributor?s name on the Receipt and Acknowledgement Forms. In one additional instance, staff determined that someone other than the contributor signed the contributor?s name on the money order. The Commission management sought investigative assistance from the Attorney General?s of?ce to conduct ?eld interviews of the contributors. On or around May 12, 2016, an Attorney General detective interviewed three of your contributors and provided them with an opportunity to inspect the Receipt and Acknowledgement Forms that included their names. All three contributors confirmed that they had never seen the Receipt and Acknowledgement Form, and that the handwriting and signatures on the forms were not theirs. You signed these particular forms as the circulator. Mr. William Welch Page 6 June 20, 2016 You subsequently contacted the detective and, in a conversation with him, disclosed that you signed the names of 10?12 contributors to the Receipt and Acknowledgement Forms. Although you claimed to the investigator that the contributors had authorized you to sign their names, this claim of authorization was inconsistent with the information that the three contributors provided to the investigator. 2. False Circulator Statements by You On the Receipt and Acknowledgement Forms, you signed a statement in the lower right hand box for ?circulators.? In the statements, you af?rmed that ?to the best of my knowledge and belief, the signature [of the contributor] is the signature of the person whose name it purports to be.? With respect to the contributors whose names you signed, these statements by you were false. 3. Application of M.R.S.A. 1125(5) Under M.R.S.A. 1125(5), I am required to determine whether you have met the requirements in through Because of the falsi?cation of signatures on the Receipt and Acknowledgement Forms and the false circulator statements by you, I am unable to determine that: 0 you have not submitted ?any falsi?ed acknowledgement forms,? as required by 1 (italics added), and 0 you have not made a material false statement in a document submitted to the Commission, as required by Therefore, the Commission staff is denying your request for Maine Clean Election Act funding. Mr. William Welch Page 7 June 20, 2016 B. 42 Invalid Qualifying Contributions On April 19, 2016, you submitted qualifying contributions and Receipt and Acknowledgement forms by hand-delivery to the Commission office. On May 2, 2016, campaign worker Ben Daggett submitted an alphabetical list of 197 of your contributors. (The Commission?s Rules permit submission of this list after the qualifying period.) In reviewing your qualifying contributions, Candidate Registrar Erin Gordon determined that Mr. Daggett?s list omitted nine names (Richard Corson, Mark Ducharme, William Welch, Sarah Farrell, John Lajoie, Patricia Berry, Elmer Berry, David Farrell, and Brenda Welch). Accordingly, the Commission staff Views your application as claiming the receipt of 206 qualifying contributions the 197 contributions on the May 2'1d list, plus the nine contributors who were omitted. For the reasons described below, the Commission staff has determined that 42 of the 206 contributions are invalid, meaning that you have submitted a total of only 164 valid qualifying contributions. No qualifying contribution submitted during qualifying period (12) 0 During the qualifying period which ended on April 20, 2016, you did not submit qualifying contributions for six contributors: Denise Asselin, Susan Grenier, Ronald Lessard, ZamZam Mohamud, Tim Rucker, and Sabrina Therrien. Their names appeared on your alphabetical list and the Receipt and Acknowledgement Forms that you submitted on April 19, 2016. On May 6, 2016, Mr. Daggett submitted these checks and money orders, along with a new Receipt and Acknowledgment Form. The Commission is unable to count these six contributions as valid because they were submitted after the end of the qualifying period, pursuant to 21-A M.R.S.A. 1125(4) and Chapter 3, Section of the Commission Rules. (The alphabetical list and the Receipt and Acknowledgement Forms and checks and money orders for these contributions Mr. William Welch Page 8 June 20, 2016 are included in the documents attached to this determination as Attachment A, at pages 1?10.) 0 You did not submit qualifying contributions for four contributors (Joules Campbell, Amy Morin, Joan Potvin, Claire Tardif), although their names appeared on your alphabetical list and Receipt and Acknowledgement Forms. (Attachment A, pages 11-14) a You did not submit qualifying contributions for Marc Gusselin and Riley Negm. They were listed as contributors on your alphabetical list but did not sign Receipt and Acknowledgement Forms submitted to our of?ce. (Attachment A, pages 2-3) Duplicate contributions (1) 0 Mark Carrier of 64 Sherbrooke Avenue in Lewiston made an online qualifying contribution on April 14, 2016. Someone listed an April 6, 2016 contribution from ?Mark Carier? with the same address on a Receipt and Acknowledgement Form submitted to our of?ce (although no check or money order accompanied that form, and there was no signature on the Receipt and Acknowledgement Form). Both names were included on the alphabetical list. The Commission staff has determined that ?Mark Carier? is a duplicate, and therefore invalid. (Attachment A, pages 1, 14) No voter registration veri?cation for contributions (2) 0 Mitchell Debose and Vincent Oden were not verified by the Lewiston registrar as registered to vote in your district. Also, Mr. Oden did not sign the Receipt and Acknowledgement Form. (Attachment A, pages 11, 15) Joint Contribution from family members at different addresses (1) 0 Kristen D?Eramo signed a Receipt and Acknowledgement Form affirming that she made a contribution. She is registered to vote at 15 Gina Street. Andrew D?Eramo signed the same form. He is registered to vote at 37 King Avenue. Mr. William Welch Page 9 June 20,2016 Both contributions were covered by a single $10 check written from the account of Andrew D?Eramo, 37 King Avenue in Lewiston. (Attachment A, page 16) In order to be a valid qualifying contribution, the donation must be made with the ?personal funds? of the contributor. In Chapter 3, Section of the Commission?s Rules, the Commission has interpreted this statutory requirement to allow family members who reside in a single household to make qualifying contributions in the form of a single check, but only if they are registered to vote at the address of the household and all contributions are made with the personal funds of the contributors. The contribution from Ms. D?Eramo does not meet the conditions of this rule, because she is registered to vote at a location other than Andrew D?Eramo. Signatures on money orders (2) In order to be a valid qualifying contribution, a money order must be signed by the contributor. Peter Grenier and Bruce Milliken have not signed the money orders intended as their qualifying contributions. These money orders were returned to the campaign at time of submission in order that these signatures might be obtained, but the campaign did not resubmit the money orders to our of?ce signed by the contributors. (Attachment A, pages 17-18) Contributor did not sign Receipt Acknowledgement Form family member or neighbor signed for contributor (4) As noted above, in order for a qualifying contribution to meet the statutory de?nition, the contributor must acknowledge in writing that the contribution was made from the contributor?s personal funds in support of the candidate and nothing of value was received in exchange. (21-A M.R.S.A. This acknowledgement is required to make sure that the contributor knowingly made a contribution to support the candidate. Mr. William Welch Page 10 June 20, 2016 In the following four cases, based on its review, the staff of the Commission has concluded that a family member or neighbor signed for the contributor on the Receipt and Acknowledgement Form. In two of these instances, the family member or neighbor signed his or her own name on the line where the contr?ibutor?s signature is supposed to appear. Because the contributor did not sign the form, the contributions are invalid. Monique LaChapelle did not sign the Receipt and Acknowledgement Form submitted for her contribution. Rick LaChapelle (presumably a member of her family) signed his own name for her contribution. (Attachment A, pages 19) Based on the similarity of signatures, the Commission staff has concluded that Terry LaClair did not make the required signature on the Receipt and Acknowledgement Form, and that her husband (Paul LeClair) signed her name on the form. (Attachment A, pages 20?21) Based on the similarity of signatures, the Commission staff has concluded that Bonnie Gilchrist did not make the required signature on the Receipt and Acknowledgement Form, and that her husband (David Gilchrist) signed her name on the form. (Attachment A, page 22) Ann McKenney made a qualifying contribution by signing a personal check drawn 011 an account at a credit union. She did not sign the Receipt and Acknowledgment Form. Rather, Barbara Anthoine (who appears to be registered to vote in Ms. McKenney?s neighborhood) signed her own name for Ms. McKenney?s contribution. (Attachment A, page 23) Contributor did not sign Receipt Acknowledgement Form or Money Order (20) As noted in part ILA of this determination, the Commission staff has determined that contributors did not sign the Receipt and Acknowledgement Form for 19 contributions submitted on April 19, 2016, based on a comparison between the contributor?s signature on the Form and the contributors? signatures on the check or money order used to make the contribution and the contributor?s voter Mr. William Welch Page 11 June 20, 2016 registration card, and con?rmation from three of the contributors who told a detective that they did not sign the form. The Commission staff has determined that someone other than the contributor signed these 19 names to the Receipt and Acknowledgement Forms. The basis for these conclusions is set out in a con?dential investigative memorandum accompanying this determination (Attachment B). These contributions are not valid because a written acknowledgement is a required element of a valid qualifying contribution. (21-A M.R.S.A. The staff has also determined that someone other than the contributor signed One money order submitted on April 19, 2016, which renders the contribution invalid pursuant to 21-A M.R.S.A. 1125(3). See Attachment B. For the above reasons, 42 qualifying contributions are not valid. Therefore, the Commission staff determined that your campaign submitted 164 valid qualifying contributions in support of your request for Maine Clean Election Act funding, which is 1 fewer than the 175 required by M.R.S.A. Your Right to Appeal You have a right to appeal the staff determination to the members of the Commission, pursuant to M.R.S.A. 1 125(14). Ifyoa wish to do so, please submit the appeal, in writing, within seven days, addressed to: Margaret E. Matheson, Chair Maine Ethics Commission 135 SHS Augusta, ME 04333 The Commission is required to hold a hearing to consider the appeal within five calendar days of receiving the appeal. The hearing would be held in accordance with the State Administrative Procedure Act (5 M.R.S.A. 8001-11008). You would have the burden of proving that the Commission staff?s decision was in error as a matter of law or was Mr. William Welch Page 12 June 20, 2016 based on factual error.
